RONALD HARVIEUX
WHEREAS, Ronald Harvieux has requested a metes and bounds subdivision of his
property into two single-family lots of 15,064 square feet and 18,442 square feet; and
WHEREAS, the property was previously subdivided in September 2005 as Harvieux
Addition; and
WHEREAS, the proposed subdivision complies with all requirements of the Chanhassen
City Code; and
WHEREAS, the proposed subdivision is consistent with the Chanhassen Comprehensive
Plan and Zoning ordinance.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves the metes and bounds subdivision separating Lots I and 2, Harvieux Addition into
separate lots subject to the following conditions:
1. The property shall comply with the original conditions of approval for the Harvieux

This letter is to confirm that on August 25, 2014 the Chanhassen City Council
approved a metes and bounds subdivision creating Lots I and 2, Block 1,
Harvieux Addition as separate lots. The approval is subject to the following
conditions:
1. The property shall comply with the original conditions of approval for the
Harvieux Addition, Planning Case #2005-26.
2. Deeds shall be recorded at Carver County creating the new lots.
City Code specifies that the documents creating the separate lots shall be recorded
within 30 days with the county recorder's office (Section 18-37 (c)). Please
submit the deeds to me so that I may have the city attorney's office record them
with the county.

A RESOLUTION APPROVING A FINAL PLAT
CREATING HARVIEUX ADDITION,
RONALD AND LEANNE H&RVIEUX
WHEREAS, Ronald and Leanne Harvieux have requested a subdivision of their property
into three single family lots of 15,064 square feet, 18,800 square feet and 46,441 square feet with
variances for the use of neck lots; and
WHEREAS, the proposed subdivision complies with all requirements of the Chanhassen
City Code; and
WHEREAS, the Chanhassen Planning Commission held a public hearing on September
6, 2005, and found the plan consistent with the Chanhassen Comprehensive Plan and Zoning
ordinance and recommended approval of the subdivision.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves the final plat for Harvieux Addition (Planning Case #05-23) for the Harvieux property,
legally described as Lot 2, Block 1, Sathre Addition; and that part of Horseshoe Curve, originally
dedicated in the record plat of Sathre Addition and now vacated which lies easterly of a line
described as follows: Commencing at the northwest comer of Lot 2, Block 1, in said Sathre
Addition; thence southerly, a distance of 84.82 feet, along the westerly line of said Lot 2, to the
point of beginning of the line to be described; thence southerly, tangent to the curve on said
westerly line, a distance of 53.28 feet; thence southerly, on a tangential curve concave to the
west having a radius of 150.04 feet, to the west line of said Horseshoe Curve, creating Lots 1, 2
and 3, Block 1, Harvieux Addition as shown on the plans received September 12,2005, prepared
by Demars-Gabriel Land Surveyors, hic., subject to the following conditions:
Only trees shown on the preliminary plat as being removed shall be allowed. No trees are to be
removed on Lot 1. Four trees are allowed to be removed on Lot 2. Any other trees removed
shall be replaced at a rate of 2:1 diameter inches.
2. Tree preservation fence shall be installed at the grading/clearing limits prior to any construction
activities and shall remain in place until construction is complete.
3. Detailed grading, drainage, tree removal, and erosion control plans will be required for Lots
1 and 2 at the time of building permit application. Development of lot 2 shall incorporate a
single -lane construction entrance covered with wood chips, tree protection fencing must line
the entrance route and a single storage area shall be designated for all materials. Cement
trucks may not be allowed to rinse out on site.
4. The front lot lines for Lots 2 and 3 are the westerly lot lines.
5. If grading will be done, a final grading plan and soils report must be submitted to the
Inspections Division before building permits will be issued.
6. Separate water and sewer services must be provided for each lot. Relocate Lot 1 sanitary sewer
and water services from the northwest off Pleasant View Road to the west off Horseshoe Curve.
7. Addresses for each home must be posted on Horseshoe Curve and on each home.
8. No burning permits will be issued. Trees must either be chipped or removed from site.
9. Builder/Developer must comply with Chanhassen Fire Department Policy #29-1991 regarding
premise identification.
10. Erosion control blanket shall be installed on all slopes greater than or equal to 3:1. All exposed
soil areas shall have temporary erosion protection or permanent cover year round, according to
the following table of slopes and time frames:

