This letter is to formally notify you that on December 14, 2020, the Chanhassen City Council adopted
the following motions:
REZONING
The City Council approves rezoning the Property described in the attached Exhibit B "Property" with
an approximate area of 9.03 acres to Planned Unit Development -Residential, incorporating the
following standards:
PUD DEVELOPMENT DESIGN STANDARDS
a. Intent
The purpose of this zone is to create a Residential Low Density Development. The use of the
PUD zone is to allow for more flexible design standards while creating a higher quality and
more sensitive development. Except as modified by these development standards, the standards of
the Residential Low Density District, RSF, shall apply. If there is a question as to whether or not a
use meets the definition, the Community Development Director shall make that interpretation.
Each structure proposed for development shall proceed through building permit application
based on the development standards outlined below.
b. Uses
The permitted uses within the development shall be one single-family home and one
accessory dwelling unit.
2. The accessory dwelling unit may not be sold separately from the main single-family .., �?

3. Short-term lease of the Accessory Dwelling Unit is prohibited. A short-term lease is defined
as a lease of less than three months.
4. The accessory dwelling unit shall have a maximum of two bedrooms and may not exceed
1,600 square feet of footprint area.
5. Due to the unique access and lack of a viable water source to support fire suppression
activity, the city strongly encourages the petitioner to install a fire suppression system for the
residential buildings on the property. The design and installation should be done by a
qualified fire suppression engineer.
6. The two homes must utilize one access driveway into the homes which must be shared access
until the driveway comes within 50 feet of the first dwelling unit at which point they can
split.
7. Prior to any site clearing, a walk-through of the grading limits with the city forester to review
opportunities for tree preservation is required.
8. The total footprint area of all detached accessory buildings excluding the accessory dwelling
unit, must not exceed 2,000 square feet collectively and no individual detached accessory
structure shall exceed 1,000 square feet of foot print area.
9. All water -oriented structures must comply with applicable City ordinances.
10. The Property shall have a maximum of two docks.
11. Prior to issuance of any building permit on the Property, an Operations and Maintenance
(O&M) Plan for the existing bridge and a Bridge Safety Inspection Report shall be submitted
to the city. The O&M Plan shall be prepared by a registered Professional Engineer in the
state of Minnesota and the Inspection Report shall be prepared by a MnDOT Certified Bridge
Safety Inspector. The O&M Plan and
Inspection Reports shall include applicable Weight Limit with
information concerning Timber structures.
The Owner of the Property shall submit to Symbols T, T, T

Upon results of the initial Inspection Report,

comply with all applicable findings and recommendations of the routine inspection reports.

The PUD ordinance requires setbacks from roadways and exterior property lines. The following

FINDINGS OF FACT
AND RECOMMENDATION
IN RE:
Application of John W icka to rezone property located at 1601 Lake Lucy Road.
On December 1, 2020, the Chanhassen Planning Commission met at its regularly
scheduled meeting to consider the application of John W icka to rezone property from Rural
Residential to Planned Unit Development —Residential. The Planning Commission conducted a
public hearing on the proposed Planned Unit Development preceded by published and mailed
notice. The Planning Commission heard testimony from all interested persons wishing to speak
and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Rural Residential District, RR.
2. The property is guided in the Land Use Plan for Residential Low Density.
3. The legal description of the property is shown in the attached Exhibit A.
4. The Zoning Ordinance directs the Planning Commission to consider six (6) possible
adverse affects of the proposed amendment. The six (6) affects and our findings
regarding them are:
a) The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official city Comprehensive
Plan.
Finding: The proposed Planned Unit Development has been considered in relation to the
specific policies and provisions of the land use plan and has been found to be consistent
with the official city Comprehensive Plan. It complies with providing single-family
homes that meet density requirements.
b) The proposed use is or will be compatible with the present and future land uses of the
area.
Finding: The proposed use is compatible with the present and future land uses of the
area. Staff has prepared an ordinance that will regulate the site and ensure specific
regulations are adhered to.
c) The proposed use conforms with all performance standards contained in the Zoning
Ordinance.
Finding: The proposed uses will conform with all performance standards contained in
the Zoning Ordinance such as bluff setbacks, shoreland setbacks, etc. The ordinance
regulating the site will add additional higher standards and establish limitations that
govern the site.
d) The proposed use will not tend to or actually depreciate the area in which it is
proposed.
Finding: The proposed use is consistent with and compatible with all surrounding
parcels that have been guided or have developed as single-family homes.
e) The proposed use can be accommodated with existing public services and will not
overburden the city's service capacity.
Finding: The site is located within the Municipal Urban Service Area however, due to
the location of the island in relation to utilities and due to the potential impact on the
natural features of the site, the applicant will provide an on -site septic system and well.
The applicant also intends to sprinkle the home. These steps will ensure the proposed use
will not overburden the city's service capacity.
f) Traffic generation by the proposed use is within capabilities of streets serving the
property.
Finding: The request is for a single-family home and an accessory dwelling unit. Traffic
generation by the proposed use is within capabilities of streets serving the property.
5. The planning report #2020-18 dated December 1, 2020, prepared by Sharmeen Al-Jaff, et
at, is incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the Planned Unit
Development.

