Directo~s Comments: In response to a direc om the commission, Park Superintendent
Gregory prepared the attached plan and cost e mate. Mr. Gregory consulted with Mr. John
Hopko of Professional Turf and Renovation in the preparation of the plan. The proposed
drain field would flow from north to south outleting into a storm water pond. The maximum
level of perfomi.ance of the drain tile system is unknown due to the unpredictability of heavy
clay soils. Assuredly these proposed improvements would alleviate some of the drainage
problems currently being experienced in this area.
The Park Acquisition and Development budget contains a $10,000 contingency for 1995. The .
commission approved the expenditure of $5,078 in contingency funds for parking lot
improvements (basketball) at Power Hill Park on May 9, 1995. This commitment leaves
$4,922 in the contingency fund. Mr. Gregory's estimate for the proposed Power Hill drain
tile project is $4,713. Staff awaits the commission's direction in this regard.

To simplify the establishment of Recreation Center fees, I have prepared a proposed schedule. This schedule
includes the discounts and surcharges discussed by the commission on May 9, 1995. My recommendation for
the fees includes a base rate of $1 O/hour. The base rate lies to a resident renting one community meeting
room (no kitchenette) for a private function on a weekda onday-Thursday). Weekend fees (Friday-Sunday)
were established by attaching a $5.00 surcharge to the y fee.

Regarding the discussion on renting out room space for multiple hours, my recommendation is to give a 20%
discount/hour for rentals of 3 or more hours. This will provide incentive to those who rent the community
meeting rooms or conference room for a larger block of time such as a half or full day.
Example: Private resident wants all four community meeting rooms for a wedding reception on Saturday from 5
to 10 p.m. Without the discount, the fee would be $325, but with the discount, the fee would be $260.

Sunday mornings it would be easier to extend the hours rather than to cut back if Sunday mornings are quiet.

On May 8, 1995, the Chanhassen City Council approved the formation of a Parkland
Acquisition and Development, Trail Construction and Open Space Preservation Task Force.
The job of the task force is to investigate the merit of a special referendum to finance these
proposed initiatives. Potential projects include:
· Development of Bandimere Community Park.
Preservation of woodlands.
· Preservation of the Bluff Creek waterway.
· Acquisition of a large tract of land for the city's final community park.
· Acquisition of the Bluff Creek Golf Course.
Construction of trail segments to include Highway 101 north; Powers Boulevard north;
Galpin Boulevard north; Highway 41 and a portion of the Bluff Creek trail.
The task force will be comprised of the following eleven members:

Playground Legislation: Approved and signed by Governor Carlson.
State Representative Tom Workman (former Chanhassen City Council member) authored
House File No. 1709 to ensure that Chanhassen citizens get the most for their money in
playground equipment. Senator Ed Oliver guided the bill through the senate. The bill
provides for experimental bid specifications allowing for creativity in the purchase of
playground equipment.
Current law does not permit playground purchases over $25,000 to be based upon quantity
and design. This bill will allow Chanhassen to purchase equipment using design-based
criteria. In other words, the company that meets certain standard specifications and provides
the most equipment is awarded the contract.
If the proposal works, the state will consider its application statewide. The idea initiated from
a conversation between Representative Workman and me.

News on the Street: Chris Polster, President of the Chanhassen Athletic Association, is
working on a plan to renovate the Frontier Building. The general concept is a youth
recreation center.
Mr. Polster is also considering a presentation to city officials regarding the merits of the city
hiring an employee to assist in the coordination of youth activities.
More Trees on the Move: Michael Gorra has once again graciously donated trees to the city.
For the cost of moving, we can take all the 4" to 6" Linden, Locust and Ash trees we can
use. Damaged tree stock throughout the park system will be replaced with these new trees.
Final cost for each of these trees is between $25 and $30.
Extended Illness Affects Park Maintenance Division: Keith McKinley, Park LEO has been on
sick leave for over two weeks. Mr. McKinley's condition required hospitalization. He is
recovering at home. Keith is one of two of the current full time field operation employees in
the Park Department.

What's the plan' and what are we buYing here?

