In the interest of open communications, the Chanhassen City Council wishes to provide an opportunity for the public to address the City Council. That opportunity is provided at every regular City Council meeting during Visitor Presentations. Anyone seeking a response or action from the City Council following their presentation is required to complete and submit a Citizen Action Request Form. An online form is available at https://www.chanhassenmn.gov/action or paper forms are available in the city council chambers 2 prior to the meeting. A total of thirty minutes is alloted for Visitor Presentations. Priority is given to Chanhassen residents. An additional thirty minutes may be provided after General Business items are complete at the discretion of the City Council. Anyone indicating a desire to speak during Visitor Presentations will be acknowledged by the Mayor. When called upon to speak, state your name, address, and topic. All remarks shall be addressed to the City Council as a whole, not to any specific member(s) or to any person who is not a member of the City Council. If there are a number of individuals present to speak on the same topic, please designate a spokesperson that can summarize the issue. Limit your comments to five minutes. Additional time may be granted at the discretion of the Mayor. If you have written comments, provide a copy to the Council. Comments may also be emailed to the City Council at council@chanhassenmn.gov. During Visitor Presentations, the Council and staff listen to comments and will not engage in discussion. Council members or the City Manager may ask questions of you in order to gain a thorough understanding of your concern, suggestion or request. Please be aware that disrespectful comments or comments of a personal nature, directed at an individual either by name or inference, will not be allowed. The table below shows the proposed 2025 budgets and ending fund balance for governmental funds (ending cash balance for enterprise funds): 11 2 | Page Comparison of 2024 to 2025 Revenues – All Funds The table below shows a comparison of budgeted revenues for each fund for 2024 and 2025: Overall revenues are decreasing from $64.6 million in 2024 to $52.2 million in 2024, which is a $12.4 million, or 19.2% decrease. The decrease is largely due to grants and aid received for street reconstruction projects in 2024, in particular the Galpin Blvd. project. The budgets for the Enterprise Funds incorporate the utility rate increases proposed in the Ehlers rate study, however overall revenues for these funds are projected to decrease due to lower budgeted connection fees. The City had forecasted a large amount for connection fees from the Avienda development in 2024 and 2025, but since this development has not occurred yet, these fees have now been spread out over ten years. The preliminary levy of $15,450,000 accounts for 29.6% of total revenues. 12 3 | Page Comparison of 2024 to 2025 Expenditures – All Funds The table below shows a comparison of budgeted expenditures for each fund for 2024 and 2025: Overall expenditures are decreasing from $69.7 million in 2024 to $61.7 million in 2025, which is a $7.9 million, or 11.4% decrease. The decrease is largely due to large street reconstruction projects in 2024, in particular the Galpin Blvd. project. The PMP Fund accounts for 38.6% of the entire City budget for 2024. The increases in the Water and Storm Water Funds are largely due to the expenses for the utility portions of the street reconstruction projects. 13 4 | Page General Fund Budget & Levy Budgeted revenues for the General Fund total $16,105,870 and budgeted expenditures total $16,405,870. This results in a $300,000 reduction in fund balance, due to a proposed one-time transfer to the Park Renovation Fund. This one-time use of fund balance coupled with a levy in the Park Renovation Fund allows for the completion of several park replacement items over the next five years. The projected ending unassigned fund balance is $8,623,872 at the end of 2025. This amount exceeds the City policy minimum fund balance requirement of $6,045,000 (50% of the 2025 levy) by $2,578,872. Fund balance has increased over the last few years due to favorable budget results, particularly from increased investment income and permit revenue from trenching fees and building permits. For 2024, actual revenue is projected to exceed budgeted revenue by about $580,000. General Fund budgeted revenues are increasing by $362,520, or 2.3%, primarily due to the levy increase of $239,000. Increased state fire and police aid total $70,000. There have been a few minor adjustments to the preliminary expenditure budget which was reviewed with Council on November 18, 2024. The line items for lifeguards for $40,000 and the proposed new Park Operator FTE position for $50,000 have been removed. Staff has added $30,000 for park maintenance contractual service items, including field aeration and fertilization, and weed control for gutters and curbs. Special Revenue Funds The City has five special revenue funds for 2025. The City does not levy a property tax for these funds as they rely on other dedicated funding sources. The City is gradually phasing out the Cable