11. Street cleaning of soil tracked onto public streets shall include daily street scraping and street
sweeping as needed
12. The applicant shall pay the total SV;MP fee, due payable to the City at the time of final plat
recording in the amount of $7,558.
13. The developer shall pay full park fees for the two new lots at the time of final plat recording in
the amount of $8,000.
14. Permits from the appropriate regulatory agencies will have to be obtained, including but not
limited to the MPCA and Watershed District.
15. Tree preservation fencing must be installed at the limits of tree removal.
16. Extend the silt fence to the north along the west side.
IT Add a note to the plan: All sanitary services must be 6 -inch PVC-SDR26 and water service I -
inch copper.
18. If importing or exporting material for development of the site is necessary, the applicant will be
required to supply the City with a detailed haul route and traffic control plan.
19. The sanitary sewer and water hookup charges are applicable for each of the new lots. The 2005
trunk hookup charge is $1,458 for sanitary sewer and $2,955 for watermain.

20. All disturbed areas, as a result of construction, must be seeded and mulched or sodded
immediately after grading to minimize erosion.
21. Gutters must be installed on the house on Lot 2 and must discharge to the southwest comer of
the lot.
22. Submit a security to ensure that the street cuts are properly restored to City standards.
23. The applicant should be aware that any retaining wall more than 4 feet in height must be
designed by a Structural Engineer registered in the State of Minnesota. Also, it will require a
building permit through the City's Building Department.
24. Cleanouts are required at all bends of the sanitary sewer service or every 90 feet, whichever is
less.
25. A ten foot drainage and utility easement shall be dedicated along the western property line of
Lot 3.
26. A cross -access and maintenance agreement shall be recorded over Lot 3 for the benefit of Lot
46, Pleasant View Addition, for the existing -driveway.

Mayor Furlong: Let's start with a staff report if we could and then we'l I have, if Mr. Harvieux's here
we'll have a presentation there as well.
Kate Aanenson: Thank you Mayor, members of the City Council. This is a metes and bounds
subdivision. The City Council may approve a metes and bounds subdivision into two lots. Ile splitting
of it if all the urban services are available and then both lots result in meeting the standards of the City,
which in this circumstance they do. As you stated this lot is located on 6601 Horseshoe Curve. So the
proposal then is for the two lots. This lot has a home on it and you're creating Lot 1. This subdivision
was approved back in 2012. Created a zoning lot and then it, so it was, there was an existing home to the
south and these two lots were created. A house was built and then they were combined back in order to
get, go back and create a lot you have to go through the subdivision process and in this circumstance
again it's the metes and bounds is the mechanism. So this is the as -built survey. So this is existing home
here. Existing home here and then the proposed new subdivision lot. All these lots meet the minimum
15,000. The new lot being created is 15,064. We do have the compliance table in there. We did get a
call from a few neighborsjust making sure that the lot's met the minimum and they do. Also we had the

hard surface calculation. Again just ensuring that no variance would be required in the future and making
sure a house does fit on that lot, And as demonstrated it does so with that we are recommending approval
of the subdivision and we'd be happy to answer any questions that you have.

City Council approval requires a majority vote of City Council.
EXECUTIVE SUMMARY
The applicant is requesting metes and bounds subdivision approval to divide the
property into two lots. City council may approve a metes and bounds subdivision of a
lot into two lots inside the urban services area if both resulting lots meet the minimurn
requirements of the zoning ordinance and abut an existing public street, pursuant to
section 18-37 (b) of the Chanhassen City Code.
PROPOSAL SUMMARY
The applicant is requesting a metes and bounds
subdivision of a 0.9 -acre parcel into two (2) lots (re-
establishing Lots I & 2 as separate lots) on property
zoned Single-Fairtily Residential (RSF) located at
6601 Horseshoe Curve. The applicant is Ron
Harvieux.
LEVEL OF CITY DISCRETION IN
DECISION-MAKING:
'fhe City's discretion in approving or denying a plat is
limited to whether or not the proposed plat meets the
standards outlined in the Subdivision Regulations and
Zoning Ordinance. If it meets these standards, the
City must approve the subdivision. This is a quasi-
judicial decision.