The park behind our home is
beginning to take shape. I appreci-
ate the park board's ability to
preserve space in my neighborhood
for a park. And now that the board
is forming a commission to ask us
for more money to support such
endeavors, my first reaction is to
support them in their efforts.
There is a small voice from
within, however, that says, "Hold
on. What are they asking for?"
I've been to one meeting of the
Parks and Recreation board. Our
neighborhood was invited to discuss
the future of parkland behind our
homes. The meeting began at 7 p.m.
and it became apparent that our
neighborhood park was not first on
the list. I, along with a large
contingency of homeowners from
the neighborhood, waited until after
9 p.m. until that for which we were
invited became the topic of discus-
sion.
After a spirited debate between
neighbors and board members, the
discussion was tabled. We were told
that the decision on what sort of
. park would take shape wouldn't
need to happen right away anyway
because the money wasn't available
for another three to five years. I had
seen many issues come before the
l?oard that evenin& and had not. seen
the board act on a single occasion.
While many seemed to be issues of
available funds, even those that did

not require money were tabled until
the board could receive "more
information."
I left the meeting feeling
cheated. While part of my displea-
sure was with being invited to a
meeting in which there was no way
to make a decision on that which we
were discussing, part of it also was a
displeasure with the process. I
watched a board examine issue after
issue and not come to any decision
whatsoever. With each issue, the
board either needed more time,
more information or more money. I
truly believe the discussions on each
issue would have been shorter if the
board had the ability or the inclina-
tion to'say, "OK, let's go with it" or
"No, we won't support that."
Todd Hoffinan, director of parks
and recreation, has said that the
commission must act quickly to
keep ahead of the game. My
question is whether the board is
prepared to act quickly. Acting
quickly is much more than deciding
what dollar amount to put forth to
the residents of Chanhassen.
What is needed here is a detailed
plan. What land is targeted for sale?
. What are the plans for the land once
it is purchased? What's the timeta-
ble for development of those laQds?
These are questions which should
be answered, must be answered,
before the question of how much it
costs is asked. While I, personally,
would support a detailed plan for
building parklands in our communi-
ty, I w,i11 not write a blank check.
It seems to me that giving the
park board enough money to act is
not enough to provoke action. The
board I saw in action -was a board
unable and seemingly unwilling to
take action. We need to see what
actions they plan and how and when
they intend to implement those
actions.
My advice to the commission
formed to study the referendum: get
your information in place now,
before you ask for my money. The,
only thing worse than asking for .i
money is not having a clear plan for
it once you get it.

Thank you for participating in our initial 4 Your Parks promotion with WCCO- TV.
As you may be aware, we had an excellent response to the program (37 departments and
agencies). Despite a rather late start and some logistical shortcomings, we were able to distribute
over 5,000 trash bags for use.
Next year we intend to do better and we hope you will continue to support the program.
Hopefully by the '95 State Conference in St. Cloud (November 1 - 3), we will have more
details.

The future of this submittal is uncertain. The commission's recommendation to require

dancing in bookstore
Facts
A city ordinance restricted adult
entertainment centers to one per
block. Later, the city decided to
expand the ordinance's definition of
'adult entertainment center' to include
all establishments that sell liquor. Due
to this expanded definition, a block
that originally had only one adult
entertainment center (an adult
bookstore) now had two (the bookstore
and a bar offering nude dancing).
Since both businesses existed before
the ordinance change, the council
allowed them both to stay in business.
However, when the bookstore owner
applied for a license to present nude
dancing in his bookstore, the city
council denied the license.
Analysis
The Minnesota Court of Appeals
held that the expanded definition of
adult entertainment center was
constitutional and the denial of the
bookstore's nude dancing license was
proper. The court stated that when the
definition was changed, and there we
two adult entertainment centers one
block, they both became no onform-

Facts
The city brought a condemnation
action against a landowner. The
landowner is an attorney and repre-
sented himself at trial. After the city
gave up the litigation, the landowner
asked for, and the trial court awardeq,
more than $2,000 in attorney's fees.
Analysis
The Minnesota Court of Appeals
reversed the trial court and held that
the landowner was not entitled to any
attorney's fees. According to the court,
Minn. Stat. 117.195 Subd. 2 (1992) and
prior case law require an actual "cash
expenditure" before a party will be
entitled to attorney's fees. The
landowner was not entitled to any
attorneys fees b did not

ture for legal services (City of Victoria v.

Facts
A city fired an employee because he
had alcohol on his breath and was
operating city machinery in a careless
manner. After his termination the
employee applied for, and was granted,
reemployment insurance benefits by
the Commissioner of Economic
Security. The city protested, claiming
that the employee was not entitled to
such benefits because he was dis-
charged for misconduct.