Franchise Fund as franchise fees are now accounted for in the General Fund. The Grants Fund is used to account for items such as ARPA funds and Public Safety Aid. The City will use its remaining ARPA funds in 2024, so the balance is primarily due to Public Safety aid which will be spent over the next few years. The Local Affordable Housing Aid Fund is new as the City began receiving this aid in 2024. The City will determine use of these funds over the next few years. Debt Service Funds The City has four debt service funds. The Permanent Revolving Debt Fund accounts for residual debt service payment transactions and some special assessments. The City plans to use these funds and the remaining 2009A debt service funds to lower debt service levies for the new Civic Campus debt. The PW Facility Bonds Fund is used to account for repayment of the PW Facility debt. The final bond payment occurs in 2030. The Civic Campus Bonds Fund is used to account for the repayment of the Civic Campus debt. Property tax levies are the primary revenue source for these funds. Capital Projects Funds The City has eight capital projects funds. The following four funds have historically had a property tax levy as one of the sources of revenue: Vehicle & Equipment Replacement Capital Facilities TIM (Transportation Infrastructure Management) PMP (Pavement Management Project) For 2025, staff is recommending a property tax levy for the Park Renovation Fund. The recommended levy is $180,000, which would come from a decrease in the amount of the preliminary levy certified for the General Fund. Staff is also recommending a one-time transfer of General Fund balance. An ongoing levy that increases by $10,000 annually until 2029 would allow for the completion of $1.4 million in items identified by park maintenance staff: 14 5 | Page The City had planned to start a levy for this fund in 2029. By starting this levy earlier and increasing the funding gradually the City could fund the above items. Under this scenario, levy revenue that would come in between 2030 and 2034 would total $3.25 million. This amount could be used toward the several park renovation items that have been identified in the Appendix to this report. The Park Development fund primarily relies on park dedication fees as its revenue source. State law restricts use of these funds to new park amenities and replacement of park infrastructure is not allowed. Some of the items in the Appendix could be funded from these fees, however the fees from Avienda and Roers have been dedicated to the Bluff Creek Community Center. The City has two tax increment financing funds. The primary revenue source for these funds is tax increment revenue and the City has entered into pay-as-you-go notes with developers, which account for most of the uses of these funds. Enterprise Funds The City has three enterprise funds for its three utilities: Water, Sewer, and Storm Water Management. The City does not levy a property tax for these funds but instead charges user fees and connection charges. Rate increases are planned for 2025 in accordance with the Ehlers utility rate study. Staff reviewed some minor changes to the proposed future rate increases due to several large capital projects planned. All three of these funds are projecting that expenditures will exceed revenues for 2025. This is due to the large amount of utility work planned for the street reconstruction projects. The Storm Water Fund will have a negative cash balance at the end of 2025. The City will use interfund loans or issue bonds as needed. The planned rate increases over the next several years will generate enough revenue to close the cash balance deficit for the fund. 2025-2029 Capital Improvement Plan Staff reviewed the preliminary 2025-2029 Capital Improvement Plan (see attached CIP Funding Source report) at last week’s work session. All the 2025 CIP items have been incorporated into the 2025 budget for each fund. 15 6 | Page Property Tax Levy Options On September 9, 2024, the City Council adopted the following preliminary property tax levy: At the last work session staff reported that the General Fund levy could potentially be reduced by $156,000 due to a budget surplus and a few items that could be removed, including lifeguard services and a contingency for open enrollment health insurance changes. Since last week staff has made a few more changes that result in an additional $24,000 available, or $180,000 total available for a levy reduction or reallocation. The table below shows two potential levy options for 2025: • Scenario A – Reduce levy increase to 5.6% – eliminates $180,000 in General Fund Levy • Scenario B – Reduce levy increase to 5.9% - redirect $45,000 of General Fund levy to Park Renovation Fund • Scenario B – Reduce levy increase to 6.2% - redirect $90,000 of General Fund levy to Park Renovation Fund • Scenario B – Reduce levy increase to 6.6% - redirect $135,000 of General Fund levy to Park Renovation Fund • Scenario E – Keep levy at level adopted in September – 6.9% increase, but redirect $180,000 of General Fund levy to Park Renovation Fund 16 7 | Page Staff has prepared a table showing the impact of Scenarios A and E levy amounts on various taxpayers assuming