PROPOSAL/SUMMARY
There are three actions being requested with this application, a subdivision, a conditional use
permit for a day care facility and site plan review for a day care and office/warehouse building.
The site is zoned lOP, Industrial Office Park and located east of Audubon Road, north of Sunset
Ridge Park and south of the Twin Cities and Western Railroad. The lot area of the day care
facility site and office building is 2.89 acres. It is located in an Industrial Office Park District. A
day care is a conditional use in the lOP District.
The subdivision request consists of replatting Lots 9 and 10, Block 1, Chanhassen Business Park
7th Addition (11.736 acres), into 3 lots and two outlots. The daycare-office/warehouse is
proposed on Lot 3. The remaining two lots will be reserved for future development. Outlot A
will contain the right-of-way that will provide access to the subdivision and Outlot B will contain
a NURP pond. There is one minor revision required on Lot 2. The ordinance allows a minimum
of 60 feet of lot frontage on lots abutting a cul-de-sac. Lot 2 has 51.02 feet of lot frontage. This
lot line can easily be shifted to meet ordinance requirements. The subdivision request is a
relatively straightforward action;
The site plan is for the daycare-office/warehouse building and is reasonably well developed. The
building is proposed to utilize rock face block on all four sides accented by bands and cornice.
Entry ways are accented by canopies. Loading docks are located along the east elevation and will
be screened from views. Staff is not objecting to the design of the building, however, on June
14, 1999, the City Council approved four office/warehouse buildings that are similar in design to
the subject proposal. Staff made the applicant aware of this concern and he explained that he
was willing to make the modification. We are recommending the applicant introduce some new
elements to this building.
The applicant has not shown the location of the outdoor play area for the daycare. The plans
must be modified to show type of fencing and landscaping within that area.
Parking for vehicles is located around the building. Vehicles will be screened by landscaping
and future buildings. The site landscaping is deficient and will need to be increased to meet
ordinance requirements.
A parking lot light plan is required. The plan should incorporate the light style, height, and
photo-metrics. Also, a detailed sign plan which include lighting method has to be submitted.
The site plan shows that trash will be located inside the building.

Rooftop equipment and mechanical equipment are not shown on the plans. All equipment must
be screened from views.
Staff regards the project as a reasonable use of the land. Based upon the foregoing, staff is
recommending approval of the site plan, without variances, a conditional use permit and
subdivision requests for this proposal.
BACKGROUND
On April 12, 1999, the City Council approved a Resolution Declaring No Need for an
Environmental Impact Statement for the Chanhassen Lakes Business Park 7th Addition Project,'
Subdivision 99-1 preliminary plat to replat Outlot D into 10 lots, Chanhassen Lakes Business
Park 7th Addition, and wetland alteration permit to fill 1.23 acres, provide 1.62 acres of in kind
mitigation and 1.89 public value credits, as shown on the plans dated received January 26, 1999,
subject to conditions. The final plat was approved by the City Council on June 14, 1999.
Lots 9 and 10 were envisioned to be the home for two buildings. As a condition of approval, the
NURP pond was moved to Lot 10 which made the lot unbuildable. The applicant decided to
replat these two large lots into three smaller lots with three smaller buildings.
PRELIMINARY PLAT FOR CHANHASSEN LAKES BUSINESS CENTER 8TM ADDITION
The applicant is requesting preliminary plat approval to replat Lots 9 and 10 into three lots and
two outlots. The site is zoned lOP, Office Industrial Park and is located east of Audubon Road,
north of Sunset Ridge Park and south of the Twin Cities and Western Railroad.
Lots 1 and 2 are reserved for future developments. Lot 3 is proposed to contain a daycare-
office/warehouse building. Outlot A will contain the right-of-way for the cul-de-sac and Outlot B
will contain a NURP pond. All three lots meet the minimum depth, width, and area requirements
of the zoning ordinance with the exception of lot 2. The ordinance allows a minimum of 60 feet
of lot frontage on lots abutting a cul-de-sac. Lot 2 has 51.02 feet of lot frontage. This lot line
can easily be shifted to meet ordinance requirements.
Access to the subdivision will be provided via a cul-de-sac which extends off Lake Drive West.
The subdivision request is a relatively straightforward action and staff is recommending approval
with conditions.
WETLANDS
There are no wetlands on the subject site.

