In summary, with the incorporation of staff recommendations the proposed site plan application
would meet ordinance requirements, and staff is recommending approval with conditions outlined
in the staff report.
BACKGROUND
On April 12, 1999, the City Council approved a Resolution Declaring No Need for an
Environmental Impact Statement for the Chanhassen Lakes Business Park 7th Addition Project,
Subdivision 99-1 preliminary plat to replat Outlot D into 10 lots, Chanhassen Lakes Business
Park 7th Addition, and wetland alteration permit to fill 1.23 acres, provide 1.62 acres of in kind
mitigation and 1.89 public value credits, as shown on the plans dated received January 26, 1999,
subject to conditions. The final plat is scheduled to appear before the City Council on May 24,
1999.
GENERAL SITE PLAN/ARCHITECTURE
The proposed office/warehouse building, with an area of 18,388 square feet, will be situated
parallel to and northwest of Future Lake Drive West and A Street. The site is bordered by Lake
Drive West to the south, A Street to the east, and vacant industrial sites to the north and west.
The site located south of future Lake Drive West is zoned PUD-R and is occupied by a park.
Access to the building is proposed from future Lake Drive West and A Street. Parking will be
scattered around the building. Screening of the parking lot can be improved by incorporating a
meandering berm with landscaping, 3 to 4 feet in height along the perimeter of the site.
Materials used on the triangular shaped building, are pre-colored rock thce block on all three
elevations. Entrances into the building are adorned by a canopy. Decorative pre-colored
rockface block bands are integrated into the walls on all three elevations. The south and east
elevation are stepped out combined with the different colors and materials give the building the
desired visual appeal. There is a section along the south wall that can easily be improved by
adding some windows or increase landscaping. There are no loading docks with this site,
however, there are two drop off doors shown on the plan.
The site plan fails to show the trash enclosure location. The dumpsters must be screened by a
wing-wall and doors with siding and trim to match the building. Current state statutes require
that recycling space be provided for all new buildings. The area of the recycling space must be
dedicated at the rate specified in Minnesota State Building Code (MSBC) 1300.4700 Subp. 5.
The applicant should demonstrate the required area will be provided in addition to the space
required for other solid waste collection space. Recycling space and other solid waste collection
space should be contained within the,..same enclosure.

The building is located 40 feet from the north, 81 feet from the east and 79 form the south
property line. The ordinance requires a 30 foot parking setback along Lake Drive West. The
plans show a 25 foot setback. Plans must be revised to reflect a 30 foot setback. This will result
in a reduction of the building because the rear setback is at the minimum for wetland setbacks.
SITE PLAN FINDINGS
In evaluating a site plan and building plan, the city shall consider the development's compliance
with the following:
(1)
Consistency with the elements and objectives of the city's development guides,
including the comprehensive plan, official road mapping, and other plans that may
be adopted;
(2) Consistency with this division;
(3)
Preservation of the site in its natural state to the extent practicable by minimizing
tree and soil removal and designing grade changes to be in keeping with the
general appearance of the neighboring developed or developing areas;
(4)
Creation of a harmonious relationship of building and open space with natural site
features and with existing and future buildings having a visual relationship to the
development;
(5)
Creation of functional and harmonious design for structures and site features, with
special attention to the following:

An internal sense of order for the buildings and use on the site and
provision of a desirable environment for occupants, visitors and general
community;
b. The amount and location of open space and landscaping;
Materials, textures, colors and details of construction as an expression of
the design concept and the compatibility of the same with adjacent and