a 1.07% average market value increase for residential taxpayers and a 5.16% average market value increase for commercial taxpayers. The table below shows the tax impact for residential taxpayers using scenarios A and E above: Most commercial property will see a larger percentage increase in City property taxes for 2024 and 2025 due to a larger increase in the value of commercial properties as compared to residential. The table below shows the tax impact for commercial taxpayers using scenarios A and E above: The table below shows levy projections through 2034 assuming a 6.9% increase in 2025 and new levies for City Hall Campus and Bluff Creek Community Center debt: 17 8 | Page If the levy is reduced by $180,000, the increase for 2025 would be 5.6%. The table below shows the year-by-year levy: The City continues to be on the low end for overall property tax burden and property tax increases. The chart below shows levies for neighboring and comparable cities for 2025: While not in our comparable cities list, the following larger suburban cities plan the following levy increases: Apple Valley 13.7%; Bloomington 11.5%; Eagan 8.2%; Golden Valley 4.9%; Lakeville 12.05%; Maple Grove 6.96%; and Plymouth 5.2%. The statewide average for all MN cities is 8.2%. Next Steps Staff requests Council direction on the amount of the levy to present for the December 9, 2024, Council meeting. The Truth in Taxation public meeting is scheduled for that night. At that meeting, the budget and levy will be discussed, and the public must be given a chance to speak. Staff presented a draft ordinance which identified specific zoning districts that would allow for retail cannabis businesses as well as zoning districts specific to light industrial cannabis businesses such as cultivators and manufacturers. The Council unanimously expressed its desire to limit the number of cannabis retail licenses to a maximum of three which is the minimum allowed by state law. State law requires a city to allow at least one retail cannabis business per 12,500 residents. It also expressed its preference to maintain control over that number, as compared to relinquishing that authority to Carver County if Carver County was delegated as the governmental unit responsible for licensing retail cannabis businesses. One element of the draft ordinance included a 500-foot buffer for any retail cannabis business from schools and residential treatment facilities. The Council was divided on its feelings on requiring a 500-foot buffer around any cannabis retail store, in part because liquor and nicotine stores are not required to have a similar buffer and felt it important to treat similar businesses equally, and recommended continuing the discussion within the Planning Commission and Economic Development Commission as well as soliciting resident feedback through a future public hearing at the Planning Commission. Pickleball Court Location Discussion Jerry Ruegemer, Parks & Recreation Director presented a summary about the current (and future) state of pickleball v. tennis courts throughout Chanhassen. Residents often ask the city to convert tennis courts to pickleball courts, which costs ~$1,500 to convert. The city currently has ten dedicated pickleball courts (and two additional courts with painted pickleball lines). Four 49 City Council Work Session Minutes –October 28, 2024 2 more will arrive when the Civic Campus is completed. The city owns 16 tennis courts. Concerns around pickleball courts include parking and noise. Mr. Ruegemer asked for guidance from the Council on whether the city should convert neighborhood tennis courts to pickleball courts or should they only be constructed in community parks. In September 2024, the Parks and Rec Commission recommended not converting neighborhood tennis courts to pickleball courts and to adopt the practice of locating pickleball courts within community parks in order to create further distance from resident housing. Council discussed whether to keep pickleball courts within community parks and asked for additional information on expansion costs for new courts, maintenance costs for existing courts, usage and noise mitigation before making a final decision. Highway 7 Corridor Communities Update The Council unanimously agreed to support the city’s participation in advancing safety improvements on Hwy. 7 via the City of Shorewood’s receipt of a $200,000 grant and the development of a transportation management organization (TMO) for the Hwy 7 Corridor. A resolution to this affect is on the consent agenda at tonight's Council meeting. Select Wood Cladding color for City Hall/Senior Center Building The Council was asked to pick between two colors dark brown and light brown -- that would be utilized on some outside design elements for the new Civic Campus. The Council unanimously picked dark brown. Set Canvassing Meeting The City Council selected a time to participate in Carver County s post-election canvassing meeting on November 13th. The primary goal of a canvassing meeting is to ensure that all votes have been accurately counted and that the election results are valid. The city’s previous holiday tree had to be cut down during the Civic Campus’ construction. The options presented were: a real evergreen tree, an artificial light tree, and an artificial panel tree. The City Council unanimously supported a real evergreen tree. Kelly Grinnell, Finance Director, presented the preliminary 2025 utility fund budgets and the 2025-2029 Capital Improvement Plan. The next steps for the council will be to give feedback on utility rates and budgets, wetland bank credit sales, 2025-2029 CIP items, and funding for Park items. The City Council agreed to move ahead with perusing the sale of the wetland bank credits. 