GRADING
The site will be graded with Chanhassen Lakes Business Park 7th Addition. Therefore, no
additional grading is anticipated to occur with this proposal. Overall, the grading plans appear to
be consistent with the final grading, drainage and erosion control plan approved with Chanhassen
Lakes Business Center 7th Addition.
UTILITIES
Municipal water service is proposed to be extended to the plat in conjunction with the City's
public improvement project for Lake Drive West, Project No. 98-15. Sanitary sewer and water
service is proposed to be extended by the developer. Sanitary sewer service is proposed to be
extended from the existing trunk interceptor lines located in the northeast comer of the site.
Water service will be extended along the proposed street to the individual lots by the developer.
Detailed construction plans and specifications in accordance with the City's latest edition of
Standard Specifications and Detail Plates shall be submitted to the City for review and approval
in conjunction with final plat approval. Construction plans and specifications need to be
submitted a minimum of three weeks prior to final plat consideration. The developer will be
required to enter into a development contract with the City and provide a financial security to
guarantee installation of the public improvements and final plat conditions of approval.
DRAINAGE
The plans propose on extending a series of storm sewer lines to convey surface water runoff into
the regional stormwater pond located on Outlot B. The developer will be constructing the storm
sewer in the street to the stormwater pond. The pond will be constructed with Chanhassen Lakes
Business Park 7th Addition improvements. Detailed stormwater drainage calculations for a 10-
year and 100-year, 24-hour storm event shall be submitted to the City Engineer for review and
approval prior to final plat consideration.
STREETS
The developer has petitioned the City to construct street and utility improvements for Lake Drive
West in conjunction with the platting of Chanhassen Lakes Business Park 7th Addition. Lake
Drive West is proposed to be constructed in accordance with the City's urban industrial street
section which is a 9-ton road design, 36-foot wide face-to-face street section with boulevard
street lighting and landscaping. An 8-foot wide bituminous trail will also be constructed along
the northerly line of Lake Drive West. The plans are proposing to extend the short cul-de-sac
street (public) offofLake Drive West to service the lots within the plat. The appropriate amount
of right-of-way is being dedicated with the plat for the public street. Staff does recommend that a
30-foot radius be designed into the cul-de-sac where the tangent street meets the cul-de-sac

(southwest comer) to accommodate truck turning movements. The public street will need to be
constructed by the developer as part of the overall development improvements. Boulevard
lighting and sidewalks are to be included with the street improvements. The City roadway shall
be built in accordance with the City's urban industrial street section which is a 36-foot wide, face-
to-face, 9-ton road design. Detailed construction plans and specifications for this street will need
to be submitted a minimum of three weeks prior to final plat consideration for City review and
approval. The developer will need to name the cul-de-sac street prior to final plat approval. The
street name shall be subject to the City Public Safety Department's approval to avoid duplication
of City street names.
In conjunction with the EAW for the Chanhassen Lakes Business Park 7th Addition, a traffic
study for the proposal indicated that a future traffic signal may be warranted at the intersection of
Lake Drive West and Powers Boulevard. As was recommended with the 7th Addition phase, the
developer shall be required to escrow with the City a financial guarantee for its share based on
traffic generated from the site of the local cost participation for a traffic signal at Lake Drive
West and Powers Boulevard. The City's local participation costs of the traffic signal is not
known at this time. Once the final traffic study is completed to address traffic-related issues as a
result of this development, staff will be able to incorporate a methodology to determine the
developer's share for a future traffic signal. A condition will be placed in the development
contract accordingly.
EROSION CONTROL
Erosion control measures are proposed throughout the site. A rock construction entrance is also
proposed off of Lake Drive West.
MISCELLANEOUS
The existing drainage and utility easement dedicated with Chanhassen Lakes Business Park 7th
Addition over Lots 9 and 10, Block 1 will need to be vacated. The developer will need to
petition the City to formally vacate the unused drainage and utility easement prior to recording
the final plat.

The maximum height for a structure is 4 stories/50 feet.
· Minimum building and parking setback requirements are 30 foot front yard, 30 foot rear yard

· There is no minimum parking setback requirements when it abuts, without being separated by
a street, another off-street parking area.
· Maximum hard surface lot coverage is 70%.
· The wetlands shall be protected by a buffer strip. The width of the buffer strip shall be 0'-20'
with an average of 10 feet. All buildings shall maintain a 40 foot setback from the outside
edge of the buffer strip. Wetland buffer areas shall be surveyed and staked in accordance
with the city ordinance.
SITE PLAN REVIEW
GENERAL SITE PLAN/ARCHITECTURE
The proposed daycare-office/warehouse building, with an area of 20,195 square feet, will be
located on proposed Lot 3. Access to the building is proposed from a cul-de-sac which will
connect to Lake Drive West.
The building is located 104 feet from the north, 139 feet from the east, 78 feet from the south,
and 64 feet from the west property line.

Materials used on the building will consist of face block on all four sides. The entries are
proposed to have canopies. Accent bands and a cornice rap around the building. As mentioned
earlier in the report, staff is not objecting to the design of the building, however, some similar
buildings were recently approved by the City Council within the same business park and staff is
recommending new architectural features be introduced to this building.
GRADING
In conjunction with the development of CLBP 7th, the developer will rough grade the building
site. Only minor grading is anticipated on the lot for the building and parking lot improvements
after the project has been initially graded by the developer.
There was no grading plan included with this submittal. Staff assumes that the grading plan will
follow the grading plan submitted with the preliminary plat of CLBP 8th Addition. Prior to city
council consideration of the site plan, the applicant shall supply the city with a final grading plan
for review and approval.
Erosion control measures (silt fencing, rock construction entrance) in accordance with the City's
Best Management Practice Handbook shall be incorporated into the grading plan.
DRAINAGE
No utility plans for stormwater management was submitted. Again staff assumes that the
drainage plans submitted by the developer for CLBP 8th will be adhered to with this site
proposal. The runoff from the parking lots/building will be conveyed via storm sewers into a
regional stormwater pond southeast of the site for pretreatment pursuant to the preliminary utility
plans submitted CLBP 8th Addition. The storm sewer system on the site shall be privately
constructed by the applicant and owned and maintained by the applicant upon completion.
Detailed storm drainage calculations will be required to determine if there are sufficient catch
basins being provided to convey surface water runoff from the site. The drainage calculations
shall be for a 10 and 100-year, 24-hour storm event (rational method) shall be submitted to the
City for review and approval at time of building permit application.
UTILITIES
Municipal sewer and water is not yet available to the site at this time. The developer has
petitioned the City to construct the infrastructure and Lake Drive West (Project No. 98-16) this
summer. The developer of CLBP 8th will be responsible for extending the utility and street
improvements to the site from Lake Drive West. Installation of the private utilities throughout
the site (i.e. storm sewer, sanitary sewer, water) will require permits and inspections through the