BACKGROUND
On November 20, 2012, the property owner requested Lots I and 2, Harvieux Addition be
combined as one parcel into a single zoning lot (Admin. Sub. #12-02). After designation of a
zoning lot, the lot may not be subdivided without complying with the city's subdivision ordinance
(Section 20-903 (c) of the Chanhassen City Code).
On September 29, 2005 the Chanhassen City Council approved the preliminary plat and final plat
for Harvieux Addition creating three lots with a variance for the use of flag lots (Planning Case
#2005-26).

STREETS
Access to the lots will be from Horseshoe Curve.
UTILITtES
No public utility improvement is proposed as the applicant is proposing to extend the water and
sanitary services from City sewer and watermain off Horseshoe Curve for Lot 1. The developer
must submit a security to ensure that the street cuts are properly restored to City standards.

Sanitary sewer and water hookup charges will still be applicable for Lot I at the time of building
permit. The 2014 trunk hookup charge is $1,549 for sanitary sewer and $4,401 for watermain.
Sanitary sewer and watermain hookup fees may be specially assessed against the parcel at the
time of building permit issuance. These charges are based on the number of SAC units assigned
by the Met Council.
PARKS AND RECREATION
As a condition of the Harvieux addition, the owner paid park fees for the two new lots. No
additional park fees are required.
SURFACE WATER MANAGEMENT
The applicant paid SWMP fees with the original plat. No additional fees shall be required.
COMPLIANCE TABLE
Lot width on neck or flag lots and lots accessed by private streets shall be 100 feet as measured at
the front building setback line.
Neck/flag lots must� by definition, be a minimum of 30 feet wide.
RECOMMENDATION
Staff recommends that City Council adopt a resolution approving the metes and bounds
subdivision creating two lots subject to the following conditions; and adoption of the Findings of
Fact and Decision:

IN RE:
Application of Ron Harvieux for Subdivision approval.
On August 25, 2014 the Chanhassen City Council met at its regularly scheduled meeting to
consider the application of Ron Harvieux for a metes and bounds subdivision approval to create
two lots. The City Council conducted a public hearing on the proposed subdivision preceded by
published and mailed notice. The City Council heard testimony from all interested persons
wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Single -Family Residential District, RSF.
2. The property is guided in the Land Use Plan for Residential Low Density uses.
3. The legal description of the property is:
Lots I and 2, Block 1, Harvieux Addition, Carver County, Minnesota
4. The Subdivision Ordinance directs the Planning Commission to consider seven possible
adverse affects of the proposed subdivision. The seven (7) affects and our findings regarding
them are:
a. The proposed subdivision is consistent with the zoning ordinance;
b. Tbc proposed subdivision is consistent with all applicable city, county and regional plans
including but not limited to the city's comprehensive plan;
c. The physical characteristics of the site, including but not limited to topography, soils,
vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and storm water
drainage are suitable for the proposed development;
d. The proposed subdivision makes adequate provision for water supply, storm drainage,
sewage disposal, streets, erosion control and all other improvements required by this
subdivision ordinance;
e. The proposed subdivision will not cause environmental damage;
f. The proposed subdivision will not conflict with easements of record; and

g. The proposed subdivision is not premature. A subdivision is premature if any of the
following exists:
1) Lack of adequate storm water drainage.
2) Lack of adequate roads.
3) Lack of adequate sanitary sewer systems.
4) Lack of adequate off-site public improvements or support systems.
5. The planning report #2014-25 dated August 25, 2014, prepared by Robert Generous, et al, is
incorporated herein.
DECISION
The City Council approves the metes and bounds subdivision creating two lots.

WHEREAS, Ronald Harvieux has requested a metes and bounds subdivision of his
property into two single-family lots of 15,064 square feet and 18,442 square feet; and
WHEREAS, the property was previously subdivided in September 2005 as Harvieux
Addition; and
WHEREAS, the proposed subdivision complies with all requirements of the Chanhassen
City Code; and
WHEREAS, the proposed subdivision is consistent with the Chanhassen Comprehensive
Plan and Zoning ordinance.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves the metes and bounds subdivision separating Lots I and 2, Harvieux Addition into
separate lots subject to the following conditions:
1. The property shall comply with the original conditions of approval for the Harvieux
Addition, Planning Case #2005-26.