53 City Council Work Session Minutes –November 18, 2024 2 Discuss amending the city's zoning ordinance regarding conditional uses in the Rural Residential (RR) and Agricultural Estate (A-2) zoning districts related to Group Homes serving 7 to 16 persons. Eric Maass, Development Director, discussed amending the city's zoning ordinance regarding conditional uses in the Rural Residential (RR) and Agricultural Estate (A-2) zoning districts related to Group Homes serving 7 to 16 persons. At the October 14, 2024,City Council work session, the City Council directed staff to draft an ordinance amendment reducing the number of persons able to reside in a group home through the issuance of a Conditional Use Permit (CUP). This proposed text amendment would apply to both the Agricultural Estate (A-2) and Rural Residential (RR) zoning districts which currently allow a maximum of 16 persons through the issuance of a CUP. City staff prepared a draft ordinance reducing the maximum number of persons from 16 to eight (8), as well as modifying the standard conditions associated with group homes operating under a CUP. Because Minnesota State Statute regulates Group Homes serving 6 or fewer residents as permitted uses in single-family zoning districts, the City Council s preference was to rely solely on the State of Minnesota for regulations regarding group homes and directed staff to modify the proposed ordinance to eliminate Group Homes allowed through a CUP as well eliminating the standard conditions associated with group homes operated through a CUP as they would no longer be relevant with the conditional use option removed. The City Council directed Mr. Maass to start the process of the formal ordinance amendment with the planning commission which will include a public hearing. Discussion Items 1. Environmental Academy Update The first Environmental Academy course was held at Chanhassen City Hall where City Manager Laurie Hokkanen presented about the Civic Campus project highlighting environmentally related initiatives. Initiatives she covered included the stormwater reuse system, a grant acquired by the city to install solar panels on the new building, a pollinator-friendly landscaping plan, and energy-efficient systems. The Reuse Night was held on September 12; about a dozen people participated, and the overall message was that waste reduction is the most effective method. The group also went to the Lending Library in Chaska where they were taught how the whole operation works. The event at SMSC Organics Recycling Facility was rescheduled from August 29 to September 30. Approximately 20 people attended. SMSC takes in organic waste and yard waste and processes it. They do sell mulch and compost. There are three remaining Academy events this month. 2. Environmental Trivia Updates 60 Commissioner Grefe and Commissioner Pengelly will be checking teams in. Commissioner Cripe will run the laptop, and Commissioner Stutzman will operate the timer up front. Commissioner Pengelly and Commissioner Lindmark will be collecting answer sheets after each round. Commissioner Elhadi and Commissioner Buckholz will be keeping score after each round. Dave Ryan will once again emcee for trivia night. Topics include aquatic invasive species, terrestrial invasive species, climate change, Chan- Happening, and Environmental Academy. One tie-breaker question will be ready as well. Questions were written by the commissioners. The commission discussed prizes and the possibility of introducing bamboo kitchen tools or local gift cards as a new option. 3. Outreach Opportunities Ms. Marsh is looking to improve outreach for educational opportunities. The spring Chanhassen Connection article is due soon and she would like to introduce new information. Commissioner Lindmark recommended discussing new invasive species, such as phragmites. Commissioner Pengelly mentioned partnering with Camp Fire Minnesota for an interpretive nature walk. Additional ideas included visiting a local farm, highlighting new practices in farming, and taking part in the farmers’ market. The commissioners also discussed the idea of making short video content. Ms. Marsh advised that they will likely need to hone in on some ideas to maintain a reasonable workload. Meeting with Camp Fire is a next step as there is an established space and a naturalist. 