City's Building Department. All utility improvements shall be constructed in accordance with
the city's latest edition of standard specifications and detail plates and/or state plumbing codes.
There are existing sanitary sewer lines that extend through the site that may be impacted by this
development. The applicant will be responsible for any adjustments to heights of the manhole
structures as a result of site improvements.
STREETS/PARKING
Lake Drive West is proposed to be constructed this year by the City. The developer of CLBP 8th
Addition will be responsible for constructing the street to access this site inconjunction with
platting CLBP 8th Addition. The drive aisles and parking stalls appear to meet city codes. Staff
recommends that the radius on the westerly curb line at the driveway entrance be expanded to a
20 foot radius to provide adequate turn movements for emergency vehicles. An industrial
driveway apron will be provided by the developer of the plat.
MISCELLANEOUS
Site plan approval shall be contingent upon final plat approval for CLBP 8th Addition. Issuance
of building permits within the plat should be a topic for discussion. The City requires that each
site have a paved street access (7-ton design) prior to issuance of a building permit. In addition,
the utility improvements designated to service the site will need to be installed, tested, and
accepted by the City prior to issuance of a building permit. The City in the past has typically
issued one building permit adjacent to a hard surfaced street to each subdivision. There have also
been situations in the past where the City issued up to four residential building permits as long as
they were easily accessed from a paved street (within 150 feet) and if the City's fire marshal's
concerns are addressed. Given the timetable of this development (CLBP 7th Addition) and the
City's improvement project for Lake Drive West, it is doubtful that the required utility and street
improvements will be completed prior to mid-November of 1999. Therefore, building permits
may not be issued until sometime in November 1999 unless the applicant can meet the concerns
of the City's Public Safety Dept.
LANDSCAPING
Minimum requirements for landscaping include 3,529 sq. ft. of landscaped area around the
parking lot, 14 trees for the parking lot, and buffer yard plantings along the west property line.
Applicant's proposed as compared to the requirements for landscape area and parking lot trees is
shown in the following table.

The applicant is short 9 trees for the parking lot and overstory trees in the buffer yard area. Staff
recommends the applicant increase plantings in order to meet ordinance requirements.
Additionally, the landscape plan is vague and does not show shrub quantities, sod or seed limits,
landscaping for the daycare play area, or a distinction between landscaped groundcovers or
paving near the building. The applicant will need to submit a more detailed landscape plan for
city approval.
LIGHTING
Lighting locations have not been illustrated on the plans. Only shielded fixtures are allowed as
required by ordinance. A detailed lighting plan should be submitted. Street lights consistent
with Lake Drive East and West will be at 200 feet intervals, staggered from one side to the other.
SIGNAGE
The applicant haS not submitted a signage plan. One ground Iow profile business sign is
permitted per lot. The area of the sign may not exceed 80 square feet and a height of 8 feet.
Also, one wall mounted sign per business shall be permitted per street frontage. The total display
area shall not exceed 15% of the total area of the building wall upon which the signs are
mounted. No sign may exceed 90 square feet. Staff is recommending the following criteria be
adopted:
All businesses shall share one monument sign per lot. Monument signage shall be
subject to the monument standards in the sign ordinance.
2. Wall signs are permitted on no more that 2 street frontages.
3. All signs require a separate permit.
The signage will have consistency throughout the development and add an
architectural accent to the building.

5. Consistency in signage shall relate to color, size, materials, and heights.

No illuminated signs within the development may be viewed from the residential
section south of the site.
7. Back-lit individual letter signs are permitted.

Only the name and logo of the business occupying the unit will be permitted on
the sign.
The applicant must obtain a sign permit prior to erecting the signs on site. One stop sign must be
posted on the driveway at the exit point of both sites. A detailed sign plan incorporating the
method of lighting, acceptable to staff should be provided prior to requesting a building permit.
SITE PLAN FINDINGS
In evaluating a site plan and building plan, the city shall consider the development's compliance
with the following:
(1)
Consistency with the elements and objectives of the city's development guides,
including the comprehensive plan, official road mapping, and other plans that may
be adopted;
(2) Consistency with this division;
(3)
Preservation of the site in its natural state to the extent practicable by minimizing
tree and soil removal and designing grade changes to be in keeping with the
general appearance of the neighboring developed or developing or developing
areas;
(4)
Creation of a harmonious relationship of building and open space with natural site
features and with existing and future buildings having a visual relationship to the
development;
(5)
Creation of functional and harmonious design for structures and site features, with
special attention to the following:
An internal senSe of order for the buildings and use on the site and
provision of a desirable environment for occupants, visitors and general
community;

b. The amount and location of open space and landscaping;

