SIGN CRITERIA
Medical Arts Building Phase I
a. Wall Mounted Sims:
1. Signs are only allowed within a continuous 2'2" high band near the roof line on the north
and south sides of the building, including the projections over entries. Signs shall be
attached directly to the building siding and not project above or below the designated sign
area.
2. All signs shall be comprised of individual letters and/or logos. Letters shall not exceed 12"
in height and logos shall not exceed 24" in height.
3. Signs along the north elevation of the building shall not be illuminated during non -business
hours. Signs along the south elevation may be illuminated during any hour.
b. Free Standing Sims:
1. Monument Sign: One Single Sided monument sign for building identification (not tenant
identification) may be placed in the southwest yard between the building and the sidewalk.
The top of the sign may not exceed 4 feet in height. The dimensions of the sign may not
exceed 2 feet high by 14 feet wide. The copy shall have a maximum height of one foot and
be internally illuminated.
c. General:
I. One non -illuminated temporary real estate sign which advertise sale of the building or space
for lease within the building. The area of the sign shall not exceed 12 square feet nor exceed
5 feet in height nor be located less than 10 feet from the property line. The sign shall be
removed within seven days following sale, lease, or rental of the property.

Ron Kleve: My name is Ron Kleve, 7307 Laredo Drive. Some of you might recognize me as a
member on the Lotus Lake Conservation Alliance and I am not a member of the LLCA anymore.
My tenure expired and I chose to give others a chance to serve so if you hear mixed messages
between myself and the Board, the LLCA tonight that's because these are my personal opinion.
I had an opportunity to be part of the boat inspections on Lotus Lake this summer. I took the
task of interfacing with Todd on scheduling and any issues that might arise by inspectors and so I
think I have kind of a unique position to share with you tonight. One item I want to bring up is
the DNR providing labor I don't think is a very good idea. They don't seem to have the same
attitude as the City does and as the citizens do as far as commitment to a schedule. They seem to
not have the same attitude I guess. For example they, they gave Todd a schedule at the
beginning of the year that they would comply to and they ended up not following that and they
didn't update Todd or anyone. They just quit showing up. I think Chanhassen is leaps ahead on
efforts on inspections. I think it's partly due to the City. I think it's partly due to the citizens
efforts. The, another item I'd like to mention on the, on Volt. Just as a, you know I, during my
tenure on the board I went to watershed meetings. I went to park and rec meetings. I went to the
county park and rec and each time I went to the groups meetings I was hoping that this group
would be the group that would take the reins and go with it and I never saw that happen.

City Council approval of the sign plan amendment requires a majority vote of City
Council present.
EXECUTIVE SUMMARY
The applicant is requesting an amendment to the sign criteria for the Medical Arts
Buildings Phases I and Il. The current criteria limits the number of signs on the north
and south elevations of each building. The applicant is requesting the signs be
limited to a sign band rather than a fixed number of signs.
The site is located at the northwest comer of the intersection of Great Plains
Boulevard and West 781" Street. Access to the site is gained via West 78"' Street.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on November 18, 2014. The Planning
Commission voted 7-0 to recommend approval of the project. The November 18, 2014
Planning Commission minutes are included in the December 8, 2014, City Council
packet.
RECOMMENDATION
Staff recommends approval of the request.

Staff regards the requested amendment as reasonable and consistent with the Sign Ordinance.
Based upon the foregoing, staff is recommending approval of the sign plan amendment.
APPLICABLE REGULATIONS
Chapter 20, Article II, Division 6, Site Plan Review
Chapter 20, Article XXVI. — Signs
On May 22, 1989, the City Council approved the preliminary plat and site plan application for the
Medical Arts Buildings. The site plan review was approved with two buildings to be built in two
phases. Phase I building was completed in 1990 and Phase H in 1992.

Part of the site plan approval included a sign plan. Due to the size of the building and potential
number of offices within the building, the City wanted to insure a detailed sign plan was in place.
This plan limited the number of signs within a designated strip as well as the number of signs
allowed on each building.
ANALYSIS
When these buildings were constructed, Ridgeview Medical was the major occupant of the building.
Since then, the medical office built their own building and left the site. The space within the
Medical Arts Buildings has been reconfigured and leased to a number of smaller businesses. Staff
often receives requests for signs on these buildings and informs the applicant that the allotted
number of signs permitted on the building has been used. Staff contacted the management company
for the site and advised them to request an amendment to the criteria governing this site. The
existing location of the sign strip would remain unchanged and all the applicable regulations remain
the same. The only recommended change is removing the limit on the number of signs on the
building. This is a practice that can be observed on all buildings within the City of Chanhassen.