I am asking the City of Chanhassen to consider rezoning our property located at 1601 Lake
Lucy Road, to Planned Unit Development - Residential. The property itself is unique, primarily
because it is an island. A road and bridge were constructed out to the island approximately 22
years ago. For several years my wife and I have been looking for a larger parcel of land to build
a home. A primary reason for that was so we could build a living space nearby for my mother
who is now 86 years old. The island was a perfect opportunity for us to build living quarters
near but still allow my mother to keep her independence.
In the fall of 2018, we set out to design a home that would achieve all of these goals by creating
essentially two living structures combined by a tunnel or skyway. Unfortunately, every option
we explored led to a dead end. The island is an amazing piece of geography - beautiful in every
way, but it also provides many home building challenges to overcome. After trying to "piece
together the puzzle" for a year, we paused our design plans as we were temporarily exhausted
from running into blockers. After consulting with our architect, we realized that the opportunity
to create two separate living structures on the 8 acre parcel (not including the driveway down to
the island) dramatically simplifies many aspects of the design and build. To accomplish this
goal, we needed some flexibility of ordinances. This is the reason we are requesting a rezoning
of the island to Planned Unit Development - Residential. This zoning category allows flexibility,
but in turn requires high design standards. I hope to demonstrate that we intend to meet the
higher standards.
We have included several documents to add some additional context to the application and
address some known concerns in your consideration. Included are:

A map showing a preliminary design of the two living structures and accessory building and the
total buildable area.

The natural beauty of the island is undeniable, but in 2018 it was deep into the cycle of being
overtaken by an invasive species - buckthorn. Shortly after purchasing the property, we worked
with Jill Sinclair to get direction on removing the buckthorn. This was no simple matter. This
invasive species was quite literally taking over the island and muscling out other native trees
and plants. We hired one of the specialists Jill recommended and cut, treated and removed an

