GRANT OF
PERMANENT TRAIL EASEMENT
YOBERRY FARMS, LLC, a Minnesota limited liability company, hereinafter referred to
as "Grantor", in considerntion of One Dollar ($1.00) and other good and valuable considerntion, the
receipt and sufficiency of which is hereby acknowledged, does hereby grant ooto the CITY OF
CHANHASSEN, a mlUlicipaI COIpornDon organized ooder the laws of the State of Minnesota, the
Grantee, hereinafter referred to as the "City", its successors and assigns, furever, a pennanent
easement for public trailway pmposes over, across, on, ooder, and through land situated within the
Coooty of Cmver, State of Minnesota, as descn"bed on the attached Exhibit" A It and depicted on the
Description Sketch attached hereto as Exhibit "B".
INCLUDING the rights of the City, its contmctors, agents, servants, and assigns, to enter
upon the easement premises at all reasonable times to consIIUct, .recOhstruct, ~ repair, and
maintain said public trailway systems over, across, on, ooder, and through the easement premises,
together with the right to grade, level, fiD, drain, pave, and excavate the easement premises, and the
further right to remove trees, bushes, unde1growth, and other obstructions interJering with the
location, construction, and maintenance of said public trailway systems.

The above named Grantor. its SUccesSOIS and $Signs, does covenant with the City. its
SUCcesSOIS and assigns, that it is well seized in :fee title of the above described easement premises;
that it has the sole right to grnnt and convey the easement to the City; that ~ere are no unreconled
interests in the easement premises; and that it will indemnifY and hold the City harmless for any
breach of the foregoing covenants.

A to.OO foot wide trail easement over and across that part of ~Iot D, lDGHCREST
MEADOWS, Carver COlmty, Minnesota, lying 5.00 feet on either Side of the following
described center line: .
Commencing at the northeast comer of said Outlot D; thence on an assumed bearing
ofNortb 89 degrees 52 minutes 12 seconds West along the most northerly line of
said Outlot D, 20.17 feet to the POINT OF BEGINNING; thence South .11 degrees
21 minutes 23 seconds West, 30.94 feet; thence southerly 3231 feet along a
tangential curve concave to the east having a central angle of 11 degrees 02 minutes
27 seconds and a radius of 167.69 feet; thence South 01 degree 13 minutes 47
seconds West, 2932 feet; thence southwesterly 1230 feet along a tangential curve
concave to the northwest having a central angle of 55 degrees 34 minutes 42 seconds