established;
(4) The safety of motorists, cyclists, pedestrians and other users of public streets and property is
affected by the number, size, location and appearance of signs that unduly divert the attention
of drivers;
(5) Installation of signs suspended from, projecting over, or placed on the tops of buildings,
walks or other structures may constitute a hazard during periods of high winds and an
obstacle to effective firefighting and other emergency service;
(6) Uncontrolled and unlimited signs adversely impact the image and aesthetic attractiveness of
the community and, thereby, undermine economic value and growth;
(7) Uncontrolled and unlimited signs, particularly temporary signs, which are commonly located
within or adjacent to public right-of-way, or are located at driveway/street intersections,
result in roadside clutter and obstruction of views of oncoming traffic. This creates a hazard
to drivers and pedestrians and also adversely impacts a logical flow of information.
Finding: The proposed amendment to the sign plan will be consistent with the sign
ordinance. All signs must receive a sign permit prior to installation. The sign band area will
limit the total signage permitted on the building.
RECOMMENDATION

AND RECOMMENDATION
IN RE: Application of Medical Arts Buildings Phase I and II for an amended Sign
Plan Review— Planning Case No. 2014-34
On November 18, 2014, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Medical Arts Buildings Phase I and II for an amended
Sign Plan Review located at 470 and 480 West 78'h Street (Lots 1 & 2, Block 1, Medical Arts
Addition). The Planning Commission conducted a public hearing on the proposed sign plan
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned CBD, Central Business District.
2. The property is guided in the Land Use Plan Commercial.
3. The legal description of the property is Lots 1 & 2, Block 1, Medical Arts Addition.
4. In evaluating a sign plan, the city shall consider the following:
(1) Permanent and temporary signs have a direct impact on, and a relationship to, the image
of the community;
(2) The manner of installation, location and maintenance of signs affects the public health,
safety, welfare and aesthetics of the community;

Dear Chanhassen City Council:
This letter shall serve as a request to amend the current Sign Plan use at 470 and 480 W 7F Street,
Chanhassen, MN.
In the early 1990's both 470 and 480's Sign Plan was established. At that time the buildings were occupied by
very few tenants as each tenant occupied a significant amount of the buildings square footage thus making the
original sign plan's intent work well.
Since that time the buildings have seen a significant change in the tenant mix and the amount of tenants that
occupy the building. Gone are the large tenants that occupied a majority of the building. What has blossomed
today are some great small businesses that take up many small suites in the building.
Therefore, our request is to update the sign plan for both buildings in order to give our small businesses the
ability to advertise their name on the exterior of the building in order to be even more successful -
Attached are images of the sign areas of the building that are being underutilized at this time based on the
current sign plan requirement. We ask that the sign plan allow both 470 and 480's buildings to have 12 signs
on the exterior sign area that faces W 78" Street and 12 signs on the exterior sign area that faces the parking
lot (north side of the building). We are not requesting any other changes to the plan. The north side signage
would remain non -illuminated and the south side (W 78' St.) would still have the option to illuminate.

Al-Jaff: Chairman Aller, members of the Planning Commission. The subject site is located at
the northwest corner of the intersection of Great Plains Boulevard and West 78`s Street. Brief
background on the buildings that we have out there. In 1989 the City Council approved the
preliminary plat and site plan application for the Medical Arts Building. It was approved in two
phases. Phases 1 and 2 and Phase I was completed in 1990. And Phase 2 in '92. Part of the site
plan approval for those two buildings was a sign plan for the overall site. The City wanted to
ensure that there was a detailed plan in place. This is, this was a fairly large building for
Chanhassen at the time and they just needed to ensure that things didn't get out of hand and signs
weren't all over the building. The one thing that we need to point out is at the time when those
buildings were built the main occupant was Ridgeview Medical and there were a couple of other
large users within the building. The developer at the time requested that the sign band facing
78'h as well as the parking lot be limited in how many signs it would include. Since then
Ridgeview, as you know built their own building and moved to the comer of Highway 5 and
Powers Boulevard. This building, these spaces started to get occupied by smaller businesses but
quite a few more within the building and we're often faced with a request to put up a sign along
the building and within the sign band. Unfortunately when we look at the criteria that was
approved for the Medical Arts Building, our answer always has to be no. And we got to a point
where we picked up the phone and contacted the management company and said please request
an amendment to this criteria. This is not something that you find anywhere else in the city. All
of the buildings usually you will see a sign band and this is where you will have your signage so
what staff is recommending is we remove the limit on the number of signs. One of them is
currently the Phase 1 building is limited to 10 signs. Five on each side and the second one is
limited to 14, 7 on each side. Instead what we have is a sign band that is limited to 2 feet 2
inches and it doesn't matter how many signs you can fit within that band as long as it meets the
criteria set in the, in this application then that's fine. And just on another topic, I did do the math
for the overall area of the facade of the building and the percentage that will be occupied by
signage and it is way below what is permitted by ordinance so with that staff is recommending
that we remove the language limiting the number of signs on each face. Everything else within
that development will remain as is. And I'll be happy to answer any questions.
Aller: How many tenants are we expecting to be in the facility?

