development; a 9+ acre site on the north end, a 4
acre si te along CR 17, a 6+ acre linear parcel
along the west side of Lake Susan, and an 18 acre
site located within this addition.

BACKGROUND
.
This proposal is part of a 300f acre PUD development which lies on
both sides of CR 17 south of Lake Drive. As part of the approval
process, a PUD agreement was executed (attached) which outlines the
park and trail requirements and the dedication credit for such.
specifically, the developer is required to dedicate 4 parcels of
parkland and to rough grade on them, for which he will receive 50%
credit toward park dedication fees.
The developer is requesting that the PUD be amended to reconfigure
the layout of the lots and to provide additional park property.
Initially it was proposed that the additional property be dedicated
without further compensation, however, last week staff received a
letter from Argus Development requesting the remaining 50% be
waived.
The 3.8 acres of proposed additional parkland contains soils
unsuitable to support houses. The plan shows pedestrian access to
the new parkland from the north and the west, and to the original
park si te at a north central point (see attached map). The
developer is also proposing to move the boundary line of the
original park land so as to add area to the lots along the north
edge. As this is the narrowest section of the park, such should
not be approved.

The plan includes a small holding pond on the south end of the
proposed new parkland which in reality, according to our
Engineering Department's calculations, will have to be
significantly larger. Such would block the pedestrian access to
the original portion of the park. Staff would suggest that the
pond be moved to the northern portion of the site and that a berm
be built to accommodate a trail that would high and dry.
This is not a park deficient area. The bulk of the proposed new
parkland will contain a large holding pond. It would be difficult
to justify the expenditure of park funds for property with limited
park development potential and in an area that is not lacking
parkland. Additionally, if such a credit was given, there would be
no funds available for park development.
RECOMMENDATION
It is the recommendation of this office to approve the site plan
with the same conditions outlined in the PUD agreement. If any
additional property is available, such should be accepted, however,
no additional credit toward park dedication fees should be granted
as this is not a park deficient area.

PLANNED UNIT DEVELOPMENT AGREEMENT
AGREEMENT, dated November 16, 1987, between the CITY OF
CHANHASSEN, a Minnesota municipal corporation (the -City-), and LAKE
SUSAN HILLS, a Minnesota general partnership, and JAMES A. CURRY and
BARBARA CURRY, husband and wife (the -Developer-).
1. aequest for Planned Unit Develop.ent Approval. ~he
Developer has asked the City to approve a Planned Unit Development to be
known as -LAKE SUSAN HILLS WEST PUD- (the -Development-) on the land
legally described on the attached Exhibit -A-.
2. Planned Unit Develop.ent Concept Approval. The City hereby
grants general Concept Plan approval of the plan attached as Exhibit
-BW. Approval is subject to the following: development and final stage
. approval, a negative declaration of the EAW, compliance with the EAW
review findings and compliance with the terms and conditions of this
Agreement. Except as modified herein, each plat shall also be subject to
the standards of the City's Zoning and Subdivision Ordinances as may be
amended from time to time.
3. Density and Use. The following densities are approximate
and subject to- change:
A. Single Family Residential. The total number of single
family lots in the development shall not exceed 411. Except as modified
herein, single family lots shall be developed in accordance with the
,
uses, standards, and requirements of the RSF Zoning District.
B. Multiple Family (High Density Residential). The
development shall provide a minimum of 21.5 acres of high density

high density multiple family residential property shall not exceed 375,~
or a density greater than 17.4 units per acre. Except as modified
herein, the development of the high density multiple family residential
shall be in accordance with the uses, standards, and requirements of the
R-12 Zoning District.
C. Multiple Family (Mixed Medium Density Residential). The
development shall provide a minimum of 23.6 acres of mixed medium
density residential units. The total number of dwelling units of mixed
medium density residential property shall not exceed 221, or a density
greater than 9.3 units per acre. Except as modified herein, the
development of the mixed medium density residential shall be in
accordance with the uses, standards, and requirements of the R-8 Zoning
District.
.c. Parks. The Developer shall dedicate to the City Outlot F ~
(18.1 acres), Outlot G (9.8 acres), outlot H (3.9 acres), and Outlot E.
A credit of 6.7 acres for park dedication will be given for Outlot E.
Unless otherwise required by the City, conveyances of the park land
shall be made when the final plat, wherein a park is located, is signed
by the City. The land shall be platted as Outlots and transferred to the
City by warranty deed. The Developer, at its sole cost, shall grade the
land for the City in accordance with a timetable and plans to be
furnished by the city. The Developer shall be qiven a credit of sot of
the park fee per dwelling unit in the plat for the conveyance of the
above described land to the city. The balance of the park dedication
fees shall be paid in cash in an amount and at the time required by city
ordinance and policies in effect when final plats are approved.

