Commissioners Present: Michael Lynch, Michael Rosenwald, Curt .
Robinson, Wallace McKay, Susan Boyt, and Jim Mady. Lori Sietsema
was also present and Charlie Robbins was absent.
Minutes
Robinson moved to recommend the acceptance of the minutes dated
October 7, 1986. The motion was seconded by Mady and carried
unanimously.
Comprehensive Plan Updating Process:
A. Park Needs Survey
Sietsema explained that the City Council reviewed the request to
hire a temporary employee to assist in the survey process. She
said that the Council reviewed the rough draft of the survey as
well and were concerned that it did not represent the current
position of the City in regards to parks. They were also con-
cerned about the method of distribution and the estimated number
of responses. It was suggested that the Park and Recreation Com-
mission meet with residents in each area to discuss the City's
current position and location of existing parks, with a survey

Sietsema said that it may not be appropriate to develop each type
of park the same. She said that different neighborhoods have
different personalities and needs.
Mckay said he wants to know what is appropriate for each type of
park. He said that standard criteria was needed to treat each
park development request equal. He said that he feels that staff
has no long range planning when it comes to park development and
just plays it by ear. He said that since he has been on the Com-
mission, it has only been the "squeaky wheel that gets the oil"
and he resents the looseness in the way decisions are dealt with.
Lynch said that although long range planning is needed, inflexa-
bility tends to cause waste. He said that criteria was needed
that would determine what the minimum size is for a park to be
considered for a ballfield, or what the minimum size for a park
~hould be, or how close to a highway is acceptable to develop
park facilities.
Boyt said that if such criteria is included in the Comprehensive
Plan, the Commission will be better equipt to make sound deci-
sions, which will be defendable to the City Council. She said
criteria that would state "a ten acre park is eligible for..." or
"a three acre park is eligible for ..." She said she would like
to know what is appropriate for each size park.

Rosenwald said that if this was done, he would suggest stating
for the record that it is anticipated that the Commission will be
asking for a budget amendment in 1987 upon the completion of the
trail plan. This will let the Council know we are looking ahead
and there will not be any suprises.
Lynch suggested making a contigency list:
-Lake Susan running track (pending the acquisition of addi-
tional 8 acres)
-trail development (pending the completion of the trail plan
and estimated costs of such a plan)
-Herman Field Access Development (pending the results of the
access plan)
Rosenwald moved to amend the original proposed 1987 Capital
Improvement Plan Budget to delete the running track at Lake Susan
($1000), the trail development funds ($25,000), the Herman Field
development ($5,000), and to add $3,500 for the development of an
access plan for Herman Field. This brings the total request to
$80,500. The motion was seconded by Boyt and carried unanimously.
McKay said he would like to know how much is in the Park budget.
He said that staff should be able to provide the Commission with
the financial status and projections.
McKay moved to request the balances for the 1987 Capital Fund,
the 1987 estimated Capital Fund income, and any earmarked funds
that are a part of the beginning balance, in order that the Com-
mission can enhance its recommendation for this fund. The motion
was seconded by Boyt and carried unanimously.
Commissioner Appointments
Sietsema said the terms of office were to expire on December 31,
1986 for Boyt, Lynch, Rosenwald, and Robbins. She said that the
Commission was to make a recommendation to the City Council as to
reappoint or advertise the vacant positions. She said that she
received a call from Robbins who said that he would not be
interested in a reappointment. Lynch, Boyt and Rosenwald all
indicated they would like to be reappointed for another term.
McKay moved to recommend the reappointment of Lynch, Boyt, Rosen-
wald and Robbins and the authorization to the advertisement for
the vacant position of any who do not wish to continue. The
motion was seconded by Robinson and carried unanimously.

