City Code Section 20-232 outlines twelve (12) parameters for the
City to review proposed Conditional Use Permit (CUP) requests.
•Currently the group home serves up to 6 individuals as a Permitted Use, the
request to serve 2 additional person for a total of up to 8 individuals triggers the
requirement of a CUP.
•The proposed building addition and site improvements including the additional
parking, circulation, outdoor recreation, increased bedroom capacity, vegetative
and distance buffering and landscaping improvements properly mitigate the
impacts of the two (2) additional people that would be allowed to live at the
group home through the issuance of a CUP.
Group Home CUP and Site Plan Review
City Code Section 20-110 outlines nine (9) parameters for the City to
review proposed Site Plan requests.
•Staff finds that the 9 parameters required by City Code for site plan approval are
met.
Site Plan Requirements
•1 parking space per every two bedrooms plus one space for each employee on
the largest shift.
•Requirement to have 6 parking spaces. 13 parking spaces are shown.
•Building setbacks are met (50 feet to front, 50 feet to rear, 10 feet to side yard)
•Stormwater generated is mitigated through two stormwater BMP’s
•The Site has adequate access to both sewer and water utilities

Group Home CUP Standards
City Code Section 20-261 establishes the following basic
conditions for group homes serving between 7 and 16 persons:
•The structure must be in compliance with the state
licensing requirement.
•The structure must be in compliance with local building
and fire codes.
•The site will be reviewed annually through a public hearing
process.
•Septic systems must be in compliance with chapter 19,
article IV.
Group Home CUP Standards
Staff recommended additional conditions include:
•Maximum occupancy of eight (8) persons.
•Lot line adjustment to be completed so that all
improvements associated with Hope House exist on the
same property.
•Applicant to enter into a Site Plan Agreement with the City.
•Final construction plans to be approved by the City prior to
the Conditional Use Permit or Site Plan Agreement being
released for recording with Carver County.

and adopts the attached Findings of Fact and decision.”
