1987 06 29BOARD OF ADJUSTMENTS AND APPEALS MINUTES JUNE 29, 1987 CALL TO ORDER Chairman Johnson called the meeting to order at 7:00 p.m. MEMBERS PRESENT Willard Johnson, Carol Watson and Dale Geving. STAFF PRESENT Barbara Dacy, City Planner PUBLIC HEARING Request for a Rear Yard Setback Variance for 3900 Lone Cedar Lane, John Merz Dacy presented the staff report to the Board. The applicant, John Merz, stated that he should have known the setbacks; however, he had ordered materials from Europe for the construction of the enclosure. He was not aware of the 30 foot setback requiremen% until after application was made for the ouilding permit. He felt that the addition would enhance the north elevation of the house and improve the view of properties on the north side. He also submitted a petition signed by adja- cent property owners that were in favor of the variance request. He stated that the roof would be gutted and raised and the enclo- sure become an integral part of the building. Geving asked if the names that were on the petition were on the property owners list? Dacy confirmed that names on the list were property owners that were notified. Watson asked if he intended to sell the lot that he owns on the north side of the property. Merz stated no. Watson suggested that a jog in the lot line could be accomplished to accommodate the necessary footage. Merz stated that he did not want to affect the buildability of the adjacent lot. Johnson asked if the addition could be added on the east side of the building. Metz stated that because of the existing position of the kitchen, extending the building to the east would not be practical. BOA Minutes JP~ne 29, 1987 Page 2 Terry Johnson, 3898 Lone Cedar Lane, spoke in favor of the variance. Geving moved, seconded by Johnson, to approve the variance request as presented because there was no other area to build, nor is there ability to adjust the line, variances have been given in other lots of the subdivision, and the proposal is uni- que to the area. Geving voted in favor; and Johnson and Watson were opposed. Motion failed. Chairman Johnson stated that this item would be heard by the City Council the same evening. APPROVAL OF MINUTES Geving moved, seconded by Watson to approve the April 20, 1987, minutes as written.