Herman Field Access Plan
Mady moved to recommend the authorization of Van Doren Hazard
Stallings to prepare an access plan for Herman Field at an esti-
mated cost of $2,500-3,500. The motion was seconded by McKay and
carried unanimously.
Eagle Scout Project Update
Sietsema said that she received a letter from Steve White
regarding his Eagle Scout Project at Chanhassen Pond Park. White
said that because of weather and other difficulties he was not
able to complete the project this fall. He said he will continue
to work on the project next spring and gave June 30, 1987 as an
estimated completion date.
McKay asked staff to send White a letter of thanks.
Discussion of Commission/City Council Goals and Objectives
McKay said that specific areas should be identified to set goals,
i.e. how we run meetings. Mady said problem areas should also be .
identified, i.e. how does the Commission interface with the Coun-
cil. McKay said the the Commission lacks the financial data to
base decisions. Mady said Chanhassen's part in park development
should be discussed. Boyt said the survey should be included.
Lynch said that the City needs to plan for when the City will
take over the youth athletic programs. Boyt said the Commission
should ask when a referendum for trail development would be con-
sidered. Mady said that it did not sound like the City has much
tax base for a bond issue. Lynch said the Commission should
establish when and if the City should consider a Community
Center. McKay said a long range plan should be developed. He
said there was a problem with the Council's confidence with the
Park and Recreation Commission.
Mady moved to adjourn the meeting. The motion was seconded by
Robinson and carried unanimously.

OBJECTIVES, JANUARY 1. 1987
GOAL: PARK AND RECREATION COMMISSION MUST INTERFACE
EFFECTIVELY WITH CITY STAFF, CITY COUNCIL AND RESIDENTS.
OJECTIVES:
1) To deal effectively the City Council needs
good and timely information. To accomplIsh this,
the Park and Recreation commission should assign
one member per month to attend all city council
meetings to answer any questions which may arise
or present the Park and Recreation plan on a given
subject.
Timing: Immediately

2) To be responsive to the residents of Chanhassen,
the Park and Recreation Commission must know the
desires of its residents. In order to do this,
Bi-Annual, statistically accurate, sample surveys
should be made.. Further, the commission should
hold monthly meetings in the parks prior to the
regular commission meetings to learn the wishes
of the residents. The meetings shold be held during
the months of good weather and a mailing should go
out a week ahead of the meeting to inform the residents .
of the meeting.
Timing: Six Months
GOAL: DEVELOPEI-1ENT OF PARKS AND TRAILS MUST BE BASED ON
A DETAILED PLAN.
OBJECTIVES:
1) Developement of a comprehensive plan in general
terms to show long range objectives.
Timing: Two Months
2) Determine park defincient areas and develope a
plan to acquire park land thru the use of deeded
land in lieu park dedication fees, outright purchase
or trading parcels between developements.
Timing: Two Years
3) Develope a comprehensive trail plan that connects
with trails in neighboring co~~unities .if possible.
Plan should include main artirial trails and feeder
trails connecting park land. Trails could run east
and west along highway 5 and south along highway 101
and north along Kerber boulevard.

Attendance Policy - City Commissions and Committees

On July 19, 1982 the City Council acted to set an attendance
policy which is to be used by all City Commissions and
Committees. This policy should be incorporated into the bylaws
for commissions operating under existing bylaws or adopted as a
policy statement within our various committees.
The attendance policy should ask for the resignation of any mem-
ber who misses three consecutive meetings, without notifying the
Chairman as to the special circumstances requiring such absence;
or, if a member is found to be absent for more than 75% of the
meetings during any 12 month period of time. The chairman of the
commission/committee is to be responsible for notifying a member of
his/her failure to meet this policy with a copy of such notificaiton
being forwarded to the City Council.

McKay's Resignation
Wallace McKay stopped by my office last week to deliver a letter
of resignation from the Park and Recreation Commission
(attached). McKay has sold his house and does not expect to
relocate within the City. Mr. McKay's resignation is effective
immediately, however he has agreed to continue to serve on the
Commission until he is replaced.

It is the recommendation of this office for the City to accept
Mr. McKay's resignation.

Policy on Park Dedication in the Rural Area
Following the Park and Recreation Commission's action regarding
the Lake Park Estates proposed subdivision, this office forwarded
the recommendation to the City Attorney, Roger Knutson. Mr.
Knutson was asked what represents a "reasonable taking" in rural
developments.
.
Attached please find Mr. Knutson's response which states that the
City must show that the increased population created by the sub-
division will need the amount of land requested. Mr. Knutson
says that the courts questioned that the need was the same for
both large and small lots.
Mark Koegler was on staff at the time the Comprehensive Plan was
developed, which outlines park goals and policies. He was also
on staff when the Park Dedication Ordinance was drafted, (which
interfaces with the Comprehensive Plan's goals and policies). I
have asked Mr. Koegler to be present at the January 6th meeting
to discuss the background of the two documents as well as the
potential amendments reflecting current trends toward sub-
divisions in the rural area, (as rural subdivisions were prohi-
bited when the Comprehensive Plan and the Park Dedication
Ordinance were established).
Mr. Koegler will make an oral presentation on this matter before
the Commission reviews the two proposed site plans appearing on
the agenda.