Analysis
The Minnesota Court of Appeals
upheld the Commissioner's decision.
Usually, employees discharged for
misconduct are disqualified from
receiving reemployment insurance
benefits. However, the court found
t at because the employee was an
al holic, he qualified for the "serious
ill ess" exception to disqualification
( inn. Stat. 268.09 Subd. l(c)(2)).
nder this exception, an individual
who is terminated due to his chemical
dependency is entitled to reemploy-
ment benefits if the employee has
made "consistent efforts...to control
[his] illness." The court found that
since the employee was regularly
attending meetings of Alcoholics
Anonymous at the time he was dis-
charged, he was making consistent
efforts to control his illness and
therefore, he was entitled to receive his
insurance benefits (Bilben v. City of
Wheaton, C6-94-2085, Feb. 21,1995,

prior to its connection with the railroad underpass. Said trail to be constructed
with the first phase of improvements completed by th'e applicant with a lump
sum cost for the trail being reimbursed by the city. Note: The applicant shall
supply the city with three quotes for the construction of said trail with the fmal
alignment being staked for approval by the City's Park and Recreation and
Engineering Departments prior to construction.
10. The applicant shall revise the development plans to include a lOa-foot setback buffer

Handbook. The applicant will need to develop a sediment and erosion control plan in
accordance with the City's Best Management Practice Handbook and the Surface
Water Management Plan requirements for new developments. The plan shall be
submitted to the City for review and formal approval by the City Council. Type III
erosion control will be required adjacent to all wetlands except where storm ponds will
intercept runoff prior to discharging into the wetlands. In these areas Type I erosion
control is required.
12. All utility and street improvements shall be constructed in accordance with the latest
edition of the City's Standard Specifications and Detail Plates. Detailed street and
utility plans and specifications shall be submitted for staff review and City Council
approval.
13.
The applicant shall provide detailed storm sewer calculations for lO-year and 100-year
storm events and provide ponding calculations for storm water quality/quantity ponds
in accordance with the City's Surface Water Management Plan for the City Engineer
to review and approve. The applicant shall provide detailed predeveloped and post-
developed storm water calculations for 100-year storm events and normal water level
and high water level calculations in existing basins. Individual storm sewer
calculations for a lO-year storm event between each catch basin segment will also be
required to determine if sufficient catch basins are being utilized. In addition, water
quality ponding design calculations shall be based on Walker's Pondnet model.
14. The applicant shall enter into a development contract with the City and provide the
necessary financial security to guarantee compliance with the terms of the
development contract.
15. The applicant shall apply for an obtain permits from the appropriate regulatory
agencies, i.e. Carver County Watershed District, MWCC, Health Department, PCA,
DNR, Army Corps of Engineers and MnDOT and comply with their conditions of
approval.
16. Prior to final plat approval the applicant shall submit to the City soil boring
information. On lots with fill material that have been mass graded as part of a multi-
lot grading project, a satisfactory soils report from a qualified soils engineer shall be
provided to the Building Official before the City issues a building permit for the lot.
17.
The appropriate drainage and utility easements should be dedicated on the final plat
for all utilities and ponding areas lying outside the right-of-way. The easement width
shall be a minimum of 20 feet. Consideration should also be given for access for
maintenance of the ponding areas.

18. No berming or landscaping will be allowed within right-of-way areas.
19. The lowest floor elevation of all buildings should be a minimum of 3 feet above the
high water level calculated according to the shoreland ordinance guidelines.
20. The proposed storm water ponds shall be designed with side slopes of 10: 1 for the
fIrst ten feet at the normal water level and no more than 3: 1 thereafter or 4: 1
throughout for safety purposes. The storm ponds shall be constructed with the initial
site grading.
21. Individual grading, drainage and erosion control plans will be required for each
wooded lot prior to issuance of a building permit.
22. Water quality fees will be based in accordance with the City's SWMP. If the
applicant constructs the water quality ponds as proposed these fees will be waived.
23.
Water quantity fees will be based in accordance with the City's SWMP. Storm sewer
trunk fees will be evaluated based on the applicant's contribution to the SWMP design
requirements. The fees will be determined by staff upon approval of the construction
plans.

