CONDITIONAL USE PERMIT #1984-07 FOR A HORSE STABLE
WHEREAS, the subject property, located at 675 Lakota Lane, received a conditional use
permit for a horse stable on August 22, 1984, Conditional Use Permit #1984-07; and
WHEREAS, Conditional Use Permit #1984-07 was recorded in the Office of the County
Recorder in Carver County, Minnesota, as Document No. 60734 in Book 79 of Misc. page 277-278 on
August 23, 1984; and
WHEREAS, the subject property was rezoned from Single -Family Residence District (R-1)
to Agricultural Estate District (A-2) on December 15, 1986, as part of Ordinance No. 80; and
WHEREAS, city staff visited the subject property and spoke with the property owner of the
site to verify compliance with the conditions of the conditional use permit and discovered that the
conditional use permit was not needed for the property since horse stables are a permitted accessory
use in the Agricultural Estate District (A-2), per City code Sec. 20-573; and

FINDINGS OF FACT
AND DECISION
I
The revocation of Conditional Use Permit #1984-07 for a Horse Stable. On August 22,1984, the
City Council approved Conditional Use Permit #1984-07 to allow the stabling of four (4) horses on
an R-1, Single Family Residence District, property located at 675 Lakota Lane. The subject
property was rezoned in 1986 fi-orn Single -Family Residence District (R-1) to Agricultural Estate
District (A-2). Horse stables are a permitted accessory use in the Agricultural Estate District (A-2),
per City Code Section 20-573, making the adsting conditional use permit unnecessary.
On December 14, 2015, the Chanhassen City Council met at its regularly scheduled meeting to
consider the revocation of Conditional Use Permit #1984-07. The City Council conducted a
public hearing on the proposed conditional use permit which was preceded by published and
mailed notice. The City Council heard testimony from all interested persons wishing to speak
and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Agriculture Estate (A-2).
2. The property is guided by the Land Use Plan for Residential Low Density.
3. The legal description of the property is:

Finding: The revocation of the conditional use permit is consistent with the City's
Comprehensive Plan and complies with Chanhassen City Code.
c. Will be designed, constructed, operated and maintained so to be compatible in
appearance with the existing or intended character of the general vicinity and will not
change the essential character of that area.
Finding: There win not be any required alteration to the property for the revocation of
the conditional use permit. Therefore, the appearance and existing or intended character
of the neighborhood in the general vicinity will not be changed.
d. Will not be hazardous or disturbing to existing or planned neighboring uses.
Finding: There will not be any required work done on the property for the revocation of
the conditional use permit. Therefore, there will not be any hazardous or disturbing
conditions for existing or planned neighboring uses.
e. Will be served adequately by essential public facilities and services, including streets,
police and fire protection, drainage structures, refuse disposal, water and sewer systems
and schools; or will be served adequately by such facilities and services provided by the
persons or agencies responsible for the establishment of the proposed use.
Finding: There will be no alternation in services required by the revocation of the
conditional use permit. The property is adequately serviced by the city or through
services provided by the persons or agencies responsible for the property.
f. Will not create excessive requirements for public facilities and services and will not be
detrimental to the economic welfare of the community.
Finding: The use of public facilities and services will not be altered by the revocation of
the conditional use permit.
g. Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare because
of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash.
Finding: The revocation of the conditional use permit will not involve uses that have the
potential to create any adverse conditions, as previously stated.
h. Will have vehicular approaches to the property which do not create traffic congestion or
interfere with traffic or surrounding public thoroughfares.
Finding: Access by motorized vehicles to the property is currently adequate and win not
be altered by the revocation of the conditional use permit.

historic features of major significance.
Finding: The revocation of the conditional use permit will not result in the destruction,

conditional use permit for an amateur radio tower on August 26, 1996, Conditional Use Permit
#1996-04;and
WHEREAS, Conditional Use Permit #1996-04 was recorded in the Office of the County
Recorder in Carver County, Minnesota, as Document No. 205783 on January 10, 1997; and
WHEREAS, city staff visited the subject property and spoke with the property owner of
the site to verify compliance with the conditions of the conditional use permit and discovered
that the conditional use was not present on the property; and
WHEREAS, the amateur radio tower conditional use has not been taking place on the

The revocation of Conditional Use Permit #1984-07 for a Horse Stable. On August 22,1984, the
City Council approved Conditional Use Permit #1984-07 to allow the stabling of four (4) horses on

WHEREAS, the subject property, located at 330 Pleasant View Road, received a
conditional use permit for a horse stable on June 21, 1982, Conditional Use Permit #1982-02;
and
WHEREAS, city staff visited the subject property and spoke with the property owner of
the site to verify compliance with the conditions of the conditional use permit and discovered
that the conditional use was not present on the property; and
WHEREAS, the horse stable conditional use has not been taking place on the property
for over six (6) months; and
WHEREAS, City Code Section 20-236 states, "if the conditional use is discontinued
for six (6) months, the conditional use permit shall become void; and
WHEREAS, the City Council, after notice and public hearing, reviewed Conditional Use
Permit #1982-02 for Lot 3, Block 1, Julius Addition (PID: 253700030).
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
revokes Conditional Use Permit #1982-02.

