Under ctu~nt building codes, a building cannot encroach on two parcels that are under different ownerships. In this case, Lot 1, Block 2 is owned by the EDA and Lot 2, Block 2 is owned by the City. Staff is recommending approval of the attached resolution accepting the ownership of LOt 1, Block 2, Schneider Park from the EDA to the City. ATrACHMENT 1. Plat of Schneider Park 2. CITY WHEREAS, the City is in the process of platting SCHNEIDER PARK SECOND ADDITION; and WHEREAS, one parcel of land that will be part of this plat is legally described as Lot 1, Block 2, SCHNEIDER PARK (the "Subject Property"); and WHEREAS, the Subject Property is owned by the Economic Development Authority in and for the City of Chanhassen ("EDA"); and WHEREAS, to facilitate the platting process, the EDA proposes to convey the Subject Property to the City; NOW, BE IT RF_~OLVED that the City Council of the City of Chanhassen does hereby accept the EDA's proposed conveyance of the Subject Property. BE IT FURTmr~R RESOL~, that pursuant to Minnesota Statutes Section 462.356, subdivision 2, the City Council finds that the proposed acquisition of the Subject Property has no relationship to the comprehensive municipal plan.
