Finance Phone: 952.2271140 Fax: 952.2271110 The city's 2013 budget includes $42,750 in expenditures for the Aquatic Invasive Species Management Program. An additional $13,000 to $15,000 in Park & Recreation administration costs are expected to be invested in the 2013 program. Web Site The funding sources for watercraft inspections are currently programmed to www.ci.chanhassen.mn.us include a $25,000 contribution from the Riley Purgatory Bluff Creek Watershed Chanhassen is a Community for Life - Providing for Today and Planning for Tomorrow Park & Recreation Commission March 26, 2013 Page 2 District (RPBCWD), a $10,000 contribution from the City of Chanhassen, and a $7,750 Grant from the Minnesota Department of Natural Resources. In the event that one or more of these funding sources is reduced or eliminated, the program hours and duration would be reduced. In 2012, the Lotus Lake Conservation Alliance contributed $7,050 to add inspection days and hours at the Lotus Lake public water access. In the event that this group contributes again in 2013, inspection days and hours will again be increased for Lotus Lake. The 2013 City of Chanhassen Watercraft Inspection Program is currently budgeted to include 102 days of inspections at Lake Ann, Lake Susan and Lotus Lake commencing on May 24 and concluding on September 2. Inbound and outbound watercraft inspections will be conducted by Minnesota Department of Natural Resources Trained Level I Watercraft Inspectors. The inspectors are employed by the City of Chanhassen through a contact with Volt Workforce Solutions. Inspectors will be on duty at these city -owned public water accesses on Fridays, Saturday, Sundays, holidays and the full week of the 4 th of July from 5 a.m. to 8 p.m. and all other days between May 24 and September 2 at Lotus Lake from 5 a.m. to 9 a.m. and 4 p.m. to 8 p.m. The MnDNR may also conduct watercraft `inspections at Lotus Lake'independent of the city program. During the 2012 program, the following compliance and failure rates with State of Minnesota aquatic invasive species and watercraft transportation laws were recorded. • Lake Ann Arrivals in compliance with State Law — 96% (263) Arrivals in violation of State Law — 4% (11) • Lake Susan Arrivals in compliance with State Law — 95% (308) Arrivals in violation of State Law — 5% (15) • Lotus Lake Arrivals in compliance with State Law — 94% (1434) Arrivals in violation of State Law — 6% (85) The full 2012 Annual Report is attached. ' M41; '' • „` 0 :v ...4: , /1 Allot, , :: f. .4% A ve . - i; I Program Background • In 2010, Zebra Mussels were discovered in Lake Minnetonka. • Over 100 Minnesota lakes and waterways have been confirmed as containing zebra mussels. • Concern over the close proximity of an abundant Zebra Mussel population prompted the Lotus Lake Conservation Alliance to initiate a volunteer -led AIS Inspection Campaign at the South Lotus Lake Park Public Boat Access in 2011. • In 2012, the City of Chanhassen initiated an Aquatic Invasive Species Program at three City -owned and operated public water accesses — Lake Ann, Lake Susan and Lotus Lake. • The Lotus Lake Conservation Alliance (LLCA) continued to fill a portion of the unstaffed hours at the Lotus Lake Public Water Access with volunteer inspectors. • The MnDNR also conducted watercraft inspections at the Lotus Lake Public Water Access in 2012. • . ►r ki t ;. r ,"x r ._JL. ►. _ _ - . �.1 c_.. A distant third was transporting a watercraft with water on board. • A single zebra mussel was identified after being transported to the Lotus Lake public water access. J �i �' -_�'� �r 4r .. .lr. r t • ^. rL, v ' ..1 •may ... .._ - ,. �. +... � +nom �. �. . __... °' '- Oi PHOTO COURTESY OF TERRI KELLY 2012 Watercraft Inspection Program Financial Statement Program Budget: Inspections: 2,508 @ $15.75 each $39,501.00 Supervision: 150 hours @ $15.75 $2,362.50 Training: 100 hours @ $15.75 $1,575.00 Equipment /Materials /Uniforms $1,863.00 Total $45,301.50 Actual Program Expense: Volt Workforce Solutions $42,000 Program Administration costs (approx.) $13,700 :.. � 1...:` f -._ -.. _, _ _ -. -- � '• _ , -f Best Management Practices for Water Accesses • On February 27, 2012, staff reviewed proposed action steps for a 2012 Aquatic Invasive Species Program, including proposed best management practices (BMP) for city -owned boat access sites with the City Council. • The goal is to educate the public about the presence of aquatic invasive species (AIS) in our environment and how best to avoid spreading these species. • Existing BMPs were inventoried and proposed BMPs were evaluated for both entering and exiting watercraft.The Minnesota Department of Natural Resources delivered a variety of AIS education signage to the city for installation at public water locations. • Signage kiosks were manufactured and installed at all three city -owned public water access locations and a "clean in /clean out" street stencil was purchased to facilitate painting this message on the in -bound and out -bound approaches to each access. • In total, $4,900 was invested in materials and