Dear Roger:
In the past, staff has advised developers of the three basic for-
mulas used to determine park dedication requirements in a
subdivision, i.e. 10% of the actual land, 10% of the raw land value,
or $415 per building permit for a single family dwelling. In a
normal development with three units per acre, each of these for-
mulas represents a reasonable taking and on the average, work out
to have about the same value.
The Park and Recreation Commission recently reviewed the proposed
development plan for Lake Park Estates located southwest of Lake
Riley. This proposal is a 134 acre development in the rural area
with forty-two 2t acre lots, a two acre private park, and a one
acre beachlot. Upon review, the Park and Recreation Commission
recommended that the City request at least 10% of the developable
land be dedicated for public park purposes.
I would like you to respond to the legality of such a request and
in doing so, please explain "a reasonable taking" in rural develop-
ments. Please call me if you need any additional information.

Dear Lori:
Minn. Stat. ~ 462.358 2b authorizes cities to require
subdividers to dedicate "a reasonable portion of any proposed
subdivision ... for public use as parks." The Minnesota Supreme
Court has upheld the constitutionality of the statute. Collis .
v. City of Bloomington, 246 N.W.2d 19 (Minn. 1976), copy enclosed.
If the land dedication requirement is "a reasonable portion"
there is no taking. The rationale is that the subdivider has
created a need for park land and can therefore be required
to fulfill the need he has created. In Collis the court defined
"reasonable portion" to mean:
That portion of land which the evidence reasonably establishes
the municipality will need to acquire for the purposes
stated as a result of approval of the subdivision. This
is, of necessity, a facts-and-circumstances test, but
it is the only kind of test that will consider the myriad
of factors which may bear on a municipality's needs for
certain kinds of facilities and the relationship of a
particular subdivision to those needs. Id. 246 N.W.2d
at 27
To uphold a 10% land dedication requirement the City would
have to show that the number of people the subdivision will
introduce into the community will need roughly that amount
of land for park purposes. The court in Collis questioned how
a flat 10% dedication requirement could be justified for both
large and small lots. Why do residents of large lot subdivisions
need more park land than residents of small lot subdivisions?

It has been my feeling that in the past the Park and Recreation
Commission has been one of the more informal commissions.
However, it is important that if for any reason you are unable to
attend a meeting, you contact the Commission Chairperson. If you
are unable to make 75% of the meetings, the Chairperson is
required to ask for your resignation. In addition to contacting
the Chairperson, I would ask that you call me at 937-1900 so that
I know if we have a quorum for each meeting.

Proposed 1987 CIP Budget
The City Council reviewed the proposed Capital Improvement
Program Budget for 1987 and tabled action pending the joint
meeting between the Park and Recreation Commission and the City
Council. Attached please find the minutes with the Council's
discussion on this item.
Commission Appointments
.
The ordinance establishing the Park and Recreation Commission
states that Commission appointments are to be made by the Mayor
with the approval of the City Council. The Mayor noted at the
last Council meeting that anyone interested in making applica-
tion, including Commissioners whose terms are expiring, should
complete an application form and return it to my office
(application enclosed). It was also noted that applicants
should be scheduled for an interview with the Mayor through my
office.
The next Park and Recreation Commission meeting is scheduled for
January 6th. City Council by-laws state that all officers are to
continue to serve until either reappointed or a successor is
named. Please let me know if you will be unable to attend the
meeting.
Herman Field
The City Council acted to authorize Van Doren Hazard Stallings
to prepare an access plan for Herman Field. Mark Koegler will be
working on the plan to explore every conceivable means by which
to gain access to the park.

