Trail Segment Connecting Saddlebrook and Butte Court
to Meadow Green Park
In July of 1990, a petition from residents of Saddlebrook was
received requesting the trail linking Saddlebrook and adjacent
neighborhoods with Meadow Green Park be completed (see attached
document) . This petition was presented to the Mayor and City
Council at the July 23, 1990 City Council meeting. The Council
briefly discussed this item and referred it to the Park and
Recreation commission for further investigation. The minutes of
that meeting are attached.
As illustrated on the map, the trail connects Butte Court and
Saddlebrook Pass with Meadow Green Park. I visited this area on
the evening of August ~3, 1990 and was able to talk with residents
in two of the households directly adjacent to the trail. The
resident whose lot is shown as No. 16 on Butte Court was not
opposed to the trail being constructed,1;:lut indicated concern for
children playing in the area due to the close proximity of" the
holding pond. The resident at Lot 27.cm~utte Court was not home
at the time. The resident whose < lot ... is shown as No. 1 on
Saddlebrook Pass (westot .t.he trail easement.) was... whole-heartedly
in favor of trail construction. She indicated the persons who live
on the east side of the trail easement would alsp.approve of the
trail being installed.
In addressing the actual construction process for this proposed
trail, I have reviewed this item with Dale Gregory, Park Foreman.
Upon receiving approval to construct this trail, Park Maintenance
would perform the necessary light grading, install an aggregate
base and asphalt the trail in conjunction with other asphalt
projects in the City. The cost of materials would be paid out of
trail dedication funds of which $30,038 has been collected through
July, 1990.

In considering the interests of the residents who support this
trail segment and with no apparent opposition to the trail, it is
the recommendation of staff to pursue completion of this
project.

Council.an Boyt: Okay. Are you proposing we wait until 7(a)?
Councilman Johnson: Right. It's fairly quick stuff inbetween hopefully.
Hayor ChMiel: I know what you're saying. I sat on the lake a week ago last
Sunday and just coincidentally the Sheriff's patrol came over to our boat and
checked for life preservers, fire extinquisher. Everything.
Councilwoman ~ialer: Is this Lake Lucy?
Hayor Chmiel: Pardon?
Councilwoman Oimler: On Lake lucy? On your lake, Lake Lucy?
Hayor Chmiel: Oh no. On Lotus. I did that specifically. And I did watch the
action on that lake. There were a lot of skiers that had been going. There
weren't any Jet Skis on it that particular day but just as we were leaving,
there was a Jet Ski coming on so I'm aware of some of it and of course previous,
last year in going down and requesting a few of the people that were using Jet
Skis to be in conformance with what our ordinances basically are and they
weren't aware. And I think as I'm mentioned, they were from Excelsior and
Hinnetonka so they had no idea as to what it is and what it consistented of. SO
I would suggest then as mentioned already, that we hold off on this until item
7.

B. PETITION FOR COMPLETION OF BIKE PATH BETWEEN SADDlEBROOK AND ~ADOW GREEN
PARK.
Colleen Murphy: My name is Colleen Murphy. I live at 910 Saddlebrook Pass.
When my husband and I bought our house 2 years ago we were told that a bike path
would be going in that would link our neighborhood with Meadow Green Park. I
and many of our neighbors looked forward to that because there was no paved
access to get to the park. No way for kids on bikes or mothers pushing
strollers to get to the park and that's why I brought forth a petition with 44
signatures asking that we can move this forward. That's all I have to say.
Hayor Ch.iel: Okay, thank you. Any questions?
Councilman Johnson: Does anybody know the status of this path?
Hayor Chmiel: Yeah, I don't.

Council.an Johnson: This particular subdivision went in just after Bill and I
had finished a fight to get paths put to a city park frol a neighborhood where
the developer wanted to not put the paths in. That'was before we were on the
Council and now that we're here, we've been pretty diligent to let people have
access to their parks.
Councilaan Workman: Where specifically does this trail run because I know Gary,
he's still not here now. Where's Gary?
Council.an Johnson: He's good at slipping out at the right time.
Council.an Work.an: We've got the whole aap here and I iaagined it off of.
Council.an Johnson: I think it's where Trotter's Circle comes into Saddlebrook
Pass going out to Outlot A?
Councilaan Work.an: Okay, there it is. I noticed in the Adminstrative Pack
that we just got done paying for sidewalk construction in there in the aaount of
about $20,000.00. Wasn't this supposed to be a part of that whole thing?

Don Ashworth: That was for the sidewalks along the streets. A decision was
aade initially that the developer was to build those and later that came back as
a petition for concrete and then there were cost differentials and it literally
has taken the 2 year period of ti.e for billing that out. The trail as it would
go frol the neighborhood back over to the park area, I left a call in to both
Mark Koegler and to Rick Murray. I'. sorry, I don't have an answer regarding
that particular piece. They did not return .y calls.
Councilman Work.an: Is this something that we should be referring to the Park
and Rec to find where they're going to co.e up with the aoney to do so?
Don Ashworth: Right.
"ayor Chaiel: Yeah, I agree.
Councilman Boyl: Well when this went in, the reason it went from bituminous to
concrete was the price difference was almost nothing at that particular time.
This was a sidewalk/trail system that was to be put in as part of the
develop.ent contract. As I recall there's so many lots in there, I think that
the trail assessment on these lots aade it a wash to the City. This is we're
talking SOMething was done ~ years ago so I'm a little sketchy on all the
details but this is the development where we learned a little bit about the
timing~f when you put sidewalks in. In teras of driveways and people aoving
Into their houses. Certainly it makes sense to have Park and Rec confirm all
that but I'm pretty sure that all of this is in the development contract and I
won't say aore. I'll just get In trouble.

We have built a fair chunk of expensive trail.

Mayor Chmiel: I think that's what should be done. Refer this back to Park and
Rec and have them come up with soae kind of an answer. See where the dollar
allocation is or where it's gone or where it's at. Thank you.
C. PUBLIC SAFETY COt1HISSION, PUBLIC SAFETY DIRECTOR'S RESIGNATION.
Bill Bernhjelm: Hy nale is Bill Bernhjela. I live at 9380 Kiowa Trail and I'.
the Chairman of the Public Safety Co.mission. I want to make sure that
everybody knows that aany of the other Public Safety Commissioners are here.
Craig Blechta, Barb Klick, Dave Dummer and also some of the departaent
employees. At our last aeeting on the 12th we discussed so.e issues that had
occurred. Obviously the resignation of Ji. Chaffee as Public Safety Director
has occurred and a public notice of that in the media and we expressed a concern
that we had not been foraally advised of the resignation and felt that perhaps
some things were not being properly attended to. We drafted a letter to Hr.
Ashworth and sent copies to the Council. I'a assuming that you all have seen
them. I won't go into the exact wording of the letter. I won't read the
letter. Our concerns primarily are, is the Public Safety Co..ission being
ignored? Is this resource that we have in the community being properly
utilized? Tonight I understand we'll be getting an issue that needs some
attention and that's one of the few that has come back to us fro. Council and
I'. glad to see that. A major concern again is rumoring and that kind of thing
that takes place when a position opens. Is the position going to be refilled?
Who's going to fill it? Those kinds of things. I don't want to get into the ~~.)
personnel issues here. That's clearly the perview of Mr. Ashworth and you ..,
folks. However, what we're looking for is to make sure that we have some
continuity here before Ji. does leave. He's leaving the State. Going to
California. I think we need to see some strong leadership in the depart.ent.
It's grown to a department of 12 full time employees at this point. Public
Safety we feel is very important in the coa.unity at this juncture especially tn
the developing years. We think that the basis and the foundation for a good
public safety department has been created and we'd like to see that continue.
Primarily again, we understand that there are some concerns amongst employees
about communication issues. Are they being ignored? Again, these people are
dealing with the public on a daily basis and they talk to .probably 20 tiles the
number of folks that you do as Council people and I'm sure they have a lot of
insight on what's really going on in the nuts and bolts of this operation and we
feel again that they should be listened to. At least given an opportunity to
speak about changes that may be on the offing. We again want to offer our
services. We have people with military background. We have people with fire
background. We have police background. Hedical services background. ~e feel
we were appointed because of our varied backgrounds and we want to be able to
contribute to the community in the way that we are best qualified. We want to
be involved. If there is going to be reorganization or some changes going on,
we want to be involved in that and pro.ote some open discussion about what's
going on and what the future of Chanhassen's Public Safety is going. That's
all I have.
Mayor Chmiel: Okay Bill. Thank you. I think at least from my standpoint, I
don't feel that we're trying to ignore anybody. In fact, I would suggest that ~

