SUMMARY OF REQUEST: The developer is requesting an Interim Use Permit for grading for new tennis courts at Minnetonka Middle School West. If the City finds that all the applicable interim use permit standards are met, the permit must be approved. This is a quasi - judicial decision. PROPOSAL /SUMMARY The school district is proposing the grading of the playing field to the north and east of the school building and parking lot for the construction of seven tennis courts. There are currently two tennis courts that will be refurbished as part of the plans. Northwest of the proposed tennis courts are single- family homes on Melody Lane. North of the athletic fields are Melody Hill, a local street, and single - family homes. To the east are additional single - family homes. Since the amount of grading exceeds 1,000 cubic yards, an interim use permit is required. Minnetonka Middle School West IUP January 4, 2011 Page 2 of 6 APPLICABLE REGULATIONS Chapter 7, Article III, Excavating, Mining, Filling and Grading Chapter 20, Article IV, Division 5, Interim Use Permits Chapter 20, Article XXI, "OI" Office and Institutional District BACKGROUND On February 27, 2006, the Chanhassen City Council approved Interim Use Permit #2006 -03 to permit the grading of approximately 3,400 cubic yards for an infiltration basin and drainage swales to reduce downstream erosion and sedimentation along Highway 41 (Planning Case #2006 -03). On June 9, 2003, the Chanhassen City Council approved Interim Use Permit #2003 -02 to permit grading in excess of 1,000 cubic yards to install a storm water pond and reconfigure the bus circulation route and parking area on the north side of the school. ANALYSIS GRADING, DRAINAGE AND EROSION CONTROL Grading and Erosion Control (Sheets 2, 3 & 5) Adequate sediment and erosion control practices must be installed prior to any earth - disturbing activities. This includes, at a minimum, perimeter silt -fence control, inlet protection and rock construction entrance. This is the minimum best management practices required. This will need to change as climatic conditions and site conditions change. All silt -fence shall use metal t -posts and shall be consistent with City Detail Plate No. 5300. Include detail on sheet 5. Rock construction entrance locations shall be shown on the plan and should be placed such that construction traffic does not cross the proposed infiltration areas. Rock construction entrances shall be consistent with City Detail Plate No. 5301. Include detail on sheet 5 Infiltration areas shall be protected from sediment deposition and compaction resulting from construction equipment throughout construction. This must be noted on the plans along with all other areas to be protected. Category 3 erosion control blanket shall be used on all disturbed slopes with positive flow to the pond unless sod is to be placed and staked. ery -j j J r ! f 1 `- ! The applicant is responsible for procurement of the NPDES General Permit to Discharge Stormwater Associated with Construction Activity prior to any earth disturbing activities. A full SWPPP will need to be prepared and submitted to the City for review and approval prior to any earth - disturbing activities. The SWPPP must include all components identified in Parts III and IV of the permit. Redundant erosion control measures shall be included at the two new inlets to the pond. Floating silt curtain should be used at the more southerly inlet but a second line of silt fence may be adequate at the other new inlet. Drainage and Hydrology (Sheets 1, 3 & 4) The infiltration design and maintenance shall be consistent with the 2008 Minnesota Stormwater Manual; in particular Chapter 12 and Appendix D. Protection must be provided to assure that construction equipment is not tracked over the proposed infiltration areas, materials are not stockpiled in these areas and sediment deposition does not occur in these areas. This is most commonly accomplished through the use of silt fence. Further, this should be noted on the plan set, in the SWPPP and within the project specifications manual. Infiltration features must be separated from the ground water by a minimum of three feet. Provide boring data to confirm this separation. As the infiltrometer tests were performed approximately 60 feet west of the proposed infiltration area and the infiltration rates are under the optimal conditions, and likely to decline over time, a margin of safety shall be built into the design to account for a diminished infiltration. To assure that the area drains in 48 hours or less it is recommended that the system be designed with an underdrain and coarse aggregate storage as depicted in Appendix D of the Minnesota Stormwater Manual — ` Bioretention /Infiltration/Filtration Facility", page 723 of 885. This would likely satisfy the above condition. It appears any rain event meeting or exceeding the 10 -year event will result in flooding of the courts adjacent to filtration swale 1P. Even at a 2 -year event a small area of the two most southerly courts will be inundated. CBMH 1 shall be moved northerly on the site and lowered so that the rim elevation is below 1060 feet. This would also make the ponding depth more consistent with typical bioretention facility design depths of one foot or less. The applicant shall re- locate to proposed drain tile outlet for the four most easterly tennis courts. The new outlet shall be between the most southerly court and the next most southerly court. This shall then be connected to CBMH 2 and the outlet for this manhole shall then be sized accordingly. At minimum fescues and/or other deep - rooted grasses should be used to promote infiltration. The new outlet elevations are shown to be 1046 feet. It appears that the ordinary high water level (OHW) is at 1045.4 and the normal water level (NWL) is at an unknown elevation but likely at or around 1043.5. The newly proposed outlet shall be set at the NWL. It is strongly recommended that the applicant or their consulting engineer develop a operations and maintenance manual for the infiltration/filtration features and that this includes some type of vegetative filter to provide pretreatment of the water entering the system. Site Layout (Sheet 4) The City would like to relocate the water tower onto the school property. Of particular interest is the area south of the existing pond. The City requests that the school district keep this in mind and continue to work with the City toward achieving a suitable location for the water tower. Request for an Interim Use Permit for grading for tennis court construction located at Minnetonka Middle School West. On January 4, 2011, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Inspec and Minnetonka School District 276 for an Interim Use Permit for grading for tennis court construction. The Planning Commission conducted a public hearing on the proposed development preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned OI, Office and Institutional District. 2. The property is guided in the Land Use Plan for Public /Semi - Public uses. 3. The legal description of the property is shown on the attached Exhibit A. 4. When approving an interim use permit the City must determine the capability of a proposed development with existing and proposed uses. The general issuance standards of the conditional use Section 20 -232, include the following 12 items: a) The proposed development will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. All reasonable and appropriate erosion control measures shall be used to protect the public. b) The proposed development will be consistent with the objectives of the city's comprehensive plan and the zoning chapter and shall comply with the grading requirements of Chapter 7 of the City Code. C) The proposed development will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. d) The proposed development will not be hazardous or disturbing to existing or planned neighboring uses. e) The proposed development will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. f) The proposed development will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. g) The proposed development will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. h) The proposed development will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. i) The proposed development will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. j) The proposed development will be aesthetically compatible with the area. k) The proposed development will not depreciate surrounding property values. 1) The proposed development will meet standards prescribed for certain uses as provided in Chapter 7, Articles III, of the Chanhassen City Code. 5.