24. The applicant shall report to the City Engineer the location of any drain tiles found
during construction and shall relocate or abandon the drain tile as directed by the City
Engineer.
25. The southerly cul-de-sac shall be re-evaluated for a private driveway in an effort to
pull the house pads away from the tree line. A turnaround in accordance to the Fire
Marshal's recommendations shall be provided.
26. The applicant shall be required to extend an 8-inch sanitary sewer line to the westerly
edge of the plat along the Bluff Creek tributary (Lots 21, 21, 23, 24 and 25, Block 3).
27. The northerly proposed interim storm pond shall be shown on the grading plan.
Details such as contour lines and the outlet control structure shall be included.
28.
The north/south street shall be extended through to the frontage road within three
years after the fInal plat is approved. The applicant shall provide the city with a
financial security to guarantee the roadway extension will be completed. A temporary
cul-de-sac (42 foot radius) shall be constructed until such time as the roadway is
extended. At that time, the temporary cul-de-sac shall be removed. A barrier shall be
erected at the end of the paved right-of-way. A sign indicating that "THIS STREET
WILL BE EXTENDED IN THE FUTURE" will be erected upon the barrier. The

developer shall file a notice in the chain-of-title of each lot notifying each owner that
the north/south road is to be extended in the future.
29. The trail alignment around the wetlands (Bluff Creek corridor) shall be detennined in
the field after walking the site and consulting a soils engineer.
30. The final plat shall dedicate the appropriate utility and drainage easements for access
and maintenance of the storm sewer lines as well as ponding areas and wetlands. The
wetlands and ponding areas may be deeded to the City as outlo~ as well.
31. The applicant shall employ the use of retaining walls along the east side of the
southerly creek crossing to minimize tree loss.
32. Adjust the lot lines for those properties that abut the Bluff Creek tributary to use the
tributary!bottom of ravine as the lot line.
33.
The applicant shall investigate modification of the landscaping plans to further
intensify planting along the northern Timberwood property line to enhance the
screening effect from existing Timberwood development, particularly those dwellings
at 8001 Acorn Avenue and 2050 Oakwood Ridge.
34. Applicant shall adjust the alignment of the roadway at the southern end of the parcel
within the right-of-way to minimize the impact to the existing wetland in that area.
35. Staff will present to Council the different options and costs available for sewer
extension to Timberwood at the time of final plat.
Conditional Use Permit
The City Council approved Conditional Use Permit #94-4 to permit the placement of fill and
excavations and alterations within the flood plain subject to the following condition:
1. The applicant shall comply with the wetland fill/excavation and wetland mitigation
conditions as stated in Corps of Engineers Section 404 pennit. Mitigation work shall
be implemented prior to or concurrent with wetland fill activity in future phases of the
project. All mitigation work shall be limited to the Bluff Creek corridor and not in
the wetland located at the southwest corner of the site.
Wetland Alteration Permit
The City Council approved Wetland Alteration Permit #94-4 to pennit filling and replacing
wetlands on the site subject to the following conditions:

1. All buffer areas shall be surveyed and staked by the applicant in accordance with the
City's wetland ordinance. The City will install wetland buffer edge signs before
construction begins and will charge the applicant $20 per sign.
2. Wetland buffer areas are required around the wetlands in accordance with the City
Wetland Ordinance. The applicant shall revise the development plans to include a 50-
foot buffer around Bluff Creek with a 100 foot building setback and a 10 to 30 foot
buffer with a minimum average of 20 feet around the tributary to Bluff Creek with a
50 foot building setback.
Ten copies of the final plat should be submitted 3 to 4 weeks prior to the City Council

contractor, soliciting bids for construction of an 8 ft. wide
asphalt trail as depicted on the applicant's grading and drainage
plan dated March 1994. The trail segment north of Longacres
Drive at Highway 41 shall be the only exclusion. Final
alignment of this trail shall be staked by the applicant and
approved by the Park and Recreation Director and City Engineer.
This trail shall be constructed per standard city specifications
and must maintain a minimum separation of 10 ft. from the
wetland delineation. A minimum of three bids for the
construction of this trail shall be presented to the city for
consideration by the Chanhassen City Council. The council will
elect to accept a qualifying bid or reject all bids in favor of
rebidding the work under city contract. In the event that a bid is
accepted, Lundgren Brothers Construction will coordinate this
work as a part of the first phase of public improvements. Upon
completion and acceptance of the trail construction, the city will
pay Lundgren Brothers Construction the full amount for said
construction.