Al-Jaff: When we spoke to the applicant, I mean they said what do you think if you limited it to
12? It's a matter of how many they can fit on the fagade and it's really limited, they will only be
able to potentially fit 10 signs. I don't believe they can fit in 12. And it depends on.
Aller: My concern is if it comes, something that looks like a gaudy, 10 different styles and
shapes and names in there and it becomes a detraction to what would otherwise be a nice
building.
Al-Jaff: You won't be able to, the space is limited. There is a separation between each
individual letter. There is also, you want the separation between one sign and the other so when
you incorporate these, I tried to do the math to figure out how many signs you could potentially
put in there but then it depends on the length of the name of a business. Maybe you'll have one
business that will just put up a logo and nothing else so I didn't think that I can give you a
number. A solid number.
Aller: Nope but I'm glad that we've examined that and you've thought it through because that
was my first blush. Oh -oh, we're going to have a bunch of signage in there and it's going to
detract so any other questions?
Hokkanen: You don't have a closer up picture of the signs do you? I mean I'm really familiar
with the buildings so I know what you're talking about and I agree with you.
Aanenson: I think the most recent one would be the MacPhail.
Al-Jaff: Yes.
Aanenson: Which is a nice sign.
Al-Jaff: Correct and that was located on Phase 1. And all the signs that you see there, it is
letters that are 24 inches and in compliance with ordinance.
Aller: And this doesn't change any of the other conditions that would be placed on it by
ordinance.
Al-Jaff: None. None.

Jonathan Adam: Thanks. I'm Jonathan Adam, 165 Louisic Court, Chaska, Minnesota. I'm with
Silverstone Realty. I'm the leasing agent for the two buildings and I'm also here representing
the owner tonight. Thanks for the time. As Sharmeen mentioned we ran into this problem
recently when we started switching over these buildings to become more multi -tenant than single
tenant related. Especially at the 470 building which is a two story building. That sign
requirement only limited us to 5 signs on the 78d' Street side which became a big problem which
we weren't fully aware of because this dates back to 1990. So going forward what we have been

doing is managing the tenants based on size requirements so if you have a larger tenant like
MacPhail or Health Source which are our two biggest tenants currently in the building, we've
reserved the canopy kind of areas for them so we're not just giving everybody the opportunity to
have a sign so we do limit that in some ways so we won't have you know just a plaster of signs
everywhere. We do reserve them for the larger tenants so I think that's all I really have. If you
have any questions I'd be happy to answer them.

IN RE: Application of Medical Arts Buildings Phase I and II for an amended Sign
Plan Review— Planning Case No. 2014-34
On November 18, 2014, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Medical Arts Buildings Phase I and II for an amended
Sign Plan Review located at 470 and 480 West 78t° Street (Lots 1 & 2, Block 1, Medical Arts
Addition). The Planning Commission conducted a public hearing on the proposed sign plan
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned CBD, Central Business District.
2. The property is guided in the Land Use Plan Commercial.
3. The legal description of the property is Lots 1 & 2, Block 1, Medical Arts Addition.
4. In evaluating a sign plan, the city shall consider the following:
(1) Permanent and temporary signs have a direct impact on, and a relationship to, the image
of the community;
(2) The manner of installation, location and maintenance of signs affects the public health,
safety, welfare and aesthetics of the community;
(3) An opportunity for a viable identification of community business and institutions must be
established;
(4) The safety of motorists, cyclists, pedestrians and other users of public streets and
property is affected by the number, size, location and appearance of signs that unduly
divert the attention of drivers;
(5) Installation of signs suspended from, projecting over, or placed on the tops of buildings,
walks or other structures may constitute a hazard during periods of high winds and an
obstacle to effective firefighting and other emergency service;
(6) Uncontrolled and unlimited signs adversely impact the image and aesthetic attractiveness
of the community and, thereby, undermine economic value and growth;
(7) Uncontrolled and unlimited signs, particularly temporary signs, which are commonly
located within or adjacent to public right-of-way, or are located at driveway/street
intersections, result in roadside clutter and obstruction of views of oncoming traffic. This

creates a hazard to drivers and pedestrians and also adversely impacts a logical flow of
information.
Finding: The proposed amendment to the sign plan will be consistent with the sign
ordinance. All signs must receive a sign permit prior to installation. The sign band area
will limit the total signage permitted on the building.
5. The planning report #2014-34, dated November 18, 2014, prepared by Sharmeen Al-Jaff, et
al, is incorporated herein.
The Planning Commission recommends that the City Council approve the Sign Plan.