supplies for Best Management Practices for water access improvements. • The largest portion of the 2012 BMP proposal, $11,400 for additional asphalt, was not completed to minimize additional hard surface areas at the landings. • The city will continue to procure and install AIS educational signs as they become available and implement any new BMPs that are identified and approved. PHOTO COURTESY OF TERRI KELLY Grants & Collaboration with Other Project Partners • City Council and staff have worked with numerous agencies and organizations in an effort to protect area lakes from infestation by aquatic invasive species. Discussions between the Minnehaha Creek Watershed District and officials from area municipalities were initiated on March 10, 2011. Subsequent to this meeting, additional organizations became involved in seeking a solution including the MN Department of Natural Resources, Carver County Parks, Riley- Purgatory -Bluff Creek Watershed District (RPBCWD) and Lakeshore associations and homeowners from Minnewashta, Christmas and Lotus Lake. • As a result of this collaboration, the City of Chanhassen, RPBCWD, and the Lotus Lake Clean Water Alliance participated in a program to inspect watercraft entering and exiting Chanhassen area lakes with a city -owned access point. In addition, the Department of Natural Resources offered training for inspections and funds to help defray the costs of the inspection program. The city also was responsible for installation and maintenance of signage. • The Minnehaha Creek Watershed District collaborated with the Christmas Lake Association, the Lake Minnewashta Association and Carver County Parks to administer similar programs on Christmas Lake and Lake Minnewashta. The public water access for Lake Minnewashta is owned by Carver County Parks and the Christmas Lake public water access is located in Shorewood. y 7$ aumm juirmiumnim Ali - le fr it - ' — " 7 ' main HOTOCO RTESYO TERRIKELLY Public Education and Education on AIS • The City of Chanhassen sponsored a public meeting on aquatic invasive species at the Chanhassen Recreation Center on October 29, 2011. This meeting is available online on the City's website, as are numerous links to other educational resources concerning aquatic invasive species, as well as general lake management information. Staff from the MN Department of Natural Resources, the Lotus Lake Clean Water Alliance, the Christmas Lake Association as well as staff members from the City of Chanhassen and other concerned community members provided input at this meeting. • During the 2011 boating season, the city received signs from the Minnesota Department of Natural Resources that were placed at the Lotus Lake boat launch. In 2012, additional signage was added at Lake Susan and Lake Ann. Other methods to disseminate information included literature and pamphlets available at city offices and collaborating with Minnehaha Creek Watershed District and Carver County Environment and Natural Resources on drafting articles for the Connection, the Villager and other publications. rJL��._. We areasking the Pads and Recreation Commission to consider recommending to City Council implementation cif a multi -lake apptaach to inspections, to inerease the hours per day and number of days of inspection coverage for Lake Ann, Lake Susan and Lotus Lake. This type of plan has the support of the Riley Purgatory Bluff Creek Watershed Dtst ict. The LLCA believes the proposed pilot program is a good compromise plan, one that balances lake preservation and boater convenience. Currently proposed plan — Option A: - In 2012, part-time MS inspections were performed by an inspector on site at each lake, Inspector (Volt) labor was paid for by: o Watershed $25,000 o 1NR $7,500 o LLCA $7,050 o Chanhassen $2,450 (budgeted $10,000) - For 2013, Chanhassen is considering implementing a plan much like the 2012 plan, adding one hour to the Friday through Sunday morning schedule, with inspections starting at each ramp at 5 :00 a.m. instead of 6:00 a.m. For ease of diseussion, this plan will be referred to in this document as Option A. See Exhibit 1 for the Option A Inspection Schedule. - Total budget for the 2013 Option A plan is $49,550. See Exhibit 2 for Option B Budget. Why the LLCA is asking the Parks and Recreation Commission to consider another option; The LLCA believes that the currently recommended part-tune inspection program for 2013 (Option A) is potentially harmful for Chanhassen's lakes because: - Inspections last year prevented infestations at both Lake Minnewashta and Lotus Lake. - Inspection of all incoming watercraft is an essential part of any effective AIS prevention program. Option A does not provide this coverage. - Proximity to super- spreader lakes like IvMinnetonka and Prior puts Chanhassen's lakes at high risk. - 14% of boaters launching in Chanhassen lakes had last launched in infested waters. - 8% of boaters arriving at Chanhassen's lakes were in violation of state AIS laws. Most violations were for hull plug in place, water on board, or weeds on the trailer, The LLCA believes that a plan