we probably sit down at sOle ti.e as we've done before, with the Council, with
the Public Safety Co.mission and at least understand ~here we're coming fro,
with what we're looking at right now. The replace.ent for Jil is already in the
.ove right now. Whether that particular position's going to be replaced, that's
sotething we have to review and scrutinize that a little bit too. And so I
guess that's probably ~here I'. really coming from. Hopefully the co..unication
problem should be luch better between staff to the e.ployees and understanding
what their concerns are as well and I think that's already being addressed as
well. So hopefully we can take care of .uch of those ite.s.

resignation. The interim period I have talked with Scott Karr. He has been
offered the interi. director position. He is currently deciding as to whether
or not he wishes to accept that.

street Vacation of Old Lake Lucy Road
At the July 23, 1990 City Council meeting, the street vacation of
a portion of Lake Lucy Road within Lot 6, Whitetail Ridge was
approved with two conditions. One of those conditions was the
provision of any trail easement ,.' as requested by the Park and
Recreation Commission.

A number of documents are attached to assist the Commission in
reviewing this item. They include a diagram of the area in
question, a copy of the Senior Planner's report to the City Manager
dated July 9, 1990, and a letter received from five households
(indicated by "x") on White Dove Drive.
The decision at hand is to determine if a trail easement should be
retained in Lot 6, Whitetail Ridge Court and ultimately along the
entire length of old Lake Lucy Road. At 'this time, plans to pursue
development of such trail are not being considered. However, with
the development of this area not yet complete and with the new
neighborhood park being located. just to the east, it would not be
in the best interest of all residents to abandon this opportunity
to retain an easement
It is therefore the recommendation of staff to,. require a 20 ft.
permanent trail easement. within that portion .of Lake Lucy Road
being vacated. Further, it would be the recommendation of staff to
pursue continuation of this trail ,easement along Lake Lucy Road at
such time when it is being considered for vacation.

On May 18, 1987, the City Council approved the final plat for
Whitetail Ridge (Attachment #1). As part of the plat approval, a
portion of Lot 6 was within the Lake Lucy Road right-of-way. Lake
Lucy Road was real igned to the south as part of Lake Lucy Highlands
subdivision and was intended to be vacated where it previously
existed adjacent 'to Whitetail Ridge and Pheasant Hill.
The applicant is requesting vacation of the portion of Lake Lucy
Road that is a part of Lot 6 Whitetail Ridge. It is no longer
necessary to maintain this area as a public street right-of-way
since Lake Lucy has been realigned to the south. The Engineering
Department is requesting a 20 ft. permanent utility easement to go
over a sanitary sewer line as shown in Attachment t2. In addition,
the Park and Recreation Department is reviewing whether or not a
trail easement should be maintained within the right-of-way for
future trail development. Sta,ff has not yet received comments back
from the Park Department or Park and Recreation Commission.
Approval of the vacation would be conditioned upon final review by
the Park and Recreation Commission.
RECOMMENDATION
The proposed vacation is consistent with what reviewed at time
of the Whitetail Ridge subdivision. As long as the proper
drainage, utility and trail easements are retained, staff has no
objectJon to vacating the remaining portion of Lake Lucy Road as
part of Lot 6, Whitetail Ridge. Staff recommends that the City
Council adopt the following motion:
"The City .Council recommends approval of Vacation No. 89-10
for that portion of Lake Lucy Road within Lot 6, Whitetail
Ridge with~the following conditions:

Jeremy Jenson: It will be built strong enough for bicycle traffic to go
across.
Mayor Hamil ton: I'm not concerned about them going across. I don't want them
going across. They should be deterred fran going across there I would think.
Bicycles shouldn't be allowed on that path. .......
Mike Lynch: You've got a steep hill which is the only south access to that
bridge where Steve is putting in his steps in now and that will be an
extremely difficult access for a bicycle. A real determined bicycler could
get through there but not normal.
Mayor Hamil ton: }t)w about in the wintertime? 00 you see any problem in the
winterttme with any type of all terrain vehicle or snowmobile or sanething?
Mike Lynch: Not that we wouldn't have otherwise. In the winter there was a
snowmobile aoo all terrain that could use. the bridge, or use the lake or they
could drive through the stream bed but it certainly improve access for them
though.

Councilman Geving: Just a quick comment. I think we're into about the third
or fourth year of the sealcoating project arXi as I look at what we are e
attempting to do this particular year, I refer you to page 1 of 2 in the very
back of the sealcoating spec aoo bid proposal. I see now we're working on the
north end of Chanhassen and I would like to make a proposed change to the ;
specs to a&i the area of LyOOon just to the north. The whole area there w,here
we have Lymon Circle, Kirkwood CirCle, Joslin Circle and the reason I'm
asking that we a&i it, it would complete that one whole area of the north eoo
of Chanhassen all in one shot. That's quite a large area but I think rather
than cane back aoo pick it up next year or the year after, we can a&i it to
our specs and I wanted to ask Gary if we were ei ther to add it to the specs or
to trade off that Pipewood CUrve area across 'Ill 7, what are your thoughts on
that Gary?
Gary Warren: I asked the street superintendent to give me a list of streets
here and I'm not personally familiar with the coooition of the streets in the
Lymon Circle area. '
Mayor Hamilton: They're good.
Councilman Geving: '1hey're about the same age as all the rest of them.
Probably newer. In fact they are very new. They're within five years.
Gary Warren: I would think that we're not adding that much footage to it. I
can look at that. .

SUBJ: Final Plat Whitetail Ridge
The Whitetail Ridge Subdivision was approved by the Planning
Commission on February 11, 1987 and by the City Council on March
2, 1987. A condition of approval was that a drainage easement
be provided over Lot 6 to accommodate overland flow from
Waldrip's pond. The drainage easement has not yet been provided
and must be submitted as part of the final plat approval. The
applicant must also submit the required financial securities and
enter into a development contract with the city.
The applicanc has indicated that the easterly lot line of Lot 5
shall be shifted 4 feet to the east to accommodate a house pad.
The lot line adjustment will not impact the lot area and staff
approves of the adjustment. A revised final plat must be sub-
mitted. A portion of Lot 6 is within the Lake Lucy Road right-of-
way. Removal of this portion of Lake Lucy Road was approved by the
city during preliminary plat review and will be formally vacated
by the city in the near future.
RECOMMENDATION
Staff recommends approval of Whitetail Ridge final plat dated May
7, 1987, with the following conditions:
1. Submi t tal of drainage easement over Lot 6.
2. Submittal of financial securities and approved development
contract.
3. Submittal of a revised final plat.