Materials, textures, colors and details of construction as an expression of
the design concept and the compatibility of the same with adjacent and
neighboring structures and uses; and

Vehicular and pedestrian circulation, including walkways, interior drives
and parking in terms of location and number of access points to the public
streets, width of interior drives and access points, general interior
circulation, separation of pedestrian and vehicular traffic and arrangement
and amount of parking.
(6)
Protection of adjacent and neighboring properties through reasonable provision
for surface water drainage, sound and sight buffers, preservation of views, light
and air and those aspects of design not adequately covered by other regulations
which may have substantial effects on neighboring land uses.
Finding: The proposed development is consistent with the comprehensive plan, the
zoning ordinance, and the site plan review requirements. The site design is compatible
with the surrounding development. It is functional and harmonious with the approved
development for this area. Staff is recommending the introduction of some new
architectural features.
PARKING
The city's parking ordinance requires 4.5 parking stalls per 1,000 square feet of office (23 stalls),
one stall per 1,000 square feet of warehouse area (7 stalls) and one stall per 6 children of design
capacity for the daycare (12 stalls). The ordinance requires a total of 42 parking spaces. The
applicant is providing 63 spaces.
CONDITIONAL USE PERMIT
Day care centers are permitted in the IOP District as a conditional use. The following constitutes
staffs review of this proposal against conditional use permit standards.
GENERAL ISSUANCE STANDARDS
1. Will not be detrimental to or endanger the public health, safety, comfort,
convenience or general welfare of the neighborhood or city.

FINDING -
The site is zoned IOP. The proposed use will not create any significant or
unexpected impacts from this use. It will provide a convenient location
for employees of the office industrial park to drop off their children.
Will be consistent with the objectives of the city's comprehensive plan and this
chapter.
FINDING -
The proposed use would be consistent with the City Comprehensive Plan.
It meets the requirements of the design standards as discussed in the site
plan/architecture section.
Will be designed, constructed, operated and maintained so to be compatible in
appearance with the existing or intended character of the general vicinity and will
not change the essential character of that area.
FINDING -
The site is located north of a collector road. It is in the industrial district
and as such, a day care center is fully consistent with this site.
Architectural standards required by the site plan requirements are being
adhered to.
4. Will not be hazardous or disturbing to existing or planned neighboring uses.
FINDING -
There will be no measurable impacts to the existing or planned
neighboring uses. This use will have traffic patterns that should combine
trips with existing businesses.
Will be served adequately by essential public facilities and services, including
streets, police and fire protection, drainage structures, refuse disposal, water and
sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use.
FINDING -
Full city services are available to be extended to this site. Roads serving
the site, which will include Lake Drive West and a proposed cul-de-sac,
are fully capable of handling the access needs of this proposal.

Will not create excessive requirements for public facilities and services and will not
be detrimental to the economic welfare of the community.
FINDING - Staff is not aware of any excessive requirements for public facilities.
However, we do believe that there is always a need for a day care center

within any office industrial park. The day care use is a good auxiliary use
for the industrial park.
Will not involve uses, activities, processes, materials, equipment and conditions of
operation that will be detrimental to any persons, property or the general welfare
because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents,
or trash.
FINDING -
This site will not create adverse impacts to persons, property or the general
welfare of the area. Hours of operation, orientation of the building, and
lighting standards will comply with city ordinances.
Will have vehicular approaches to the property which do not create traffic
congestion or interfere with traffic or surrounding public thoroughfares.
FINDING -
The site is accessible from a collector street designed to commercial
standards. There will be no direct traffic impacts to any area residential
neighborhood.
Will not result in the destruction, loss or damage of solar access, natural, scenic or
historic features of major significance.
FINDING - The development of this site will not result in the loss of any features of
major significance.
10. Will be aesthetically compatible with the area.
FINDING
The site plan is well designed. Staff is recommending the introduction of
some new architectural elements to the building and additional
landscaping.
11. Will not depreciate surrounding property values.
FINDING -
The site is being used for a day care type of operation which is consistent
with its designation. It will not depreciate surrounding property values.
On the contrary, it will add a convenient location for employees working
in the surrounding area to drop off their children.
12. Will meet standards prescribed for certain uses as provided in this article.

FINDING - The following is our review of conditions of approval and appropriate
findings:
a. The site shall have loading and drop off points designed to avoid interfering
with traffic and pedestrian movements
FINDING - The building is surrounded by a sidewalk to allow pedestrian movement.
b. Outdoor play areas shall be located and designed in a manner which
mitigates visual and noise impacts on adjoining residential areas.
FINDING - There are no adjoining residential areas.
c. Each center shall obtain all applicable state, county, and city licenses.
FINDING - Staff will ensure compliance with this condition prior to issuing a
Certificate of Occupancy.
Based upon the foregoing findings, staff is recommending that the conditional use permit be
approved with appropriate conditions.