MRPA Request to Host Men's Region Softball Tournament

Stu Alexander, Minnesota Recreation and Park Association (MRPA)
Athletic Coordinator, recently called me to ask if the City of
Chanhassen would be interested in hosting the 1987 Men's Open
Region Softball Tournament in August. The tournament would
involve approximately 32 teams. Mr. Alexander indicated that
MRPA would do the scheduling of games and umpires and the City
would be required to provide a tournament director, field main-
tenance, and concessions. MRPA would handle all costs incurred
by the tournament itself, such as umpire fees.
I believe I will be able to schedule our in-house tournaments
around this weekend so there would not be a conflict in schedu-
les. I have discussed this with the Park Maintenance Foreman,
Dale Gregory, and he has indicated that they would be able to
have the fields in top shape for the event and does not believe
this will burden his summer workload to extensively.
The Chanhassen Fire Department have an annual Firemen's
Tournament in June which includes a concession stand. This tour-
nament is run very well, however in recent years it has not been
the big money maker it once was. I would like to offer the con-
cessions to the Fire Department in exchange for field maintenance
throughout the day and 10% of the proceeds.
Recommendation
.
It is the recommendation of this office for the City to host the
Men's Open Region Softball Tournament for the weekend of August
14, 15 and 16, and that Lake Ann Park entrance fees be waived for
that weekend. It is also recommended that the concessions be
offered to the Chanhassen Fire Department with 10% of the pro-
ceeds being returned to the City and their agreement to drag the
fields btween games.
Another val id meth:x3 of looking at this issue is to examine approaches taken by
other municipalities. Chanhassen is facing the issue of. rural park dedication .
largely due to upcoming changes in the zoning ordinance which have prompted
private lard owners to try to develop parcels in conformance with the old, more
lenient zoning standards. This situation makes Chanhassen somewhat unique in
the metropolitan area and a quick review of other city's ordinances did not
uncover similar situations.
Municipalities in various parts of the country have employed a sliding scale for
park dedication which is tied to lot size. A model ordinance prepared by the
American Society of Planning Officials in the mid 1970's contained the following
suggestion:

In accordance with the ASPO model ordinance, 15,000 sq. ft. lots create
approximately five times the demaoo for recreation that is created by lots of
approximately two acres or larger. This relationship is inverse to the
situation created by strict application of the ten percent land dedication
requirement in Chanhassen. .
As was indicated previously, all residential developments create a demard for
parks and as such, should not be immune from dedication requirements.
Perta ining to 2.5 acre lot sub:1ivisions, strict application of the ten percent
dedication requirement seems to result in dedication that is not consistent with
created demand. Since most of the proposed subdivisions are in the same
geographic area, it may be possible to identify an appropriate location for one
new neighborhood park and then require land dedication in an amount of
approximately two percent from the appropriate larrl owner or owners. Since the
2% dedication requirement is not going to be adequate to obtain a park of 10-15
acres within anyone subdivision, money collected from the other rural
subdivisions in lieu of land dedication could be used for acquisition purposes.
It is likely that the most appropriate location for a new neighborhOod park may
not be within the confines of any of the land parcels ~esently ~oposed for
development. If this is true, the Park and Recreation Commission could
recommend collection of the cash contribution of $415 per unit for all new
subdivisions in the rural area. Proceeds could be earmarked for acquisi tion of
a new neighborhood park. The location or alternate locations for the
neighborhood park could be identified in the park aoo recreation chapter update
of the Comprehensive Plan.

As a part of updating the recreation chapter of the Chanhassen Comprehensive
Plan, we have been requested to address the issue of park dedication
requirements in the rural, unsewered area. !his issue has confronted the Park
comnission as a result of the proposed development plan for Lake Park Estates as
well as receipt of the applications for other sulxUvisions in the rural area.
It is o~iously important that the City establish a policy of park dedication in
the rural area. !he current cases require irrrnediate comment and recomnendation
by the Park and Recreation Commission. This unfortunately may preclude the
Commission from taking a detailed look at the entire issue. Due to upcaning
changes in the zoning ordinance, however, it appears as though two separate
issues actually exist. The first issue is park dedication requirements for
developments of a density of one unit per 2.5 acres arrl the second is the issue
of park dedication requirements for development at a density of or less than one
unit per ten acres.
The general issue of park dedication requirements in the rural area has both
local arrl regional overtones. Chanhassen, arrl its updating of the Canprehensive
Plan is subject to the policy requirements of the Metropolitan Council. The
Metropolitan Council's policies are stated in the Metropolitan Development
Investment Framework which was adopted in late 1986. The framework states that
n the Council supports development in the general rural use area consistent with
service levels appropriate for a rural area". Neighborhood parks are typically
considered urban rather than rural services.

talked to Metropolitan Council staff members Pat Pahl in the Planning and
Technical Assistance Division and Jack Mauritz in the Parks and Natural