that covers more days and more hours would better protect Chanhassen's lakes, and so we are suggesting an alternate pilot program, or Option B. Lotus Lake Conservation Alliance 1 Proposal for 2013 AIS Prevention Plan Highlights of Option B: - Option B is the type of plan that is supported by the Riley Purgatory bluff Creek Watershed District, the principle funding source for AIS prevention in Chanhassen (see Exhibit 3). - Centralized inspection station located at Lotus Lam, serving all three lakes. Previously, the LLCA proposed centralized inspections at Lake Ann Park, because it is a larger facility. But based on analysis of the 2012 watercraft inspection data (entering boats only), the vast majority of boaters are headed for Lotus Lake, which makes Lotus the most convenient spot for boaters. = Launch information based on 2012 data - Friday through Sunday, Memorial Day to Labor Day; Total Launches %, of Lauuehes Launches s per Day Lake Ann 209 14% 7 Lake Susan 277 19% 9 Lotus take 9 67% - 32 - Based on a license plate analysis of boaters visiting Where the boaters come from: Chanhassen lakes in 2012, 76% of boaters are coming Shakopee from other cities. 2 % ��,, 24% - Of this 76% approximately 74% are coming from the East or Northeast, and are likely to be headed down Other Highway 101 or :Highway 5. Edina 3% 2 % - Of the 48 boaters visiting a Chanhassen lake on a typical summer weekend day, approximately 3 visitors to Lake Ann, and 5 to Lake Susan, would be coming from the South or West. For these 8 boaters, Lotus is 1.5 miles from Lake Susan, and 2 miles from Lake Ann. The other 40 visitors, or 84% of all visitors, would either be heading to or by South Lotus Lake Park. Weekday traffic would obviously be lower, but there is no data for weekdays at Lake Ann or Lake Susan. - Option B is a pilot program that could be modified as learning occurs during the boating season. - All boats legally entering Chanhassen's lakes during the 2013 boating season (May 11 November 15) would be inspected for AIS, and given a tag, valid for that day only, to hang from their rear view mirror to show they've been inspected (see example on page 6). - Inspections would run from: o 5:00 a.m. to 9:00 p.m., May 11 (Fishing Opener) to September 2 (16 hours, 111 days) o 6 :00 a.rn. to 9:00 pm., September 3 to November 15 (15 hours, 72 days) - Total costs for Option B would be $49,116, which is $434 less. than Option A. A centralized inspection program is the least expensive way to conduct Level 1 inspections for all of Chanhassen's lakes. Option B is specifically designed to protect Lake Ann, Lake Susan and Lotus Lake equally. - An attempt to "privatize" the lakes. The LLCA's goal is to preserve each of Chanhassen's lakes so they can be enjoyed by people and provide habitat for native fish and plants for generations to come. To this end, the LLCA has been working with the City, Watershed and DNR for the past several years to protect Chanhassen's lakes. The LLCA was awarded Chanhassen's Environmental Excellence Award in 2011 for our work to preserve Lotus Lake. - Difficult to implement. All of the recommendations could easily be implemented in time for the upcoming 2013 boating season, Nearby LGU's that are inspecting all inbound watercraft: - Carver County is moving towards a centralized inspection program. At the February 26 2013 meeting "Maluchnik moved, Workman seconded, to direct staff to pursue alternative solutions for centralized Christmas Lake inspections at Lake Minnewashta. Motion carried unanimously." (From Carver County Commission minutes.) Staff will also be investigating adding other Carver County takes to the centralized inspection model. Agreements for centralized inspections are currently being worked on between. Carver County and Shorewood, the DNR, and the Minnehaha Creek Watershed District. Who is supporting this plan? - The Riley Purgatory Bluff Creek Watershed District, the primary fonder of Chanhassen's AIS prevention program, unanimously passed a resolution at their March 6 2013 meeting to support a centralized, multi-lake inspection approach to MS prevention (see Exhibit 3). - The DNR has suggested this type of plan as a way for LGU's to prevent the spread of AIS in a cost-effective manner. - The Minnesota Legislature passed laws in 2012 making this type of centralized inspection program legal. Our proposed program meets all the requirements of the new laws. The Riley Purgatory Bluff Creek Watershed District agrees that a multi-lake Inspection program should be developed for Chanhassen's lakes, To put things in plain terms, the issue boils down to this: which option provides the best protection for Chanhassen's lakes, while not overly burdening visiting boaters. Is it better for the City of Chanhassen to implement Option A, a parkime inspection program with inspectors at each park, or is it better to implement Option B, and inspect twice the hours and twice the days, but send an average of 8 boaters on the heaviest use days (3 from Chanhassen) to a eentralized inspection station located 2 miles or less away? It is important to