Chairman Papke called the meeting to order at 7:15 p.m.

PUBLIC HEARING:
ARBORETUM SHOPPING CENTER: REQUEST FOR A MINOR PLANNED UNIT
DEVELOPMENT (PUD) AMENDMENT TO ALLOW AN LED MOTION SIGN ON THE
PERMITTED SIGN ON PROPERTY LOCATED AT 7755 CENTURY BOULEVARD
(LOT 2, BLOCK 1, ARBORETUM SHOPPING CENTER). APPLICANT: SIGN
SOURCE & NORTH COAST PARTNERS, LLP, PLANNING CASE 08-17.

Angie Auseth presented the staff report on this item. Commissioner Undestad asked about the
color of the lettering. Commissioner Keefe asked if there was motion or scrolling in the sign.
Commissioner Laufenburger clarified the size and location of the sign. Commissioner Dillon
asked if this sign complies with amendments being proposed in the city code regarding signage.
Chairman Papke asked if staff had any concerns with traffic in this area. The applicant, Jim
Abrahamson with Sign Source, 7660 Quattro Drive, and on behalf of Ron Clark, Bryan Monahan
and North Coast Partners in Edina, requested that changes be allowed for this type of a sign in
order to advertise for the tenants in the center. He noted that scrolling lettering was permitted on
the school sign in town as a conditional use permit. Commissioner Dillon asked for clarification
of ownership and who and how advertising would be allowed on the sign. There was discussion
between the commission and the applicant whether scrolling letters were permitted on electronic
reader signs. Bryan Monahan spoke on behalf of the tenants in the mall on the need for
advertising.
Chairman Papke called the public hearing to order. Lynne Etling, 7681 Century Boulevard
stated her preference would be to have amber lettering, no scrolling on the sign and expressed a

concern with lights in the neighborhood and the traffic. Chairman Papke closed the public
hearing. After comments and discussion from the commission regarding scrolling display on
signage, the following motion was made.
Keefe moved, Dillon seconded that the Planning Commission recommends the City Council
approve the Planned Unit Development amendment for Arboretum Shopping Center (PUD
03-06), Planning Case #08-17, amending the design standards Section e. Signage Criteria
to allow an electronic message center on an existing monument sign as follows:
Monument Sign
1.Lot 1 shall not contain any monument signs. In return, the applicant shall be permitted to
place a 10-foot high sign with a maximum area of 48 square feet along Highway 5 on Lot
2.
a.An electronic message center sign may be permitted as part of the 48 square-foot
sign display area in lieu of alternative temporary signage and shall comply with
the following standards:
i.No electronic message center sign may be erected that, by reason of
position, shape, movement or color interferes with the proper functioning
of a traffic sign, signal or which otherwise constitutes a traffic hazard.
ii.Electronic message center displays shall not exceed 5,000 Nits between the
hours of civil sunrise and civil sunset and shall not exceed 500 Nits between
the hours of civil sunset and civil sunrise.
iii.Electronic message center signs shall not cause direct glare nor become a
distraction due to excessive brightness.
iv.The lamp wattage and luminance level in candelas per square meter (Nits)
shall be provided at the time of permit applications.
v.There shall be no electronic message center signs in the front setback area
within 50 feet of a street intersection (as measured from intersecting right-
of-way lines) or within 125 feet of a residential district, except where
lighting for such sign is indirect or diffused and in no way constitutes a
traffic hazard.
vi.Electronic and non-electronic message center sign display area used on a
sign shall not exceed a total of 40 square feet or 25 percent of the allowable
sign area, whichever is less. The message displayed on electronic message
center signs shall be depicted in one statement and not a continuing
sentence or flow of information. Flashing, scrolling, special effects or
animated scenes on electronic reader boards shall be prohibited.
vii.Electronic message center sign LED display use for signs within 500 feet of
single-family residential homes shall be limited to the hours between 6:00
a.m. and 10:00 p.m.

viii.Temporary signage other than that depicted on the LED display is
prohibited for tenants on Lot 1.
2.Lot 2 will contain one monument sign at the intersection of Highway 5 and Century
Boulevard. The height of the sign shall not exceed 5 feet with an area of 24 square feet.
3.All signs shall be built of materials similar to those used on the exterior of the buildings
and complement their architectural design. The signs must maintain a minimum 10-foot
setback from the property lines.
All voted in favor and the motion carried unanimously with a vote of 6 to 0.

