A RESOLUTION VACATING
TRAIL EASEMENTS IN THE ARBORS
PLANNING CASE FILE NO. 07-02
WHEREAS, the City of Chanhassen is being requested to vacate trail easements within the
underlying parcels of The Arbors development (Pulte Homes of Minnesota) consisting of a ten -foot
wide trail easement per Document Number 165683 on Lots 1, 8, 9, 10, 11, 12, and 14, Block 1, The
Arbors; and
WHEREAS, the existing trail easement to be vacated was granted to the City in 2007 by
Document Number 165683; and
WHEREAS, The Arbors final plat dedicated a 60 -foot wide right -of -way for the
construction of West 78 Street, which includes the construction of a five -foot wide concrete
sidewalk on the north side; and
WHEREAS, The Arbors final plat dedicated a 60 -foot wide right -of -way for the
construction of Dogwood Road.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves vacating The Arbors trail easements described above and as defined on the attached
vacation description.
Passed and adopted by the Chanhassen City Council this 9 th day of August, 2010.

That part of Lots 1, 8, 9, 10, 11, 12, and 14, Block 1, THE ARBORS, Carver County, Minnesota,
described as follows:
The northerly 10.00 feet of said Lots 1, 8, 9, 10, and 11, Block 1, and the easterly 10.00 feet of
said Lots 11, 12, and, 14, Block 1.