s. !'rail and Sidewalk Development. The Developer shall
dedicate trails and sidewalks throughout the Development to the City as
indicated on the Comprehensive Trail Plan. This dedication satisfies the
City's trail dedication fee requirements. Trails shall be completed at
the time street improvements are constructed in the phase where the
trails and sidewalks or portions thereof are located. The Developer
shall construct the following trails and sidewalks:
(1). Eight (8) foot wide bituminous trail along the west
side of Lake Susan.
(2). Eight (8) foot wide bituminous off-street trail along
the east side of Audobon Road: and an eight (8) foot
wide bituminous off-street trail along the east side
of Powers Boulevard.
(3). Five (5) foot wide concrete off-street trail-sidewalk
along one side of all internal streets except cul-
de-sacs when the streets are constructed.
Twenty (20) foot wide bituminous off-street trail
easement on the west side of Powers Boulevard. This
trail segment shall only be constructed if ordered by
the City Council. If ordered, the Developer will
convey the easement to the City without cost, but the
City will pay for the construction. Construction
timing will be at the discretion of the City Council.
6. Additional Condition. of Approval.
(4) .
A. The Developer shall provide buffer areas, acceptable to
the City, between multiple family and single family areas to assure
adequate transition between uses, including use of berms, landscaping,
and setbacks from lot lines.
B. The Developer shall not damage or remove any trees
except as indicated on the grading and tree removal plans to be approved
by the City and submitted with each plat. Trees shall be protected from
destruction by snow fences, flagging, staking, or other similar means
. during grading and construction.

C. Wetlands Nos. 14-10 and 23-01 as shown in Exhibit -G-

shall be preserved in their natural state.
D. The following shall be the maximum percentage of
allowable impervious surface: outlot A 32%, outlot B 30%, outlot C 31%,
and Outlot D 27%.
E. The Developer shall provide $500.00 of landscaping per
multiple family unit and $150.00 per single family unit.
7. 8ffect of Planne4 Unit Development Approval. For five (5)
years from the date of this Agreement, no amendments to the City'S
Comprehensive Plan, or official controls shall apply to or affect the
use, development, density, lot size, lot layout, or dedications of the
development unless required by state or federal law or agreed to in
writing by the City and the Developer. Thereafter, notwithstanding
anything in this Agreement to the contrary, to the full extent permitte~
by state law, the City may require compliance with any amendments to the
City's Comprehensive Plan, official controls, platting or dedicating
requirements enacted after the date of this Agreement.
8. Pha.e4 Development. The Developer shall develop the
development in eleven (11) phases in accordance with the EAW. No earth
moving or other development shall be done in any phase prior to approval
of final plats and development contract for the phase by the city.
t. Compliance with La.. an4 .egulation.. The Developer
represents to the City that the proposed development complies with all
applicable City, County, Metropolitan, State, and Federal laws and
regulations, including but not limited to: Subdivision Ordinances,
Zoning Ordinances, and Environmental Regulations. The Developer agrees
to comply with such laws and regulations.

10. Variations from Approved Plans. Minor variances from the
approved plans may be approved by the City's Planning Director.
Substantial departures from the approved plans shall require an amend-
ment to the Planned Unit Development, in accordance with the Chanhassen
Zoning Ordinance.
11. License. The Developer hereby grants the City, its agents,
employees, and officers a license to enter the plat to inspect the work
to be done by the Developer and to perform all work required hereunder
if Developer fails to perform in accordance herewith.
12. utility, Pond, and Drainage Bas..ents. The Developer shall
dedicate to the City at the time of final plat approvals utility,
drainage, and ponding easements located within the plat, including
access, as required to serve the plat.
13. R.8ponsi~ility for Costa.
A. The Developer shall hold the City, its officers,
agents, and employees harmless from claims by the Developer and third
parties, including, but not limited to, lot purchasers, other property
owners, contractors, subcontractors, and materialmen, for damages
sustained, costs incurred, or injuries resulting from approval of the
Agreement, the development, final plats, plans and specifications, and
from the resulting construction and development. The Developer ahall
indemnify the City, its officers, agents, and employees for all costs,
damages, or expenses, including reasonable engineering and attorney's
fees, which the City may payor incur in consequence of auch claims.
B. The Developer shall reimburse the City for costs
incurred in the enforcement of this Agreement, including reasonable
. engineering and attorney's fees. The Developer shall pay in full all

bills submitted to it by the City for such reimbursements within sixty ~J
(60) days after receipt. If the bills are not paid on time, the City may
halt all development work until the bills are paid in full. Bills nqt
paid within sixty (60) days shall be subject to an eight (8%) percent
per annum interest charge.
14. Xiacelleneoua.
A. Breach of any JIlaterial term of this Agreement by the
Developer shall be grounds for denial of building permits, plats, ~nd
- certificates of occupancy.