4. Commission Report Ms. Marsh shared a previous Environmental Commission report that will be referenced as a guide for the 2024 Environmental Commission Report is created for a year-end review. Commission Presentations Upcoming Items and Events There will be a pumpkin drop-off at public works from November 1 to November 15. The pumpkins will then be brought to a farm for animals to eat. This is the first year for the pumpkin drop-off program. The Boy Scouts will be doing their annual tree pick-up after the Christmas season. Motion Type Simple Majority Vote of members present Strategic Priority Asset Management SUMMARY As part of the new City Hall construction, an electrical transformer needs to be installed by Xcel Energy as part of the electrical service to the building. The location of the proposed transformer is on the southeast corner of the building, along Market Boulevard (see attached Site Plan). It's typical to provide an easement benefitting the utility owner for their asset, since Xcel will own and maintain the transformer. The location of the transformer is outside of the platted utility easements. The easement is attached, was prepared by Xcel, and was reviewed by the City Attorney and City staff. Upon execution by the City, Xcel will record this easement at the Carver County Recorder's office. ATTACHMENTS City of Chanhassen-Easement Site Plan 84 Page 1 of 4 Rev(l): 10-4-04 ELECTRIC EASEMENT KNOW ALL BY THESE PRESENTS, That the undersigned, hereinafter called “Grantor”, in consideration of the sum of $1.00 and other good and valuable consideration in hand paid by NORTHERN STATES POWER COMPANY, a Minnesota Corporation, the receipt and sufficiency whereof is hereby acknowledged, do hereby, grant unto said Company its successors and assigns, hereinafter called “Grantee”, an easement with the right, privilege and authority to excavate for, construct, install, mark, inspect, operate, repair, alter, replace, reconstruct, remove and maintain its facilities for the transmission and distribution of electrical energy, including the necessary poles, wires, guys, stubs, electric cables, conduits, vaults, pedestals, manholes and facilities related and appurtenant thereto “Utility Facilities”), over, across, under and upon the following described land situated in the County of Carver, State of Minnesota, (hereinafter called “Property”) to-wit: Lot 2, Block 1, Schneider Park Second Addition, Carver County, Minnesota. The grant of easement herein contained shall also include the right of reasonable use of the Property adjacent to the Easement Area by Grantee for tree trimming purposes and for temporary construction area during construction, repair or replacement of said electric facilities. 85 Page 2 of 4 Rev(l): 10-4-04 Except as otherwise provided herein or in any Underground Distribution Agreement between the Grantor and Grantee covering the above described Property, Grantee shall, after installation of the Utility Facilities, or after the exercise of any rights granted herein, restore the lands subject to this easement to as near their original condition as is reasonably possible and remove therefrom all debris, spoils, and equipment resulting from or used in connection with said installation. The work shall be completed as promptly as weather permits, and if NSP shall not promptly perform and complete the work. Remove all dirt, rubbish, equipment and material, and put the Easement Area and Property in the required condition, the Grantor shall have, after demand to NSP to cure and the passage of a reasonable period of time following the demand, the right to make the restoration at the expense of NSP, NSP shall reimburse Grantor’s cost of restoration including its administrative expense and overhead, plus ten percent (10%) additional as liquidated damages, within 30 days of receipt of an invoice for the work. This remedy shall be in addition to any other remedy available to the Grantor. Grantor further agrees that no structure or obstruction will be erected or permitted or any trees planted on or within said Easement Area, that Grantor will not change the ground elevation thereof without the written consent of Grantee, or perform any act which will interfere with or endanger the Utility Facilities. NSP shall be responsible for all costs to construct, maintain, repair or replace the Utility Facilities located within the Easement Area. NSP shall pay for all damages to landscaping, roads, and driveways, and other property caused by the construction or maintenance of its Utility Facilities. NSP shall indemnify and hold the Grantor harmless form and against all liability, actions, claims, demands, costs, damages, or expense of any kind which may be brought or made against the Grantor relating to accidents, injuries, loss, or damage of or to any person, property , or improvement occurring on or about the Easement Premises or Property, Such indemnity shall not apply to the extent of any loss or claim due to or arising from the negligent or wrongful acts or omissions of the Grantor, its officials, employees, agents, assigns, guests or invitees occurring on or after this Agreement. Nothing contained in this Agreement shall be construed as a waiver by the Grantor of any limitations on liability contained in Minnesota Statutes, Chapter 466. The grant herein contained shall also include the right of Grantee to permit the joint undergrounding with public utility and cable television companies. Grantor covenants with Grantee, its successors and assigns, that Grantor is the owner of the above described