PC 11.19.2024 WSCHANHASEN PLANNING COMISSION WORK SESSION MINUTES November 19, 2024 The work session was called to order at 6:00 p.m. COUNCIL MEMBERS PRESENT: Commissioner Steve Jobe, Commissioner Ed Goff, Chair Eric Noyes, Commissioner Ryan Soller, and Commissioner Katie Trevena COUNCIL MEMBERS ABSENT: Commissioner Jeremy Rosengren, Commissioner Perry Schwartz STAFF PRESENT: Eric Maass, Community Development Director; Rachel Arsenault, Associate Planner; Rachel Jeske, Planner Cannabis Code Discussion • Eric Maass, Community Development Director, introduced topic, scope, and when the commission could expect to see this topic in public hearing. • Mr. Maass reviewed the scope of the ordinances, licensing delegation, and zoning authority. • The Commissioners discussed the caps number of licenses, and the minimum number required. • Chair Noyes asked about the difference between cannabis retail registrations and low potency hemp edibles. Would like to ensure this is clear for the public in the presentation as well. • Rachel Jeske, Planner, clarified the types of products that would be sold in each license category. • The Commissioners asked questions regarding specific business and how they could expand or be potentially hindered in their current activity. • Commissioner Soller commented on the market race for licenses that could occur and how that would affect current businesses. • Miss Jeske clarified the race for licenses that could occur would only be for cannabis retail, not for low potency that we see sold now. Therefore, some business could potentially keep operating as they are today. • The Commissioners requested that staff addresses the existing consumption ordinance at Public Hearing. • Mr. Maass presented on licensing: events, industrial, retail, and delivery. PUBLIC PRESENT: None • Mr. Maass presented the proposed zoning. • Commissioner Jobe asked if the buffers on the zoning map should be discussed at this point in the presentation and expressed interested in keeping the regulations the same as alcohol. • The commissioners had a general consensus that cannabis should be treated the same as alcohol. • Chair Noyes asked if any of the ordinances being discussed affected smoking areas or use areas. • Miss Jeske answered that all regulations related to use are already in place by the state. • Commissioner Soller asked if Chanhassen had any residential treatment facilities. • Miss Jeske responded there are none in Chanhassen that meet the state definition. • Mr. Maass presented on industrial use, event permitting, and highlighted main points of feedback staff would like from the commission. • Commissioner Goff asked clarifying questions on which types of business would be regulated by the caps on licenses. • Mr. Maass responded and then continued to address restrictions on hours of operation. • All commissioners were interested in mimicking state statute for hours. • The commissioners asked clarifying questions about on-sale versus off-sale. • Mr. Maass summarized the main points from the meeting.
