This is the front of the building and does not meet the current set -back requirements. We are currently at 38 feet plus for the existing structure. We will not be building closer to the road or the front set- back requirement. We are building upon the existing garage framing and going up. In this area we will be creating more living space without adding to the home's footprint. We are supplying you with detailed drawing of the project and a survey showing existing conditions and proposed. Thank you for your consideration, Tim Boyce CITY O CH riEC VED SSEN JUN 0 CHANHASSLN PLA14NING DE June 2, 2010 To: City of Chanhassen FR: Tim Boyce RE: 1231 Bluff Creek Drive Variance Written justification in pursuant to section 20 -58: To whom it may concern 1231 Bluff Creek Drive was built prior to the current ordinance. We are not asking to go beyond the buildings original perimeter, but are simply going up within the existing structure. The properties to the north seem to be consistent and also do not meet the current ordinance. The existing structure is located 38 feet back from the front property line and this is where we would adding up only, meaning that we are adding a 2" floor above garage and will not be building closer to the road in what is considered to be the front yard set -back. b. Generally the set -back requirement is not a problem for most large lot zoned areas. In this case the lot is .7 acres, which is the smallest lot in the area and was built pre set -back requirement.. c. The purpose of this variance application is to create more living space for the Good Family. d. The hardship was created because it pre dates the set -back requirements, this building was built before set backs were required. We are not asking to add on to the building perimeter, we are going up and not past the buildings current foot print. e. The building addition meets all other requirements set forth by the city. f. My opinion is that the proposed addition will have a positive effect on the surrounding properties and will not be injurious in any way. There are no structures located within a couple hundred feet of the proposed addition. In no way will the addition change the supply of light, air or add to congestion. It does not appear that it would affect public safety or fire safety as we are only going up with the addition. It should enhance rather than diminish property value.
