1985 03 18BOARD OF ADJUSTMENTS AND APPEALS MINUTES MARCH 18, 1985 CA/~L ~O ORDER Chairman Johnson called the meeting to order at 6:50 p.m. MEMBERS PRESENT Willard Johnson, Dale Geving and Carol Watson STAFF PRESENT Barbara Dacy, City Planner and Jo Ann Olsen, Asst. City Planner SIDE YARD SETBACK REQUEST, 710 WEST 96TH STREET, RONALD LANDIN, APPLICANT Olsen gave a brief overview of the variance request. She stated the applicant is requesting an additional 7 feet to the pre- viously approved 53 foot side yard setback variance granted by the Board of Adjustments and Appeals on April 16, 1984. She stated that the applicant is intending on building a new home at 710 West 96th Street which is 12 feet wider than the previous home proposed to be moved onto the property. She stated that the new home meets the conditions of the previous variance in that it will align with the house to the west and that it will connect to the 201 sewer project. Geving asked if the Landin's home at 720 West 96th Street had been sold. Mr. Landin stated that it had. Johnson asked if they had plans for the home to be built at 710 West 96th Street. The Landin's said that they did and showed them to the Board. The plans were dated February 24, 1985. The Landin's stated that they were ready to build this spring. Geving suggested they grant the variance on the condition that the house be the same size as shown on the plans dated February 24, 1985. Geving also suggested they allow a 40 foot side yard setback from the west lot line and a 30 foot side yard setback from the east lot line to allow the applicant some flexibility in the placement of their home. Watson and Johnson agreed with that suggestion. Geving moved, seconded by Johnson, to approve Variance Request #85-1 with the following conditions: 1. The proposed home must be aligned with the house to the west. 2. The project must be completed within one year from the date of approval. The house built at 710 West 96th Street be the same as the one shown on plans dated February 24, 1985. 5. That the home be located at least 40 feet from the west lot line and 30 feet from the east lot line. All voted in favor and the motion carried. APPROVAL OF MINUTES Watson moved, seconded by Geving to approve the minutes as pre- sented. Motion unanimously approved. Geving moved, seconded by Watson to adjourn the meeting at 7:10 p.m. All voted in favor and the motion carried.
