APPEAL TO THE INTERPRETATION OF THE ORDINANCE, 7307 LAREDO
DRIVE, LEIGH COLBY
Staff presented the report.
Leigh Colby stated that he was confused by the ordinance and
wanted an interpretation of corner lots and how they are
restricted. The applicant presented several existing cases and
wanted the interpretation or how the setbacks were applied.
Watson stated that corner lots have two 30 foot setbacks.
Colby questioned why other homes were closer to the roadway then
what he was asking.
Watson stated that he must meet the setback and that the defini-
tion of front yard setback was from the front lot line which is
adjacent to the street right-of-way. She stated that the request
was not unreasonable but they must determine if the ordinance was
correctly interpreted and if they feel the interpretation of
the ordinance was correct but did not like the way the ordinance
was written, they would have to amend it.
Colby asked how he can get the variance and how can he get the
deck.
Watson stated that he would have to locate it on the site where
it would meet the setbacks.
Watson moved, seconded Johnson, to deny the appeal of the
interpretation of the ordinance and supported that staff had
interpreted the ordinance correctly. All voted in favor and the
motion carried.
Allen Fox from the audience stated that he was a neighbor and he
just wanted to make his support to the variance.
Watson moved, seconded by Dimler, to close the public hearing.
All voted in favor and the motion carried.
Watson moved, seconded by Dimler to adjourn the meeting at 7:30
p.m. All voted in favor and the motion carried.
