1986 07 14BOARD OF ADJUSTMENTS AND APPEALS MINUTES JULY 14, 1986 CALL TO ORDER Chairman Johnson called the meeting to order at 6:30 p.m. MEMBERS PRESENT Thomas Hamilton, Carol Watson and Willard Johnson. STAFF PRESENT Barbara Dacy, City Planner and Todd Gerhardt, Planning Intern PUBLIC HEARINGS Front Yard Setback Variance Request to Construct a Single Family Home, Jack Barnes Public Present Mr. Jack Barnes applicant Gerhardt presented the findings of the staff report and recom- mended approval based on the submitted site plan. Because the parcel exists as a separate parcel of record created in 1887, Carol Watson moved, seconded by Hamilton, to approve Variance Request ~86-10 for a 10 foot front yard setback variance from West 78th Street and Erie Avenue for the construction of a single family home, based on the site plan stamped "Received June 26, 1986". All voted in favor and the motion carried. Front Yard Setback Variance Request for Construction of Two Twinhomes, David Kosemcic Public Present David Kosmecic Keith Narr Steve Undis applicant Gerhardt presented the findings of the staff report and recommended approval based on the submitted site plan. Keith Narr, neighboring resident, stated that he did not feel that the proposed setbacks were consistent with other homes in the sub- division and presented a specific site plan depicting such. He stated that the City should vacate the easement to allow for a 30 foot setback. Mr. Narr also presented a petition from 80% of the residents in the neighborhood opposing the variance. Steve Undis stated that he was a Fire Department member and felt that the proposed setbacks would cause additional cars in the cul- de-sac. He stated that because children tend to play in cul-de- sac, the increased occurrence of cars in the area would be a hazard. Board of Adjustments Minutes July 14, 1986 Page 2 He also stated that because cars would be parked in the cul-de-sac, emergency vehicles would not have adequate turnaround area. He stated that Lots 3 and 4 could be adjusted to reduce the amount of encroachment or meet the setback. He also stated that snow removal would be more difficult with the homes placed closer to the cul-de- sac. He also stated that half the circumference of the cul-de-sac would contain the surface of the driveway. David Kosmecic, the applicant, stated that the City of Chanhassen prohibits overnight parking on public streets. He also noted that the sewer easement contains an 8 inch trunk sewer line which serves most of the surrounding area. He stated that they were not aware of the easement until final papers were being prepared. Hamilton stated that the proposed twinhome on Lots 3 and 4 could be moved back approximately 5 feet. He stated that it should'nt affect the aesthetics or property values in the neighborhood. He also stated that the twinhomes shouldn't increase traffic in the neighborhood. Willard Johnson concurred with Hamilton's suggestion of moving the twinhome on Lots 3 and 4 back 5 feet. Steve Undis requested that the twinhome on Lots 3 and 4 also be shortened 7 feet to allow a staggering of the twinhomes so that one of the units would meet the 30 foot setback and the unit on Lot 3 would be moved back an additional 5 feet. Kosmecic stated that roof lines would be chopped up and would not be aesthetically appealing. He also stated that the units have been pre-sold based on the proposed design. The Board felt that staggering the unit was a good idea. Carol Watson moved, seconded by Hamilton, that Lots 1 and 2 be granted the 10 foot front setback variance for the construction of a twinhome and that Lot 3 be moved to the edge of the easement line and that the unit on Lot 4 be moved back ten feet. It is intended to make clear that there is no setback variance on Lot 4. All voted in favor and the motion carried. Approval Of Minutes Carol Watson moved, seconded by Johnson, to approve the May 19, 1986 minutes as written. Watson and Johnson voted in favor, Hamilton abstained, motion carried. Adjournment Watson moved, seconded by Johnson, to adjourn the meeting at 7:10 p.m. All voted in favor and the motion carried.