astonishing amount of buckthorn. That effort returned the island to it's natural balance. In our
plans to build we intend to preserve that beauty in every way possible.
We are planning to build "green" structures using solar for power, geothermal for
heating/cooling, green roofs on parts of the structures, highly efficient building designs, rain
water harvesting for watering the lawn and vegetation and various other plans to minimize our
impact on the environment. Furthermore, as we get deeper into the design process, we plan to
engage a civil engineer to assist with both a grading and erosion control plan to introduce the
appropriate amount of water management located near the driveways to account for any run-off
towards the lake including french drains, rain garden, etc. Given the majority of the current bluff
conditions (mainly exposed soli), we propose addressing any susceptible bluff areas with native
plantings to help mitigate potential erosion.
Obviously, in the building process we will be impacting the island and vegetation, but the bulk of
the tree removal will be on the interior of the island and the driveways on the island are
designed to be appropriately narrow for the tree canopy to grow over. The bluff areas and
shorelines will not be affected in terms of tree and canopy coverage. The grading limits and
calculations have been provided in the accompanying documents. Additionally, we have
ordered a tree survey from an expert (again recommended by Jill - thank you Jill!) and will make
it available as soon as it is complete.
A few weeks ago, I was able to walk the island with the Fire Chief, Don Johnson. Don shared
his concerns and recommendations. One concern he shared was the ability for the larger fire
trucks to navigate the island and have the ability to turn around. Since then, we have updated
our plans to allow for turn around areas for the fire trucks. Don also recommended we design
the living structures with fire suppression sprinkler systems. We plan to incorporate this into our
designs going forward.
Lastly, we hired a licensed septic designer (sourced from the approved contractor list on the
Carver County website) to do some preliminary calculations to ensure we have enough area for
the septic system and primary and secondary drain fields. The architectural drawings allow for
12,984 square feet for the septic system while his calculations call for only 11,000 square feet.

Here are the Septic System Drainfield sizing calculations based on a total number of 7 bedrooms for two
residential use units on the property.
Preliminary Disclosure:
1. No soil borings have been done to validate the type, use, nor extent of suitable soils for a
drainfield.
2. No percolation test have been conducted.
3. The depth to a seasonally saturated soil water level is based upon worst case soils scenario of
just having the minimum of 12 inches of suitable soil above a restricting layer.
4. Septic sizing criteria is based on the soil characteristics of a clay loam soil designing for a
Mound on an estimated 6 percent slope.
5. No preliminary staking of rock and sand beds to reflect the overall footprint of the system has
been done.
6. Slope direction, length, and contours have not been established.
7. Essentially, the attached septic sizing information is not a design and the design forms utilized
are just to generate the overall square footage needed to fit a primary and a secondary septic
system on this property.
Sizing requirements per estimated septic calculations:
A. Primary Mound for 7 bedrooms is 45 x 122'. Or about 5500 square feet.
1. This would require a same elevation contour length of 122'.
B. A matching Alternate site would be the same: 5500 square feet.
1. This would also require a same elevation contour length of 122'.
C. There would be options to break the total system in half as far as placement and siting goes
to adjust to natural features of the landscape. But the overall square footage requirement
would remain the same or actually require more area.
D. Or one 5 bedroom system could be designed and placed for the home and one 2 bedroom
system designed and placed for the guest home. Square footage would again be about the
same or end up a bit larger.

this property. This area is determined and plotted by 'others' and not Homestead Septic. No
field or soil verifications have been made in this proposed area by Homestead Septic.

when Phillip Elkin (City of Chanhassen), you and 1 inspected the bridge on 3/24/99. Based on the
on -site inspection, the 3/1/99 as -built bridge survey prepared by your contractor and the as -built
driveway survey that was completed by city staff on 3/25/99, 1 hereby find that you have met the
requirements of DNR Permit 994-6078. In particular, the requirements in Special Provision #7
have been met (i.e., an as -built survey and representative photographs were submitted so that we
could verify the bridge had been constructed in accordance with the permit).

Pursuant to General Provision #3. in DNR Permit #94-6078, 1 hereby notify the
appropriate regulatory authorities of the completion of the respective bridge as of
February 25, 1999. This notice has been delivered via facsimile within the five (5) day
notice period per the provision in the Permit.
Pursuant to Special Provision V. in Attachment A to DNR Permit #94.6078, 1 will be
forwarding to each of you *representative photographs and an as -built survey" as soon
as these items are available (hopefully within 2 weeks) Should you need or desire to
inspect the constructed bridge, I welcome you to do so. Please let me know when you
will be coming out to the site so I can direct you to it and 'bore' you with the details of the
construction.
At some point in the not too distant future, I would like to obtain a "written OIC' from your
respective offices indicating that I am in good standing with the authorities upon
completion of this bridge project. Thanks once again to all of you for your assistance,
Counsel and patience in handling from the outset a once very inexperienced and