PARK AND TRAIL
The Park & Recreation Commission recommended the city require payment of full park and trail
dedication fees for Chanhassen Lakes Business Park 8th Addition.
Subdivision Findings:
1. The proposed subdivision is consistent with the zoning ordinance;

drainage are suitable for the proposed development;

specified in this report.
4. The proposed subdivision makes adequate provision for water supply, storm drainage,
sewage disposal, streets, erosion control and all other improvements required by this
chapter;

Finding: The proposed subdivision will not cause environmental damage subject to
conditions if approved.
6. The proposed subdivision will not conflict with easements of record.
Finding: The proposed subdivision will not conflict with existing easements, but
rather will expand and provide all necessary easements.

Finding: The proposed subdivision is provided with adequate urban infrastructure.
RECOMMENDATION
Staff recommends that the Planning Commission adopt the following motions:
I. SUBDIVISION
"The Planning Commission approves the preliminary plat for Subdivision #99-9 for Chanhassen
Lakes Business Park 8th Addition as shown on the plat received June 4, 1999, with the following
conditions:
The final plat shall revise the cul-de-sac street design to include a 30-foot radius at the
point where the street connects to the cul-de-sac on the southwesterly comer of the cul-
de-sac.
The developer shall submit street names to the Public Safety for review and approval.
The final street name shall be listed on the final plat and construction documents.
o
All areas disturbed as a result of construction activities shall be immediately restored with
seed and disc-mulched or wood fiber blanket or sod within two weeks of completion of
each activity in accordance with the City's Best Management Practice Handbook. All
side slopes in excess of 3 to 1 shall be restored with erosion control blankets after site
grading is completed.
All utility and street improvements shall be constructed in accordance with the latest
edition of the City's Standard Specifications and Detail Plates. The street shall be
constructed in accordance with the city's urban industrial street section. Detailed street
and utility plans and specifications shall be submitted for staff review and City Council
approval. All private streets/driveways shall be constructed to support a minimum of 7-
ton per axle design weight in accordance with the City Code 20-1118 "design of parking
stalls and drive aisles.

All driveway access points shall incorporate the City's Industrial Driveway Apron Detail
Plate No. 5207.
The applicant shall provide detailed storm sewer calculations for 1 O-year and 100-year
storm events and provide ponding calculations for stormwater quality/quantity ponds in
accordance with the City's Surface Water Management Plan for the City Engineer to
review and approve. The applicant shall provide detailed pre-developed and post-
developed stormwater calculations for 100-year storm events and normal water level and
high water level calculations in existing basins, created basin, and/or creeks. Individual
storm sewer calculations between each catch basin segment will also be required to
determine if sufficient catch basins are being utilized. In addition, water quality ponding
design calculations shall be based on Walker's Pondnet model.
The applicant shall enter into a development contract with the City and provide the
necessary financial security to guarantee compliance with the terms of the development
contract.
The applicant shall apply for and obtain permits from the appropriate regulatory agencies,
i.e. Watershed District, Metropolitan Waste Control Commission, Health Department,
Minnesota Pollution Control Agency and Minnesota Department of Natural Resources,
and comply with their conditions of approval.

No berming shall be permitted within the city's right of way. Landscaping may be
permitted subject to staff review and approval.
10.
Street and utility improvements located within the public street right-of-way upon
completion will become City maintained and owned. Individual sewer and water services
through each lot shall be privately owned and maintained. Building permits will be
required from the City's Building Department for the private utility portion of the project.
Drainage and utility easements shall be dedicated over the public utility lines located
outside of the right-of-way on the final plat. Depending on the depth of the utilities, the
minimum drainage and utility easement width shall be 20 feet wide. Consideration for
access routes shall also be incorporated in the easement width.
11.
The developer shall escrow with the City a financial guarantee for a share of the local cost
participation based on traffic generated from the site for a future traffic signal at the
intersection of Lake Drive West and Powers Boulevard. The cost of the traffic signal is
not known at this time. Preliminary estimates between the City and County may be used
for an security escrow.

12. Driveway access points to the lots shall be limited to the interior street system and not
Lake Drive West. Access to Lots 1,2 and 3, Bk. 1 shall be reviewed by the city on an
individual basis as site plans are submitted.
13. Stormwater ponds must have side slopes of 10:1 for the first ten feet at the normal water
level and no more than 3:1 thereafter or 4:1 throughout for safety purposes.
14. The applicant shall report to the City Engineer the location of any drain tiles found during
construction and shall relocate or abandon the drain tile as directed by the City Engineer.
15. The developer shall petition the City to vacate the drainage and utility easements
dedicated over Lots 9 and 10, Block 1, Chanhassen Lakes Business Park 7th Addition,
prior to recording the final plat.
16. The developer shall be responsible for adjustments to existing infrastructure impacted by
site improvements.
17. Park and trail dedication fees to be collected per city ordinance.
18. The applicant shall submit a boulevard tree landscape plan for city approval. The plan
shall list location, species and size of materials.
The lot frontage for lot 2 shall be increased to a minimum of 60 feet.
One ground low profile business sign is permitted per lot. The area of the sign may not
exceed 80 square feet and a height of 8 feet. Also, one wall mounted sign per business
shall be permitted per street frontage. The total display area shall not exceed 15% of the
total area of the building wall upon which the signs are mounted. No sign may exceed 90
square feet. All signage must meet the following criteria:
a. All businesses shall share one monument sign per lot. Monument signage shall be
subject to the monument standards in the sign ordinance.
b. Wall signs are permitted on no more that 2 street frontages.
c. All signs require a separate permit.
d. The signage will have consistency throughout the development and add an
architectural accent to the building.
e. Consistency in signage shall relate to color, size, materials, and heights.