Vehicular and pedestrian circulation, including walkways, interior drives
and parking in terms o..f location and number of access points to the public
streets, width of interior drives and access points, general interior
circulation, separation of pedestrian and vehicular traffic and arrangement
and amount of parking.
(6)
Protection of adjacent and neighboring properties through reasonable provision
for surface water drainage, sound and sight buffers, preservation of views, light
and air and those aspects of design not adequately covered by other regulations
which may have substantial effects on neighboring land uses.
Finding: The proposed development is consistent with the city's comprehensive plan, the
zoning ordinance, and the site plan review requirements. The site design is compatible
with the surrounding development. It is functional and harmonious with the approved
development for this area.
WETLANDS
This proposed site plan maintains a 40 foot setback from the ag/urban wetland without a buffer
zone along the building's northwest face. The buffer zone for this wetland is increased in other
areas to establish a 10 foot average in accordance to the approved Wetland Alteration Permit (99-
1).
GRADING
The preliminary plat for Chanhassen Lakes Business Park (CLBP) 7th Addition was approved by
the City Council on April 12, 1999. Final plat and construction plan approval is tentatively
scheduled for the May 24, 1999 City Council meeting. In conjunction with the platting of this
project, the developer will rough grade all the building sites and streets in the development and
install the public utilities and street improvements in Marshland Circle. Only minor grading is
anticipated on the lots after the project has been initially graded by the developer. Since the final
construction plans have not been approved, there may be minor adjustments of the grades and/or
utility connection points on this site. The plans label Lake Drive West as Audubon Road. This
should be revised accordingly. The preliminary grading plans for this plat proposed a three to
four-foot high earth berm along the north side of Lake Drive West adjacent to this lot. The site
plans will need to be revised to incorporate berms along Lake Drive West as shown on the
preliminary plans to provide the required screening. The berming will not require modifications
to the proposed parking or building improvements as shown on the plans.
The plans are proposing to create a regional stormwater pond just north of the site to pretreat
runoff prior to discharging into the wetlands. There is a finger of wetlands that will be graded

around and preserved. Erosion control fencing is proposed around the grading limits. Staff
recommends that erosion control fence around the wetlands be Type III which is a heavy duty silt
fence.
DRAINAGE
Stormwater runoff from the parking lot will be conveyed via storm sewers into the regional
stormwater pond north of the site for pretreatment. The northerly portion of the storm sewer
system on the site will be constructed by the developer and owned and maintained by the City
upon completion. The final plat will need to dedicate a 20-foot wide drainage and utility
easement centered upon the public portion of the storm sewer line which lies north of the
entrance off Marshland Circle. In addition, the applicant shall enter into an encroachment
agreement with the City to construct the parking lot and landscape improvements within the
City's drainage and utility easement.
Detailed storm drainage calculations will be required to determine if there are sufficient catch
basins being provided to convey surface water runoff to the pond. The drainage calculations
shall be for a 1 O-year, 24-hour storm event and be submitted to the city for review and approval
at time of building permit application.
UTILITIES
Municipal sewer and water is not available to the site at this time. The developer has petitioned
the city to construct the infrastructure and Lake Drive West (Project No. 98-16) later this
summer. The developer will be responsible for extending the public utility and street
improvements in Marshland Circle from Lake Drive West which will provide utility service and
access to this parcel. Installation of the private utilities throughout the site (i.e. storm sewer,
sanitary sewer, water) will require permits and inspections through the City's Building
Department.
STREETS
Lake Drive West is proposed to be constructed this year by the city. The developer of CLBP 7th
Addition will be responsible for constructing Marshland Circle. An 8-foot wide trail will be
constructed along the north side of Lake Drive West adjacent this site. A 6-foot wide concrete
sidewalk will be constructed by the developer on the east side of Marshland Circle. Lake Drive
West is classified as a Class I collector street in the City's Comprehensive Transportation Plan. It
is also designated as a Municipal State Aid Route and is being constructed to Municipal State
Aid standards which prohibits parking along one side. Typically, with Class I collector routes,
the city prohibits parking on both sides of the street. However, given the park location, staff/City
Council may revisit the parking situation in the future.