A RESOLUTION APPROVING A FINAL PLAT
CREATING HARVIEUX ADDITION,
RONALD AND LEANNE HARVIEUX
YMEREAS, Ronald and Leanne Harvieux have requested a subdivision of their property
into three single family lots of 15,064 square feet, 18,800 square feet and 46,441 square feet with
variances for the use of neck lots; and
WHEREAS, the proposed subdivision complies with all requirements of the Chanhassen
City Code; and
MMREAS, the Chanhassen Planning Commission held a public hearing on September
6, 2005, and found the &m consistent with the Chanhassen Comprehensive Plan iind Zoning
ordinance and recommended approval of the subdivision.
NOW� THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves the final plat for Harvieux Addition (Planning Case #05-23) for the Harvieux property,
legally described as Lot 2, Block 1, Sathre Addition; and that part of Horseshoe Curve, originally
dedicated in the record plat of Saffire Addition and now vacated which hes easterly of a line
described as follows: Commencing at the northwest comer of Lot 2, Block 1, in said Sathre
Addition; thence southerly, a distance of 84.82 feet, along the westerly line of said Lot 2, to the
point of beginning of the line to be described; thence southerly, tangent to the curve on said
westerly line, a distance of 53.28 feet; thence southerly, on a tangential curve concave to the
west having a radius of 150.04 feet, to the west line of said Horseshoe Curve, creating Lots 1, 2
and 3, Block 1, Harvieux Addition as shown on the plans received September 12,2005, prepared
by Demars-Gabriel Land Surveyors, Inc., subject to the following conditions:
1. Only trees shown on the preliminary plat as being removed shall be allowed. No troes are to be
removed on Lot 1. Four trees are allowed to be removed on Lot 2. Any other trees removed
shall be replaced at a rate of 2:1 diameter inches.
2. Tree preservation fence shall be installed at the grading1clearing limits prior to any construction
activities and shall remain in place until construction is complete.
3. Detailed grading, drainage, tree removal, and erosion control plans will be required for Lots
1 and 2 at the time of building permit application. Development of lot 2 shall incorporate a
single -lane construction entrance covered with wood chips, tree protection fencing must line
the entrance route and a single storage area shall be designated for all materials. Cement
trucks may not be allowed to rinse out on site.
4. The front lot lines for Lots 2 and 3 are the westerly lot lines.

5. If grading will be done, a final grading plan and soils report must be submitted to the
Inspections Division before building permits will be issued.
6. Separate water and sewer services must be provided for each lot. Relocate Lot I sanitary sewer
and water services from the northwest off Pleasant View Road to the west off Horseshoe Curve.
7. Addresses for each home must be posted on Horseshoe Curve and on each home.
8. No burning permits will be issued. Trees must either be chipped or removed from site.
9. Builder/Developer must comply with Chanhassen Fire Department Policy #29-1991 regarding
premise identification.
10. Erosion control blanket shall be installed on all slopes greater than or equal to 3: 1. All exposed
soil areas shall have temporary erosion protection or permanent cover year round, according to
the following table of slopes and time frames:

11. Street cleaning of soil tracked onto public streets shall include daily street scraping and street

12. The applicant shall pay the total SWMl? fee, due payable to the City at the time of final plat
recording in the amount of $7,558.
13. The developer shall pay full park fees for the two new lots at the time of final plat recording in
the amount of $8,000.
14. Permits from the appropriate regulatory agencies will have to be obtained, including but not
limited to the MPCA and Watershed District.
15. Tree preservation fencing must be installed at the limits of tree removal.
16. Extend the silt fence to the north along the west side.
17. Add a note to the plan: All sanitary services must be 6 -inch PVC-SDR26 and water service I -
inch copper.
18. If importing or exporting material for development of the site is necessary, the applicant will be
required to supply the City with a detailed haul route and traffic control plan.
19. The sanitary sewer and water hookup charges are applicable for each of the new lots. The 2005
trunk hookup charge is $1,458 for sanitary sewer and $2,955 for watermain.