From review of existing utilities in the vicinity of the area in
question, it was found that a sanitary sewer line extends through
a portion of the area for proposed vacation (see attachment). It
is my recommendation that, if the proposed vacation is approved,
a 20 foot wide permanent utility easement be designated for the
portion of sewer line extending through the vacation area.

Dear Council Members:
My request to vacate Old Lake Lucy Road between Whitetail
Ridge and Wood Duck Lane is based upon prior understandings with
your staff. '
Back in 1986 and 1987 ! \o1orked with Bill Munk, city engineer
and Barb Dacey, city planner regarding the future plans to
reroute Lake Lucy Road to the southwest. It was determined at
that time that old Lake Lucy Road would no longer be needed. The
understanding was that the city would move to vacate this portion
to bring this unused land back onto the tax rolls. My numerous 41
calls to staff to begin the prr:ceedings has brought little ac-
tion. I know the rapid growth of Chanhassen has severely taxed
the staffs ability to handle tbese less pressing concerns. The
loss of taxes over t~e past ~earsis most likely in $l,OOO.OO's
of dollars. At this time I feel it is my civic duty to start the
process. With that in mind, ! respectfully request similar cost
reimbursement once the action to vacate the balance of Old Lake
Lucy Road is commenced by the city. It would make sense that the
list of certified names I have paid for would he usable for your
purposes also. From m~' discussions with the neighbors abutting
this portion of road they will take no action. At this time they
feel it perfectly acceptable to use this land, changing and .im-
~roving it without paying for it. .
This seems quite unfair considering the city's need to
balance increased costs. Plus the constant need to provide parks
for these new neighborhoods will cause even greater financial
needs in the future. AcqUiring the park to the SE of Pheasant
Hills would be a great compliment to the area. .

PUBLIC HEARING: STREET YACATION REQUEST TO YACATE AN UNUSED PORTION OF OlD lAKE

,Hayor Chmiel: I'll open this public hearing. This is for a street vacation
request to vacate an unused portion of old Lake Lucy Road between Whitetail
Ridge and Wood Duck Lane. Paul?
Paul Krauss: Hr. Hayor, we received a petition fro. the owner of Lot' to
vacate a small portion of old Lake Lucy Road right-of-way. It's now called
Whitetail Ridge Court. The old Lake Lucy Road right-of-way of course has been
surplanted by new lake Lucy Road which runs to the south. We no longer need
that area for roadway purposes. Therefore we are recollending that the vacation
be appr~ved. We are however recollending that an easelent for utilities .~ich
happen'to be in there, you can see where the sewer line runs, be laintained and
also that the park board reassess whether or not that a trail ease.ent is needed
in there and pending the outcome of that. that a trail easelent be required if
they do reco..end such. With that we are reco..ending that the vacation be
approved.

Mayor Ch.iel: Okay, thank you. Is there anyone wishing to address this
specific item?

Paul Palmer: I a. Paul Palmer, 1930 Whitetail Ridge Court in Excelsior, 55331.
I am the developer of all of Whitetail Ridge and this is the final lot to be
sold at the end of the cul-de-sac. It really has no further need as a road and
I think all the neighbors to the east of me would be joyous in hearing that
there isn't going to be a road in their backyards. 8ecause the vacation hasn't
been completed through the entire stretch of lake lucy Road, which is part of
what engineering and staff and everyone anticipated doing as a part of new
lake lucy Road redevelopment. As a part of that, the City had planned to vacate
this portion and com.ence the process. Through repeated telephone calls and
contacts, we were not able to convince the City to of course .ove ahead with
this when your time requirements and your budgets and your staff needs are
always pressing and of course then you have people resign and 90 on to other
things or whatever they do. Which only puts more strain on the entire process.
As a concerned citizen for Chanhassen I feel it is my duty to bring this
. vacation to head because as you know, the rest of the property sits out there
producing no revenue for the very city that we need to support. So as a good
citizens, the City should from a business standpoint, vacate the rest of that
portion and put it back on the tax rolls where it can pay for itself. In the
process we are able to generate revenue for the park system which is badly
needed in that quadrant up there. The only question that I have for Council is
whether or not you feel that the trail system should become a part of this
overall plan because I would reco..end it on the south portion of the old
Lake Lucy Road. That portion only adds additional land.to really unuseable
portions of their lots so these people on a tax basis become burdened by this. ~
So if we put the trail on the south side, we could tie that trail right into the ..,
park that I think is still in the works to the east of us. Then all of the area
to the west can funnel down Galpin and down Lake Lucy Road and to the park and
all the school kids and everything else can have a path in which to stay off of
the county roads which just keeps our traffic accidents in hand. So with that,
I'. open to questions.

started out asking for.

Dear Jo Ann:
The purpose of this letter is to immediately voice our concern for an issue
regarding the property on the southside of our homes (the old Lake Lucy
Road). Our understanding is that Paul Palmer has proposed that a "trail"
be built connecting his development and the Pheasant Hill development.
.
The issues are as follows:
1. We bought these particular lots during the p~st few years, becaus~ we
wanted privacy in our back yards. Those of us who purchased lots durIng
1987 checked with the city at the time of lot purchase to confirm that the
road would in fact be removed, and we were told that the land would
eventually be conveyed over to the home owners whose land is adjacent to
it. Our developers also confirmed their understanding of this idea. Some
of us were also told that because the property to the south of our lots was
"DNR Designated Wetlands"; that 50X of the road would be added to this
special area. This was the most critical issue for most of us regarding
our lot purchases. We did not want homes, a road, or a trail immediately
behind our homes...~e wanted and therefore purchased simple, natural and
private lots. ~
2. This "trail" is not included in the proposed Chanhassen Trail
system, and if it was to be, it should have been brought up at the time
that our lots were purchased.
3. The information letter regarding this topic of discussion was
inadequate with regard to: not enough notice (some of us received the
letter for the Monday, July 23, meeting after Friday July 20, and were out
of town until after the Monday meeting). For some of us, that is the only
letter received referencing this issue; some received NO letter regarding
the meeting that was held last week. And some of us read the public notice
in the Saturday, July 21 issue of the Villager, '(again after the fact.)
Equally important, there was absolutely NO mention of a "trail" system
linking the two neighborhoods. The one letter we received mentioned
"vacating th~ property". We feel that an issue such as this w~rrants clear
and ample notification, particularly during the popular vacation month of
July.
4. It is now our understanding that the reason for this proposal in the
first place, is that Paul Palmer is interested in making a lot at the end
of his development more "saleable". We can understand his concern here,
but certainly not at the expense of deteriorating our properties, and
eliminating our privacy. All of the homes in his private development have
ample privacy, and we are sure that none of them would appreciate a trail
through their backyards. And, if in fact it is for the Palmer children, ~
their house is for sale anyway. ..