Property and has the right to sell and convey an easement in the manner and form aforesaid. This instrument and the covenants and agreements contained herein are binding upon the Grantor and Grantee, their successors and assigns. Grantee shall execute a recordable termination of this Easement after Grantor delivers a written notice to Grantee requesting removal of the Facilities (the “Request”) and satisfies any other reasonable requirements designated by Grantee in response to Grantor’s Request. The ballot question was: Sales and Use Tax for Chanhassen Bluffs Community Center Shall the City of Chanhassen impose a one-half of one percent (0.5%) sales and use tax for up to 20 years or until $40 million is collected, plus the cost of issuing bonds, to finance the construction of a 129 new Chan Rec Center, which is expected to include an indoor walking track, indoor ice facilities, indoor playground, indoor fieldhouse, and expanded community center amenities, as outlined in the Chanhassen Bluffs Community Center project plan? The financing for the Chanhassen Bluffs Community Center is not subject to Minnesota Statute 275.60, because it is being financed using sales tax proceeds and tax abatement bonds. Both mechanisms are specifically excluded from MS 275.60. The special law authority Chanhassen received from the legislature expressly states the sales tax revenue bonds question is exempt from the requirements of Section 275.60. See subdivision 3(b), which states that the issuance of such bonds “is not subject to Minnesota Statutes, sections 275.60 and 275.61. The city also intends to use General Obligation (GO) Tax Abatement bonds. Under Minnesota State Statute 475.58.1 Section 9, cities are not required to hold an election to consider authorization of this obligation. The City Council will be informed by the referendum's outcome and will use their authority to increase the property tax levy. Forty-five percent ($18 million) of the one-half percent (0.5%) sales tax will be paid by nonresidents, according to research from the University of Minnesota. Property Tax Levy: The property tax increase will be phased in over time. The estimated property tax impact will be about $17 per month for a residential home valued at $600,000, averaged over 20 years. Other Funding Sources: The remainder of the project funding includes, but is not limited to, the sale of the existing Rec Center, naming rights and sponsorships, and property taxes generated by the Avienda Development that will be dedicated to the repayment of the bonds on the Community Center project. The Chanhassen Bluffs Community Center will be built within the Avienda development but will have no connection to the development or developer. The one-half percent (0.5%) sales tax amounts to a ½ cent for every $1 spent. For example, a $10 purchase will cost an additional 5 cents if the one-half percent sales tax is approved. The sales tax does NOT apply to groceries, clothing, gas, or automobile purchases. Councilmember McDonald said that he liked including the question about the pool. Councilmember Schubert said she was still not comfortable with including the pool because the long - term costs would be so high. Councilmember McDonald said that the public has asked for a pool and if residents have been educated about the costs of a pool, then we should put the question on the ballot because the residents are the ones that should make the decision. Councilmember Kimber said that the residents should decide. He suggested putting both questions on the ballot and communicating the costs to let the residents have a stay. He then said that he has heard from residents that they don’t like to go to the neighboring pools in the area and pay non -resident prices. He asked if there was a way to negotiate reciprocity with another city to get the costs down. Laurie Hokkanen, City Manager reported that the city has not yet explored that option but that there could be negotiations to provide reciprocity for lower costs to access other pools in the area. The council members discussed the wording of the questions. It was decided that the ballot question would be just one question regarding the sales tax. 134 City Council Work Session Minutes – August 12, 2024 2 Minnewashta Parkway Traffic Workshop Follow-Up Discussion Mayor Ryan reported that city staff had hosted a neighborhood meeting to get input from residents about the Minnewashta Parkway Traffic changes. There was good attendance at the meeting and staff received a lot of feedback. There is an item on the agenda for the council meeting that addresses a stop sign at Kings Road that neighbors have requested. Charlie Howley, Public Works Director/City Engineer, told the council that at the neighborhood meeting residents brought up a safe crossing at Kings Road, lowering the speed limit on Minnewashta Parkway, increased enforcement of the speed limit, directing traffic to different routes, Landscape Arboretum helping to beautify the parkway, and a right-in/right-out option to the intersection at Highway 5. Councilmember Schubert asked if the Arboretum was planning on still having the exit to the Arboretum where the current entrance is located since the entrance is