FINDINGS OF FAC'I-
AND RECONINIENDATION
IN RE:
Application ofCharles Cudd Company for Subdivision approval
On September 17,2026, the Chanhassen Planning Commission met at its regularly scheduled
meeting to consider the application of Charles Cudd Company for preliminary plat and final plat
approval ofproperty into 39 lots and six outlots.
The Planning Commission conductcd a public hearing on the proposed subdivision which was
preceded by published and mailed notice. The Planning Commission heard testimony from all
interested persons wishing to speak and recommended approval of the requested prelirninary plat
based upon the City Ordinances in effect at the time.
On September 23,2024. the Chanhassen City Council met at its regularly scheduled meeting to
oonsider the application referenced above and based upon the ordinances currently in place the
City Council makes thc following:

l. The property is cunently zoned PUD-RC.
2. The property is guided in the Land Use Plan for Office or Regional Commercial.
3. The legal description ofthe property is: Lots l-5 (inclusive) Block l, Lots l-3 (inclusive)
Block 2, Lots l-7 (inclusive) Block 3, Lots l-4 (inclusive) Block 4, Lots l-11 (inclusive)
Block 5, Lots 1-8 (inclusive) Block 6, Outlot A, Outlot B, Outlot C, Outlot D, Outlot E, and
Outlot F. Carver County, Minnesota.
4. The Subdivision Ordinance directs the Planning Commission to consider seven possible
adverse effects ofthe proposed subdivision. The seven (7) affects and our findings regarding
them are:
a. The proposed subdivision is consistent with the zoning ordinance including the Planned
Unit Development RC District regulations;
b. The proposed subdivision is consistent with all applicable City, County and regional plans
including but not limited to the City's Comprehensive Plan and implements the following
policres and goals:

a) Encourage developmenl u'ithin the MUSA. and support the planned and
efficient expansion of the MUSA to increase the amount ofdevelopable land.
b) Support low density residential dovelopmetrt in appropriate areas ofthe
community in such a manner as maintain the aesthetic of existing single-family areas. and to

create new neighborhoods of similar character and quality.
c) Transitions should be created between different land uses
2\ Housing:
a) Pror"ide housing opportunities for all residents, consistent with the identified
community goals.
b) The City will continue to provide altemate types of housing including smaller lot
homes, krwnhouses, eto. that will supplement the conventional single-family homes.
c) Housing development methods such as PUDs, cluster development, and
innovative site plans and building types. should be encouraged to urnsenre energy and
resources for housing.
The physical characteristics of the site, including but not limited to topography, soils,
vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and stormwater
drainage are suitable for the proposed development;
d. The proposed subdivision makes adequate provision for water supply, storm drainage,
sewage disposal, streets, erosion control and all other improvernents required by the
subdivision ordinance, Chapter 18, and Water, Sewers and Sewage Disposal. Chapter l9;
e. The proposed subdivision will not cause significant environmental damage;
f. The proposed subdivision will not conflict with easernents ofrecord; and
g. The proposed subdivision is not prernature. A subdivision is premature if any of the
following exists:

Lack of adequate stormwater drainage.
Lack of adequate roads.
Lack of adequate sanita-ry sewer systems.
Lack ofadequate off-srte public improvonents or support systems

DEC'ISION
The City Council approves the proposed Preliminary Plat and Final Plat ofAvienda
Townhomes Addition based on the findings offact included herein, and subject to the conditions
of the staff report.