5. Furthermore, if the landowner on the southside of our property is not
~.interested in having 50/. of the property conveyed over to them, that is
~lso understandable because it lies on the perimeter of their large lot.
But shouldn't we home owners whose backyards it directly affects have some
consideration as to the available alternatives regarding the outcome of the
property now that the real issues Ca "trail") have been brought to the
table? Perhaps an arrangement could be made for IOO/. of the property to
be conveyed to the home owners with adjacent properties on the north side
instead of just 50/.. '
6. Paul Palmer did approach Aadne Eliassen, with just a light mention of
the issue some time ago; again with no discussion of a "trail system".
Then Palmer continued to the other homes, prefacing the conversation with
something like "according to everyone 'up there' it is o.k.", pointin~ in
the direction of the Eliassen home. Palmer did talk with most, but not all
of the five home owners, and his comments eluded to the fact that we would
not notice any impact. Obviously, nothing could be further from the truth.
We are all very angry, frustrated, and upset for the following reasons:
a. PRIVACY - we appreciate, and enjoy the PRIVACY that we presently
have. This is the primary reason we purchased our lots; instead of lots at
the end of the cul-da-sac.
b. . EXPOSURE - because of the nature of our lots, our homes are very
high, with all three levels exposed. The proposed "trail" is very low, and
we would have NO PRIVACY. Nor would it be possible to construct a privacy
fence, or plant a hedge that would provide any privacy. We would be
aompletely e>:posed to whom ever would be walking, riding, or standing on
~at "trail".
c. SECURITY - would be reduced greatly, because again, anyone could
have access to our backyards, and the back of our homes. Additionally,
those of us with young children'would not feel comfortable with our
children playing in our backyards, knowing that they could be approached by
any stranger on the "trail".
d. MOTORIZED VEHICLES - perhaps would not be legal, however, it would
be very difficult to control.
e. PROPERTY VALUES - would undoubtedly decrease, making our homes
less marketable.
f. COST OF THE "TRAIL" - who would be responsible for the cost of
building and maintaining the "trail"? It would be expensive and difficult
to maintain because most of this low property has running or standing
water~ We certainly are not interested in being responsible for costs
associated with this.
g.DNR DESIGNATED WETLANDS - we are concerned that a "trail" would
disrupt this natural setting, and do not want to negatively affect the
wildlife. Again, this was part of the reason we purchased these particular

In summary, there is a significant decrease in value for we five home
owners that this directly affects. Palmer's development is not a part of
Pheasant Hill, and those home owners have known that since they made their
purchase. They enjoy the same type of privacy that we do not intend to
forfeit. We believe that this entire issue was pushed through the system
by one individual, for the interest of one individual; and it was in a
manner that did not provide the affected property owners with ample notice,
or the correct and complete information necessary to totally understand the
issue, and the ramifications. As a result, our feelings were not known to
the city planning commission and/or City Council, and we 'strongly request
that we five home owners be consulted prior to any final action.
Please contact us, because we are looking forward to determining what our
next ~tep sho~ld be in stopping this "trail".

TRAIL PLAN
e
The 1980 Chanhassen Comprehensive Plan addressed trails in
recognition of increasing pub1 ic interest. The Plan contained
recommendations for implementation of a moderate slstem of regional
trails and local walkways/bike paths. The intent of the system was
to connect major points of interest throughout the City. The map
entitled 1980 Trail Plan depicts this system.
The 1980 Plan contained goals and policies pertaining to
recreation. The f 011 0 win gp 01 i c i e s were directly applicable to
the trail system:
1. Provide a balanced park system which includes
neighborhood parks, community parks, special use
facilities, schools and private developments; all
interconnected by a linear trail network.
2. Abandoned right-of-ways should be preserved for public
use whenever possible.
Since 1980, two events have occurred to further public interest in
the establishment of a trail system. First, Chanhassen has seen
unprecedented growth since 1985. From 1985 through 1989, the City
issued 1694 building permits for residential units. This building
permit activity is indicative of the amount of new residential
development that occurred in recent years and the amount expected
to occur in the future. In reviewing proposed developments, the
need for an overall trail plan linking neighborhoods and parks
became apparent.
The second factor contributing to the heightened awareness of
trails in the City of Chanhassen is the development of trail
systems in adjacent communities. Chaska and Eden Prairie have been
active in developing trail systems. Since many Chanhassen
residents pass through both communities on a regular basis, they
see the trails in place and observe them being used.
The exhibit entitled Eden Prairie and Chaska Trail Connections
identifies locations where the Chaska and Eden Prairie trail
systems intersect the Chanhassen border. Planned trail connections
occur at four locations along Chanhassen's eastern boundary with
Eden Prairie. Additionally, Eden Prairie's plan identifies a trail
segment along Lake Riley Boulevard, approximately one half mile
east of the border.
Along Chanhassen's western border, Chaska's trail system intersects
Chanhassen in three locations. Chaska's trail plan differentiates
between roadway tra i 1 sand greenway tra il s (off-road). Audubon
Road which forms the common boundary between the two communities
is included in Chaska's plan as an identified trail segment.

Increased public awareness of trails has translated directly into ~
increased demand for such facilities by Chanhassen residents. In ..,
April of 1987, the City commissioned a survey to determine resident
interest in park and recreation programs and facilities. Four out
of the top seven most popular activities involved trails. Sixty-
eight percent of the residents indicated that the City has too few
bicycle trails and 64% indicated that the City has too few walking
trails. The responses also indicated that 65% of Chanhassen's
residents think that more funding should be available for the
development of trails.
TRAIL TYPES
Trail networks can accommodate various transportation modes.
Walking, jogging, roller skating, bicycling, cross country skiing,
snowmobiling and horseback riding are frequent uses of trail
systems. For the purposes of this plan, Chanhassen's trails are
categorized into two general classifications: walkways/bikeways
and nature trails.
Walkways/Bikeways: Walkways/bikeways are trail facilities designed
to accommodate both bicycle and/or pedestrian usage. Materials
used for the construction of such trails in Chanhassen vary with
the location and function of the route. For example, trails in
open areas along major roadway corridors should be 8 feet wide and
paved with bituminous surfacing. In areas of heavy activity,
separate trails for pedestrian and bicycle usage may be needed.
In developed areas, trails may be constructed of concrete with a ~
smaller overall width respective of tighter right-of-way conditions ~
and development constraints such as landscaping, mail boxes,
driveways, etc. Depending on location and form, walkways/bikeways
may also accommodate activities such as roller skating in the
summer and cross country skiing in the winter.
Nature Trails: Nature trails are designed solely for pedestrian
usage. They can be used for functional purposes such as trips to
school but in most cases they are designed for purely recreational
usage. In the southern portion of Chanhassen, for example, they
may be used to provide public pedestrian access to areas isolated
by extreme topography, tree cover or other factors. The surfacing
of most nature trails will consist of mowed turf.
In addition to the two major types of trails, special use corridors
may also exist. Special use corridors may accommodate activities
such as snowmobile trails, equestrian trails and trails for
exclusive use of cross country skiers.
This plan does not specifically address special use corridors. At
the present time, the provision of such facilities is not
financially feasible. Of the types of special use corridors
available, snowmobile trails are currently the most popular. The
City of Chanhassen cooperates with private clubs to designate
snowmobile routes which connect to routes in adJacent communities.
Because of the significant amount of vacant and rural land within

Chanhassen, snowmobiling can be accommodated without interference
with urban residential neighborhoods. As the community continues
to grow and additional residential areas are established, suitable
snowmobile trails will be come harder to find. It is realistic to
assume that at some point in the future when the community becomes
largely urban, snowmobiling will be confined to specific park
areas. Until that time occurs, the Park and Recreation Commission
will continue to work with the local snowmobile clubs to establish
appropriate routes.
EXISTING SYSTEM
At the present time, Chanhassen has small
walkway/bikeway trails and nature trails.

