1996 08 12CHANHASSEN BOARD OF ADJUSTMENTS AND APPEALS REGULAR MEETING AUGUST 12, 1995 Chairman Johnson called the meeting to order at 6:30 p.m. MEMBERS PRESENT: Willard Johnson, Mark Senn, and Carol Watson STAFF PRESENT: John Rask, Planner I A FIFTEEN (15) FOOT LAKESHORE SETBACK VARIANCE FOR THE CONSTRUCTION OF A 22 X 30 HOME ADDITION AND A 24 X 24 FOOT ATTACHED GARAGE ADDITION. LOCATED AT 6631 HORSESHOE CURVE. HAROLD AND KATHY DAHL John Rask presented the staff report on this item. Willard Johnson asked if the applicant had anything to add to the staff report. Harold Dahl gave a brief overview of the home and stated that he believed there was hardships in the location of the home. Mr. Dahl stated that they attempted to minimize the encroachment upon the lake by setting the home addition as far back as possible, and that they will maintain all other setbacks. No comments were received from the audience. Mr. Johnson asked if the Board members had any comments. Carol Watson stated that she looked at the property and saw no other location in which they could add on to the building, and that she liked the design of the home and the fact that they tried to minimize the need for a variance. Ms. Watson further explained that there was not much the applicant could do with the existing home located at fifty feet. Mark Senn indicated that he had no problem with the variance request. Willard Johnson stated that he appreciated the fact that the applicant worked with staff on the variance. Mr. Johnson stated that he was in favor of the variance. Watson moved, Senn seconded that the Board of Adjustments and Appeals approve a fifteen (15) foot lake shore variance based on the findings presented in the staff report. More specifically, the Board finds the following: ~ 1. The applicant has identified a hardship in the location and size of the existing structure. . Board Of Adjustments And Appeals Minutes August 12, 1996 Page 2 2. The hardship is not self-created as the structure was constructed prior to the adoption of the City's zoning ordinance. 3. The applicant has minimized the need for a variance by offsetting the addition to provide a greater lake setback. 4. The addition will not negatively impact the lake or adjacent properties. All voted in favor and the motion carded unanimously. Watson moved, Mark seconded to close the public hearing. All voted in favor and the motion carded. The public hearing was closed. APPROVAL OF MINUTES: Watson moved, Johnson seconded to approve the minutes. All voted in favor and the motion carried. A motion was made to adjourn the meeting.