The plans propose two driveway access point.s, one from Marshland Circle and another one from
Lake Drive West. The driveway access from Lake Drive West was not shown or approved with
the preliminary plat for CLBP 7th Addition. Staff has reviewed the sight lines along Lake Drive
West and believes the access will not create any significant traffic concerns. The drive aisle
width and parking stalls appear to be designed in accordance with the City's ordinance. An
industrial driveway apron with pedestrian ramps will be required with construction of the
driveway access point at Lake Drive West. The other access points on Marshland Circle will
only require an industrial driveway apron.
MISCELLANEOUS
Site plan approval should include provisions for staff to administratively approve minor changes
to the site plan resulting from the final plat approval for Chanhassen Lake Business Park 7th
Addition and the City's Lake Drive West Public Improvement No. 98-16. Changes may include
grading, landscaping, and utility connection points.
Issuance of building permits within the plat should be a topic for discussion. The city requires
that each site have a paved street access (7-ton design) prior to issuance of a building permit. In
addition, the utility improvements designated to service the site will need to be installed, tested,
and accepted by the city prior to issuance of a building permit. The city in the past has typically
issued one building permit adjacent to a hard surfaced street to each subdivision. There have also
been situations in the past where the city issued up to four residential building permits as long as
they were easily accessed from a paved street (within 150 feet) and the city's fire marshal's
concerns were addressed. Given the timetable of this development (CLBP 7th Addition) and the
city's improvement project for Lake Drive West, it is doubtful that the required utility and street
improvements will be completed prior to mid-November of 1999. Therefore, building permits
other than one off Audubon Road will not be issued until sometime in November, 1999.
SWMP
Storm Water Quality/Quantity Fees
The Chanhassen Lakes Business Parks 7th Addition development was required to construct water
quality ponds and pay fees associated with the management of storm water in accordance with the
City's Surface Water Management Plan (SWMP).
These fees are determined when the final grading and utility plans are submitted with each phase of
the project. The fees are due at the time of final platting.

LANDSCAPING
Minimum requirements for landscaping include 2,370 sq. ft. of landscaped area around the
parking lot, 9 trees for the parking lot, and buffer yard plantings along Lake Drive, as well as
neighboring property lines. Applicant's proposed as compared to the requirements for landscape
area and parking lot trees is shown in the following table.

The applicant is short plantings for the buffer yard area. Staff recommends the applicant increase
plantings in order to meet ordinance requirements.
LIGHTING
Lighting locations have not been illustrated on the plans. Only shielded fixtures are allowed as
required by ordinance. A detailed lighting plan should be submitted. Street lights consistent
with Lake Drive East and West will be at 200 feet intervals, staggered from one side to the other.
SIGNAGE
The applicant has not submitted a signage plan. One ground low profile business sign is
permitted per lot. The area of the sign may not exceed 80 square feet and a height of 8 feet.
Also, one wall mounted sign per business shall be permitted per street frontage. The total display
area shall not exceed 15% of the total area of the building wall upon which the signs are
mounted. No sign may exceed 90 square feet. Staff is recommending the following criteria be
adopted:
All businesses shall share one monument sign per lot. Monument signage shall be
subject to the monument standards in the sign ordinance.
2. Wall signs are permitted on no more that 2 street frontages.

PARKING
The city's parking ordinance requires 4.5 parking stalls per 1,000 square feet of office (21 stalls)
and one stall per square feet of warehouse area (14 stalls). The total parking spaces required by
ordinance are 35. The applicant is providing 46 spaces. The applicant is also showing 12 future
parking spaces should the need present itself.

