1988 05 09BOARD OF ADJUSTMENTS AND APPEALS MINUTES MAY 9 , 1988 MEMBERS PRESENT: Willard Johnson, Carol Watson and Dale Geving STAFF PRESENT: Jo Ann Olsen, Assistant City Planner Meeting called to order by Chairman Johnson at 6:35 p.m. SIDE YARD VARIANCE TO CONSTRUCT AN ADDITION TO A SINGLE FAMILY RESIDENCE, 3621 IRONWOOD ROAD, CHARLES ERICKSON Olsen presented the staff report. Mrs. Erickson presented a letter to the Board of Adjustments and Appeals from the owner of the property to the west stating that he had no objection to the variance request. Watson stated that it was easy to see why the applicant wanted the variance but that she could not see any hardship. Geving asked the applicant if they could build the bedroom on the front of the house facing the lakeshore rather than on the side. He stated that the intent of a variance was to provide means for granting exceptions but that he saw no hardship in this case. He stated that since he did not know how the property to the west would be subdivided and is currently vacant, he would recommend approval. Even though he could not find a hardship in this case he felt it would improve the home. Johnson stated that he did not see a hardship but also felt that it was an improvement to the home. The applicant stated that they could not construct the bedroom on the lakeside of the house due to the existing structure of the home and the slope of the property. They stated that they needed the 12 foot addition to be located where proposed so that they could use the existing plumbing on the west side of the house. Watson stated again, that she did not feel it was a hardship and it was a difficult decision but that interpreting the ordinance she could not grant the variance. Geving moved, seconded by Johnson to close the public hearing. All voted in favor and the motion carried. Geving moved to approve the 4 foot variance to permit the construction of a 12' x 24' addition. Johnson seconded the motion. Geving voted in favor. Watson and Johnson were opposed. Motion failed. APPROVAL OF MINUTES Geving moved, seconded by Johnson, to approve the April 25, 1988, minutes as amended. All voted in favor and the motion carried. Geving moved, seconded by Watson, to adjourn the meeting. Ail voted in favor and the motion carried.