IN RE:
The revocation of Conditional Use Permit #1996-04 for an Amateur Radio Tower. OnAugust26,
1996, the City Council approved Conditional Use Permit #1996-04 for a 75 -foot amateur radio
tower located at the subject property. This conditional use permit has become void due to its
discontinued use for at least six (6) months and may now be revoked by the city per Section 20-236
and Section 20-237 of City Code.
On December 14, 2015, the Chanhassen City Council met at its regularly scheduled meeting to
consider the revocation of Conditional Use Permit #1996-04. The City Council conducted a
public hearing on the proposed conditional use permit, which was preceded by published and
mailed notice. The City Council heard testimony from all interested persons wishing to speak
and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Rural Residential (RR).
2. The property is guided by the Land Use Plan for Residential Large Lot.
The legal description of the property is: Lot 18, Block 1, The Hesse Farm Addition
(PID: 253300150)
4. Conditional Use Findings:
a. Will not be detrimental to or endanger the public health, safety, comfort, convenience or
general welfare of the neighborhood or city.

Kate Aanenson: Good evening Mayor, members of the City Council. As part of the annual
duties of the planning department we review all conditional uses and interim use permits. Let
me clarify. Not all of them. We put them on a schedule to make sure that they're in compliance.
As a part of that if there's an interim use or conditional use that is no longer being used then in
order to clean up the property we recommend that those be revocated by the City Council as is
the process so tonight we're looking at 4 conditional use permits and I'll go through each of
those briefly. This is the public hearing as we've stated on here and if the conditional use hasn't
been used for 6 months it can become void but most of these have been longer than 6 months so
we didn't just get right to the 6 months and then notify property owners. Soagainallthe
property owners have been notified that the conditional use is being voided and then again we
are requesting the public hearing. So the first one is on 330 Pleasant View Road. A conditional
use permit. This conditional use permit is to allow a horse in the RSF district. This was done
back in 1980's and this is no longer a permitted use with horses in the residential so up until then
it's been legal non -conforming. There has not been horses on this property so this is one that the
staff is recornmending that we revoke.
Mayor Laufenburger: Can we?

Mayor Laufenburger: Ms. Aanenson can we deal with all of these together after?
Kate Aanenson: We have all the findings, yep.
Mayor Laufenburger: Okay.

Kate Aanenson: Okay great. The second one is on Lakota Lane. As you are aware this is part
of when we officially mapped the new 101. This is a property that the City has bought. There is
a horse stable on this property. It's under a conditional use. In this zoning district horses are
permitted. A conditional use is not, no longer being applied. This would be an interim use and
again an interim use is where we put a deadline on such as such time these improvements
become available. Sewer and water, those sort of things so while the owner of that property is
renting it back from the City, there still will be a horse on there but the conditional use is no
longer applicable. That also helps us as we clean up the property or as you know we're tying to

acquire properties down there. There's less encumbrances on the property so with that the
homeowner is satisfied that to continue to keep the horse on the property but there will not be a
conditional use with that. Any questions on that one? I'm sorry.
Councilman Campion: Kate...
Kate Aanenson: Yep, there will be a horse on the property but there will not be a conditional use
for a stable or anything like that so she can keep her one horse on there. She's not boarding
horses. That sort of thing so her own personal use.
Councilman Campion: Okay.
Kate Aanenson: The Bluff Creek Inn, again this is for a bed and breakfast. A bed and breakfast
is a conditional use. Is a conditional use within the zoning district. Again that's been changed to
an interim use in the zoning district back when this was approved so it hasn't been used as a bed
and breakfast for a number of years so with that we are recommending again revocation of the
conditional use. So again if that was to come in today we'd have it go under the interim use
where we'd put a definite timeline on that. And then finally a conditional use for an antenna on
this property. This property is zoned rural residential. A cell tower is a conditional use so
someone else in this zoning district could do a cell tower. Those are permitted within. Again a
conditional use would require a public hearing before the Planning Commission and then be
approved by the City Council but that conditional, the tower is no longer there. It is not being
used so with that to clean up the property we are recommending that you also consider
revocation of that conditional use. So that concludes the 4 properties so at this time, again we
did notify all the property owners. People within 500 feet if they had questions so there is
standards for all of the resolutions for all of those, for all 4. Pretty much they're all consistent.
No longer in place. That sort of thing if anybody had questions on the resolution I'd be happy to
answer that but we are recommending you open a public hearing and then suggested a motion for
you.
Mayor Laufenburger: Alright, thank you Ms. Aanenson. That concludes the staff report at this
time. First of all before I open the public hearing, are there any questions from council to Ms.

do with the expectation that the surrounding properties conditional uses are permitted. You can
put conditions on to mitigate that so we want to make sure it was hours of operation are limited,
those are the kind of things. No outdoor storage. Those are the kind of things that we make sure
that they're being good neighbors and follow up on.

use then we will, they will no longer be on the rolls to be inspected for that.

