1983 07 05BOARD OF ADJUSTMENTS AND APPEALS MINUTES JULY 5, 1983 Members Present Willard Johnson and Mike Thompson Staff Present Bob Waibel Public Present James Frerich Kurt Bardal 651 Broken Arrow Dr. 631 Broken Arrow Dr. Side Yard Setback Variance Request, James Frerich, Public Hearing. Waibel presented the staff report indicating that the Board might discuss design alternatives with the applicant in order to make the proposed addition conforming or more conforming with the ordinance standards. Mr. Bardal inquired as to whether or not the approval of the request wouldy reduce his property value or would it affect his ability to use his property in the future. The Board members indicated that they could not speculate as to what impact the approval would have on his property value. Waibel mentioned that approval could possibly set a precedent that would expand his ability to develop within the side yard areas of his property however, at present, the ordinance allows him to build only within ten feet of his side yard. Each variance is handled on its own merits. Waibel indicated that within the 10 foot side yard area no structures may be place with the exception of fences up to 8 feet in height. Mike Thompson moved to approved the variance as requested for reasons that he feels there are circumstances involved with the property including that the existing house is extremely close to the property line already, a revision in the plans would require major remodeling of the kitchen area at great expense to the applicant and that the approval would not be inconsistent with existing development patterns in the area. Motion seconded by Willard Johnson, motion unanimously approved. Side Yard Setback Variance Request, Ronald Ytzen, Public Hearing. Public Present Ronald and Beth Ytzen 9227 Lake Riley Blvd. Waibel delivered the staff report summarizing that the property is very limited as to design alternatives and that the proposal appears to be a reasonable response to those limitations. Attachment #8 Board of Adjustments and Appeals July 5, 1983 Page 2 Mike Thompson moved to approve the variance as requested due to the existing structure location and limited amount of area for which the home could be expanded. Motion seconded by Willard Johnson, vote unanimous, motion carried. Front, Side and Shoreland Management Ordinary High Water Mark Setback Variance Request, Lot 7 and 8, Block 4, Red Cedar Point, Lumir Proschek, Public Hearing. Public Present Mr. & Mrs. Proschek Waibel delivered the staff report and mentioned that the neighbor to the east inquired as to the possibility of shifting the pro- posed building two feet to the west in order to have a compliant side yard setback on the east property line. He additionally mentioned that, from a planning standpoint, it would be preferrable to have the garage entrance oriented to the north as opposed to the present proposal oriented to the west allowing for off-street parking on the garage apron. Mr. Proschek indicated that although it is possible to shift the proposal two feet to the west they preferred to have it remain as is to provide a little more distance between the northwest side of the home and the street and that it is preferrable to have the garage entrance facing the west in order that shade trees would not have to be removed to provide garage access to the north. Willard Johnson moved to recommend approval of the variance as requested with the conditions that: 1. The home will not be constructed on the existing foundation. 2. That hard surface parking be provided for a minimum of two cars on the severed property to the north. Motion seconded by Mike Thompson, vote unanimous, motion carried. The Board of Adjustments and Appeals stated that the reason for approval was due to the limitations of the property as well as the character of the surrounding properties.
