The Comprehensive Plan does not call for parks
in this area as Lake Susan Park serves the
industrial park. Additionally, the city has a
park in the Lake Susan Hills West development
which will lie just across Lake Drive East from
this proposal.
COMPREHENSIVE TRAIL PLAN: Lake Drive East will include a sidewalk
along the south side of the road. The
trail plan calls for a concrete sidewalk
along the east side of Audubon Road, north
of Lake Drive East.

RECOMMENDATION

As this property does not lie within a park deficient area, no parkland
dedication is necessary. A 20 ft. wide easement and construction of a
5 ft. wide concrete sidewalk should be required along Audubon with a
credit of $3,500 given toward the trail fee.
It is the recommendation of this office to require the payment of park
dedication fees in lieu of parkland dedication, to require a 20 ft. wide
trail easement along Audubon Road and the construction of a 5 ft. wide
concrete sidewalk within the easement, and to allow a $3,500 credit
toward the trail fee for sidewalk construction.

SUBJ:
As directed at a previous Park and Recreation Commission meeting,
I have had plans for playground equipment at Chanhassen Hills Park
and Lake Susan Park drawn up. The Commission has indicated that
they do not like the ring bridge or stationary diggers, so I did
not include such in the plan.
Attached please find plans for each site with the cost estimates.
Each design includes area for a second phase. $10,000 is budgeted
for each site. Upon Commission approval, I will order the
equipment which can be delivered in 6-8 weeks.

BACKGROUND
This is a proposal to subdivide 11.67 acres into 13 single family
lots and two outlots. This proposal was submitted some time ago
and reviewed again in January. Originally, the Park and
Recreation Commission expressed interest in purchasing the entire
piece and the proposal was put on hold. A purchase price was not
agreed upon, and the Commission acted against condemnation pro-
ceedings. In January, the Commission acted to table this item so
as to get more information from the Engineering Department
regarding the wetland area.
The applicant is proposing to dedicate 4.24 acres for park pur-
poses. A large portion of this area is a Class B wetland area,
which means it is protected by our Wetland Ordinance. Since the
last time that we reviewed this plan, the Engineering Department
has determined that a good portion of the property will be needed
for storm water retention after heavy rains. The property will
have some recreational value, but certainly not to the extent
that a dry parcel will have. The site could potentially accomo-
date a totlot, volleyball court, half-court basketball, and some
open space. Therefore only 50% credit on park dedication fees is
recommended.
The Comprehensive Trail Plan calls for sidewalks along all thru
streets. As the street in this development connects this develop-
ment and Pheasant Hill to the Lake Lucy Road trail system, such
should be required.

RECOMMENDATION
It is the recommendation of this office to accept the proposed
parkland for open space in lieu of 50% of the park dedication
fees, and to require a 5 ft. wide concrete sidewalk along the
west side of the thru street in lieu of the trail dedication fee.

SUBJ: Lake Ann Park Legion Shelter
.
In 1986 the city advanced money to the Legion to build the park
shelter near the ballfields. The agreement was that the Chanhassen
Legion would purchase the materials.and construct the park shelter,
repaying the funds with proceeds from their charitable gambling
fund. The park shelter was completed in 1988 and the Legion is
making payments as agreed.
The construction fund has a remaining balance of roughly $8,000.
The Park and Recreation commission has three options as to what to
do with the balance:
1. Return the funds to the park acquisition and development fund;
2. Improve the shelter to include water; or
3. Improve the shelter to include electricity.
Staff feels that the park shelter needs electricity and water.
Installation of a well, however, that would accommodate the Legion
Shelter, the planned community shelter,.. and possibly field
irrigation could cost well over the $8,000. As the community
shelter is scheduled to include a well, it is not necessary to
proceed with such at this time.
Staff feels that the Legion shelter would be much more functional
if served by electricity. This proposal would extend the
electrical service from the gate house to the shelter with an
outlet at both Field 1 and Field 2.

It is the recommendation of this office to authorize the
expenditure of the $8,000 in the Legion Shelter account to provide
electrical service to Fields 1 and 2 and to the Legion Shelter.

Canoe Racks
.
Last fall the Park and Recreation Commission acted to include canoe
racks in the park plan for Carver Beach Park. The Park Maintenance
Department built three racks that each hold six canoes. Two of the
racks are for Carver Beach Park and the other can be placed at the
park of your choice, i.e. North Lotus, South Lotus, Lake Susan,
Lake Ann or Greenwood Shores.
Three things need to be addressed before the canoe racks can be
placed:
1. Location of the canoe racks within the park
2. Cost of canoe rack rental
3. Method of selecting canoe rack renters
Attached please find a park plan for Carver Beach Park with
recommended locations of the racks. Staff.felt that one at the big
beach and one at the old access site would be appropriate.
As for the third canoe rack, it makes sense to put it at either
Lake Ann Park or at Greenwood Shores as Lake Ann is a quiet lake.
The selection process could be. . a challen<.Je. Staff would suggest
putting an article in the summer brochure along with a registration
slip. If someone is interested, they would send in the
registration and the fee. If more requests are received than slips
available, staff would put the registrations in a hat and draw for
each spot.
.
A fee of $20.00 for the season does not seem unreasonable and is
similar to what is charged by other cities. It is recommended that
a similar fee be adopted.

