Release of land from contract for private redevelopment and
Reimbursement Agreement between the City of Chanhassen and
CHADDA/Heritage Park Apartments
BACKGROUND
The attorney for CHADD A and Heritage Park Apartments Limited has requested
that the City grant a release from their contract for private redevelopment.
The Downtown TIP District (#1) was decertified on September 13, 2004.
Under the agreements, the City provided TIP assistance and loan for the project.
The project repaid the City the total amount due, $253,395.22. The final payment
of $60,000 was received on March 3,2008.
Staff has reviewed the files and finds the project complete and in compliance with
the redevelopment contract.
RECOMMENDA TION
Staff recommends that the Chanhassen EDA approve the attached "Release of
Land from Contracts for Pri vate Redevelopment and Assessment Agreement and
Reimbursement Agreement". Approval of this item requires a majority vote of
the ED A.

Minnesota, legally described as follows:
Lot 1, Block 1, HERITAGE SQUARE ADDITION
is hereby released from all obligations, terms and conditions found in the following documents:
1. That certain Contract for Private Development dated November 21, 1988, by and
between the Housing and Redevelopment Authority in and for the City of
Chanhassen, a public body corporate and politic nlkla the Chanhassen Economic
Development Authority, a public body corporate and politic; the City of
Chanhassen, a Minnesota municipal corporation; and CHADDA, a Minnesota
general partnership; and
2. That certain Reimbursement Agreement dated May 26, 1989 between the
Housing and Redevelopment Authority in and for the City of Chanhassen, a
public body corporate and politic nlkla the Chanhassen Economic Development
Authority, a public body corporate and politic, and Heritage Park Apartments
Limited Partnership, a Minnesota limited partnership, filed with Carver County on
May 30, 1989 as Abstract Document No. 105549 and as Torrens Document No.
T61119.
