Notice of this public hearing has been mailed to all property owners within the required 500 feet. Staff is recommending approval of the request with conditions. If it meets these standards, the City must then approve the site plan. This is a quasi-judicial decision. The City has limited discretion in approving or denying conditional use permits, based on whether or not the proposal meets the conditional use permit standards outlined in the Zoning Ordinance. If the City finds that all the applicable conditional use permit standards are met, the permit must be approved. This is a quasi-judicial decision. West Fire Station Communication Antenna Planning Case 2013 -05 February 5, 2013 Page 2 PROPOSAL /SUMMARY The applicant is requesting a conditional use permit and site plan approval for the construction of a 60 -foot pole with a 10 -foot antenna for a utility meter reader. The pole is proposed to be situated south of Highway 7 and north of Minnewashta Parkway. Q. Subject =.� Site Jaw F w• A single 10 -foot antenna will be mounted above the 60 -foot pole. The pole will have a base of 11.25 inches wide and tapers as it reaches the highest point. The control equipment will be housed inside the fire station building located on the subject site. No landscaping is proposed since the site has existing mature tree cover. No trees are proposed to be removed. The pole will be fully screened by the existing mature trees. Access to the pole is provided via the parking lot that serves the fire station which is accessed off of Minnewashta Parkway. Staff is recommending approval with conditions. BACKGROUND On September 24, 2012, the City Council approved a contract to replace the City's water meter radios. These radios are connected to every residential and business water meter in the city and allow the City to read the meters with a City vehicle equipped with a meter reader. This system is considered a drive -by system. Most of the City's water meter radio batteries are over 10 years old and are failing. A cost - benefit analysis was completed for the water meter radio project to determine a cost - effective and long -term solution for the radios. It was determined the drive -by meter radios should be replaced with a fixed -based collection system. This system is more efficient and offers a lot more customer service features then the old system. This system also has the longest life expectancy. In order for the fixed -based system to collect the water meter West Fire Station Communication Antenna Planning Case 2013 -05 February 5, 2013 Page 3 information, collectors need to be installed throughout the City. A propagation study has been completed by the system manufacturer which identified the need for six collectors. Most of the collectors can be located on existing water towers or antenna poles owned by the City. However, no existing city -owned infrastructure in the northwest corner of the City is tall enough to service this area. GENERAL CONDITIONAL USE PERMIT AND SITE PLAN The applicant is requesting a conditional use permit and a site plan review to construct a 60 -foot monopole with a 10 -foot antenna for a utility meter reader. The City's Zoning Ordinance allows towers and antennas in Office and Institutional Districts subject to the approval of a conditional use permit by the City Council. In reviewing conditional use permit requests, the Planning Commission must consider possible adverse affects of the use. The standards are: The City of Chanhassen finds it necessary for the promotion and preservation of the public health, safety, welfare, and aesthetics of the community that the construction, location, size, and maintenance of wireless telecommunication facilities be controlled. Further, the City finds: (1) Towers and antennas have a direct impact on, and a relationship to, the image of the community; (2) The manner of installation, location, and maintenance of towers and antennas affects the public health, safety, welfare, and aesthetics of the community; (3) A reasonable opportunity for the establishment of wireless telecommunication must be provided to serve residential and business needs, and; (4) Uncontrolled and unlimited towers and antennas adversely impact the image and aesthetics of the community and, thereby, undermine economic value and growth. The following constitutes our findings: A 60 -foot high pole with a 10 -foot antenna at this location should not be injurious to the use and enjoyment of surrounding property or substantially diminish property values, as the proposed tower is virtually hidden from views and surrounded by existing mature vegetation. Further, the proposed tower should not endanger the public health or safety if the conditions attached to the permit and building code requirements are adhered to. In locating a pole, the applicant must demonstrate that the antenna cannot be accommodated on an existing or approved tower or building within a one -mile search radius. The applicant is requesting approval to erect a monopole because there are no existing structures of adequate height in this portion of the City. These trees are approximately 40 feet tall. The fire station is on the east side of the parking lot. The properties on the south side of Minnewashta Parkway, south of the fire station have a finished floor elevation lower than Minnewashta Parkway. These lots also have mature trees that are along Minnewashta Parkway which provides screening. Due to the existence of mature trees in the area and the significant distance to other properties in the area from the proposed pole site, no additional landscaping is planned. Staff took images showing the pole in the proposed location using the fire department ladder truck. The top of the fire truck railing is approximately the height of the proposed pole. City