MINUTES OF JULY 22, 1991
MEMBERS PRESENT: Carol Watson, Willard Johnson and Don Chmiel.
STAFF PRESENT: Sharmin A1-Jaff, Planner I and Paul Krauss,
Planning Director.
A Front Yard Setback Variance for the Construction of an Addition
to be located 19.3 feet from the right-of-way on property zoned RSF
and located at 6689 Nez Perce Drive, Daniel and Karen Woitalla.
Sharmin presented the staff report. The variance is for a 12.5
foot front yard setback variance for the purpose of enlarging a
single family residence.
Daniel Woitalla, the applicant, stated that there are two houses,
895 and 760 Nez Perce that have a reduced front yard setback.
Staff indicated that those two houses are outside of the 500 foot
distance from the subject property. Staff indicated that it is
difficult to recommend approval for this variance as there is no
existing hardship.
Daniel Woitalla stated that the real reason for this variance is
because his wife is pregnant and has multiple sclerosis and in the
near future she will be needing a wheel chair and the size of the
bedroom does not allow for.a crib and a wheel chair at the same
time.
Don Chmiel stated that there is a medical hardship in this case but
the applicant should bring a letter from a doctor stating that the
applicant actually has MS and is pregnant.
A1 Klingelhutz stated that he is in favor of any improvement that
takes place in the area of Carver Beach. He also stated that he
owns the parcel adjacent to the applicant's parcel.
Chmiel moved to approve the variance with the condition that the
City receive a letter from the doctor that the case is as such and
that the hardship is a medical hardship. Watson seconded the
motion. The vote failed 2 to 1. Johnson was opposed to the motion
as he believed that a hardship does not exist.
This item will be reviewed by the City Council when the applicant
provides a letter from the doctor describing Karen Woitalla's
medical condition and a floor plan of the subject house°
Watson moved, seconded by Johnson to approve the minutes of June
10, 1991. All voted in favor and the motion carried.
Watson moved, seconded by Johnson to adjourn the meeting. Ail
voted in favor and the motion carried.