20. All disturbed areas, as a result of constructi on, must be seeded and mulched or sodded
immediately after grading to minimize erosion.
21. Gutters must be installed on the house on Lot 2 and must discharge to the southwest comer of
the lot.
22. Submit a security to ensure that the street cuts are properly restored to City standards.
23. The applicant should be aware that any retaining wall more than 4 feet in height must be
designed by a Structural Engineer registered in the State of Nlinnesota. Also, it will require a
building permit through the City's Building Department.
24. Cleanouts are required at all bends of the sanitary sewer service or every 90 feet, whichever is
less.
25. A ten foot drainage and utility easement shall be dedicated along the western property line of
Lot 3.
26. A cross -access and maintenance agreement shall be recorded over Lot 3 for the benefit of Lot
46, Pleasant View Addition, for the existing driveway.

The above described application for approval of a land development proposal was filed with the Chanhassen Planning
Department on July 18, 2014. The 60 -day review period ends September 16, 2014.
In order for us to provide a complete analysis of issues for Planning Commission and City Council review, we would
appreciate your comments and recommendations concerning the impact of this proposal on traffic circulation, existing and
proposed future utility services, storm water drainage, and the need for acquiring public lands or easements for park sites,
street extensions or improvements, and utilities. Where specific needs or problems exist, we would like to have a written
report to this effect from the agency concerned so that we can make a recommendation to the Planning Commission and City
Council.
This application is scheduled for consideration by the Chanhassen City Council on September 8, 2014 at 7:00 p.m. in the

8. No burning permits will be issued. Trees must either be chipped or removed from site.
9. Builder/Developer must comply with Chanhassen Fire Department Policy #29-1991 regarding
premise identification.
10. Erosion control blanket shall be installed on all slopes greater than or equal to 3: 1. All exposed
soil areas shall have temporary erosion protection or permanent cover year round, according to
the following table of slopes and time frames:

11. Street cleaning of soil tracked onto public streets shall include daily street scraping and street

12. The applicant shall pay the total SWMP fee, due payable to the City at the time of final plat
recording in the amount of $7,558.
13. The developer shall pay full park fees for the two new lots at the time of final plat recording in
the amount of $8,000.
14. Permits from the appropriate regulatory agencies will have to be obtained, including but not
limited to the MPCA and Watershed District.
15. Tree preservation fencing must be installed at the limits of tree removal.
16. Extend the silt fence to the north along the west side.
17. Add a note to the plan: All sanitary services must be 6 -inch PVC-SDR26 and water service I -
inch copper.
18. If importing or exporting material for development of the site is necessary, the applicant will be
required to supply the City with a detailed haul route and traffic control plan.
19. The sanitary sewer and water hookup charges are applicable for each of the new lots. The 2005
trunk hookup charge is $1,458 for sanitary sewer and $2,955 for watermain.
20. All disturbed areas, as a result of construction, must be seeded and mulched or sodded
immediately after grading to minimize erosion.
21. Gutters must be installed on the house on Lot 2 and must discharge to the southwest comer of
@41%46t.
22. Submit a security to ensure that the street cuts are properly restored to City standards.

23. The applicant should be aware that any retaining wall more than 4 feet in height must be
designed by a Structural Engineer registered in the State of Nfinnesota. Also, it will require a
building permit through the City's Building Department.
24. Cleanouts are required at all bends of the sanitary sewer service or every 90 feet, whichever is
less.
25. A ten foot drainage and utility easement shall be dedicated along the western property line of
Lot 3.
26. A cross -access and maintenance agreement shall be recorded over Lot 3 for the benefit of Lot
46, Pleasant View Addition, for the existing driveway.
Two signed mylar copies of the final plat shall be submitted to our office for signatures along
with signed access easement and the administrative fees in the amount of $16,163.00. Two
I "=200'scale mylar reductions of the final plat and one 1"=200'scale mylar reductions of the
final plat with just street names and lot and block numbers shall be submitted. In addition, a
digital copy in dxf format and a digital copy in tif format (pdf compatible) of the final plat shall
be submitted.
The City will submit all the necessary documents to Carver County for recording of the