Approval of 4th of July Fireworks Display

Attached please find bids from two companies for the 4th of July
fireworks display. A letter from vitale Fireworks Display Company
1S also attached. When requesting bids for the 1990 show, a copy
of the show which Banner Fireworks presented in 1989 was included
in our correspondence. As a result, you will notice the two bids
which were received appear to be very similar.
Upon request for references from Arrowhead Fireworks Company, Inc.,
a limited number were made available with only two municipalities
among them. The review which the people contacted at these cities
gave Arrowhead Fireworks was less than enthusiastic. Specifically,
it was their opinion that they received less of a show than they
expected and it was one person's opinion that Arrowhead paid less
attention to set up and safety than other companies they had worked
with. Banner Fireworks Display Company has presented the past six
fireworks displays in Chanhassen. All of them have been of high
quality from the standpoints of safety, professionalism, and level
of excitement. They have always shown an interest in giving the
best show possible and visit the display site before the actual
shoot.
It is staff's recommendation to accept the bid from Banner
Fireworks Display Company in the amount of $5, 190.00 for the 1990
fireworks display.

SUBJ:
Chanhassen Spring Clean-up Day
.
Saturday, May 5, 1990, has been designated as Chanhassen Spring
Clean-up Day. To facilitate this project, an initial meeting with
interested citizens, neighborhood associations, scouting leaders
and local businesses has been scheduled for April 17, 1990 at 7:00
p.m. in the City Council Chambers. This meeting will establish the
means by which the clean-up day will be conducted. This first year
program will not be highly structured, but rather a self-motivated
activity. A minimal amount of collection points may be designated
throughout the City, however, it will be encouraged to include the
litter collected in regular residential trash pick-up.
Every person that I have discussed this program with is highly
motivated towards seeing that a clean-up occurs. An advertisement
blitz will take place on the week of April 23 promoting the clean-
up day. This may include but is not limited to advertisement in
local papers, distribution of flyers to area schools, posting of
notices in the downtown area and distribution of letters to
appropriate organizations.

Attached find information concerning ticket sales for the 1991 US
Open Championship at Hazeltine National Golf Club. This
prestigious championship will be played June 13-16, 1991 with
practice rounds on June 10, 11 and 12. We are able to purchase up
to six tickets; the ticket packages available are described on the
enclosed order form. The tickets are transferrable and includa
parking and a voucher for the US Open Magazine. One seven day
ticket costs $175.00. If you are interested in purchasing one day
of the ticket package it would cost $22.00 for the practice round

The YouthNews Press
The YouthNews Press is a local monthly newspaper published by, for, and about student age
youths. The tabloid sized issues are printed on newsprint paper, typeset on Macintosh hardware
using Aldus Pagemaker and Adobe Illustrator software applications. Visual images are scanned
onto the pages using a 400 OPI scanner.
YouthNews Press Copy
All sponsors are eligible to submit press releases and photographs involving their youth
development activities/events. Stories, essays, poems, pictures and pholographs submiUed by
students through their sponsors are eligible for publication. The YouthNews Press will publish as
much as funding will allow and reserves the right to select the best or most irf1)Ortant subrnssions
from all of the different age groups. The Youth News Press also reserves the right to edit for space
considerations. All announcements of coming youth development opportunities will be
published at no charge to the sponsor. The announcement will include activity/event title, date,
place, time, and cost.

The YouthNews Press will be distributed to each student family in the school district at no charge.
Students in grade school will be given the newspaper at school to be brought home in their
weekly communications folders. Junior and senior high school student families will receive their
copies in the mail. Projected growth of distribution will be 31 school districts and 315k students
by fall of 1994. The average distribution per school district is about 5800. Very large school
districts will be divided into sub districts to keep newspaper size at a manageable level. This
newspaper will reach about 25% of all homes, 53% of all family homes, and 70% of all homes with
children.
Sponsors
The newspaper will be funded by sponsors that benefit in several ways:
· Eligible to submit copy for publication.
· Eligible for free announcement of youth development activities/events
· Listed in the sponsors directory published each month
· 20% discount off of published Gel graphic arts services
· Public image from association with youth development product
· Influence the effects of youth development in community
· Tax deductable expense reduces taxable income
Sponsors targeted will include school districts, park boards, public service organizations, non-
profit associations or institutions, local businesses, and metropolitan businesses.
Cost of Sponsorship
The cost of sponsorship is 3 cents per student per year. The billing will occur prior to the school
year, with payment required by August 15th. Sponsors may target one or more districts.
Sponsorship of a district with 4000 students will amount to $120 per year. Sponsors interested in
metro wide sponsorship may eventually pay $9450 per year.

