2024-75 1 CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA DATE: November 25, 2024 RESOLUTION NO: 2024-75 MOTION BY: von Oven SECONDED BY: Schubert RESOLUTION VACATING PLATTED PUBLIC DRAINAGE & UTILITY EASEMENTS OVER BLOCK 1 LOT 9, THE FRONTIER WHEREAS, Michael Ingram & Elspeth Ingram (“Applicants”) have applied for vacation of all of the platted public drainage and utility easements legally described as follows: All of the drainage and utility easement as dedicated in the plat of THE FRONTIER, Carver County, Minnesota, lying within the following described property: That part of Lot 9, Block 1, THE FRONTIER, Carver County, Minnesota, described as follows: Commencing at the southeasterly corner of said Lot 9; thence on an assumed bearing of North 00 degrees 31 minutes 39 seconds West, along the easterly line of said Lot 9, a distance of 198.10 feet to the point of beginning of the parcel to be described; thence continuing along said easterly line North 42 degrees 58 minutes 27 seconds East a distance of 20.52 feet; thence continuing along said easterly line North 00 degrees 02 minutes 54 seconds West a distance of 60.00 feet; thence South 42 degrees 58 minutes 27 seconds West a distance of 20.52 feet; thence South 00 degrees 02 minutes 54 seconds East a distance of 60.00 feet to the point of beginning. AND All of the 5 foot drainage and utility easement dedicated in the plat of HISCOX ADDITION, Carver County, Minnesota, adjoining and easterly of the following described line: Commencing at the southeasterly corner of Lot 9, Block 1, THE FRONTIER, Carver County, Minnesota; thence on an assumed bearing of North 00 degrees 31 minutes 39 seconds West, along the easterly line of said Lot 9, a distance of 193.10 feet to the point of beginning of said line to be described; thence continuing along said easterly line North 00 degrees 31 minutes 39 seconds West distance of 5.00 feet; thence continuing along said easterly line North 42 degrees 58 minutes 27 seconds East a distance of 20.52 feet; thence continuing along said easterly line North 00 degrees 02 minutes 54 seconds West a distance of 65.00 feet and there terminating. (“Easements”); WHEREAS, pursuant to Minnesota Statutes § 412.851 the City Council of the City of Chanhassen has conducted a hearing preceded by the statutorily required two (2) weeks published and posted notice and mailed notice to the abutting property owners, to consider the vacation of the Easements. WHEREAS, following the hearing and consideration of the proposed vacation, the City Council finds that the Easements are not needed for public purposes. The Easements are hereby vacated conditioned upon the Applicants granting to the City drainage and utility easements as legally described in Exhibit A attached hereto. 2. The vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue maintain the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof. 3. The City Clerk shall transmit a certified copy of this Resolution to the County Auditor and County Recorder subject to the condition in Paragraph 1 of this Resolution.