PARK AND TRAIL
The Comprehensive Park Plan identifies this site as lying within the park service areas of Lake
Susan Park and Sunset Ridge Park. Sunset Ridge Park is situated across the street from this site.
The Comprehensive Trail Plan identifies an east/west connecting link along Lake Drive. On
other sections of Lake Drive, this walkway/trail is constructed as a concrete sidewalk. This
section of walkway will be developed as a component of the new section of Lake Drive.
The Park & Recreation Commission recommended the city require payment of full park and trail
dedication fees for Chanhassen Lakes Business Park 7th Addition.
RECOMMENDATION
"Staff recommends the Planning Commission recommend approval of site plan 99-6 for an
18,388 square foot office warehouse building to be located on Lot 4, Block 1, Chanhassen Lakes
Business Park 7th Addition, as shown on the plans dated April 16, 1999, subject to the following
conditions:
The applicant shall Increase plantings for buffer yard areas in order to meet ordinance

seed and disc mulch or wood fiber blanket or sod in accordance with the approved plans
within two weeks the completion of each activity in accordance with the City's Best
Management Practice Handbook.
All utility street improvements shall be construction in accordance with the City's latest
edition of Standard Specifications and Detail Plates.
All private streets/driveways shall be constructed to support a minimum of 7-ton per axle
design weight in accordance with City Code 20-1118.
The applicant shall apply for and obtain permits from the appropriate regulatory agency,
i.e. Watershed District.

applicant, Eden Trace Corporation, requests Site Plan Review for a 18,388 sq. ft. office/
warehouse building to be located on Lot 4, Block 1, Chanhassen Lakes Business Park
7th Addition on property zoned lOP, Industrial Office Park, and located east of Audubon Road,
north of Heron Dr., south of the Chicago, Milwaukee, St. Paul, Pacific Railroad tracks, Chanhassen
Lakes Partnership LLP.
What Happens at the Meeting: The purpose of this public hearing is to inform you about the
developer's request and to obtain input from the neighborhood about this project. During the
meeting, the Commission Chair will lead the public hearing through the following steps:
I. Staff will give an overview of the proposed project.
2. The Developer will present plans on the project.
3. Comments are received from the public.
4. Public hearing is dosed and the Commission discusses project. The commission will then
make a recommendation to the City Council.
Questions and Comments: If you want to see the plans before the meeting, please stop by City
Hall during office hours, 8:00 a.m. to 4:30 p.m., Monday through Friday. If you wish to talk to
someone about this project, please contact Sharmin at 937-1900 ext. 120. If you choose to
submit written comments, it is helpful to have one copy to the department in advance of the meeting.

Site Plan Review for Lot 4, Block 1, Chanhassen Lakes Business
Park 7th Addition Land Use Review File No. 99-13
Upon review of the plans prepared by Schoell & Mads0n, Inc. dated April 16,
1999, I offer the following comments and recommendations:
GRADING
The preliminary plat for Chanhassen Lakes Business Park (CLBP) 7th Addition was
approved by the City Council on April 12, 1999. Final plat and construction plan
approval is tentatively scheduled for the May 24, 1999 City Council meeting. In
conjunction with the platting of this project, the developer will rough grade all the
building sites and streets in the development and install the public utilities and
street improvements in Marshland Circle. Only minor grading is anticipated on the
lots after the project has been initially graded by the developer. Since the final
construction plans have not been approved, there may be minor adjustments of the
grades and/or utility connection points on this site. The plans label Lake Drive
West as Audubon Road. This should be revised accordingly. The preliminm3,
grading plans for this plat proposed a three to four-foot high earth berm along the
north side of Lake Drive West adjacent to this lot. The site plans will need to be
revised to incorporate berms along Lake Drive West as shown on the preliminary
plans to provide the required screening. The berming will not require
modifications to the proposed parking or building improvements as shown on the
plans.
The plans are proposing to create a regional stormwater pond just north of the site
to pretreat runoff prior to discharging into the wetlands. There is a finger of
wetlands that will be graded around and preserved. Erosion control fencing is
proposed around the grading limits. Staff recommends that erosion control fence
around the wetlands be Type III which is a heavy duty silt fence.
DRAINAGE
Stormwater runoff from the parking lot will be conveyed via storm sewers into the
regional stormwater p6nd north of the site for pretreatment. The northerly portion
of the storm sewer system on the site will be constructed by the developer and
owned and maintained by the City upon completion. The final plat will need to
dedicate a 20-foot wide drainage and utility easement centered upon the public
portion of the storm sewer line which lies north of the entrance off Marshland