f. No illuminated signs within the development may be viewed from the residential
section south of the site.
g. Back-lit individual letter signs are permitted.
h. Only the name and logo of the business occupying the unit will be permitted on

i. The applicant must obtain a sign permit prior to erecting the signs on site. A
detailed sign plan incorporating the method of lighting, acceptable to staff should
be provided prior to requesting a building permit.
A sidewalk shall be extended along A Street.
Fire Inspector conditions:
a. All the post indicator valves going into the building must have tamper protection.
b. Please refer to Chanhassen Fire Department/Fire Prevention policies for site and
building requirements for plans to be issued to the Building Department."
II. SITE PLAN REVIEW
"The Planning Commission approves Site Plan Review #99-14 for a daycare-office/warehouse
building as shown on the site plan received June 4, 1999, subject to the following conditions:
Grading, drainage, utility and erosion control plans shall be submitted to staff for review
and approval by to the City Council consideration of the site plan.

letter of credit or cash escrow which will be returned upon satisfactorily completing the
project.
All areas disturbed as a result of construction activities shall be immediately restored with
seed and disc mulch or wood fiber blanket or sod in accordance with the approved plans
within two weeks the completion of each activity in accordance with the City's Best
Management Practice Handbook.
All utility improvements shall be construction in accordance with the City's latest edition
of Standard Specifications and Detail Plates and/or state plumbing codes.
All private streets/driveways shall be constructed to support a minimum of 7-ton per axle
design weight in accordance with City Code 20-1118.

The applicant shall provide a meandering berm with landscaping surrounding the parking
lot. The height of the berm shall be between 3 to 4 feet.

The applicant shall enter into a site plan agreement with the city and provide the
necessary financial securities as required for landscaping.
19. Environmental Resource Specialist conditions:
a. Increase plantings for buffer yard area in order to meet ordinance requirements.
b~ Increase parking lot trees by nine in order to meet ordinance requirements.
c. The applicant shall submit a revised landscaping plan that shows shrub quantities, sod
or seed limits, landscaping for the daycare play area, and details of the landscaped
areas and paving near the building.
20. Building Official conditions:
The daycare facility must be separated from an adjoining office, warehouse or
manufacturing use by a one-hour fire-resistive occupancy separation.
The building owner and or their representative meet with the Inspections Division
as soon as possible to discuss plan review and permit procedures.

Fire Marshal must witness the flushing of underground sprinkler
service line, per NFPA 13-8-2.1.
A final inspection by the Fire Marshal before a Certificate of
Occupancy is issued.
Fire Department access roads shall be provided on site during all
phases of construction. The construction of these temPorary roads
will conform with the Chanhassen Fire Department requirements for
temporary access ro'ads at construction sites. Details are available.
Onsite fire hydrants shall be provided and in operating condition
during all phases of construction.
The use of liquefied petroleum gas shall be in conformance with
NFPA Standard 58 and the Minnesota Uniform Fire Code. A list of
these requirements is available. (See Policy #33-1993)
All fire detection and fire suppression systems shall be monitored by
an approved UL central station with a UL 72 Certificate issued on
these systems before final occupancy is issued.

General
Numbers or addresses shall be placed on all new and existing
buildings in such a position as to be plainly visible and
legible from the street or road fronting the property. Said
numbers shall contrast with their background. Size and
location of numbers shall be approved by one of the
following - Public Safety Director, Building Official,
Building Inspector, Fire Marshal.
Requirements are for new construction and existing buildings

Upon review of the plans prepared by Schoell & Madson, Inc. stamped June 4, 1999, I
offer the following comments and recommendations:
GRADING
The site will be graded with Chanhassen Lakes Business Park 7th Addition. Therefore,
no additional grading is anticipated to occur with this proposal. Overall, the grading
plans appear to be consistent with the final grading, drainage and erosion control plan
approved with Chanhassen Lakes Business Center 7th Addition.
UTILITIES
Municipal water service is proposed to be extended to the plat in conjunction with the
City's public improvement project for Lake Drive West, Project No. 98-15. Sanitary
sewer and water service is proposed to be extended by the developer. Sanitary sewer
service is proposed to be extended from the existing trunk interceptor lines located in
the northeast corner of the site. Water service will be extended along the proposed
street to the individual lots by the developer. Detailed construction plans and
specifications in accordance with the City's latest edition of Standard Specifications
and Detail Plates shall be submitted to the City for review and approval in conjunction
with final plat approval. Construction plans and specifications need to be submitted a
minimum of three weeks prior to final plat consideration. The developer will be
required to enter into a development contract with the City and provide a financial
security to guarantee installation of the public improvements and final plat conditions
of approval.
DRAINAGE
The plans propose on extending a series of storm sewer lines to convey surface water
runoff into the regional stormwater pond located on Outlot B. The developer will be
constructing the storm sewer in the street to the stormwater pond. The pond will be
constructed with Chanhassen Lakes Business Park 7th Addition improvements.

