Approve an Amendment to Interim Use Permit #2021-13 Termination Date for Agritourism Use on the Degler Farm.

Definition
Agritourism means activities carried out on a farm that allows organizations or members of the general public, for recreational, entertainment, or educational purposes, to view, enjoy,
or participate in rural activities regardless of compensation.
Uses include corn/bean mazes, hay rides, pumpkin picking, harvest-your-own produce, corn pits, hill slides, pumpkin throwers/cannons, lookout towers, zip lines, straw bale mazes,
apple picking, play structures, antique tractors displays, saw mill demonstrations, agricultural demonstrations, hay stacks, kiddie trains, sleigh rides, snowshoeing, maple syrup harvesting,
cross country skiing, animal walks, animal rides, farm implement games, sledding hills, axe throwing, outdoor music, archery.

Interim Use Permit
The applicant requested that the termination date be extended to eternity. However, Interim Use Permits by ordinance and state statute require a definitive termination date or event.
Staff proposes a duration of 50 years from the date of City Council approval.
Additionally, an interim use permit shall terminate on the happening of any of the following events, whichever first occurs:
Upon violation of conditions under which the permit was issued;
Upon change in the City's zoning regulations which renders the use nonconforming;
Upon the subdivision of the property or the alteration of the lot lines of the property.

MOTION
The Chanhassen Planning Commission recommends City Council approve an amendment to Interim Use Permit (IUP) #2021-13 regarding Agritourism at 9111 Audubon Road to extend the termination
date to 50 years; And
Adopts of the Findings of Fact and Recommendation.
