GRANT OF PERMANENT EASEMENT
FOR DRAINAGE AND UTILITY PURPOSES
CHARLES H. NEWELL III, a single person, hereinafter referred to as "Grantor", in
consideratian of {one Dollar ($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant unto the CITY OF
CHANHASSEN, a Minnesota municipal corporation, the Grantee, hereinafter referred to as the
", City►'its successors and assigns, forever, a pennanent easement for public drainage and utility
purposes over,, across, on, under, and through land situated wiflun the Counter of Carver, State of
Minnesota, as described an the attached Exhibit "A" and depicted on Exhibit "B" Clhe Easement
Premis&`).
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter upon
the Easement Pre at all reasonable times to construct, reconstruct, inspect, repair, and maintain
said public drainage. and utility systems over, amass, are, under, and through the Easement Premises,
together with the right to grade, level, fill, chain, and excavate the Easement Premises, and the further
right to remove trees, bushes, undergrowth, and other obstructions interfering with the location,
construction, and maintenance of said drainage and utility systems.

The above teamed Grantor, for himself, his heirs, successors and assigns does covenant with
the pity, its successors and assigns, that. he is well seized in fee title of the above -described Easement
Premises; that he has the sole right to grant and convey the easement to the City; that there are no
unrecorded interests �n the Easement Premises; and that he will indemnify and bald the City harmless
for any breach of the foregoing covenants.

Addition, the centerli.�e of which is described as commencing at the northeasterly comer of said Lot 5;
thence on an assumed bearing of South 67 degrees 01 minute 44 seconds west along a Northerly Line of
said Lot S a distance of 1.96-26 feet; theme South 80 degrees 27 minutes lU seconds a distance of 216 feet,
more or less, to the shoreline of Lake Minnewashta, and said line there ternunating. The sidelines of said
easement shall be shortened or lengthened t4 extend to the westerly right-of-way line of Dogwood Road
