City council may approve a metes and bounds subdivision of a lot into two lots inside the urban services area if both resulting lots meet the minimum requirements of the zoning ordinance and abut an existing public street, pursuant to section 18 -37 (b) of the Chanhassen City Code. Access for parcel B shall be limited to Yosemite. The site www.ci.chanhassen.mn.us slopes from a high point of 1027 in the northwest corner of proposed Parcel B to a low point of 1009 in the southeast corner of the property. There are a couple trees in the northwest corner of Parcel B. Parcel B is currently used as a pasture for one horse with a fence surrounding it. This fence encroaches onto the proposed Parcel B and should be relocated to the new property line. A culvert conveys water from the southeast corner of the site across Yosemite to a stormwater pond on the east side of the road. A drainage and utility easement is proposed over this area to accommodate potential stormwater storage. Lots 1 and 4, Block 1, Stoddart Addition were combined as a zoning lot in 2008. City Code states that "after designation as a zoning lot the lot may not be subdivided without complying with the city's subdivision ordinance" (Section 20 -903 (c)). Therefore, Parcel A's legal description must be revised to include Lot 4, Block 1, Stoddart Addition. The proposed subdivision meets city ordinance requirements and staff is recommending approval subject to the conditions of this staff report. BACKGROUND June 1, 2012. Stable permit issued for 1611 West 63 Street to permit one horse. This permit must be renewed annually. (Chapter 5, Article Il, Division 2, Stable Permits require a minimum of one acre for a permit. Minimum 2 acres for two horses. October 2008. Lots 1 and 4, Block 1, Stoddart Addition combined as zoning lot. April 15, 1985. Final plat for Stoddart Addition creating four lots was approved. APPLICABLE REGULATIONS Chapter 18, Subdivisions Chapter 20, Article X1I, "RSF" Single - Family Residential District LAND USE: Residential Low Density (1.2 — 4.0 units per net acre) SUBDIVISION REVIEW The applicant is requesting a metes and bounds subdivision creating two lots. The net density of the development is 1.4 units per acre. GRADING, DRAINAGE AND EROSION CONTROL Minimal grading is required to build on Parcel B. Based on the information submitted, a retaining wall will be required northwest of the proposed building pad to ensure that runoff is diverted away _ f Todd Gerhardt Meyer Addition December 10, 2012 Page 3 of 6 from the proposed home. If the retaining wall exceeds four feet in height, it must be designed by an engineer and a building permit for the wall will be required. The lowest floor elevation of the existing and proposed homes shown on the plan meet the City Code requirements. Surface Water Management Fees Surface water management fees are based upon a net buildable acreage of 0.295. Water quality fees are calculated as $2,670.00 /acre (0.295ac) which is equal to $787.65 and water quantity fees are calculated as $3,820.00 /acre (0.295ac) which is equal to $1,126.90. Total surface water management fees due prior to recording the property deed are $1,914.55. STREETS The subject property is bound by West 63rd Street to the north and Yosemite Avenue to the west. These urban streets were reconstructed in 2007 and are sufficiently designed for the proposed subdivision. The driveway to the existing home will remain off of West 63rd Street. The driveway to Parcel B is proposed to connect to Yosemite Avenue, approximately 50 feet south of the West 63rd Street intersection. UTILITIES Sanitary sewer and watermain are within West 63rd Street and Yosemite Avenue. The existing home on Parcel A is currently connected to City sewer and water. Parcel B sewer and water services are off of Yosemite Avenue. Thirty percent of the sanitary sewer and water hookup fees must be paid before the deeds are recorded at the rate in effect at the time. The remaining 70% of the hookup fees must be paid with the building permit at the rate in effect at that time. EASEMENTS A drainage and utility easement dedicated with the Stoddart plat currently encumbers the eastern half of proposed Parcel B. The Stoddart subdivision information does not indicate specifically why such a large easement was granted. Originally the area in question was the low area of a 7.4 -acre watershed that discharges eastward to Clasen Lake via a culvert under Yosemite Avenue and southward under Yosemite Avenue. Wetland conditions were not present in this area. In 2007, the low area was filled in conjunction with the street and utility reconstruction project. Additional storm sewer was installed in Yosemite Avenue with the project, discharging to a stormwater pond to the south. The low area on the subject property is now primarily drained by the Yosemite Avenue storm sewer system; the culvert underneath Yosemite Avenue acts as an overflow structure. The applicant's engineer has completed a drainage analysis and calculated the peak elevation of runoff from the 7.4 -acre watershed during a 100 -year rainfall event. The applicant proposes to dedicate an easement over this elevation; therefore, staff supports vacating the existing easement Todd Gerhardt Meyer Addition December 10, 2012 Page 4 of 6 that encumbers the east half of proposed Parcel B. The applicant also proposes to dedicate perimeter drainage and utility easements for Parcels A and B in accordance with the City Code. FEES The applicant must pay the following fees before the deeds are recorded: Park Dedication fee: $5,800.00 Partial payment of the Water Hook Up: $1,715.00 Partial payment of the Sewer Hook Up: $632.00 Surface Water Management Fee: $1,914.55 GIS Fee: 2 parcels x $10 /parcel = $20.00 Recording Fees: 2 deeds x $46 /document $92.00 Total Cash Fees: $10,173.00 These fees are based on the 2012 rates. If the final subdivision submittals (deeds for recording and fees) are received after 2012, the rates in effect at that time will be collected. PARKS AND RECREATION The proposed Meyer development is located within an area that is in the municipal park service boundaries of Pheasant Hill Park. In lieu of parkland dedication, the development shall pay full park fees in force at the time of subdivision approval. Parks fees for 2012 are $5,800.00 for each new single - family lot. LANDSCAPING AND TREE PRESERVATION The applicant did not provide a tree inventory and removal plan for the subdivision. There are no bufferyard plantings required for this development. Tree preservation calculations for the development have been approximated and are shown below. If the trees are removed or damaged during construction, replacement will be required at a rate of 2:1 diameter inches. On December 10, 2012 the Chanhassen City Council met at its regularly scheduled meeting to consider the application of Jay Meyer and Kathryn Stoddart for a metes and bounds subdivision approval to create two lots. The City Council conducted a public hearing on the proposed subdivision preceded by published and mailed notice. The City Council heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Single - Family Residential District, RSF. 2. The property is guided in the Land Use Plan for Residential Low Density uses. 3. The legal description of the property is: Lots 1 and 4, Block 1, Stoddart Addition. 4. The Subdivision Ordinance directs the Planning Commission to consider seven possible adverse affects of the proposed subdivision. The seven (7) affects and our findings regarding them are: a. The proposed subdivision is consistent with the zoning ordinance; b. The proposed subdivision is consistent with all applicable city, county and regional plans including but not limited to the city's comprehensive plan; c. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and storm water drainage are suitable for the proposed development; d. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage disposal, streets, erosion control and all other improvements required by this subdivision ordinance; e. The proposed subdivision will not cause environmental damage; f. The proposed subdivision will not conflict with easements of record; and g. The proposed subdivision is not premature. A subdivision is premature if any of the following exists: 1) Lack of adequate storm water drainage. 2) Lack of adequate roads. 3) Lack of adequate sanitary sewer systems. 4) Lack of adequate off -site public improvements or support systems. 5. The planning report #2012 -19 dated December 10, 2012, prepared by Robert Generous, et al, is incorporated herein.