Trail: Lake Ann/Greenwood Shores Park
Type: Walkway/Bikeway
Description: This trail which was installed in 1985 connects Lake
Ann Park and Greenwood Shores Park covering a total distance of
2,200 feet. The trail is bituminous surfaced and is 6 feet in
width. In addition to the paved trail, a wood chip walkway
parallels the alignment of the walkway/bikeway. The old wood
chip trail is used primarily by joggers.
Trail: Lake Lucy Road
Type: Walkway/Bikeway
Description: Lake Lucy Road was upgraded in 1987 from County Road
17 to Galpin Boulevard (Co. Rd. 117). As part of the road
improvement project, a 6-foot wide walkway/bikeway was constructed
immediately adjacent to the traffic lanes on both sides of the
street. The traffic lane is separated from the walkway/bikeway by
painted striping. Additionally, signage is used to alert motorists
of the possible presence of pedestrians and bicycles.
Trail: Kerber Boulevard
Type: Walkway/Bikeway
Description: The Kerber Boulevard trail segment extends along the
street from County Road 17 to West 78th Street. The trail consists
of a 6-foot wide bituminous pathway along one side of the street
and a concrete pedestrian walkway along the other side. This
system includes an east/west connecting link to Powers Boulevard
that passes through the Saddlebrook neighborhood.

Type: Walkway/Bikeway
Description: In conjunction with the Lake Drive East street
improvement, a 6-foot wide concrete sidewalkl/trail was installed
along the north side of the street. This trail segment currently
extends from T.H. 101 to Dakota Avenue.
Trail: Carver Beach
Type: Nature Trail
Description: Carver Beach Park contains a wood chip trail
extending the length of the park from the northern to the southern
boundary. The trail which parallels Lotus Lake passes through
steep terrain areas and is suitable only for. pedestrian use.
Trail: Carver Beach Road
Type: Walkway/Bikeway
Description: The Carver Beach Road trail segment consists of a
five foot wide concrete walkway .along the south side of Carver
Beach Road. It serves as an access to the Carver Beach playground
area on the north side of the street.

Trail: Laredo Drive
Type: Walkway/Bikeway
Description: The Laredo Drive trail is a concrete walkway along
the west side of the road. The facility's primary users are
elementary school children walking to and from Chanhassen
Elementary School.
Trail: Fox Chase Trail
Type: Nature Trail
Description: Fox Chase Trail consists of a wood chip pathway
extending from Fox Path to the southern end of the subdivision.
At its .existing terminus, the trail is approximately 200 feet from
the northern termi nus of the Carver Beach Tra il. A 1 though the
trail is presently surfaced with wood chips, the alignment is level
and could easily accommodate a paved walkway/bikeway in the future.
Trail: Chanhassen Pond
Type: Nature Trail
Description: Chanhassen Pond Park contains a wood chip trail which
extends around a portion of the pond area.
PROPOSED SYSTEM
Chanhassen's long range trail system plan is shown on the map
entitled Trail Plan. The system provides trails connecting major
parks, neighborhoods, commercial areas and regional points of
interest. Additionally, it provides trail connections to adjacent
municipalities and to the Minnesota Valley National Wildlife
Refuge.
The long range plan represents an extensive overall system that
will take years to implement. Segments such as the one along TH
101, north of TH 5 will be costly due to limited right-of-way,

difficult terrain and existing developed conditions. Some segments
can be installed more economically either as a part of new
developments or as part of street reconstruction projects.
Regardless of the timing of the construction of the entire system,
it is important to focus on the overall plan since it will provide
the vehicle for the systematic acquisition of required property,
easements and right-of-way for the n~xt 15 to 20 years.
Chanhassen's long range trail plan contains a combination of trail
segments located along streets, within parks and limited use of
trails that are located between private lot lines. Advantages and
disadvantages of each of these types of trails are listed below.

In order to ensure uniformity and safe use of trails by members of
the public, a set of standards has been developed to guide the
development of the trail system. Although the standards may be
impractical in some cases, every effort should be made to see that
new walkway/bikeway trails are constructed in accordance with the
following:

Where possible, walkway/bikeway trails should be separated
from motor vehicle traffic in order to improve safety.
3. Avoid long steep grades; 6.0% maximum slope preferred, 8%
maximum where unavoidable by existing terrain.
4. Use flatter grade or slope at intersection with streets or
other trailway; 2.0% maximum to allow adequate time to stop.
5. For drainage purposes, 1.0% preferred minimum slope; not less
than 0.5% to be used.
6. Use 0.02'/foot minimum cross-slope or crown; 0.04'/foot
maximum.
7. Provide clearance for vertical obstructions (trees, power
poles, signs, etc.); four-foot preferred minimum, two-foot
absolute minimum for bicycle facilities.

manual on Uniform traffic control Devices, latest edition.
12. Minimum standards shall be increased as necessary where
required by poor sub g r a d e soil, traffic volumes, hazardous
conditions, or other special circumstances.
IMPLEMENTATION - SYSTEM PHASING
Chanhassen's long range trail plan is an extensive system. The
eventual implementation of the system is dependent upon priorities
and available funding. Trail segments have been broken down-into
three ge'nera1 phases with the phase one improvements having the
highest priority. In order to rank trail segments, the Park and
Recreation Commission evaluated each segment considering the
following factors:

Phase 1 is shown on the map entitled Phase One Trail System. The
first phase focuses on three primary routes: TH 5, TH 101 (north
of TH 5) and Minnewashta Parkway. The construction of the first
two segments is timed to coincide with highway improvements. The
segment along Minnewashta Parkway from TH 5 to TH 7 was requested
by resident petition in 1988. The Minnewashta Parkway trail is
also linked to the improvement of the roadway.
Trail segments that are identified in either phase II or phase III
are designed to eventually complete the overall system. Phasing
is identified only for the walkway/bikeway trails. The timing of
the construction of the nature trails identified on the plan is
dependent on the availability of the property through which they ~
pass. As properties along the nature trail routes are subdivided
or otherwise become available, the City should acquire the ability
to place trails along the identified corridors.
Funding Sources
The City of Chanhassen has a variety of financial tools available
to fund the construction of a trail system. The following is a
brief comment on each of these sources. Additional information on
funding can be found in the Capital Improvement Program.
Park Improvement Bonds - Municipalities commonly utilize Park
Improvement Bonds for construction of major facilities. The
authority to sell such bonds usually requires voter approval.
Chanhassen passed its first park bond issue the late 1960's when
Lake Ann Park was originally acquired and developed. In recent
years, a referendum was approved to acquire community park property
in the southern portion of the city.
General Fund Money - If trails were determined to be a community
priority, the City Council could allocate an amount of money from
the General Fund for construction purposes.

Outdoor Recreation Grant Program - Trails are still grant-eligible
items under the Outdoor Recreation Grant Program. In order to
enhance the probability of trails being funded, most communities
combine them with other improvements which enhance public access
to lakes.
Park Dedication Fees Park dedication fees collected from
residential, commercial and industrial development can be applied
to the construction of trail systems. In lieu of a cash
contribution, a municipality can negotiate to have the developer
provide the land and install the trails as a part of overall park
credits. Chanhassen has a separate dedication fee for trail
construction which is applied to all new residential, commercial
and industrial development.
Reserve Funds - Reserve funds which have been accumulated from a
variety of sources can be used to construct trail systems.
Tax Increment Financing Chanhassen's downtown area and two
industrial parks are located within tax increment financing (TIF)
districts. Within these areas, trails can be funded through excess
increment should such funds be available.