being moved to Minnewashta Parkway. Mr. Howley responded that the Arboretum was planning on having people enter off Highway 5 at the light on Minnewashta and then pay on exit at the east road that is currently the entrance. Discussion was had about a stop sign at Kings Road and if that was the best option for safely crossing. Councilmember McDonald said he would prefer a pedestrian light crossing at Kings Road instead of a stop sign. He was concerned that a stop sign was not as safe as a flashing pedestrian crossing. Mayor Ryan asked for more details from Engineering about a stop sign to determine if that was the best option or may a pedestrian crossing be safer, Mr. Howley responded that the data came back, and it shows that there aren’t enough pedestrians using the intersection to meet the qualifications of a stop sign. However, residents are requesting a stop sign and it is reasonable that one be put up. He said that the cost of a flashing light pedestrian crossing would be approximately $35,000-$40,000. Placing a stop sign at the Kings Road crossing would be approximately $148. It was decided to table the Kings Road stop sign item from the City Council agenda and get more detail from staff to decide on a stop sign versus a flashing light pedestrian crossing. The discussion was paused for the City Council meeting. Mayor Ryan recessed the work session at 6:55 Mayor Ryan reconvened the work session at 7:36 Minnewashta Parkway Traffic Workshop Follow-Up Discussion - Continued Mayor Ryan reconvened the conversation starting with the question of how best to get people safely across the street. Councilmember McDonald agreed that addressing safety concerns and cost to find the best solution. Mr. Howley started the discussion by asking if there was any interest in a mini roundabout. It accomplishes many goals. The cost of that would be approximately $700,000. 135 City Council Work Session Minutes – August 12, 2024 3 Councilmember Schubert asked if there was more development in the area, how would that affect the crossing and what are the long-term goals? Mayor Ryan asked for more information on short-term, mid-term, and long-term goals for the road. She said that the money for a mini round about doesn’t currently exist. Mr. Howley said that he would come back to a future meeting with a memo on solutions for the area including cost and the best option for safely crossing, as safety was the most important to the councilmembers. Mayor Ryan then brought up speed control in the area and the possibility of reducing the speed limit. Mr. Howley said that there had been discussions in the past about lowering the speed limit within city limits. He said that the city needs to be consistent with speeds and that lowering a speed on one road means that other roads may need to have a lower speed limit as well. He said that lowering the speed limit city wide would be easier. Mayor Ryan said she was in support of changing the city speed limit to 25 MPH and then have increased enforcement. Discussion was then regarding a right-in/right-out intersection at Minnewashta and Highway 5. The council decided that was not a good decision for the intersection. Mayor Ryan brought up the resident’s suggestion of having the Arboretum beautify the Parkway and all agreed that was not the Arboretum’s responsibility. Mr. Howley agreed. The requested information will be added to the August 26 work session to review. Discuss Comprehensive Plan Land Use and Zoning District Designation at 6440 Hazeltine Blvd Eric Maass, Planning Director, introduced Tyler Stevens, Clover Investments. Tyler is looking to develop land at 6440 Hazeltine Boulevard and has put in a request to change the zoning of the property to appeal to possible investors. The property has 5.5 acres of land and a large elevation change of approximately 60 feet. It is located next to the planned roundabout across from Minnetona Middle School West. Mr. Maass said that the land is currently zoned Medium Density. Mr. Stevens is looking to change to High Density to appeal to an apartment building and homes. There were two possible rough drafts of development that were shown but neither one was a finished product. They show possible development that would need work before a development application was submitted. Councilmember Schubert asked how many stories the proposed apartment building would have. Mr. Maass replied that base zoning allows for three stories because of the drop in the land. Mayor Ryan, Councilmember McDonald, and Councilmember Kimber all said they would like more of an understanding of what would be built there to help guide them in changing the zoning. Mr. Stevens said that the roundabout has changed how they can develop the land and to market it there needs to be a change in zoning to let developers know what is possible. 136 City Council Work Session Minutes – August 12, 2024 4 Mayor Ryan said she can appreciate that, but the City Council would need to see more specific plans to help them determine the appropriate zoning and impact of the development. The development company would like to have the council review their plans now and give feedback so they can make an informed decision on what to bring back for approval. The location of the parcel is at Highway 212 and Bluff Creek Drive. This is just one of two separate projects that will need to have a lift station to have sewer and water for their development. This project has 48.21 acres and there are 163 units proposed. 