1985 10 07BOARD OF ADJUSTMENTS AND APPEALS MINUTES OCTOBER 7, 1985 CALL TO ORDER Chairman Johnson called the meeting to order at 6:40 p.m. MEMBERS PRESENT Willard Johnson, Carol Watson and Dale Geving. STAFF PRESENT Barbara Dacy, City Planner PUBLIC HEARING Front Yard Setback Variance Request, 3713 South Cedar Drive, Clifford Pedersen, applicant Clifford Pedersen Rick Anding appli cant Dacy stated that the applicant is requesting a 15 foot front yard setback variance for a 16 foot by 22 foot, one car garage. She noted that the lots in Red Cedar Point subdivision were platted prior to the effective date of the Zoning Ordinance and the applicant's lot measures 50' x 130' . She stated that the applicant is proposing to locate the garage 15 feet from the front property line and the right-of-way of South Cedar Drive measures approximately 30 feet in width. She noted that the applicant is proposing to continue the existing elevation of the graveled sur- face adjacent to the street where the applicant is now parking per- sonal vehicles. She explained that it is the applicant's intent to locate the garage in this manner so that drainage from the driveway and the garage will be directed to the street. She stated that the property slopes gradually toward the lake to the elevation of the existing house. She noted the following points should be con- sidered for this request: 1. Because of the existing topography of the lot and the location of the existing home, the proposed location of the garage appears to be appropriate. 2. Denying variance would prohibit the location of a garage which would provide off street parking for the property owner. The R-1 District requires that an area on a single family lot be reserved for off street parking. The proposed request is con- sistent with the intent of the ordinance. 3. The proposed location of the garage should not be materially detrimental to adjacent properties. Board of Adjustments & Appeals Minutes October 7, 1985 Page 2 4. Granting the variance is in keeping with the spirit and intent of the ordinance by creating an off street enclosed parking area. Dacy stated that staff recommends that the Board of Adjustments and Appeals approve the request for a 15 foot front yard setback variance subject the approval of the moving permit request to be considered by the City Council and compliance with building code requirements as determined by the City Building Official. Johnson stated he preferred to see the garage moved back seven feet. Rick Anding, representing the applicant, stated that additional fill would be required. Dacy stated that the property slopes toward the house and placing the garage at the proposed location would easier facilitate drainage toward the street. Geving asked if the garage could be placed in an east-west direction. Anding stated that existing trees would prevent that alignment. Geving stated that realigning may cause additional unnecessary traffic movements. Watson was concernd that moving the structure too far back may block drainge from the west. Geving moved, seconded by Watson, to approve a 15 foot front yard variance as depicted on Attachment #4 based on the findings in the staff report subject to the approval of the garage moving permit by the City Council. All voted in favor and the motion carried. Approval of Minutes Watson moved, seconded by Geving to approve the September 23, 1985 minutes as written. All voted in favor and the motion carried. Adjournment Watson moved, seconded by Geving to adjourn the meeting at 7:15 p.m. All voted in favor and the motion carried.
