PC 09.03.2024CHANHASSEN PLANNING COMMISSION REGULAR MEETING MINUTES SEPTEMBER 3, 2024 CALL TO ORDER: Chairman Noyes called the meeting to order at 6:00 p.m. MEMBERS PRESENT: Chair Eric Noyes, Steve Jobe, Perry Schwartz, Ed Goff, Ryan Soller, Jeremy Rosengren, Katie Trevena. MEMBERS ABSENT: None. STAFF PRESENT: Rachel Jeske, Planner; Eric Maass, Community Development Director. PUBLIC PRESENT: Mark Guy 510 Pleasant View Road PUBLIC HEARINGS: 1. 510 Pleasant View Road Setback Variance (Planning Case #24-14) Rachel Jeske, Planner, gave a summary of the staff report, noting the applicant is requesting a setback variance for the construction of a deck. She explained that the lot size was substandard and stated that the deck would primarily be screened from the road with the current landscaping. Commissioner Goff asked if the neighbor had any comments. Ms. Jeske responded that the applicant discussed the project with the neighbor before submitting the variance request. Chair Noyes stated that the request seemed reasonable. Commissioner Soller asked if there was a variance for the landscaping wall. Ms. Jeske answered that she thought the landscaping wall was originally put in when the home was built. Commissioner Soller stated that he did not see the landscaping wall on the map. Commissioner Jobe asked if there would be any new utilities. Ms. Jeske responded that there would be no new utilities. Commissioner Schwartz asked about what the blue rectangle was in the image. Planning Commission Minutes – September 3, 2024 2 Ms. Jeske answered that the owner owns a small section on the other side of the road, but they are a part of the same lot. Mark Guy, 510 Pleasant View Road, explained that the lot was old and there was not a lot of room to build the deck. He said that the neighbor was helping him build the deck and is okay with the location. Commissioner Schwartz asked if the wall existed. Mr. Guy responded it was existing and they received a permit for the retaining wall last summer. Commissioner Schwartz asked if it needed a variance. Ms. Jeske answered it did not trigger a variance as the retaining wall adhered to setbacks applicable to retaining walls. Commissioner Schwartz asked if anything built within the retaining wall would not need a variance. Chairman Noyes opened the public hearing. No comments. Chairman Noyes closed the public hearing. Commissioner Schwartz asked if the wall exists and the permit was given, would anything built in the wall be grandfathered in and not require a variance? Ms. Jeske responded that any property improvement is reviewed on its own merits and whether or not any one specific improvement would trigger the need for a variance would be based on the ordinance language in city code for that specific kind of improvement and would not be based on the current location of the retaining wall. Commissioner Jobe moved, Commissioner Schwartz seconded that the Chanhassen Board of Appeals and Adjustments approve the requested side yard setback variance for the construction of a deck at 510 Pleasant View Rd subject to the conditions of approval and adopts the attached Findings of Facts and Decisions. All voted in favor and the motion carried unanimously with a vote of 7 to 0. APPROVAL OF MINUTES: 1. Approve Planning Commission Meeting Minutes July 16, 2024 Commissioner Goff moved, Commissioner Trevena seconded to approve the Chanhassen Planning Commission summary minutes dated July 16, 2024 as presented. All voted in favor, and the motion carried unanimously with a vote of 7 to 0. 2. Approve Planning Commission Work Session Minutes dated August 20, 2024 Planning Commission Minutes – September 3, 2024 3 Commissioner Jobe moved, Commissioner Rosengren seconded to approve the Chanhassen Planning Commission Work Session Meeting Minutes dated August 20, 2024 as presented. All voted in favor, and the motion carried unanimously with a vote of 7 to 0. CITY COUNCIL ACTION UPDATE: Commissioner Soller asked about the formalized proposal regarding the sign code discussed at the work session and the next steps. Ms. Jeske answered that they need to formalize a draft with the City Attorney. ADJOURNMENT: Commissioner Soller moved, Commissioner Schwartz seconded to adjourn the meeting.