AMENDMENT TO CITY CODE CHAPTER 4 CONCERNING FEES.
Mayor Laufenburger: Is there a staff report?
Greg Sticha: Yes, good evening Mayor and City Council.
Mayor Laufenburger: Mr. Sticha, good evening.
Greg Sticha: On an annual basis staff presents to council recommended changes to the City's
Chapter 4 of our ordinance in regards to fees. This evening we presented in front of you a list of
items staff is proposing for changing the City fees. A few items and I'll briefly review those
with you first this evening. One, the first item is an amendment to change Section 4-15 which
applies to the liquor license investigation fee. The background check that is done by Carver
County to amend it to $250 rather than $ 100 as per what we are paying the County for that
service. The second item is in regards to building permit fees. Staff is recommending a 3
percent change in Table I -A of the building permit fee schedule to account for increased costs in
regards to credit card processing fees the City is being charged. Of note the City has not
amended it's building permit fees in regards to Table I -A since 2009 so it has been 6 years since
we've seen any increase in that particular table. The other 3 major areas are in regards to the
City's utility fimds and I'm going to go over each of those funds very briefly and talk about what
the council went through over the last 3 months to come to this evening's change in the fees for
all of it's utility funds. The City goes through an extensive process with a financial advisor to
monitor our 3 city utility funds. Tile water, sanitary sewer and storm water funds. Based on this
year's findings and direction from City Council we'll be amending the city code in terms of fees
for each of those utilities as follows. First the water fimd. One item of particular and I guess
very significant importance that the council discussed over the last several months, and actually
we've had been discussing over the last several years is when to build a west water treatment
plant. Council has put this as a priority rather sooner rather than later. We've had the plant
scheduled anywhere from 2017 to 2023 in our long term financial planning models. Council felt
it was important to make sure that that treatment plant get built in 2017-2018 time frame.

PROPOSED MOTION:
"City Council approves the resolutions revoking Conditional Use Permits
#1982-02, #1984-07, #1985-04 and #1996-04, and adopts the attached Findings

City Council approval requires a simple majority vote.
Staff, as part of compliance review/inspections, has determined that the following
conditional use pennits have not been in operation for more than six (6) months, most of
which have not been in use for several years. Staff is proposing to revoke these expired
conditional use permits to eliminate unnecessary staff inspections. Upon inspection of
these properties, staff has found that they are all being used as permitted by their
respective zoning districts.
The city has limited discretion in revoking conditional use permits, based on whether or
not the existing property meets the conditional use permit standards outlined in their
conditional use permit and the Zoning Ordinance. Failing to comply with any
conditions set forth in the conditional use permit (City Code Section 20-237), or the
discontinued use of the conditional use for six (6) months (City Code Section 20-236),
shall constitute sufficient cause for the revocation of the conditional use permit The
revocation of a conditional use permit is a quasi-judicial decision.
Staff is recommending that City Council revoke four (4) Conditional Use Permits
(#1982-02, #1984-07, #1985-04 and #1996-04). None of these conditional uses have
been used in the past six (6) months, making them void per Section 20-236 of the city
code.
Notice of this public hearing has been mailed to all property owners within 500
feet.

Ordinance No. 80, the city rezoned the subject parcel from R- I to Agricultural Estate District
(A-2). Per City Code Sec. 20-573, private horse stables are a permitted accessory use within the
A-2 District and do not require a conditional use permit. An inspection was conducted on
January 23, 2015 to ensure the property was not a commercial stable and the city verified that the

ANALYSIS
All four (4) Conditional Use Permits (#1982-02, #1984-07, #1985-04 and #1996-04) should be
revoked due to the conditional use not existing on the property for at least six (6) months. These
conditional use permits have become void per Section 20-236 of city code which states, "if the
conditional use is discontinued for six months, the conditional use permit shall become void."
Procedurally, the city must take the void conditional use permits through the public hearing
process to have them revoked. All four property owners have been mailed a letter informing
them that their conditional use permit has become void due to their discontinued use and that
their conditional use permit will be officially revoked by the Chanhassen City Council on
December 14, 2015, following a public hearing.
RECOMMENDATION
Staff recommends that the City Council approve resolutions revoking Conditional Use Permits
#1982-02, #1984-07, # 1985-04 and #1996-04.

NOTICE IS HEREBY GIVEN that the Chanhassen City Council will hold a public
hearing on Monday, December 14, 2015 at 7:00 p.m. in the Council Chambers in Chanhassen

Sec. 20-231. - Application, public hearing, notice and procedure.
(a)
The application, public hearing, public notice and procedure requirements for conditional use permits shall be
the same as those for amendments as provided in article 11, division 2, except that the permit shall be issued on
the affirmative vote of a majority of the entire council. Although specific submissions required to complete an
application for a conditional use permit may vary with the specific use and the district in which it is loGated, all
applications for such permits must include at minimum a site plan that clearly illustrates the following: Proposed
land use building mapping and functions, circulation and parking areas, planting areas and treatment, sign
locations and type, basic lighting concerns, the relationship of the proposed project to neighboring uses,
environmental impacts and demand for municipal services.