3. All easements for trail purposes necessitated by this construction
shall be granted to the city for recording. The minimum width
of said easements shall be 20 feet.
I. The existing home on Lot 4, Block 2 shall connect to the municipal
sanitary sewer line and abandon the on-site septic system per city/state codes within 30 days
after the sewer system is operational. The existing well may be used until it fails, then the
parcel must connect to city water. The existing business on Outlot D shall be removed
within 30 days after final plat approval.

runoff rate for a 100-year, 24-hour storm event. Drainage plans shall be consistent with the
City of Chanhassen' s Best Management Practices Handbook.

coincide with the city's grid system once Longacres Drive has been paved with the first lift of
asphalt. The driveway shall also be relocated to access Longacres Drive.
O. The applicant shall resolve vacating the existing private road easement
through Lots 2, 3, 4 and 5, Block 4.
P. Drainage and conservation easements shall be dedicated over all
wetland areas within the subdivision, including outlots, except for Outlots G, H, J and L
which shall be replatted in the future. Wetland mitigation measures as shown on grading plan
dated 3/10/94, revised 4/19/94 shall be completed in conjunction with site grading and
restoration.
Q. Prior to the City signing the [mal plat, the applicant shall enter into a
development contract with the City and provide the necessary [mancial security to guarantee
construction of the public improvements.
R. The applicant must still provide the city with high water elevations for
predeveloped runoff conditions for a 100 year storm event and 24 hour duration.

S. "No Parking" signs shall be posted around the islands and outside curb
line of the cul-de-sacs in order to keep a lane open for turning movements. The City Council
shall adopt a resolution for "No Parking" zone in these areas.

W. The fInal plat is contingent upon MnDOT's State Aid OffIce approving
the street alignment for Longacres Drive. Construction plan approval shall be subject to the
changes as a result of fInal review and approval of the construction plans by MnDOT's State
Aid Office. Any changes resulting from the State Aid review process may be
administratively approved by City staff.
X. The applicant may commence with site grading in accordance to the
approved grading, drainage and erosion control plan once the PUD/development contract is
executed and the city furnished with the necessary security escrow and applicable
administration fee. Utility and street construction may not commence until the fmal plat is
recorded.
Y. The developer and/or property owners shall waive any and all
procedural or substantive objections to the special assessments including, but not limited to,
hearing requirements and any claims that the assessment exceeds the benefit to the property.
Z. The developer should be given a refund or assessment credit for the
installation of the sewer and water service to Outlot F when the property owner (7305 .
Hazeltine Boulevard) connects to the individual sewer and water service.

AA. A native vegetative buffer strip 10 feet in width shall be maintained
around natural wetlands. This will limit grading to within 10 feet of the wetland. The
applicant's grading plan will have to be revised to reflect this requirement.
BB. Depending on the storm ponding calculations, if the development is not
meeting the City SWMP for water quantity, then the applicant will be required to contribute
into the City's SWMP program. The proposed rate per acre for single family is $1,980/acre
excluding wetlands.
CC. The developer shall provide a full-time on-site inspector. The inspector
will need to be state certified.
DD. The landscaped islands shall be maintained by the homeowners
association through the means of declaration of covenants.
EE. A driveway or cross access easement including maintenance agreement

The Chanhassen Park & Recreation Department Super Events are trips
to various fun places on Thursdays throughout the summer (Meet!
Return: Chanhassen City Hall). These popular trips are fully chaperoned by our Summer Discovery
Playground staff and school bus transportation is included in the price. Preregistration is required by 12
noon on the Tuesday before the Super Event and is taken on a first come/first serve basis until the
maximum is reached. Minimum/Maximum: 25/40.

Greg Olson, an Edina native and former Minnesota Gopher, New York Met, National League All-Star and
World Series catcher for the Atlanta Braves, is presently the manager of the Minneapolis Loons. Greg, as well
as other players from the Minneapolis Loons, will be the professional instructors to help improve baseball
skills. The clinic includes hitting, fielding, throwing, base running, game conditions, fitness, teamwork and
sportsmanship.
The fee includes professional instruction, camp t..shirt, photo opportunity (bring your own camera),
ticket to the Loons game on June 25, participation certificate, and "All Sport" beverages. There will be chances
to win Zubaz apparel, Loons apparel, autographed baseballs, Gopher football tickets, honorary bat person for
the Minneapolis Loons, and much more!
Supervised drop-offjpickup will be available from 8-9 a.m. and 4-5 p.m. All participants must bring a
bag lunch and a baseball glove.
