PROPOSED MOTION:
"The City Council approves a 45 -day extension for the construction of the pond for
Nick's Storage and Parking CUP 87 -2 and IUP 92 -1."
City Council approval requires a majority of City Council members present.
EXECUTIVE SUMMARY
On September 14, 2009, the City Council granted a one -year extension for the
installation of the pond located in the north corner of Parcel B, due to death of the
property owner.
Previously, on June 22, 2009, staff presented revocation of the Conditional Use
Permit 87 -2 and Interim Use Permit 92 -1 for Nick's Storage and Parking to the City
Council. City Council tabled action to allow the applicant an opportunity to resolve
the outstanding ponding and erosion control measures for the site and rescheduled
the item for the September 14, 2009 City Council meeting.
The Drainage and Utility Easement over the pond on Parcel B has been signed
and recorded. The Drainage and Utility Easement encompasses the pond, which
allows for maintenance of the pond by the City once the pond is constructed.

ANALYSIS
In August 2009, the heirs of the property owner took possession of the storage facility. They are
in the process of selling the property. While the parties are in the process of negotiations, the
owner is requesting a 45 -day extension for the installation of the pond. There is a letter of credit
on file for the pond which was a condition of approval for the Amended and Restated
Conditional Use Permit.
Staff has been in contact with the prospective buyer and has provided the background
information pertaining to the site. The prospective buyer is aware that the pond must be installed
on Parcel B.
Staff recommends approval of the 45 -day extension request to allow the parties to complete the
sale of the site. The new deadline for the pond installation is October 29, 2010.
RECOMMENDATION
Staff is recommending the City Council adopt the following motion:
"The City Council approves a 45 -day extension for the construction of the pond for Nick's Storage
and Parking CUP 87 -2 and 1UP 92 -1."