Street Improvements Street improvement projects have been
responsible for most of Chanhasse~'s existing walkway/bikeway
system. Lake Lucy Road which is the most recent example of a state
aid funded road contains walkways/bikeways within the project.
Trail improvements conducted simultaneously with street
improvements is the most economical method of constructing trails. ~
Intergovernmental Coordination Coordination and cooperation
between various governmental entities can be an effective method
of constructing trails. It is fairly common for cities and school
districts to jointly fund trail systems which benefit both parties.
Capital Cost
The cost of constructing trail segments varies significantly due
to the availabil ity of land,. terrain, tree cover and street
crossings. Because of the complexity of some trail alignments such
as TH 101 north of TH 5, feasibility studies will be needed to
accurately project estimated land acquisition and construction
costs. .
MAINTENANCE COSTS
In implementing a trail system, it is important to consider
maintenance costs in addition to capital costs. Maintenance costs
are the direct result of the level of maintenance desired. Some
maintenance of trails is optional such as winter plowing to
accommodate walking and jogging. Other types of maintenance such
as seal coating and filling are required in order tD protect the
City's investment.

The installation of a trail system will also result in increased
maintenance staff requirements. In addition to maintenance
personnel involved in sweeping, seal coating, plowing, etc.,
inspection personnel may also be necessary. Experience in adjacent
municipal ities has shown that one full time person is required
during the summer months to travel the trail system ~aking minor
repairs and effectuating clean-up efforts.

SUBJECT: Park Requirements - Lake Riley Hills Preliminary Plat
Dated August 6, 1990
BACKGROUND/COMMENT: The proposed Lake Riley Hills residential
development lies ndrthwest of the intersection of Lyman Boulevard
and Lake Riley Boulevard. The property which encompasses a total
of approximately 78 acres extends from Lake Riley Boulevard on the
south to the extensio~ of West 86th Street on the north. The site
borders the Lakeview Hills apartment property on the east and rural
density, single-family detached homes on the west. The subject
site is bisected by the TH 212 right-of-way.
Both the 1980 Comprehensive Plan and the current draft of the plan
update identify the area in and around Lake Riley Hills as a park
deficient area (Zone 2). The plan update states: "In the southeast
corner of this zone, an area exists that is deficient in its access
to neighborhood parks. This area should be served either by the
installation of a future neighborhood park north of Lyman Boulevard
or access to other parks should be provided via a convenient and
safe trail system."
Lake Riley Hills and the land lying east and west of its boundaries
constitutes an area of Chanhassen that is defined primarily by the
surrounding road network. TH 212 establishes the northern
boundary, Lyman Boulevard the south and the proposed realignment
of TH 101 serves as the western boundary. These roadways provide
a substantial barrier, especially for young children, in accessing
parks outside of this immediate zone.
In addition to the 75 lots proposed, other existing park users in
the immediate area include 170 units at the Lakeview Hills complex
and approximately 8 single family homes west of the subject
property. In addition to these existing residences, the Lakeview
Hills site may be able to accommodate as many as 300 additional
units in the future and the single family area has the potential
to be further subdivided creating 40 to 50 additional residential
units. When fully developed, this area could contain as many as
600 dwelling units. The northeast corner of proposed TH 101 and
Lyman Boulevard intersection is presently designated on the

comprehensive plan update as mixed use which could further add to
the total count of residential units in the area.
As the comprehensive plan update states, providing park areas for
Lake Riley Hills can occur either through the establishment of a
new park or by providing access to Bandimere Heights Park. Access
to Bandimere Heights Park via Kiowa Trail is approximately 1.5
miles from the northern lots of the proposed plat. When the
recently purchased- portion of Bandimere Heights Park is eventually
developed, the distance will be reduced to approximately one mile.
If safe movement between Bandimere Park and Lake Riley Hills can
be accommodated, Bandimere Park is an acceptable location for Lake
Riley Hills adult residents to pursue active recreational
activities such as tennis, organized field games, etc. Bandimere
Park is not, however, a suitable location for child-oriented
recreational activities such as casual ball games, use of play
structures, etc. These types of uses need to be provided in closer
proximity to the proposed residential area and particularly, ~
without the need to cross Lyman Boulevard or TH 101. ..,
RECOMMENDATION: Bandimere Park will provide some recreational
opportunities for the residents of the proposed Lake Riley Hills
plat. It will not, however, adequately provide safe recreational
opportunities for children in the area. Therefore, it is
recommended that the plat be revised to identify a 2 - 3 acre
neighborhood park site to accommodate an open field area, play
structure and other park facilities. Ideally, the park should be
located along the north side of Outlot C with the provision for
access to the site from the Lakeview Hills property.
Additionally, it is recommended that a trail easement along Lyman
Boulevard be secured to allow the eventual construction of a trail
to provide access to Bandimere Park.

SUBJECT: Lake SusaD Hills West Park - Outlot D (Formerly F)
In November of 1987, the Park and Recreation Commission reviewed
preliminary "thumbnail" sketches for all of the major park areas
in the Lake Susan Hills West PUD. At that time, a concept plan
for Outlot F was prepared as shown on Exhibit 7. The plan called
for two ball diamonds, tennis courts, a soccer field, parking lot
and a sledding hill. Since 1987 the boundaries of the park have
changed and the drainage system for the adjacent residential area
has been modified. The result is a park that contains limited flat
areas thereby offering limited opportunities for active recreation.
The attached grading plan reflects the existing boundaries and
topographic constraints.
The largest contiguous flat area on the site occurs in the northern
portion of the park. This area contains two drainage ponds, which
under normal circumstances will have a water level of 918.0 feet.
The extreme north end of the park contains an open area which
according to the new plan can accommodate a backstop and open
playfield area.
The central portion of the site contains a small parking lot, a
picnic area and a sliding hill for winter use. The southern end
of the site contains two tennis courts in the location originally
envisioned in the concept plan. All of the facilities within the

The addition to Lake Ann Park is nearing completion. As you know, there were problems
with the weather this spring and summer and it was very difficult to get work started
because of the wet soils.
It was fortunate. however, that the softball fields were seeded early in the spring and that
they have had the summer season to grow. The fields are looking pretty good.
More sod was laid in the park this year primarily to control erosion. The heavy rains were
bad this season and were difficult to control on the site. It was necessary to use sod to stop
the erosion and establish gro'und cover.
A drain pipe was also installed on the west side of the middle ball field to help drain this
area. There was so much rain this season that the steep bank was seeping water and
collecting in the area below the steps. The pipe should solve this problem.
General clean up is happening at the park now and a final review of the job should take
place in the next couple of weeks.

