DATE: SUBJ: Update and Extension of Pond Construction Nick's Storage and Parking CUP 87-2 and IUP 92-1 1900 Stoughton Avenue - Planning Case #08-10 PROPOSED MOTION: "The City Council approves a one-year extension for the construction of the pond for Nick's Storage and Parking CUP 87-2 and IUP 92-1." City Council approval requires a majority of City Council members present. EXECUTIVE SUMMARY Staff presented revocation ofthe Conditional Use Permit 87-2 and Interim Use Permit 92-1 for Nick's Storage and Parking at the June 22,2009 City Council meeting. City Council tabled action to allow the applicant an opportunity to resolve the outstanding ponding and erosion control measures for the site and rescheduled the item for the September 14, 2009 City Council meeting. Since the June 22,2009 City Council meeting the property owners of Parcel B (property in which the pond will be located) have signed the deed for the Drainage and Utility Easement. The Drainage and Utility Easement encompasses the pond, which allows for maintenance of the pond by the City, once the pond is constructed. Chanhassen is a Community for life. Staff recei ved an email from the applicant stating that it is still their intent to install the pond and fulfill the conditions set forth in the IUP/CUP for the storage facility. At this time the applicant is requesting a one-year extension for the installation of the pond erosion control plan. Due to the unforeseen recent events, staff is recommending approval of an extension for one year to September 14, 2010, to allow the applicant and their representatives the opportunity to resolve the underlying issues.
