All properties must be provided with separate sewer and water connections. Engineering 1. The standard 10 -foot at front and 5 -foot drainage and utility easements shall be granted around the perimeter of the parcels. 2. The owner of Parcel A must grant an easement for the water and sanitary service for Parcel B to run across Parcel A. 3. The city must grant an encroachment agreement for the water and sanitary service for Parcel B to run through the city's drainage and utility easement on Parcel B. 4. The developer must submit a soils report to the city indicating the soil conditions, permeability and slope. If water is encountered, the lowest floor elevation of the proposed building must be three feet above the highest known groundwater elevation. 5. The existing topographic plan must show the first floor elevation of the nearby building at 6360 Forest Circle. 6. The grading plan must show drainage arrows for proposed and existing water flow. 7. Grading at the northwest comer of the proposed building shall be revised so that it is not directing water towards the structure. The grading plan shall be revised to show the elevation at the corners of the proposed building pad. 8. The grading north and west of the proposed building shall be revised so that no slope is steeper than 3:1. 9. Ten percent (10%) is the maximum driveway grade allowed in the City Code. PUBLIC HEARING: METES & BOUNDS SUBDIVISION REOUEST TO DIVIDE A 2.57 ACRE PARCEL INTO TWO (2) LOTS OF 41,301 AND 70,706 SOUARE FEET, 2631 FOREST AVENUE, KENNETH AND BETTY LANG. Kate Aanenson: Thank you Mayor, members of the City Council. As you indicated this is a metes and bounds subdivision which you're aware, we had one at the last meeting that can go directly to the City Council if both lots meet the minimum requirements. So again the applicants are Kenneth and Betty Lang. The history on this property located on 2631 Forest Avenue, just south of Highway 7. West of the commercial center that you approved under consent there at 7 and 41. Access can also go down to Herman Field so Forest Avenue is here. You can see on this part of it this is what goes down to the park. It has a lengthy history. The subdivision was actually Minnewashta Park was actually platted in 1887. One of the older areas in town and the house was constructed, the existing house on the site was constructed in 1975. There was access that has been vacated in this area. Part of Oriole coming down to Herman Park. There was an access. There's wetlands going across that were vacated and part of the history of that in 1991. So there's two requests then for tonight. For Parcel A, or excuse me. The request is for the metes and bounds to create two lots. Both lots are in well excess of the minimum 15,000 square feet. The most challenging thing on this site is some of the topography and the wetlands but both lots have access onto a public frontage and meet the minimum requirements. So the subdivision itself lays out where the existing home here and then this home will be subdivided. The lot will be subdivided north to south and again a lot of that has to do with the existing drainage pattern. There's drainage through the property here and then some of the steep slopes. There's easements that will be required to get the sewer and water from the northern Parcel A to the southern Parcel B and also some of the challenges on this would be the driveway grades. You have to maintain less than 10 percent so that, I'll explain that a little bit more in the next slide but the other issue then that we have a condition on of when the home is sited that they do provide the building inspection department a soils report of exactly how the house is going to sit on there. What the ordinance requires that they show a 60 by 60 pad, which they've demonstrated so again the driveway will come in here because we don't know exactly how the house will sit on that lot. What the shape of that house will be. We'll get the soils report with the building permit. Again as I indicated the driveway is, you know cannot exceed 10 percent so that's why the house is set back a little bit further. I know that there was some concern about the proximity. This is actually treated as a side yard so it would be, could go as close as 10. They're about 30-35 feet from that side property line. There's no variances with this so it meets all the conditions of the 11 SCANNED Chanhassen City Council — December 8, 2014 staff report so the staff is recommending approval. There is a resolution attached in there as included in the motion and I'd be happy to answer any questions that you may have. Mayor Furlong: Thank you. Questions for Ms. Aanenson. Just a clarifying question. We talk about metes and bounds subdivision to create two lots. Just to be clear there are, there's currently one lot. After this there will be two. Kate Aanenson: Correct. Mayor Furlong: It's not, we're not creating two new in addition to the house. Kate Aanenson: That's correct. A total of one additional lot to make up the two lots. Mayor Furlong: Two total, thank you. Kate Aanenson: Yeah. Mayor Furlong: Any other questions for Ms. Aanenson at this time? If not we'll go ahead and open up the public hearing and invite any interested party to come forward and address the council on this matter. Ms. Aanenson can you just clarify, the subdivision does require the placement of a, like a pad or where a house could be built. Kate Aanenson: Right. Councilman Laufenburger: Is that the only place on this whole place, on this whole new parcel where a house can be built? 