Detailed stormwater drainage calculations for a 10-year and 100-year, 24-hour storm
event shall be submitted to the City Engineer for review and approval prior to final plat
consideration.
STREETS
The developer has petitioned the City to construct street and utility improvements for
Lake Drive West in conjunction with the platting of Chanhassen Lakes Business Park
7th Addition. Lake Drive West is proposed to be constructed in accordance with the
City's urban industrial street section which is a 9-ton road design, 36-foot wide face-
to-face street section with boulevard street lighting and landscaping. An 8-foot wide
bituminous trail will also be constructed along the northerly line of Lake Drive West.
The plans are proposing to extend the short cul-de-sac street (public) off of Lake
Drive West to service the lots within the plat. The appropriate amount of right-of-way
is being dedicated with the plat for the public street. Staff does recommend that a 30-
foot radius be designed into the cul-de-sac where the tangent street meets the cul-de-
sac (southwest corner) to accommodate truck turning movements. The public street
will need to be constructed by the developer as part of the overall development
improvements. Boulevard lighting and sidewalks are to be included with the street
improvements. The City roadway shall be built in accordance with the City's urban
industrial street section which is a 36-foot wide, face-to-face, 9-ton road design.
Detailed construction plans and specifications for this street will need to be submitted
a minimum of three weeks prior to final plat consideration for City review and
approval. The developer will need to name the cul-de-sac street prior to final plat
approval. The street name shall be subject to the City Public Safety Department's
approval to avoid duplication of City street names.
In conjunction with the EAW for the Chanhassen Lakes Business Park 7th Addition, a
traffic study for the proposal indicated that a future traffic signal may be warranted at
the intersection of Lake Drive West and Powers Boulevard. As was recommended
with the 7th Addition phase, the developer shall be required to escrow with the City a
financial guarantee for its share based on traffic generated from the site of the local
cost participation for a traffic signal at Lake Drive West and Powers Boulevard. The
City's local participation costs of the traffic signal is not known at this time. Once the
final traffic study is completed to address traffic-related issues as a result of this
development, staff will be able to incorporate a methodology to determine the
developer's share for a future traffic signal. A condition will be placed in the
development contract accordingly.
EROSION CONTROL
Erosion control measures are proposed throughout the site. A rock construction
entrance is also proposed off of Lake Drive West.

MISCELLANEOUS
The existing drainage and utility easement dedicated with Chanhassen Lakes Business
Park 7th Addition over Lots 9 and 10, Block 1 will need to be vacated. The developer
will need to petition the City to formally vacate the unused drainage and utility
easement prior to recording the final plat.
RECOMMENDED CONDITIONS OF APPROVAL
The final plat shah revise the cul-de-sac street design to include a 30-foot
radius at the point where the street connects to the cul-de-sac on the
southwesterly corner of the cul-de-sac.
The developer shall submit street names to the Public Safety for review and
approval. The final street name shall be listed on the final plat and construction
documents.
All areas disturbed as a result of construction activities shall be immediately
restored with seed and disc-mulched or wood fiber blanket or sod within two
weeks of completion of each activity in accordance with the City's Best
Management Practice Handbook. All side slopes in excess of 3 to 1 shall be
restored with erosion control blankets after site grading is completed.
Ail utility and street improvements shall be constructed in accordance with the
latest edition of the City's Standard Specifications and Detail Plates. The
street shall be constructed in accordance with the city's urban industrial street
section. Detailed street and utility plans and specifications shall be submitted
for staff review and City Council approval. All private streets/driveways shall
be constructed to support a minimum of 7-ton per axle design weight in
accordance with the City Code 20-1118 "design of parking stalls and drive
aisles.

All driveway access points shall incorporate the City's Industrial Driveway Apron
Detail Plate No. 5207.
The applicant shall provide detailed storm sewer calculations for 10-year and
100-year storm events and provide ponding calculations for stormwater
quality/quantity ponds in accordance with the City's Surface Water
Management Plan for the City Engineer to review and approve. The applicant
shall provide detailed pre-developed and post-developed stormwater
calculations for 100-year storm events and normal water level and high water
level calculations in existing basins, created basin, and/or creeks. Individual
storm sewer calculations between each catch basin segment will also be
required to determine if sufficient catch basins are being utilized. In addition,

water quality ponding design calculations shall be based on Walker's Pondnet
model.
The applicant shall enter into a development contract with the City and provide
the necessary financial security to guarantee compliance with the terms of the
development contract.