ADDITION-CHANHASSEN PUBLIC WORKS FACILITY. APPLICANT: CITY OF
CHANHASSEN, PLANNING CASE 08-18.
Alyson Fauske presented the staff report on this item. Commissioner Laufenburger asked for
clarification on what will be done with the material currently stored on this site. Commissioner
Keefe asked about protection of the wetlands. Chairman Papke opened the public hearing. No
one spoke and the public hearing was closed.
Laufenburger moved, Thomas seconded that the Chanhassen Planning Commission
recommends that City Council approve an Interim Use Permit to permit up to 15,000 cubic
yards of fill, plans prepared by City of Chanhassen Engineering Department dated August
14, 2008, subject to the following conditions:
1.A demolition permit is required for the removal of any structure(s).
2.If future construction in this area is anticipated, these soils must be engineered for the
intended structural loads and their placement must be properly compacted and tested as
required by such soil engineering. A report, verifying placement, compaction and soil
suitability, from the testing agency will be required before building permits will be issued.
3.Install tree protection fencing at grading limits on north, where applicable, and west sides
prior to grading.
4.Clearing limits shall be inspected by the Environmental Resources Specialist prior to any tree
removal.
5.Wetland boundary, as field identified, needs to be shown on the drawing.
6.Grading limits need to be modified to avoid impacts to the revised wetland boundary.

7.Category 2 erosion control blanket needs to be shown on the slope in the northeast corner of
the property.
8.All exposed soil areas must be stabilized within seven (7) days after the construction activity
in that portion has temporarily or permanently ceased.
9.All disturbed areas shall be seeded with Mn/DOT Mixture 150 at 40 lbs/acre and mulched
with Type 2 mulch disc-anchored at 2 tons/acre upon completion of grading for the interim
use permit.
10.The grading plan should be adjusted so that the drainage areas will not be altered, otherwise
drainage calculations are required.
11.The existing sanitary sewer, watermain and storm sewer and drainage and utility easements
must be shown on the plan.
12.The grading limits in the northeast corner of Lot 6 must be shifted in order to maintain
minimum 7.5 feet of cover over the watermain.
13.Provide additional information to the Metropolitan Council in order to determine the
maximum extent of grading allowed over the sanitary sewer.
14.Abide by the Metropolitan Council’s conditions of approval, if any.
15.Permitted hours of operation are 7:00 a.m. to 6:00 p.m., Monday through Friday, and 9:00
a.m. to 5:00 p.m. on Saturday with no work permitted on Sunday or legal holidays.
16.The interim use permit will expire one year from the date of City Council approval. The
permit may be renewed on an annual basis subject to City Council approval. Request for an
extension must be submitted 45 days prior to the expiration date.
17.All permits must be acquired prior to grading, including but not limited to a watershed
district permit, and a Minnesota Pollution Control NPDES stormwater permit. A stormwater
pollution prevention plan must be submitted to the City for review by Carver Soil and Water
Conservation District.
18.The grading plan must be signed by an engineer licensed in the State of Minnesota

APPROVAL OF MINUTES:
Commissioner Keefe noted the verbatim and summary minutes
of the Planning Commission meeting dated August 5, 2008 as presented.
COMMISSION PRESENTATIONS:
Chairman Papke asked for clarification of the
amendment to the city code regarding firearms. Commissioner Dillon asked that the commission
be updated on Robert’s Rules of Order regarding friendly amendments to motions.