Chanhassen Hills Park, Update
Progress at Chanhassen Hills Park has been significant in the past
few weeks. After the Engineering and Park Maintenance Departments
completed a survey of the property, grading began. All grading has
been completed to date and seeding is underway. The playground
equipment will be installed this raIl and a site to construct a
sand volleyball court has been identified. The grading and ..
installation of aggregate will be completed for the parking lot and -
trail which bisects the park. Asphalt will be installed later this
fall or next year.
Auqust 15. 1990 Update
As finish grading progressed this week at Chanhassen Hills Park, it
became apparent that the facilities shown on the original park plan
could not be accommodated as drawn. There is ample room in the
park to accommodate all amenities shown,\.but the final layout of

SUBJ: Curry Farms Park, Update
Work at Curry Farms Park was hindered this year as a result of
wet weather throughout the f irst.half of summer. The park is
situated in a low area and cont~ins poor draining soils. With
the extended dry period which we have been experiencing, prepara-
tion for seeding has finally begun. Even with the dry weather it
has been necessary to turn the soil allowing it to dry pr ior to
fine grading and seeding. The sand volleyball court was not
installed earlier as the ground could not support the necessary
equipment to complete the job. Plans are to install it in
the next two weeks.

Playground equipment was installed last fall, but access to it
across a weedy dirt field has been less than desirable. To make
the best of this situa.tion, a segment of>the park's trail system
connecting the parking lot and the plaYC'.t.rea wili be installed
when the parking lot is asphalted. Upon\~ompletion of seeding,
the weather will determine the success of/germination and growth.

Amendment of 1990 Park and Trail Dedication Fees and
Establishment of 1991 Fees
This item would normally be reviewed later in the year; however, a
recent challenge of Resolution No. 89-27 which established park and
trail dedication fees effective February 23, 1989, resulted in
passage of a resolution amending fees for commercial and industrial
properties. As such, it is necessary to review the park and trail
dedication fee process at this time. I will briefly, but
specifically, outline the events which led to the fees being
amended. If upon reading this report you have questions, I will
gladly address them.
Two applications for commercial/industrial building permits
demonstrated that a portion of Resolution No. 89-27 was unsound.
Specifically, the "sliding scale" system used to determine fees for
commercial developments whose land costs are higher than
$12,500.00. One permit dealt with a commercial development with
land costs of $147/500 per acre. Resolution 89-27 would require
this applicant to pay a total of $19,667 in park and trail fees.
The other permit application was for an industrial development with
land costs of $30,000 per acre. . Their park and trail fees would
have been $22,500 under the old resolution. 1J'hese fees were
considered exorbitant by the applicants. The City Council and
staff had to reluctantly agree. As a result 1 Resolution No. 90-67
amending the park dedication fee fforcommercial and industrial
properties was adopted on June 25,/1990 (see attached City Council
minutes). What this resolution did was eliminate the sliding scale
portion of the commercial/industrial fees in relation to land
costs, and set all park fees for commercial and industrial
properties at $1200 per acre (see attached copies of both
resolutions). Even though this is the fee which was established in
February of 1989, the method used to reach that figure requires
review.

In January and February of 1989, the Park and Recreation Commission
extensively reviewed the city's park and trail dedication fees. At
that time, it was determined that all park dedication fees for
developments within land costs over $12,500 per acre were to be set
according to a sliding percentage scale. As it has been shown,
land costs cannot in every case be fairly used to determine the
need created for park and recreational facilities by a development.
It is therefore the recommendation of staff to simplify the park
and trail dedication fees using a formula based on 10% of the fair
market value of unimproved land. This method is standard
throughout the metropolitan area and has been proved in determining
equitable fees. A survey of land costs in residential, industrial
and commercial areas of Chanhassen and Chaska showed the following
average land costs of unimproved land.

Note: Commercial and industrial fees are assessed at the
same rate in most ci ties. Even though commercial
property is considerably more expensive, it is difficult
to determine the cost of unimproved land in commercial
areas. It is therefore the recommendation of staff to
continue charging the same fee for commercial and
industrial developments.
Using the 10% figure results in fees of $2500 per acre for
commercial and industrial developments and $480 for residential.

As mUlti-family developments result in more households per acre, it
is more accurate to determine fees using the 1 acre of parkland per
75 people which results in a fee of $440 per unit (see attached
1989 housing unit totals).

12 units/acre x 2.74 persons/unit = 33 persons + 75
people/acre = .44 acres of created need x 12,000/acre = $5,760
+ 12 units = $440 per unit
It is the recommendation of staff to keep the current residential
single family/duplex park dedication fee of $500/unit and raise
commercial, industrial and mUlti-family fees to $2 500/acre and

HaY0r C~miel: Upon reviewing what has been proposed, I see some problems in
thi~ and I'd like to see this sent back to the Park Commission. Don, would you

Qon As~worth: Yes. The City Council did act to amend the fee schedule for
comm~pc5~1/industrial property. Actually the action being considered was for
res5den~i&1 properties and the fee schedule that was established I think
addressed concerns of where you had escalating values in the residential areas.
Ho~~~~r, that same schedule was then applied to commercial/industrial. In
looking at some recent applications, that fee schedule produces a fee which is
totally Exorbinate. It's the position of the City Attorney and myself that that
fee s~hedule was adopted, or let's say the application of that over to
co~nl~rcial and industrial was an erroneous type of an application and should not
have occurred. In other words, it was more of an adminstrative error. Staff is
recc~m~nding that the City Council re-establish the previous $1,200.00 per acre
charge and should the Council wish to further study the charging system for
commercial/industrial to potentially send that back to the Park and Recreation
Commission for further review. Given the number of applications we do have .
though, I would ask that the Council re-establish that $1,200.00 charge at this
point in time.
Councilman Johnson: We would be going back to what we had before we made the
~ther amendment right?
Don Ashworth: That's correct.
Councilman Johnson: And then we can have Park and Rec review it in the interim
and see if it needs to be increased, decreased or anything ~lse. What were your
concerns Don?
Hayor Chmiel: Well basically there's a wide variation in tome of the things
that I had seen in here, the fee for PHT prior to the amendment was
approximately $3,600.00. With the fee after amendment being $16,200.00. If
that fee would have stayed in effect, the park charge for that new retail center
would be roughly $235,000.00.
Councilman Johnson: Right, and we're backing it off to what it was.

just take a look at this to make sure this is exactly the way we want to go.

Councilman Johnson: You'r~ say,ing that even if we back off to the 10% or
$1,200.00 per acre, that you think that's too high? The old one's too high.

concerned.

Mayor Chmiel: Yeah, right. But some of these fees as we're going into the
commercial and industrial areas, as Don had mentioned.

Hayor Chmiel: Eric. I don't know if this is going to be on what we had
discussed in our telephone conversation. I don't know 'if you got my call or
not.
Eric Rivkin: I got it. I couldn't...
Mayor Chmiel: I think what we've done is we have gotten some comments back by
staff. It's been in our Admin packet. I think what Council may want to do is
to review their packet from what staff has indicated and'come up with our own
conclusions and therefore I think that if you have anything in addition to add
to what you've had before, I'd appreciate hearing that now.
Eric ~jvkin: Okay. yeah. This is in addition to it. I want to say that I
appreciate the staff for spending that kind of time on this. It's just that I
jiJst really feel passionate about saving our wetlands and I really appreciate
what time has been devoted to this. I want to separate in studying what the
wetla~ds are like on the lots that border Lake Lucy. It may be aware of
possible improvements that might be done to the wetland ordinance and that's
what J want to propose here. It doesn't have anything to do with any individual
lot:: 2t all. The intent of the ordinance is to protect wetlands reliably
detErmined by technical information, soil data, topographical surveys and
accurate wetland maps and definition of wetlands. The ordinance currently uses
ordinary high water elevation t~ determine setbacks from those wetlands but also
the City as they said in'their response, that these wetlands, the City could go
beyond the ordinary high water in cases to determine the edge of a wetland. Can
the ordinance be improved? Well, maybe it doesn't but maybe we have enough
pTQtection but J'd like to voice some concerns about it. It's commonly known
aniO~9 specialists in hydrology and boilogy that ordinary high water or 100 year
flood elevations don't always define the physical edge of a wetland. Not even
the division between a Class A or a Class B wetland since fringe wetlands
frequently exist above these elevations. For example, if you study the 1989
aErial topo of Lake Lucy around much of the shoreline, you'll ~ee a large
difference on the north, around the island and the west and part of the
southwest shores. The difference between the ordinary high water elevation, 956
and the edge of the wetland vegetation and wet soil areas is approximately 1 to
2 feet higher on the contour but those contours, some of those go up into what
they classify as Class B wetland which is reed canary grass. Even if margin of
error or discount of the true contours, if you study the soil vegetation and
natural drainage in these areas it would show their vital and integral part of
the entire wetland ecosystem. They could have, since wetlands exist above the
ordinary high water and the 100 year flood, an alteration can be permitted to
any of these wetlands areas. They could be anywhere in anyone of our lakes.
The ordinance as it stands now, it's tough. I admit that but it is somewhat
flexible and at the discretion of the Council who happens to be here. Planning
Department happens to be here and surveyors who happen to have different
opinions about where the wetland is or isn't. If alteration is to be permitted,
the ordinance could possibly allow a major negative impact which would set a bad