Dear Mr. Wcmgart:
You submitted the detailed bridge plans December 18, 1998 (received 12/23/98) for the replacement of a
private bridge and improvements to a driveway that lead to an island in Lake Lucy. DNR Waters has
reviewed the bridge plans and found them to meet the requirements of Special Provision #1 of DNR Permit
#94-6078. Therefore the plans dated 12-16-98 are hereby approved, with the following clarifications or
conditions:
1. Cross -braces are to be installed at three spots along the retaining wall on both sides of the bridge in
order to help maintain the design width of the approach to the bridge.
2. The area above the OHW of 956.1' (NGVD, 1929) under the new bridge shall be excavated to the
depth of 955', allowing for a stable slope at the bridge abutments as discussed below, and allowed
to get established with aquatic vegetation.
3. The bridge ends of the two approaches will be supported by either: (a) a retaining wall that runs
perpendicular to the approach retaining walls shown on the plans, or (b) a 3:1 (horizontal to
vertical) slope that is protected with vegetation or ungrouted, natural stone riprap, or (c) a
combination of retaining wall and a sloped base.

Dear Ceil,
As a follow-up to our recent conversation, I have enclosed the General Plan and
Elevation of the proposed bridge for my property on Lake Lucy in Chanhassen.
Also enclosed is a portion of the original Schoell & Madson engineering drawing
with the proposed bridge location highlighted for your review. The proposed
timber bridge would be built by Wheeler Lumber, LLC of St. Louis Park, MN. I
obtained information regarding this type of bridge and its manufacturer from
Martha Reger of your office. She indicated that the DNR has installed Wheeler
timber bridges on various DNR projects. Please let her know I appreciate the
reference as the Wheeler folks appear to be quite knowledgeable about DNR
issues and concerns, and, furthermore, have been very good to work with on this
project.
About the Timber Bridge:
This timber bridge is a triple 24' span, 16' clear roadway superstructure having 4"
x 10" timber rails, 8" x 8" curbs and 3" x 8" scuppers. The bridge is to be
constructed on a horizontal curve to better fit the site and minimize wetland
alteration. It is designed to HS-20 loading. Coming off of each corner will be 48'
timber abutment retaining walls to contain the rip -rap and granular materials
needed to ramp up to the deck of the bridge (approx. 3'). The parallel retaining
walls will be attached to each other with cross -members at three different
locations along the 48' so that they will not spread over time. All lumber used will
be Coastal Region Douglas Fir with a creosote treatment to 12# retention. All
hardware is hot dipped galvanized.

I have included color pictures of a similar bridge that was recently installed to an
island property in Lake Ida near Alexandria, MN. This bridge, however, is quite a
bit larger measuring 210' x 20'.
About the Piling:
The bridge will set upon a Hubbell/Chance Helical -Pier System (a/k/a, screw
piling) to be installed by Atlas Foundation of Rogers, MN. Each abutment and
each section seam will be supported by three pilings. Each pile will be installed
to support 20 tons with a safety factor of two times, i.e., 40 tons. Each pile will be
capped with a plate of tubular steel upon which the bridge will sit. I have noted
with red dots on the plan where the pilings are to be placed.
Wheeler indicated that the General Plan and Elevation drawing is typically what
is provided to the DNR for its approval. Please let me know what other
information or specifications, if any, you may need to approve this bridge design.
I will be out of town from Wednesday, December 161h through Monday,
December 2151. However, please leave me a message regarding your thoughts
on 949-9091 as I will be checking it regularly.
I hope to install the bridge during February while the frost is still in the ground
(hopefully, at the rate we're going!), and then complete the rest of the driveway
by the end of March. Please let me know what approvals or inspections your
office will require so that the appropriate notice can be given to you regarding the
various stages of construction.