12 Chanhassen City Council — December 8, 2014 Kate Aanenson: What we're saying is that's the approximate area based on the drainage swale that goes through the area. Councilman Laufenburger: Yeah I see that right there in the middle. Kate Aanenson: Yeah, there's a big drainage swale that comes through here. That was some of the, when we looked at whether or not there could be an additional lot put on the site and that's what pushed it back. Also with steep grades and to stay under that, the driveway grades change from 4 to 10 percent so we try to average that out to not to exceed the 10 percent which is the city ordinance so that's about the best approximate location that it can go. Councilman Laufenburger: Okay. Kate Aanenson: It's not going to be in a square shape but approximately there, correct. Councilman Laufenburger: And then the second question, I think you answered it with, and you talked about the grade. There probably is not a likelihood that this parcel 2, is that what it's being called? The one that. Kate Aanenson: Yeah, A and B. Councilman Laufenburger: A and B. Parcel B likely cannot be subdivided again, is that correct? Kate Aanenson: Yes. The way it's laid out now because there's wetlands on this southern portion in here, correct. Councilman Laufenburger: Okay. Alright. So what we're looking at is, this is a, this is the final subdivision that could be made to this property? Kate Aanenson: I don't want to say down in 20 years if someone wanted to come in at some time and try to fill something that might, they might try to but really this is probably the best layout for that. Councilman Laufenburger: Okay. Thank you very much. Mayor Furlong: Thank you. Other questions? Ms. Aanenson in the last metes and bounds subdivision there were issues of water and drainage with regard to neighboring properties. don't see anything in the conditions. Was there anything of concern with this? Kate Aanenson: No I think in talking to the Water Resources Coordinator, reviewing the drainage felt comfortable with the location. This was the best location of the house. Maintain existing drainage patterns. As you know there's wetlands on back side of Herman Park so this would maintain existing drainage patterns. The Easement shall run with the title to the Benefited Property and shall inure to the benefit of and be binding upon the parties hereto and their respective hens, successors and assigns, including, but without limitation all subsequent owners of the Benefited Property and all persons claiming under them. The Easement shall include the rights of the Grantees, their contractors, agents, employees, and assigns, to enter upon the easement premises at all reasonable times to construct, reconstruct, inspect, repair, and maintain said Utility System over, across, on, under, and through the Easement Premises, together with the right to grade, level, fill, drain, pave, and excavate the easement 179706v1 premises, and the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the location, construction, and maintenance of said Utility System. 2. Location of Utility Facilities. The Utility System shall be located and constructed so as not to interfere or disrupt normal operation of any facilities used for providing sewer, water, or any other public utility service located on the Subject Property. 3. Grantees Protection of Utility System. Grantees shall take reasonable measures to prevent the Grantees' Utility System from causing damage to persons or property. Grantees shall take reasonable measures to protect the Utility System from damage that could be inflicted on the facilities by persons, property, or the elements. Grantees shall take protective measures when the Grantors perform work near the Utility System, if given reasonable notice by the Grantors of such work prior to its commencement. 4. Restoration. Upon completion of any work requiring the opening of the Easement Premises, Grantees shall, in all cases, place the Easement Premises in, on, under or across which the same are located in as good condition as they were prior to said operation. Grantees shall also maintain the same in good condition for two (2) years thereafter. The work shall be completed as promptly as weather permits, and if Grantees shall not promptly perform and complete the work, remove all dirt, rubbish, equipment and material, and put the Easement Premises in the said condition, the Grantors shall have, after demand to Grantees to cure and the passage of a reasonable period of time following the demand, but not to exceed five (5) days, the right to make the restoration at the expense of Grantees. Grantees shall pay to the Granton; the cost of such work done for or performed by the Grantors. This remedy shall be in addition to any other remedy available to the Grantors. 