1988 08 22BOARD OF ADJUSTMENTS AND APPEALS MINUTES AUGUST 22, 1988 Johnson and Watson were present at 6:30 p.m. and discussed variance fees and follow up on the conditions established with variances. They stated that they wanted the conditions of variances to be better enforced. Jim Chaffee stated that the Building Inspectors were working on a system which would make it easier to keep track of the conditions when building permits were reviewed. Watson and Johnson stated that they thought the $75 variance fee should remain and that there should also be a fee for reapplica- tions which would cover at least the cost of the notice of public hearings, staff's time, etc. Geving arrived at 6:50 p.m. and he also agreed that the fee of $75 should remain and that there should be a fee for reapplica- tions but at a reduced cost. The Board of Adjustments agreed that $25 would be the minimun fee required for variance reapplications but also asked staff to get a general idea of the cost of the public hearings and staff time, etc. to determine whether the $25 fee would cover a reapplication. Chairman Johnson called the public hearing to order at 7:00 p.m. MEMBERS PRESENT: Willard Johnson, Carol Watson and Dale Geving STAFF PRESENT: Jo Ann Olsen, Assistant City Planner A 7.4 Foot Variance to the Side Yard Setback for the Construction of a 10' x 20' Boat Cover, 3605 Red Cedar Point Road, James Knight Olsen presented the report to the Board. Geving asked why staff was recommending approval. Staff stated that when variances are requested along lakeshore lots, one of the major items that is looked at is the visual impact to the lake. Staff felt that where the boat cover was located it was better screened from neighboring residences and the lake than if it was located on the east side of the garage where a variance would not be required. Geving stated that he was impressed with the number of neighbors who were unopposed. Watson asked what the boat cover floor was made of. Staff stated that it was the bare earth, no floor. Johnson felt that the boat storage was well covered and that if approved the variance should be conditioned that there be no addition to the boat cover area. Bill Boyt stated that even though the variance makes sense, he asked how approval could be justified when it was a self created hardship. Watson stated that there was no hardship and that the variance was not justifed. Watson moved, seconded by Johnson, to close the public hearing. All voted in favor and the motion carried. Watson moved, seconded by Johnson, to deny the variance. and Johnson voted in favor. Geving was opposed. Watson APPROVAL OF MINUTES Watson moved, seconded by Johnson, to approve the August 8, 1988, minutes as amended. All voted in favor and the motion carried. ADJOURNMENT Watson moved, seconded by Johnson, to adjourn the meeting at 7:25 p.m. All voted in favor and the motion carried.
