1987 09 14BOARD OF ADJUSTMENTS AND APPEALS MINUTES SEPTEMBER 14, 1987 MEMBERS PRESENT: Willard Johnson, Carol Watson and Tom Hamilton MEMBERS ABSENT: Dale Geving STAFF PRESENT: Jo Ann Olsen, Assistant City Planner FRONT YARD SETBACK AND SHORELAND SETBACK VARIANCE REQUEST, AL KLINGELHUTZ: Olsen presented the staff report to the Board. Willard Johnson asked what was meant by no alteration to the shoreland? Olsen replied that there would be no clearcutting of trees per- mitted within the shoreland setback except for where the building pad is required. Clearcutting is defined as the removal of trees with a 4 inch caliper or more at a height of 4 feet. Tom Hamilton stated that this does mean that they cannot have a yard, that they can have a lawn and mow it within the shoreland. Staff recommended that the DNR Forester could visit the site and to determine which trees could be removed and which should be saved and this could be made a condition in replacement of con- ditions #1 and ~2. The Board agreed with this. Hamilton moved, seconded by Watson, to approve the 35 foot variance to the shoreland setback and a 5 foot variance to the front yard setback with the following conditions: 1. The DNR Forester shall visit the site to determine which trees should be removed within the shoreland area. 2. No additional structures shall be permitted on the site without a variance. 3. The applicant shall provide an individual water well on the property. All voted in favor and the motion carried. APPROVAL OF MINUTES Watson moved, seconded by Johnson to approve the minutes of the August 3, 1987 meeting. All voted in favor and the motion carried. Watson moved, seconded by Hamilton to adjourn the meeting. Ail voted in favor and the motion carried.