D. This Agreement shall run with the land and JIlay be
recorded in the Carver County Recorder'. Office.
E. This Agreement shall be liberally construed to protect
the public's interest.

F. Due to the preliminary nature of many of the exhibits
and plans and the timing of the overall Development, addendums to this
Agreement may be required to" address concerns not specifically set forth
herein.
G. This Agreement shall be binding upon the parties, their
heirs, successors or assigns, as the case may be.
B. The Developer represents to the City that the plat is
not of .metropolitan significance. and that a state environmental impact
statement is not required. However, if the City or another qovernmental
entity or agency determines that a federal or state impact statement or
any other review, permit, or approval is required, the Developer shall
prepare or obtain it at its own expense. The Developer shall reimburse
the City for all expenses, including staff time and reasonable
attorney's fees, that the City may incur in assisting in preparation.
15. Notices. Required notices to the Developer shall be in
writing and shall be either hand delivered to the Developer, their
employees or agents, or mailed to the Developer by certified or
registered mail at the following address: 7600 Parklawn Avenue, Edina,
Minnesota 55435. Notices to the City shall be in writinq and shall be
either hand delivered to the City Clerk or mailed to the City by
certified or registered mail in care of the City Clerk at the following

SUBJ:
Staff was directed to place this item on to this agenda to discuss
funding and implementation. This item is scheduled for discussion
on Wednesday evening with the City Council. Staff felt that a
joint discussion may be beneficial to the Commission, perhaps
gaining direction as we proceed with outlining planning options.

.
The Park and Recreation Commission recently reviewed the proposed
site plan for the 11.5 acre Carrico property. The Commission heard
from a number of the residents in the area that this property
should not be subdivided, but should be purchased for park
purposes. The Commission indicated that they would like to
purchase the property, but unless the owner was willing to sell for
a reasonable price, such would not be possible. Staff was directed
to work with the property owner or adjacent landowners to acquire
additional property suitable for active park purposes.
Staff contacted Dave Hughes, the property owner to the west of the
Carrico property. He indicated he was willing to sell, however,
his asking price for the 4f acres was $300,000.
It was then discovered that Carl Carrico was not the current owner
of the 11.5 acre parcel. Franklin State Bank had foreclosed on the
property and since had sold it to Paul Hufnagle. Staff contacted
Mr. Hufnagle who was willing to sell the property to the city as
soon as Mr. .Carrico's option ran out.
The City Council acted to authorize staff to enter into an option
agreement with Mr. Hufnagle. Such legally obligates Mr. Hufnagle
to sell to the City at the agreed upon price of $145,000. This
agreement was executed on Wednesday. This option allows the City
the time to hold public hearings so as to ensure that the residents
want this property to be acquired for park purposes. A public
hearing is tentatively scheduled for some time in June.
Incidently, as the purchase price of the property is $145,000 and
only $100,000 is budgeted, the terms of the agreement include
paying $10,000 down, $85,000 at closing and installments over the
next five years. Therefore, no budget adjustments are necessary
for the 1990 budget.

Stocking of Fish in Chanhassen Lakes
Per a request by Commissioner Jim Mady, I have inquired about the
frequency that lakes are stocked in Chanhassen. The following
descriptions explain the information gained from a recent
conversation with Regional Fisheries Manager Duane Shodeen.
.
Lake Minnewashta: wi th the abundant natural reproduction of
northern pike and the high numbers of northern pike found in Lake
Minnewashta, a stocking program would be frui tless. Stocked
fingerling walleyes or muskies would simply become forage for the
northerns.
Any stocking or work on management plans for the lakes in the
Riley-Purgatory Watershed (Lakes Lucy, Ann, Susan, Rice Marsh and
Riley) had been put on hold pending the outcome of the proposed
clean up effort. wi th that proj ect "dead in the water", the DNR is
going ahead with work on the fish barriers portion of the clean up.
This will allow them to continue working towards better fisheries
in this watershed.
Lake Lucy: There is no public access to Lake Lucy. An access and
aeration system would be necessary for a fish management plan to be
initiated.
.
Lake Ann: No stocking has occurred since installation of the
public access. Upon review of the next test netting, the stocking
of walleyes may occur.
Lake Susan: Upon completion of the public access, the DNR will
form a management plan for Lake Susan. The installation of an
aeration system by the City or through a CORE grant would be the
first step in this plan. Lake Susan tends to have heavy winterkill
every 3 to 5 years.