10. Any extcnsion of the surface of public waters resuhing from work authorized by this permit shall become protected waters and left open and unobstructed for use
by the public.
11. No material excavated by authority of this permit nor material from my other source, except its specified herein, shall be placed on any portion of the bed of mid
water, which lies below (as indicated above.)
12. Where the work authorized by this permit involves the draining, filling or burning of wetlands net subject to DNR jurisdiction, the permittee shall not initiate my
wort under this permit until the permittee has obtained official approval from the responsible governmental unit es required by the Mitnesoas Wetlands Conservation
Act of 1991.
SPECIAL PROVISIONS
.. The detailed plans and specifications for the bridge (including approaches, abutments and
foundation work, and related construction) and mitigation excavation shall be submitted to
the Regional Hydrologist for review and approval prior to construction. Specific conditions
the design must incorporate include:
a. No filling below the ordinary high water elevation of 956.1' (NGVD, 1929) for Lake
Lucy except for the placement of the bridge pilings, piers or abutments,
b. The bridge dimensions must meet all conditions/requirements (i.e., safety and ---re
protection) of the City of Chanhassen, and
C. The bridge (including approaches, abutments and foundations work, and related
construction), roust be designed by a registered professional engineer.
2. Excavated materials must be deposited or stored in an upland area, in a manner where the
materials will not be redeposited into the protected water by reasonably expected high water
or runoff.
�. No activity affecting the bed of the protected water may be conducted between April 1 and
June 30, to minimize impacts on fish spawning and migration. If work during this time is
essential, it shall be done only upon written approval of the Area Fisheries Manager, at
612-772-7950.
4. Temporary dewatering for construction, in excess of 10,000 gallons per day or 1 million
gallons per year, is authorized by this permit provided the following conditions are met:
a. A plan for the dewatering shall be submitted to the Regional Hydrologist for written
prior approval.
b. All necessary erosion and sedimentation control measures shall be taken to prevent
transportation of sediment, including those noted in Special Provision 5.e. of this
permit.

5. Permittee shall comply with the conditions of the Riley -Purgatory -Bluff Creek Watershed
District as set forth in their letter dated December 1, 1993. Specifically:
a. Compliance with the Board of Water and Soil Resources Administrative Guideline:
Interim Program of Wetland Regulation, including designation and mitigation
requirements and guidelines for implementation of Laws 1991, Chapter 160.
b. All erosion control measures shown on the plans must be installed prior to
commencement of grading operations and be maintained until all areas altered on the
site have been restored.
If silt fence is used, the bottom flap must be buried and the maximum allowable
spacing between posts is 4 foot on center. All posts must be either 2 inch x 2 inch
pine, hardwood, or steel fence posts. If hay bales are used, all bales must be staked
in place and reinforced on the downstream side with snow fence.
C. All areas altered because of construction must be restored with seed and disced mulch,
sod, wood fiber blanket, and the driveway restored at a minimum with gravel within
two weeks from the completion of construction or no later than September 15, 1994 (or
later with Watershed District approval).
d. Upon completion of construction and restoration of areas disturbed, the permit
applicant is responsible for the removal of all erosion control measures installed
throughout the site.
e. Should dewatering of the construction area be necessary and sump pumps are used, the
District will require that all pumped water be discharged through a sedimentation
facility prior to reaching protected waters.
f. The District must be notified in writing a minimum of 48 hours prior to commencement
of construction.
The permittee shall monitor all disturbed areas for the presence of purple loosestrife and
control the plant as described in the enclosed pamphlet titled "Purple Loosestrife Alert."
The DNR aquatic plant manager should be contacted at 772-7950 for permit needs and
additional information.
Upon completion of the authorized work, the permittee shall submit representative
photographs and any as -built surveys, as appropriate, of the project area to DNR Metro
Region Waters (1200 Warner Road, St. Paul, MN 55106).
The permittee is authorized to maintain the approved work to the dimensions herein
described. Prior to commencing any maintenance work, the permittee must advise the
Department of Natural Resources of the extent and method of maintenance. Maintenance work