Circle. In addition, the applicant shall enter into an encroachment agreement with
the City to construct the parking lot and landscape improvements within the City's
drainage and utility easement.
Detailed storm drainage calculations will be required to determine if there are
sufficient catch basins being provided to convey surface water runoff to the pond.
The drainage calculations shall be for a 1 O-year, 24-hour storm event and be
submitted to the City for review and approval at time of building permit
application.
UTILITIES
Municipal sewer and water is not available to the site at this time. The developer
has petitioned the City to construct the infrastructure and Lake Drive West
(Project No. 98-16) later this summer. The developer will be responsible for
extending the public utility and street improvements in Marshland Circle from Lake
Drive West which will provide utility service and access to this parcel. Installation
of the private utilities throughout the site (i.e. storm sewer, sanitary sewer, water)
will require permits and inspections through the City's Building Department.
STREETS
Lake Drive West is proposed to be constructed this year by the City. The
developer of CLBP 7th Addition will be responsible for constructing Marshland
Circle. An 8-foot wide trail will be constructed along the north side of Lake Drive
West adjacent this site. A 6-foot wide concrete sidewalk will be constructed by
the developer on the east side of Marshland Circle. Lake Drive West is classified
as a Class I collector street in the City's Comprehensive Transportation Plan. It is
also designated as a Municipal State Aid Route and is being constructed to
Municipal State Aid standards which prohibits parking along one side. Typically,
with Class I collector routes, the City prohibits parking on both sides of the street.
However, given the park location, staff/City Council may revisit the parking
situation in the future.
The plans propose two driveway access points, one from Marshland Circle and
another one from Lake Drive West. The driveway access from Lake Drive West
was not shown or approved with the preliminary plat for CLBP 7th Addition. Staff
has reviewed the sight"lines along Lake Drive West and believes the access will not
create any significant traffic concerns. The drive aisle width and parking stalls
appear to be designed in accordance with the City's ordinance. An industrial
driveway apron with pedestrian ramps will be required with construction of the

driveway access point at Lake Drive West. The other access points on Marshland
Circle will only require an industrial driveway apron.
MISCELLANEOUS
Site plan approval should include provisions for staff to administratively approve
minor changes to the site plan resulting from the final plat approval for Chanhassen
Lake Business Park 7th Addition and the City's Lake Drive West Public
Improvement No. 98-16. Changes may include grading, landscaping, and utility
connection points.
Issuance of building permits within the plat should be a topic for discussion. The
City requires that each site have a paved street access (7-ton design) prior to
issuance of a building permit. In addition, the utility improvements designated to
service the site will need to be installed, tested, and accepted by the City prior to
issuance of a building permit. The City in the past has typically issued one building
permit adjacent to a hard surfaced street to each subdivision. There have also been
situations in the past where the City issued up to four residential building permits
as long as they were easily accessed from a paved street (within 150 feet) and the
City's fire marshal's concerns were addressed. Given the timetable of this
development (CLBP 7th Addition) and the City's improvement project for Lake
Drive West, it is doubtful that the required utility and street improvements will be
completed prior to mid-November of 1999. Therefore, building permits other than
one off Audubon Road will not be issued until sometime in November, 1999.
RECOMMENDED CONDITIONS OF APPROVAL
1. Final grading shall incorporate a three to four-foot high berm along Lake Drive
West outside of the City's right-of-way.
2. Construction activities adjacent to wetlands shall be protected with Type III
erosion control fence.

5. Installation of the public utilities throughout the site will require building
permits through the City's Building Department.

