SUBJ: Carver Beach Park along Lotus Trail
Swimming Raft
At the last meeting, staff was directed to research further the
legality of a private individual launching a swimming raft off of
park property. I have discussed this issue with the County,
Department of Natural Resources, and Jim Chaffee, reviewed the
Park Ordinance and Water Surface Use Ordinance and have found .
nothing that specifically prohibits such. Staff has referred
this item to the City Attorney, Roger Knutson, for clarification.
I will update the Commission as soon as an opinion is rendered.
Mini Beach Area
I have discussed this item in detail with Don Ashworth. It is
his recollection that the homeowners put in the mini beach just
south of the old boat access in the early 1970's. At that time,
staff felt it was a liability and recommended to the Park and
Recreation Commission that the mini beach be removed as another
beach was located just two blocks away. The Park and Recreation
Commission reviewed this item at that time and moved to allow the
mini beach. Such has been in place and used by Carver Beach
residents ever since.
General Area
I have reviewed the file on this park property extensively and
have found a lot of correspondence between the residents in the
area and the City. Private individuals are not allowed to store
personal property along the shore. The only person who has City
approval to do so is Mr. Gordon Tock who has lived there for 30
to 40 years and is handicapped. Residents have also been
notified that they are not to clear the park property.

It is the recommendation of this office to budget money in 1989
to improve the Carver Beach park along Lotus Trail bollards along
the road as necessary, reclaim the trail and promote its use.
Additionally, the area should be patrolled regularily to see that
illegal boat storage is prohibited. Staff will submit a recom-
mendation at a future meeting regarding the swimming raft,
pending a legal opinion.

BACKGROUND
This proposed development lies at the west end of the industrial
park and is part of Zone 4 in the Recreation Section of the
Comprehensive Plan. Zone 4 calls for park land to serve the
development taking place along TH 101 and around Lake Susan. As
the needs of those areas are being met with the park land dedica-
tion of Lake Susan Hills West and Chanhassen Hills, park land is
not needed from the proposed Audubon West Development.
The trail plan identifies the need for a trail along Audubon
Road. We have requested trail easements along the west side from
developments both north and south of this proposal. This align-
ment should be continued.
RECOMMENDATION
It ~s the recommendation of this office to accept park and trail
dedication fees in lieu of park land and trail construction and
to request a 20 ft. trail easement along the west side of Audubon.

Request to Realign Trail Easement, Hidden Valley
Recently the City was contacted by United Mortgage Corporation
requesting that the City consider realigning the trail easement
through the Hidden Valley development, located just west of
Chanhassen Estates along the south side of Lake Drive East and
the east side of TH 101. Staff's response was that any realign-
ment would have to be equally developable, i.e. above the ordi- .
nary high watermark, acceptable topography, etc. They were also
told that a legal description of the new alignment would be need
to be surveyed.
I had an opportunity to walk the site of the proposed alignment
and found it to be acceptable. The new trail easment would be
somewhat more meandering, making a more interesting trail, and
would not cut across the mid-section of back yards (see attached).
As the proposed trail easement will maintain the intent of the
original alignment, is equally developable for trail purposes, and
remains 20 feet in width, it is the recommendation of this office
to approve this request. It should be noted that any costs
incurred in the recording of the new easement or vacating the
original easement, should be the responsibility of United
Mortgage Corporation.

along the south side of the subject project. The easement is 20 feet in width
and was field located at the direction of your office.
As you will recall, the original trail was to be within the interceptor
sewer easement. However, due to site grading and the desires of the adjacent
property owners, it has been proposed to move the trail further south.

number of complaints received regarding flocks of geese, the City
Council approved a three to four year removal program, requesting
that it be reviewed each year.
The program involves the removal of all geese on Lakes Ann, Lucy
and Minnewashta. The adult geese are shipped to Oklahoma where
the environment is such that it entices them to stay there. The
younger geese are relocated in southern Minnesota.

The return rate of the geese is approximately 50%. By conducting
the removal program three to four years in a row, we reduce the
goose population to a number that is no longer considered a
nuisance (one goose family per lake).
Attached please find a letter from Dr. Cooper reviewing the 1987
capture. The "Goose Team" is prepared to conduct the third year
of capture pending approval.
It is the recommendation of this office to approve the goose
removal program for the 1988 season. The estimated cost is
$2,100 - a budgeted expense.
Update (May 9, 1988)
The Park and Recreation Commission acted to recommend the con-
tinuation of the goose removal project at Lakes Ann, Lucy, and
Minnewashta.