Vehicle Parking at Bandimere Heights Park

Please find attached a letter from Scott Harr, Assistant Public
Safety Director, to Wendy pemrj.ck of the Park and Recreation
Commission. This issue is being prought before the Commission to
discuss possible solutions to the congested parking in the area
which occurs during scheduled yo~th soccer games. These games are
scheduled each summer over a 2~o 2\ month period. You may recall
this issue has been discussed by the commission in the past. At
that time the construction of a parking lot which would require
vehicles to back out into the street was determined to be
undesirable. This type of .itton street" parking lot was the only
viable option as the park's size would/not accommodate an interior
parking lot.
As it has already been determined thatifl parking lot of any size
could not effectively or safely be constructed at Bandimere Heights
Park, it is staff's recommendation to investigate the installation
of no parking signs on one side of the> street with the Public
Safety and Engineering Departments... ...Thi~ may provide a viable
solution if enough vehicles can be accommodated along one side of
the road without interfet'ing.wj.th~he homesontbat.side of Kiowa

J enjoyed talking to you on the phone regarding the parking
problems near the park on Kiowa Trail. I have met with Todd
Hoffman, and he explained to me some of the history of this
issue, as it has apparently been looked at on a fairly annual
basis.
Todd and I thought that it might be best dealt with initially
by the Park and Recreation Commission, with eventual input by
the Public Safet.)' Commission. Of course, Public Safet.)' would
be concerned with the issues that you and I discussed: access
by emergency vehicles, clear visibility, etc. Todd and J
discussed such alternatives as placing no parking signs on
one side of the street, creating a parking area, etc.
If this approach is acceptable to ,YOll, I will look forward to
hearing from Todd when this issue has been dis6ussed by your
commission. If you have any other thoughts, I would appreciate
your contaciing me. Again, Wend.)', it was good talking to you.

Request from McGlynn Bakeries for a Company picnic
Reservation
Note: As this request is somewhat unusual, it is being presented
to the Commission for discussion.
A representative of McGlynn's. Bakeries called to inquire about
making a reservation for their 1991 company picnic at Lake Ann
Park. To date, the largest picnic held at Lake Ann has not
exceeded 400 people. McGlynn's has requested a reservation for
1200 people. The day they have inquired about is a Sunday in late
August, 1991.
The facilities at Lake Ann would accommodate this large of a group;
however, it would create minor inconveniences for other visitors to
the park that day.
If there is no opposition from the Commission, staff will work with
McGlynn's in accommodating their

As you are aware, the bids for the Lake Susan Park Expansion
project were opened Friday morning at 10:00 a.m. Three bids were
received as summarized in the attached bid tabulation from our
consultants. As noted therein, the low bidder was Finley
Brothers Enterprises of Minnetonka, Minnesota.
The low bid is $309,185.28. The engineer's estimate on the
project was $334,000. From the prequalification materials
submitted and our investigation as to their credentials, we find
that Finley Brothers is well-experience and capable of performing
this project.
It is therefore recommended that the Lake Susan Park Expansion
Improvement projet No. 89-3 be. awarded to Finley Brothers
Enterprises in the amount of $309,185.28.

Bids for the referenced project were received on August 10, 1990.
The low bid was $309,185.28. Two other bids were received ford the
project with the high bid being $348,433.50. It is our opinion A
that the bids are competitive and very favorable to the City. ..
The low bidder on the project is Finley Bros. Enterprises, DBA
Tennis West LTD of Minnetonka, Minnesota. The firm is a
partnership of brothers and has been in business since 1975. The
firm specializes in the construction and maintenance of outdoor
athletic facilities that include tennis courts, basketball courts,
baseball and softball fields, athletic fencing, seeding and
sodding. We have checked with references from the City's of
Waconia, Eden Prairie, Deephaven and Eagan along with some private"
health clubs and find the comments to be quite positive. We have
checked into the contractors' cooperation, management of the
process, quality of workmanship and commitment to budget and
schedule. The response has been quite satisfactory.
A major issue on this project is the specialty skills required of
the contractor to properly construct the tennis and basketball
courts and baseball field. In discussions with Finley Bros.
regarding their approach to this part of the construction, they
stated that they have had an exclusive relationship withPlehal
Blacktopping for all fine grading, gravel base and bituminous
paving work for the courts for the past !5 years. In addition
Plehal has done fine grading for all Finley Bros. baseball and"
softball fields. Finley Bros. installs the aglime and fencing with
their own crews and uses Nyen Excavating to do topsoil placement
and fine grading in the baseball field. . Nyen has successfully e
teamed with Finley Bros. on athletic field construction in Eagan
and Eden Prairie. Our reference checking has confirmed that Finley
Bros. has the appropriate experience to build these facilities.

I am Assistant City Attorney for the City of Chanhassen. I am
writing you in regard to the City's pedestrian trail which passes
through the rear section of your lot.

On October 10, 1988, The Rottlund Company, Inc. executed an
easement deed in favor of the City of Chanhassen for the limited
purpose of creating and maintaining the pedestrian trail which passes
through your back yard. During the preparation and designing stages
of the trail, a number of slight adjustments in the course were made
until the final course of the trail was approved. Unfortunately, due
to an oversight, the legal description inserted into the easement
deed from The Rottlund Company, Inc. to the City did not contain the
final and correct legal description. To remedy this error, I have
enclosed a new easement deed which contains the correct legal
description for the trail as it now exists. The new easement is
identical in all respects to the existing easement, except that it
now correctly describes the easement as it passes through your
property. I would ask that you both execute this deed before a notary
public and forward the document to your mortgage company, First
Minnesota Savings Bank, in the enclosed envelope.
I appreciate your cooperation and courtesies in this matter. If
you have any questions, or if I can be of any assistance, please do

The Park and Recreation Commission will be reviewing a request to
complete the trail segment connecting Saddlebrook and Butte Court
to Meadow Green Park at the Tuesday, August 21st Park and
Recreation Commission meeting. A copy of that evening's agenda and
the report being presented to the commission are enclosed. A
petition from residents of Saddle brook making this request is
included in the report to the commission, but has not been included
in this mailing in the interest of saving paper.
