DA TE: SUBJ: Extend Time to File Development Contract and Final Plat Mylars for Boulder Cove - Project No. 06-15/Planning Case 06-10 PROPOSED MOTION: "The City Council extends the time to file the Boulder Cove Development Contract and Final Plat to August 1, 2010 contingent upon payment of cash fees in effect at the time of filing and the applicant holding a neighborhood meeting prior to construction commencement." City Council approval requires a majority of City Council present. BACKGROUND The subject site is located north of Highway 7, east of Church Road and south of West 62nd Street. It is zoned RLM- Residential Low and Medium Density District. Chanhassen is a Community for life - Providing for Today and Planning for Tomorrow Mr. Todd Gerhardt Boulder Cove Filing Extension- Planning Case 06-10 July 13, 2009 Page 2 On September 25, 2006, City Council approved the final plat, development contract and construction plans for the Boulder Cove development. The plat consisted of 39 lots and 1 outlot. Eleven of the lots will house single-family homes, 16 lots will house duplexes, and 12 lots will house three-plexes. On November 13,2006, City Council extended the time to file the final plat to May 1,2007 due to unresolved issues with the legal description of the parent parcel. On April 3, 2007, the developer sent staff an email stating that these issues remained unresolved and requested that the time to file the final plat be extended to August 1,2008. The City Council approved the requested extension on August 13,2007. On July 8, 2008, the developer sent staff a letter requesting that the time to file the final plat be extended to August 1,2009, to allow him sufficient time to secure financing for the project. The City Council approved the request on July 28, 2008. On June 15,2009, the developer submitted a letter requesting the time to file the final plat be extended to August 1,2010 due to the current economic conditions. The developer acknowledges that the cash fees collected with the final plat will be updated to reflect those in effect at the time the development contract is to be filed. Once construction on the project is about to commence, the applicant will be required to hold a neighborhood meeting and update the residents on the project. Box 147 Chanhassen, MN 55317 RE: Plat filing Dear Ms. AI-Jaff, Cottage Homesteads at Boulder Cove, LLC is requesting the City Council to extend the filing date of our plat for one additional year to August 1 S\ 2010. I would appreciate it if you would schedule me for the July 13t\ 2009 City Council meeting. Under the current economic conditions, we have been unable to find a bank to finance our project. As you know, in order to file our plat, the City requires a letter of credit and a cash payment of fees totaling more than $1,200,000. We need a bank in order to accomplish this. I am sure you remember as I do all of the conversations and meetings that we had over the twenty month approval process in order to answer questions and solve problems relating to a wide variety of issues including closing traffic access points on highway 7 and establishing alternate access points for existing homes to the east; rerouting of surface drainage in order to alleviate flooding problems for the homes to the west; figuring out the best way to connect to sewer and water, having hydrology studies done by Braun Intertec and also by Barr Engineering. It took a long time, but I think we were all satisfied that the time was well spent and the effort was worth it. I believe that the staff, Planning Commission, and Council members were all supportive of our project, which will provide one level maintenance free living to empty nesters in the area who desire to move from their two story homes. Selling their houses are the big challenge right now. When that changes, there will be plenty of buyers and we will be able to finance the development of our project. I hope the City will keep these things in mind as our proposal is examined. Thank you for your consideration.