69 single family villas and 94 townhomes. The land is currently zoned A2, Agricultural. The area would need to be rezoned to come into line with the Comprehensive Plan. The land is also in the Bluff Creek Overlay District and needs to have a Conditional Use Permit to be able to be developed. Charlie Howley, Public Works Director/City Engineer, discussed that the sewer comprehensive plan would have to have a minor amendment to supply the sewer to this area of the city. Mayor Ryan asked who would pay the costs of the lift station. Mr. Mass replied that there would be a sharing of the costs of the sewer to both the developers and then the maintenance would be turned over to the city. Clark Wicklund, Alliant Engineering, said that there is a bluff setback that they would need to do a survey and finalize the setbacks. They are currently working off the GIS information they are getting from the County. Mario Cocchiarella, Maplewood Development, stated that if this project were of interest to the city, they would solve any issues with the lift station. Councilmember McDonald asked if there were pictures of the houses to be developed. Mr. Cocchiarella replied that there were several builders interested in the project but that has not been finalized. He stated that they could provide renderings of the homes that could be built on the property. Councilmember Schubert asked how much grading and tree removal would happen in the development area. Mr. Wicklund responded that there would be preservation of trees around the perimeter of the development but there would need to be grading and tree removal within the development to build the lines for the sewer and the houses. 138 City Council Work Session Minutes – June 24, 2024 2 Mayor Ryan asked about the Bluff Creek Drive Road repair and how that would be managed since there would now be construction along that road. Mr. Howley said that the development would extend the trail and the road is set to be repaired in the near future, between 2028-2030 and would most likely be a full reconstruction. Mayor Ryan asked for a future presentation that showed the possible homes that would be constructed on the property. She is concerned that the new houses fit with the feel of the existing neighborhood. She then asked what the next steps would be. Mr. Maass responded that he would work with the developer to bring back drawings of possible homes for the development at a future work session meeting. Chanhassen Bluffs Community Center: Ballot Question Laurie Hokkanen, City Manager, started a discussion about the ballot question for the November election for the Local Area Sales Tax. There has been feedback from residents and the main question has been about a pool being part of the project. The questions for the council to discuss: Should this plan include a pool? If it doesn’t include a pool does the current plan stay in place? If a pool is included, do we look at buying more land and amending the current plan? Councilmember Schubert asked when staff hears about a pool if people are asking for a lap pool or aquatic center? Ms. Hokkanen replied that most residents are looking for a family aquatic center. Councilmember McDonald asked what the cost of a pool that we are quoted would cover an aquatic center. Ms. Hokkanen replied that it would be for an aquatic center facility for approximately $25 million and it would be a standard pool. Councilmember von Oven asked what the potential operating costs would be. Ms. Hokkanen said that those operating costs are approximately $60-$250 thousand a year. Most pools have major renovations every 20 years. The city can’t save for those deferred maintenance costs. Councilmember Kimber said that if there is public desire for a pool to be built there should be a second ballot question letting residents decide. Councilmember von Oven agreed with Councilmember Kimber and said that the public should make the choice, but that communication should be very transparent about the cost of building and maintaining the pool. The council discussed having one question on the ballot but including the pool within that question. There was also discussion that if there was one question that it would be an all or nothing decision. 139 City Council Work Session Minutes – June 24, 2024 3 The council then decided that the original question did not include a pool and that the question should just be regarding the Local Option Sales Tax (LOST) to help pay for the new Recreation Center. The City Council decided to go with the current question and fine-tune as needed. The pool would not be part of the question on the ballot. They asked that the city website be updated to educate on what residents are actually voting on and how their voices can still be heard. The website would be updated to detail the costs of a pool. Ms. Hokkanen said she would get feedback from our council and updated language for the ballot question for the August 12 City Council meeting.
