1987 07 20BOARD OF ADJUSTMENTS AND APPEALS MINUTES JULY 20, 1987 CALL TO ORDER Chairman Johnson called the meeting to order at 6:30 p.m. MEMBERS PRESENT Willard Johnson, Carol Watson and Dale Geving. STAFF PRESENT Jo Ann Olsen, Assistant City Planner PUBLIC HEARING Request for an 18 foot variance to the 75 foot shoreland setback and a lot area variance, Dale Boyer, applicant. Olsen presented the staff report to the Board. Watson stated that nothing beyond the 50 foot setback should ever De permitted and than without the variance a home could not be built on the lot. Geving asked staff if the house could be moved closer to the street to maintain the 75 foot shoreland setback. Olsen stated that the 30 foot front yard setOack should be maintained. Geving stated that he wanted to make sure that the water drained into the lake or to the north and does not drain into the prop- erty to the the south and impact the neighbors. Johnson agreed that a variance was necessary and the house was trying to meet the setbacks as best as possible. Geving moved, Watson seconded to approve the shoreland and lot area variance with the following conditions: i. That there shall be no drainage to the south which would impact neighboring property. 2. There shall be no structure located closer than 57 feet from the ordinary high water marK. 3. There shall De no side yard variance granted. All voted in favor and the motion carried. BOA Minutes July 20, 1987 Page 2 Request for a 14.5 foot variance to the required 25 foot front yard setback, Sandcon, applicant. Olsen presented the staff report to the Board. Geving stated that they would not permit a 10.5 foot setDack and [hat the applicant could meet the setbacks by changing the house pad. Watson s~ated that the site has already been altered and there is not a hardship. Watson moved, seconded by Geving, to deny the variance for the reason that the house can meet the setbacks on the site if a dif- ferent house pad is used or if the house is moved back and there was no hardship. All voted in favor and the motion carried. Geving moved, seconded by Watson, to adjourn the meeting at 6:55 p.m.