The applicant shall apply for and obtain permits from the appropriate
regulatory agencies, i.e. Watershed District, Metropolitan Waste Control
Commission, Health Department, Minnesota Pollution Control Agency and
Minnesota Department of Natural Resources, and comply with their conditions
of approval.
No berming shall be permitted within the city's right of way. Landscaping
maybe permitted subject to staff review and approval.
10.
Street and utility improvements located within the public street right-of-way
upon completion will become City maintained and owned. Individual sewer
and water services through each lot shall be privately owned and maintained.
Building permits will be required from the City's Building Department for the
private utility portion of the project. Drainage and utility easements shall be
dedicated over the public utility lines located outside of the right-of-way on the
final plat. Depending on the depth of the utilities, the minimum drainage and
utility easement width shall be 20 feet wide. Consideration for access routes
shall also be incorporated in the easement width.
11.
The developer shall escrow with the City a financial guarantee for a share of
the local cost participation based on traffic generated from the site for a future
traffic signal at the intersection of Lake Drive West and Powers Boulevard.
The cost of the traffic signal is not known at this time. Preliminary estimates
between the City and County maybe be used for an security escrow.
12.
Driveway access points to the lots shall be limited to the interior street system
and not Lake Drive West. Access to Lots 1,2 and 3, Bk. 1 shall be reviewed
by the city on an individual basis as site plans are submitted.
13.
Stormwater ponds must have side slopes of 10:1 for the first ten feet at the
normal water level and no more than 3:1 thereafter or 4:1 throughout for
safety purposes.
14.
The applicant shall report to the City Engineer the location of any drain files
found during construction and shall relocate or abandon the drain tile as
directed by the City Engineer.

The developer shah petition the City to vacate the drainage and utility

Upon review of the plans prepared by RSP. dated June 4, 1999, I offer the
following comments and recommendations:
GRADING
In conjunction with the development of CLBP 7th, the developer will rough grade
the building site. Only minor grading is anticipated on the lot for the building and
parking lot improvements after the project has been initially graded by the
developer.
There was no grading plan included with this submittal. Staff assumes that the
grading plan will follow the grading plan submitted with the preliminary plat of
CLBP 8th Addition. Prior to city council consideration of the site plan, the
applicant shall supply the city with a final grading plan for review and approval.
Erosion control measures (silt fencing, rock construction entrance) in accordance
with the City's Best Management Practice Handbook shall be incorporated into the
grading plan.
DRAINAGE
No utility plans for stormwater management was submitted. Again staff assumes
that the drainage plans submitted by the developer for CLBP 8th will be adhered to
with this site proposal. The runoff from the parking lots/building will be conveyed
via storm sewers into a regional stormwater pond southeast of the site for
pretreatment pursuant to the preliminary utility plans submitted CLBP 8th Addition.
The storm sewer system on the site shall be privately constructed by the applicant
and owned and maintained by the applicant upon completion.
Detailed storm drainage calculations will be required to determine if there are
sufficient catch basins being provided to convey surface water runoff from the site.
The drainage calculations shall be for a 10 and 100-year, 24-hour storm event
(rational method) shall be submitted to the City for review and approval at time of
building permit application.

UTILITIES
Municipal sewer and water is not yet available to the site at this time. The
developer has petitioned the City to construct the infrastructure and Lake Drive
West (Project No. 98-16) this summer. The developer of CLBP 8th will be
responsible for extending the utility and street improvements to the site from Lake
Drive West. Installation of the private utilities throughout the site (i.e. storm
sewer, sanitary sewer, water) will require permits and inspections through the
City's Building Department. All utility improvements shall be constructed in
accordance with the city's latest edition of standard specifications and detail plates
and/or state plumbing codes.
There are existing sanitary sewer lines that extend through the site that may be
impacted by this development. The applicant will be responsible for any
adjustments to heights of the manhole structures as a result of site improvements.
STREETS/PARKING
Lake Drive West is proposed to be constructed this year by the City. The
developer of CLBP 8th Addition will be responsible for constructing the street to
access this site inconjunction with platting CLBP 8th Addition. The drive aisles
and parking stalls appear to meet city codes. Staff recommends that the radius on
the westerly curb line at the driveway entrance be expanded to a 20 foot radius to
provide adequate turn movements for emergency vehicles. An industrial driveway
apron will be provided by the developer of the plat.
MISCELLANEOUS
Site plan approval shall be contingent upon final plat approval for CLBP 8th
Addition. Issuance of building permits within the plat should be a topic for
discussion. The City requires that each site have a paved street access (7-ton
design) prior to issuance of a building permit. In addition, the utility improvements
designated to service the site will need to be installed, tested, and accepted by the
City prior to issuance of a building permit. The City in the past has typically issued
one building permit adjacent to a hard surfaced street to each subdivision. There
have also been situations in the past where the City issued up to four residential
building permits as long as they were easily accessed from a paved street (within
150 feet) and if the City's fire marshars concerns are addressed. Given the
timetable of this development (CLBP 7th Addition) and the City's improvement
project for Lake Drive West, it is doubtful that the required utility and street
improvements will be completed prior to mid-November of 1999. Therefore,

building permits may not be issued until sometime in November 1999 unless the
applicant can meet the concerns of the City's Public Safety Dept.
RECOMMENDED CONDITIONS OF APPROVAL
1. Grading, drainage, utility and erosion control plans shall be submitted to staff
for review and approval by to the City Council consideration of the site plan.
2. The applicant shall work with staff in revising westerly curb radii at the
driveway entrance to accommodate fire apparatus vehicles
