Mayor Furlong: Good evening. Ron Kleve: My name is Ron Kleve, 7307 Laredo Drive. Some of you might recognize me as a member on the Lotus Lake Conservation Alliance and I am not a member of the LLCA anymore. My tenure expired and I chose to give others a chance to serve so if you hear mixed messages between myself and the Board, the LLCA tonight that's because these are my personal opinion. I had an opportunity to be part of the boat inspections on Lotus Lake this summer. I took the task of interfacing with Todd on scheduling and any issues that might arise by inspectors and so I think I have kind of a unique position to share with you tonight. One item I want to bring up is the DNR providing labor I don't think is a very good idea. They don't seem to have the same attitude as the City does and as the citizens do as far as commitment to a schedule. They seem to not have the same attitude I guess. For example they, they gave Todd a schedule at the beginning of the year that they would comply to and they ended up not following that and they didn't update Todd or anyone. They just quit showing up. I think Chanhassen is leaps ahead on efforts on inspections. I think it's partly due to the City. I think it's partly due to the citizens efforts. The, another item I'd like to mention on the, on Volt. Just as a, you know I, during my tenure on the board I went to watershed meetings. I went to park and rec meetings. EXECUTIVE SUMMARY The applicant is requesting an amendment to the sign criteria for the Medical Arts Buildings Phases I and Il. The current criteria limits the number of signs on the north and south elevations of each building. The applicant is requesting the signs be limited to a sign band rather than a fixed number of signs. The site is located at the northwest comer of the intersection of Great Plains Boulevard and West 781" Street. Access to the site is gained via West 78"' Street. PLANNING COMMISSION SUMMARY The Planning Commission held a public hearing on November 18, 2014. The Planning Commission voted 7-0 to recommend approval of the project. ' 9 Staff regards the requested amendment as reasonable and consistent with the Sign Ordinance. Based upon the foregoing, staff is recommending approval of the sign plan amendment. APPLICABLE REGULATIONS Chapter 20, Article II, Division 6, Site Plan Review Chapter 20, Article XXVI. — Signs On May 22, 1989, the City Council approved the preliminary plat and site plan application for the Medical Arts Buildings. The site plan review was approved with two buildings to be built in two phases. Phase I building was completed in 1990 and Phase H in 1992. Due to the size of the building and potential number of offices within the building, the City wanted to insure a detailed sign plan was in place. This plan limited the number of signs within a designated strip as well as the number of signs allowed on each building. ANALYSIS When these buildings were constructed, Ridgeview Medical was the major occupant of the building. Since then, the medical office built their own building and left the site. The space within the Medical Arts Buildings has been reconfigured and leased to a number of smaller businesses. Staff often receives requests for signs on these buildings and informs the applicant that the allotted number of signs permitted on the building has been used. Staff contacted the management company for the site and advised them to request an amendment to the criteria governing this site. The existing location of the sign strip would remain unchanged and all the applicable regulations remain the same. The only recommended change is removing the limit on the number of signs on the building. This is a practice that can be observed on all buildings within the City of Chanhassen. This creates a hazard to drivers and pedestrians and also adversely impacts a logical flow of information. Finding: The proposed amendment to the sign plan will be consistent with the sign ordinance. Stop sign shall be installed at the exit point proposed on West 78th Street." r -J L 0 CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA FINDINGS OF FACT AND RECOMMENDATION IN RE: Application of Medical Arts Buildings Phase I and II for an amended Sign Plan Review— Planning Case No. 2014-34 On November 18, 2014, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Medical Arts Buildings Phase I and II for an amended Sign Plan Review located at 470 and 480 West 78'h Street (Lots 1 & 2, Block 1, Medical Arts Addition). The Planning Commission conducted a public hearing on the proposed sign plan preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned CBD, Central Business District. 2. The property is guided in the Land Use Plan Commercial. 3. The legal description of the property is Lots 1 & 2, Block 1, Medical Arts Addition. 4. PLANNING CASE 2014-34: Al-Jaff: Chairman Aller, members of the Planning Commission. The subject site is located at the northwest corner of the intersection of Great Plains Boulevard and West 78`s Street. Brief background on the buildings that we have out there. In 1989 the City Council approved the preliminary plat and site plan application for the Medical Arts Building. It was approved in two phases. Phases 1 and 2 and Phase I was completed in 1990. And Phase 2 in '92. Part of the site plan approval for those two buildings was a sign plan for the overall site. The City wanted to ensure that there was a detailed plan in place. This is, this was a fairly large building for Chanhassen at the time and they just needed to ensure that things didn't get out of hand and signs weren't all over the building. The one thing that we need to point out is at the time when those buildings were built the main occupant was Ridgeview Medical and there were a couple of other large users within the