5. Permission for Excavation. Grantees shall not open or disturb the surface of the Easement Premises for any purpose without first having obtained permission from the Grantors. Grantees may, however, open and disturb the Easement Premises without permission from the Grantors where an emergency exists requiring the immediate repair of Utility System. In such event Grantees shall notify the Grantors by telephone before opening or disturbing the Easement Premises. On the next worldng day thereafter, Grantees shall obtain any required permits and pay any required fees. 6. Termination. This Easement shall terminate if the Utility System is abandoned or relocated from the Kenneth Lang Property. 7. Indemnification. Grantees shall indemnify, keep and hold Grantors, their employees, agents and assigns, free and harmless from any and all liability on account of injury or death of persons or damage to or depreciation in value of property occasioned by the construction, maintenance, repair, inspection or the operation of Grantees' property located in, on, over, under, or across the Easement Premises. 8. Grantees to Defend Claims. In the event a suit is brought against the Grantors under circumstances where this agreement to indemnify applies, Grantees at their sole cost and expense shall defend the Grantors in such suit if written notice thereof is promptly given to 2 179706A Grantees within a period wherein Grantees are not prejudiced by lack of such notice. If Grantees are required to indemnify and defend, they will thereafter have control of such litigation, but Grantees may not settle such litigation without the consent of the Grantors, which consent shall not be unreasonably withheld. This section is not, as to third parties, a waiver of any defense or immunity otherwise available to the Grantors; and Grantees, in defending any action on behalf of the Grantors shall be entitled to assert in any action every defense or immunity that the Grantors could assert in their own behalf. 9. Compliance with Applicable Laws. Grantees shall at all times comply with all applicable laws, ordinances, rules, regulations, and codes, federal, state, and local, whether now or hereafter promulgated or enacted. Kenneth and Betty Lang are the fee owners of certain real property located in the City of Chanhassen, County of Carver, State of Minnesota, legally described on Exhibit B attached hereto ("Subject Property'). The City owns easements for drainage and utility purposes over portions of the Subject Property. C. The City hereby approves the encroachment in its easement areas on the Subject Property for the construction of the private sanitary service and private water service upon the condition that the City shall have no responsibility to maintain the private sanitary service and private water service located within the City's easements. If the City determines it is necessary to relocate the private sanitary service and/or the private water service, it may do so at the City's expense after thirty (30) days advance written notice to Kenneth and Betty Lang and Todd and Jenny Lang, except that no notice will be required in case of an emergency. 3. HOLD HARMLESS AND INDEMNITY. City Council approval requires a majority vote of City Council. EXECUTIVE SUMMARY The applicant is requesting metes and bounds subdivision approval to divide the property into two lots. City council may approve a metes and bounds subdivision of a lot into two lots inside the urban services area if both resulting lots meet the minimum requirements of the zoning ordinance and abut an existing public street, pursuant to Section 18-37 (b) of the Chanhassen City Code. PROPOSAL SUMMARY The applicant is requesting a metes and bounds subdivision of a 2.57 -acre parcel into two (2) lots on property zoned Single -Family Residential (RSF) located at 2631 Forest Avenue. The applicant and property owners are Kenneth and Betty Lange. The area is single-family residential. The applicant is not requesting to rezone the property and the provided grading plan is conceptual at this time. BACKGROUND Minnewashta Park was platted in July 1887. House constructed in 1975. November 5, 1990, the City received a 40 -foot access easement to access Herman Field Park. The applicant is requesting a metes and bounds subdivision creating two lots. The net density of the development is 0.78 units per acre. DRIVEWAY The proposed building is set at the western edge of Parcel B. A driveway approximately 200 feet long will provide access to Forest Avenue (60 foot ROW, 22' +/- paved). The grading will direct water to sheet flow over the driveway for approximately 40 feet near Forest Avenue. The driveway shows a grade of 4% and 10%. Ten percent (10%) is the maximum driveway grade allowed in the City Code. No part of the driveway may exceed 10%. The grading plan shall show the connection of the proposed driveway to the street. The developer's engineer shall submit legal descriptions and exhibits to the city for recording. The owner of Parcel A must grant an easement for the water and sanitary service for Parcel B to run across