Rice Marsh Lake: The name says it all - this lake is more of a
marsh and is not suited for stocking.
Lake Riley: Lake Riley is the last lake in the chain and stocking
of walleyes and northerns has occurred in the past. Natural
populations of both these species are present in good numbers
however. Test netting did occur this winter and will allow the DNR
to assess Lake Riley's fish population.
Lotus Lake: Designated as a good candidate for stocking of
walleyes. Walleye fingerling were stocked in 1986 and 3,300 more
were introduced in 1989. Lotus Lake will continue to be stocked
with walleyes every two to three years.
Christmas Lake: Designated as one of eight lakes in the
metropolitan area for trout stocking. Excess rainbow trout brood
stock are released in Christmas Lake every year. These fish can
weigh as much as eight pounds. The numbers introduced each year
vary from 200 to 800.
Lake st. Joe: Managed as a naturally reproducing lake.

CLEANSER
(porcelain cleaners) Dip damp cloth in baking soda and rub over stains. You
can also make a paste with water and apply it to especially
stained surfaces. Allow it to set before rubbing clean
and rinsing.
Pour vinegar and salt over copper and rub.

DRAIN OPENER
Prevent clogging by using a drain strainer.! Use plunger
or mechanical snake.! Pour ~ cup borax into the drain
followed by 2 cups of boiling water./ Flush drain weekly
with boiling water for prevention.
FlEA AND TICK REPELLENT
Feed brewer's yeast to pets, vita~in B and garlic tablets.1
Herbs such as fennel, rue and rose~ary repel fleas.!
Place eucalyptus seeds and leaves around the area where
the animal sleeps.
Use a small amount of mayonnaise and a soft cloth.!
Mix 3 parts olive oil and one part vinegar and use soft
cloth.! Mix one part lemon juice with 2 parts olive
oil and use a"soft cloth.

Mix baking soda with a small amoun: of water.! Mix 3
TBSP of wa~hing soda with one quart of warm water.
Blend 6 cloves crushed garlic. one minced onion. one
TBSP pure soap in 4 liters of hot water. Le~ sft 1-2
days. Strain before using.! Place one cigarette in
1 liter of water overnight. Strain and spray.
Use washing soda or soap in place of- detergent.! Make
I paste of washing soda and water for dirty spots.

LINOLEUM FLOOR
CLEANER/WAX
Mop with 1 cup white vinegar mixed with 2 gallons of
water to remove dull. greasy film.! P?lish with club .-
soda.! Adding sour milk or skim milk :0 rinse water
will shine the floor without polishins.
MOSQUITO REPELLENT Drink brewer's yeast or take in tablet form on a daily
basis during tne summer months. Make sure you are no:
allergic to brewer's yeast before taking it.
MOTHBALLS Flace cedar chiDS around,clothes.! Dried lavendar
can be made into sachets and placed in drawers and closets.
OVEN CLEAHER_ Sprinkle salt on spills when they are warm and scrub.!
Mix 3 TBSP washing soda with one Quart warm water./ Use
oven liners(trays) to catch spills.! Rub gently with
steel wool.
ROACHES Set out a dish of equal parts baking soda and powdered
sugar./ Set out a dish of equal parts oatmeal flour
and plaster of paris.! Put some grease or Ylseline on
the inside of a jar that contains a banana. Set a tongue
aeDressor near the jar to serve as a ramp. The cockroaches
will be trapped inside the jar.! Place bay leaves around
the cracks in the room.
SNAIL AND SLUG KILLER
Fill a shallow pan w1th stale beer and place in the .
infested area.l Overturn clay pots and the snails will
seek shelter in them from the heat. The snails can then
be collected.! Lay boards between the rows of planted
vegetables. The snails often attach themselves to the
boards.
UPHOLSTERY CLEANER Clean stains immediately with club soda. Will remove
spots on rugs and upholstery.
WINDOW CLEANER
Mix ~ cup white vinegar with one gallon warm water.!
Use newspapers to dry the glass.! Use straight lemon
juice and dry with a soft cloth.
WOOD FLOOR WAX/CLEANER
Mix half oil and vinegar solution. Apply in a thin coat
and rub in well.! Painted wooden floors can be washed
with 1 TSP washing soda and 1 gallon hot water. Rinse
with clear water.