building. The developer at the time requested that the sign band facing 78'h as well as the parking lot be limited in how many signs it would include. Since then Ridgeview, as you know built their own building and moved to the comer of Highway 5 and Powers Boulevard. This building, these spaces started to get occupied by smaller businesses but quite a few more within the building and we're often faced with a request to put up a sign along the building and within the sign band. Unfortunately when we look at the criteria that was approved for the Medical Arts Building, our answer always has to be no. And we got to a point where we picked up the phone and contacted the management company and said please request an amendment to this criteria. This is not something that you find anywhere else in the city. All of the buildings usually you will see a sign band and this is where you will have your signage so what staff is recommending is we remove the limit on the number of signs. One of them is currently the Phase 1 building is limited to 10 signs. Five on each side and the second one is limited to 14, 7 on each side. Instead what we have is a sign band that is limited to 2 feet 2 inches and it doesn't matter how many signs you can fit within that band as long as it meets the criteria set in the, in this application then that's fine. And just on another topic, I did do the math for the overall area of the facade of the building and the percentage that will be occupied by signage and it is way below what is permitted by ordinance so with that staff is recommending that we remove the language limiting the number of signs on each face. Everything else within that development will remain as is. And I'll be happy to answer any questions. Aller: How many tenants are we expecting to be in the facility? SCANNED 21 Chanhassen Planning Contssion — November 18, 2014 • Al-Jaff: When we spoke to the applicant, I mean they said what do you think if you limited it to 12? It's a matter of how many they can fit on the fagade and it's really limited, they will only be able to potentially fit 10 signs. I don't believe they can fit in 12. And it depends on. Aller: My concern is if it comes, something that looks like a gaudy, 10 different styles and shapes and names in there and it becomes a detraction to what would otherwise be a nice building. Al-Jaff: You won't be able to, the space is limited. There is a separation between each individual letter. There is also, you want the separation between one sign and the other so when you incorporate these, I tried to do the math to figure out how many signs you could potentially put in there but then it depends on the length of the name of a business. Maybe you'll have one business that will just put up a logo and nothing else so I didn't think that I can give you a number. A solid number. Aller: Nope but I'm glad that we've examined that and you've thought it through because that was my first blush. Oh -oh, we're going to have a bunch of signage in there and it's going to detract so any other questions? Hokkanen: You don't have a closer up picture of the signs do you? I mean I'm really familiar with the buildings so I know what you're talking about and I agree with you. Aanenson: I think the most recent one would be the MacPhail. Al-Jaff: Yes. Aanenson: Which is a nice sign. Al-Jaff: Correct and that was located on Phase 1. And all the signs that you see there, it is letters that are 24 inches and in compliance with ordinance. As Sharmeen mentioned we ran into this problem recently when we started switching over these buildings to become more multi -tenant than single tenant related. Especially at the 470 building which is a two story building. That sign requirement only limited us to 5 signs on the 78d' Street side which became a big problem which we weren't fully aware of because this dates back to 1990. So going forward what we have been Chanhassen Planning Cowission —November 18, 2014 • doing is managing the tenants based on size requirements so if you have a larger tenant like MacPhail or Health Source which are our two biggest tenants currently in the building, we've reserved the canopy kind of areas for them so we're not just giving everybody the opportunity to have a sign so we do limit that in some ways so we won't have you know just a plaster of signs everywhere. In evaluating a sign plan, the city shall consider the following: (1) Permanent and temporary signs have a direct impact on, and a relationship to, the image of the community; (2) The manner of installation, location and maintenance of signs affects the public health, safety, welfare and aesthetics of the community; (3) An opportunity for a viable identification of community business and institutions must be established; (4) The safety of motorists, cyclists, pedestrians and other users of public streets and property is affected by the number, size, location and appearance of signs that unduly divert the attention of drivers; (5) Installation of signs suspended from, projecting over, or placed on the tops of buildings, walks or other structures may constitute a hazard during periods of high winds and an obstacle to effective firefighting and other emergency service; (6) Uncontrolled and unlimited signs adversely impact the image and aesthetic attractiveness of the community and, thereby, undermine economic value and growth; (7) Uncontrolled and unlimited signs, particularly temporary signs, which are commonly located within or adjacent to public right-of-way, or are located at driveway/street intersections, result in roadside clutter and obstruction of views of oncoming traffic. Finding: The proposed amendment to the sign plan will be consistent with the sign ordinance. All signs must receive a sign permit prior to installation.