1990 Fisheries budget for the C.O.R.E. project proposal for a 104'
fishing pier on Ann Lake. As I mentioned during our phone
conversation of last week, one of the proposals that was originally
funded was not able to meet a necessary requirement and the Ann
Lake project was next in priority.

A representative for the Department of Natural Resources, Trails
and Waterways Unit, will be contacting you in the near future to
discuss the cooperative agreement the county is required to enter
with the State of Minnesota. I have enclosed a sample agreement for

THIS AGREEMENT. between the State of Minnesota, acting
by and through the Commissione~ of the Department of Natural
Resources, herinafter referred to as the "Stete" and the City of

WITNESSETH:
WHEREAS, the Commissioner of Natural Resources has the
authority, duty and responsibility under Minnesota Statutes,
Section 97A.141, (1986) to provide the public with free state~
water access sites on lakes
and rivers where access
is
ina~equate; and
WHEREAS. additionally the
Commissioner of
Natural
Resources has the authority, duty
and responsibility under
public with fishing piers; and

~innesota Statutes 97A.065, Subdivision 3 (1986) to provide the

'71 to operate recreational faeilities; and
WHEREAS, the City and the Commissioner have
determined that a fishing pier site on Silver Lake, hereina~ter':
referred to as "Fishing Pier" is of high priority under the state
public water access program: and
WHEREAS, plans for such Fishing Pier have been developed
by the State and have been approved. The approved plan is
attached hereto as Exhibit "AtI and shall be referred to as the

NOW THEREFORE, in consideration of the mutual benefits
to be derived by the public bodies hereto and for the benefit of
the general public, the parties agree as follows:

I. INSTALLA:ION
Installation of the Fishing Pier structure itself
shall be the responsibili~y of the State. It is understood that
the City will construct and pay for a concrete footing and
approach at the shoreline connecting the gangway to the shore.
It is further understood that the City will con.truct and pay for
a hard surfaced, bandicap accessible sidewalk connecting the
Fishing Pier to tbe parking area.
II. OPERATION OF THE FISHING PIER
The City shall operate the Fishing Pier in the
following manner:
A. The City .hall comply with all local, State,
and federal laws, re;ulations, rules and ordinances which may
apply to the management, operation and maintenance of the use of
said premises.
B. The Fishing Pier may only be u.ed for fishing
and observation.
C. The Fishing Pier and r.lated ~acilitie. shall
be free and remain open every day during open water ....on at
least 16 hours per day between the hours of 6 A.M. and midnight
or in conjunction with existing and e.tablished City hours of use
for its park facilitie.. The Fi.hing Pier .ay be closed by the
City in emergency .ituations or with the prior written consent of
the St.te. The State sb.ll be notified within 3 days if the
Fishing Pier is closed for e.ergency reasons.
D. Free and edequate parking in the vicinity will
be provided for the Fisbing Pier.
In addition, adequate and

E. The State reserves the right to inspect the
premises at all times to insure that the city is in compliance
with the teras of this Agreement.
F. The City shall provide police protection in
accordance with the City'S customary practices in providing

police protection for the City'S public park areas.
G. The City shall post a si;n informing the public
that the Fishing Pier is cooperatively provided by the City. the
Lions Club. and the Minnesota Department of Natural Resources.
The si;n shall be furnished by the State. Exact location to be
determined by the State in cooperation with the City.
B. The State shall retain ownership of the Fishing
Pier and retains the authority to relocate and/or remove the
Fishing P~er if the site (Exhibi~ "8") is determined to be
inadequate.
It is understood that before such removal or
relocation the State shall consult with the City and advise of
its position.
I. The City shall make a good faith effort to keep
the Fishing Pier in clean and sightly order in accordance with
the City's customary practices for the maintenance of the public
park area. Additionally, the City shall provide all necessary

minor repairs or routine maintenance service including repair or
replacement of decking and railing. It is understood that major
structural improvements or repairs shall be the responsibility of
the State.
3. The City shall provide any permit or license to
the State which it might require for the improvements.
~. The City shall take necessary action no later
than October 1 to protect the pier from 4..age caused by ice
action. AddJtionally, if necessary, the City ahall return the
pier to its original location (Exhibit ".") no later than May 1.

date. Said structure shall be in accordance with the plan.
IV. LIABILITY
Each party agrees that it will be responsible for
its own acts and the results thereof to the extent authorized by
law and shall not be responsible for the act.~ of the other party
and results thereof. The State's liability shall be governed by
the'provisions of the Minnesota Tort Claims Act. Minnesota
Statute 3.736 (1986). and other applicable law. The
municipality's liability shall be goverened by Minnesota Statute
466.01 - 466.15. and other applicable law.
V. TERM
This Agreement shall commence

The books. records. documents and accounting
procedures and practices of the City relevant to this Agreement
are subject to examination by the Commissioner of Natural