The proposed driveway access onto Lake Drive West shall incorporate an
industrial driveway apron and pedestrian ramps in accordance with the City
details and pedestrian ramps. The other access point at Marshland Circle shall
also incorporate an industrial driveway apron.
The applicant will need to provide financial security in the amount f $5,000 to
guarantee installation of the driveway aprons, boulevard restoration, and
erosion control measures. Security may be in the form of a letter of credit or
cash escrow which will be returned upon satisfactorily completing the project.
All areas disturbed as a result of construction activities shall be immediately
restored with seed and disc mulch or wood fiber blanket or sod in accordance
with the approved plans within two weeks the completion of each activity in
accordance with the City's Best Management Practice Handbook.
9. All utility slxeet improvements shall be construction in accordance with the
City's latest edition of Standard Specifications and Detail Plates.
10. All private streets/driveways shall be constructed to support a minimum of 7-
ton per axle design weight in accordance with City Code 20-1118.
11. The applicant shall apply for and obtain permits from the appropriate
regulatory agency, i.e. Watershed District.
12. No berming is permitted within the City's right-of-way. Landscaping
improvements may be permitted subject to staff review and approval.
13. Site plan approval shall be contingent upon final platting of Chanhassen Lakes
Business Park 7th Addition.
14. The lowest floor or opening elevation of the building shall be a minimum of
two feet above the flood elevation, the adjacent wetland or stormwater
ponding area.

Planning Case 99-6 Site Plan Review.
I have reviewed the site plan for the above project. In order to comply with the Cbanhassen
Fire Department/Fire Prevention Division, I have the following fire code or city
ordinance/policy requirements. The site plan is based on the available information submitted at
this time. If additional plans or changes are submitted, the appropriate code or policy items
will be addressed.
.,1. Submit radius turn dimensions to City Engineer and Fire Marshal for review and approval.
Pursuant to 902.2.2.3, 1997 Uniform Fire Code.
Fire lane signage and yellow curbing will be determined by the Chanhassen Fire Marshal.
Contact the Fire Marshal for the exact location of fire lane signs and curbing to be painted
yellow. Pursuant to Section 904-1, 1997 Uniform Fire Code.
A 10 foot clear space must be maintained around fire hydrants, i.e., street lamps, trees,
bushes, shrubs, NSP, US West, Cable TV and transformer boxes to ensure that fire
hydrants can be quickly located and safely operated by firefighters. Pursuant to
Chanhassen City Ordinance 9-1.
If any trees are to be removed, they must be either cbipped or hauled off site. Due to close
proximity of neighboring homes, no burning permits will be issued.
Additional fire hydrants will be required on site. Contact the Chanhassen Fire Marshal for
exact location and indicate the revision on utility plan.
Install and indicate on utility plans the location of the PIV (Post Indicator Valve). Contact
the Fire Marshal for exact location.

Fire Marshal must witness the flushing of underground sprinkler
service line, per NFPA 13-8-2.1.
A final inspection by the Fire Marshal before a Certificate of
Occupancy is issued.
Fire Department access roads shall be provided on site during all
phases of construction. The construction of these temporary roads
will conform with the Chanhassen Fire Department requirements for
temporary access roads at construction sites. Details are available.
Onsite fire hydrants shall be provided and in operating condition
during all phases of construction.
The use of liquefied petroleum gas shall be in conformance with
NFPA Standard 58 and the Minnesota Uniform Fire Code. A list of
these requirements is available. (See policy #33-1993)
All fire detection and fire suppression svstems shall be monitored by
an approved UL central station with a UL 72 Certificate issued on
these systems before final occupancy is issued.
An 11" x 14" As Built shall be provided to the Fire Department. The
As Built shall be reproducible and acceptable to the Fire Marshal.

Numbers or addresses shall be placed on all new and existing
buildings in such a position as to be plainly visible and
legible from the street or road fronting the property. Said
numbers shall contrast with their background. Size and
location of numbers shall be approved by one of the
following - Public Safety Director, Building Official,
Building Inspector, Fire Marshal.
Requirements are for new construction and existing buildings
where no address numbers are posted.