Parcel A. The city must grant an encroachment agreement for the water and sanitary service for Parcel B to run through the City's drainage and utility easement on Parcel B. GRADING: DRAINAGE The lot drains to the south and west into Lake Minnewashta through a Manage 2 shallow marsh located within Herman Park. The drainage is conveyed through a swale that intersects the eastern third of the existing parcel and drains from north to south. The proposed grading will continue the existing drainage pattern. The developer must submit a soils report to the city indicating the soil conditions, permeability and slope. If water is encountered, the lowest floor elevation of the proposed building must be three feet above the highest known groundwater elevation. The existing topographic plan must show the first floor elevation of the nearby building at 6360 Forest Circle. The grading plan must show drainage arrows for proposed and existing water flow. SITE GRADING: EROSION PREVENTION AND SEDIMENT CONTROL When a building permit application is submitted, an erosion control plan consistent with Section 19-145 of city code will be required. SITE CONSTRAINTS Wetland Protection The City of Chanhassen Wetland Inventory and the Minnehaha Creek Watershed Wetland Inventory both indicate a wetland immediately adjacent to the subject property within Herman Todd Gerhardt Forest Avenue Metes & Bounds Subdivision December 8, 2014 Page 4 Park. Given the existing topography and the mapped soil unit as well as the existing drainage patterns, there is some chance that the wetland extends onto the subject property. The conceptual grading plan appears to keep all land -disturbing activities at a high enough elevation so as to make it unlikely that it would result in any wetland impacts if it does in fact extend onto the subject property. Because of the nature of wooded ephemeral wetlands, it would be very difficult to determine the extent of the wetland with the current conditions. As such, it will be required that before any site plan is approved, the applicant at that time will need to determine the wetland extent and design accordingly. Bluff Protection There are steep slopes on the subject property with grades approaching 25%. This does not meet the criteria for classification as a bluff but does merit caution during the design and construction of any future home. The soils on much of the subject property are considered to be highly erodible. These factors must be considered in the development of the site plan and erosion prevention and sediment control plan when the site plan review is applied for. Shoreland Management The property lies within the shoreland district for Lake Minnewashta. The proposed lot dimensions meet the requirements for the management classification. Floodplain Overlay This property does not lie with a floodplain. STORM WATER MANAGEMENT Article VII, Chapter 19 of City Code describes the required storm water management development standards. Section 19-141 states that "these development standards shall be reflected in plans prepared by developers and/or project proposers in the design and layout of site plans, subdivisions and water management features." Given the wooded nature of the subject property and the space needed to construct a stormwater management feature, staff feels that it would be of equal benefit to forego the construction of a storm water management practice and spare the subject area from additional tree removal. It is noteworthy that the aforementioned swale receives surface drainage from Forest Avenue and some of Orchard Lane. There may be potential in the future for the city to install a surface water management BMP to capture and treat this watershed. Storm Water Utility Connection Charges Section 4-30 of code sets out the fees associated with surface water management. A water quality and water quantity fee are collected with a subdivision. These fees are based on land use type and are intended to reflect the fact that more intense the development type, the greater the degradation of surface water. There are no bufferyard requirements for this subdivision. PARKS AND RECREATION The proposed subdivision is located within the municipal park service boundaries of Herman Field Park. The property has access to the city's comprehensive trail system located along Highway 7 and Highway 41 via local roadways. The property is adjacent to Herman Field Park which features a playground, open play field, basketball court and trail connection to Minnewashta Regional Park. In lieu of parkland dedication or trail construction, the development shall pay full park fees in force for the one new lot (Parcel B) at the time of subdivision approval. Parks fees for 2014 are $5,800.00 per single-family lot. SANITARY SEWER AND WATERMAIN Sanitary sewer and water main were constructed under Forest Avenue as part of the Sanitary Sewer and Water Project No. 71-1 C, and the existing lot connected up to both sewer and water at that time. The project stubbed out two additional services. Parcel B intends to connect to the southernmost of the additional services, however, that service will have to cross Parcel A.