Code does require new antenna support structures to be designed to accommodate additional users. Providing opportunities for co- location is important if the total number of towers in the City is to be kept at a minimum. However, this tower is anticipated to be too short to accommodate cellular providers. In the future, an internet communication system may be installed on the pole to service the fire station. The pole is proposed to be installed at the north side of the fire station parking lot as shown in this exhibit. COLLECTOR EQUIPMENT A small collector equipment box (16" x 20 ") will be installed inside the fire station so the equipment is in a controlled environment. No other equipment is needed to be installed outside. PARKING Parking is available at the fire station to service the equipment. Staff expects only minimal vehicle traffic to visit the site for maintenance purposes. Maintenance of the equipment is anticipated to be completed by the City utility department. LANDSCAPING The fire station property is surrounded by mature trees. No trees or vegetation will be removed to install the pole. Staff is not proposing to plant any additional landscaping screening materials since the property is heavily wooded. LIGHTING The parking lot does not have any lighting. The pole is not planned to add any parking lot lighting. The pole will not be illuminated by artificial means and does not meet the criteria for needing strobe lights. SIGNAGE No advertising signage or identification of any kind will be placed on the pole. No site grading will be needed to install the pole. The drainage pattern of the fire station property will not change. MISCELLANEOUS The radio meter contractor shall submit to the City a footing pole design and drawing signed by a registered engineer. An internal sense of order for the buildings and use on the site and provision of a desirable environment for occupants, visitors and general community; b. The amount and location of open space and landscaping; C. Materials, textures, colors and details of construction as an expression of the design concept and the compatibility of the same with adjacent and neighboring structures and uses; and d. Vehicular and pedestrian circulation, including walkways, interior drives and parking in terms of location and number of access points to the public streets, width of interior drives and access points, general interior circulation, separation of pedestrian and vehicular traffic and arrangement and amount of parking. (6) Protection of adjacent and neighboring properties through reasonable provision for surface water drainage, sound and sight buffers, preservation of views, light and air and those aspects of design not adequately covered by other regulations which may have substantial effects on neighboring land uses. The site design is compatible with its surroundings. It is functional. Conditional Use Permit Findings When approving a conditional use permit, the City must determine the capability of a proposed development with existing and proposed uses. The general issuance standards of the conditional use Section 20 -232, include the following 12 items: 1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. Finding The proposed pole will provide a basic utility to the area. 2. Will be consistent with the objectives of the city's comprehensive plan and this chapter. Finding The proposed use is consistent with the city's comprehensive plan and generally complies with city ordinance requirements. 3. Will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. Finding The proposed pole complies with city ordinance requirements. The pole will be screened by existing vegetation. 4. Will not be hazardous or disturbing to existing or planned neighboring uses. Finding The proposed tower will not be hazardous to existing or planned neighboring uses. 5. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Finding The City will service the pole adequately. 6. Will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. Will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. Finding The proposed development will not destroy or damage natural, scenic, or historic features. 10. Will be aesthetically compatible with the area. STAFF RECOMMENDATION Staff recommends the Planning Commission adopt the following motions: Site Plan Review "The Planning Commission recommends the City Council approve Site Plan Permit - Planning Case 2013 -05 for a 60 -foot pole with a 10 -foot antenna as shown in Attachments 3 and 4, and adopts the attached Findings of Fact and Recommendation, subject to the following conditions: 1. A building permit is required to construct (erect) the tower (pole). 2. The tower must be designed for a 90 MPH wind load including the effect of one -half inch of radial ice. The contractor shall meet with the Inspections Division as early as possible to discuss plan review and permit procedures. The tower shall not be illuminated by artificial means and shall not display strobe lights unless such lighting is specifically required by the Federal Aviation Administration or other federal or state authority for a particular tower. 4. No signage, advertising or identification of any kind intended to be visible from the ground or other structures is permitted, except applicable warning and equipment information signage required by the manufacturer or by Federal, State, or local authorities." On February 5, 2013, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of the City of Chanhassen for a conditional use permit and site plan approval for the property legally described as: Part of LOT 2 of SCHMID'S ACRE TRACTS described as follows: Commencing at the most Southerly corner of lot 2 then northerly along the southeasterly line of lot 2 a distance of 413.94' to the point of beginning.