remember that these boater figures are for the highest use days, and that on a typical summer weekday or fall day, these figures would be lower. The LLCA is asking the Parks and Recreation Commission to consider this question. Over the past several years, The LLCA has reconimended a variety of different plans to keep additional AIS out of Chanhassen's lakes, but we feel that we have now developed a good compromise plan, one that places the proper balance between lake protection and boater convenience. We are asking the Parks and Recreation Commission to endorse Option B, and recommend to City Council implementation of this plan for the 2013 boating season. Compliance with aquatic invasive species inspection requirements is an express condition of Operating or transporting water-related equipment An inspector mayprobibit an individual from placing or operating water-related equipment in. w eters of the state If the individual refuses to allow an inspection of the individuars - watee-telated equipment or refuses to remove and dispose of aquatic invasive spe,cies, aquatic macrophytes, and water. - Subd. 2. Inspector authority. (a) The commissioner shall train and authorize individuals to inspect water-related equipment for aquatic macrophytes, aquatic invasive species, and water. The commiseioner may enter into a delegation agreement with a tribal or local government where inspection authority as provided under paragraphs (b), (g), and (h) is delegated to tribal' and local governments that assume all legal, financial, and administrative responsibilities for inspection programs on some or all public waters - within their jurisdiction. (h) Inspectors may visually and tactilely inspect watercraft and water-related equipment to determine whether aquatic invasive species, aquatic macrophytes, or water is present If a person transporting watercraft or water-ranted equipment refuses to take required corrective actions or fails to comply with an order under section ma to, subdivision 3, an inspector - who is not a licensed peace officer shall refer the violation to a conservation officer or other licensed peace officer. (e) In addition to paragraph (b), a conservation officer or other licensed peace officer may inspect any watercraft or water-related equipment that is stopped at a water access site, any other public location in the state, or a private location where the watercraft or water-related equipment is in plain view, if the officer determines there is reason to believe that aquatic invasive species, aquatic- macrophytes, or water is present on the watercraft or water-related equipment. (d) Conservation officers or other licensed peace officers may utilize check stations in locations, or in proximity to locations, where watercraft or other water-related equipment is placed into or removed _from waters of the state. Any check stations shall be operated in a manner that minimizes delays to vehicles, equipment, and their occupants. (e) Conservation officers or other licensed peace officers may order water-related equipment to be removed from a water body if the commissioner determines such action is needed to implement aquatic invasive species control measures. (1) The commissioner may require mandatory inspections of water4elated equipment before a person places or removes water-related equipment into or out of a water body. Inspection stations may be located at or near public water accesses or in locations that allow for servicing multiple water bodies. The commissioner shall ensure that inspection stations: (1) have adequate staffing to minimize delays to vehicles and their occupants; (2) allow for reasonable travel times between public accesses and - inspection stations if inspection is required before placing water-related equipment into a water body; (3) are located so as not to create traffic- delays or public safety issues; (4) have decontamination equipment available to bring water-related equipment into compliance; and (5) do not reduce the capacity or hours of operation of public water accesses. Tribal and local governments that are authotized to conduct inspections under this paragraph must: (1) assume all legal, financial, and 4ministrative responsibilities for implementing the mandatory inspections, atone or in agreement with other tribal or local governments; (2) employ Inspectors that have been trained and authorized by the commissioner; (3) conduct inspections and deeontamination_measures In accordance with guidelines approved by the commissioner, (4) have decontamination equipment available at inspmtion stations or identify alternative decontamination equipment locations will& a reasonable distance of the inspection station that can bring water-related equipment into cotnpliarice; (5) provide for inspection station locations that do not create traffic delays or public safety isaues; and (6) submit a plan approved by the commissioner wording to paragraph (h). (h) Plans required under paragraph (g) must address: (1) no reduction in capacity or hours of operation of public accesses and fees that do not discourage or limit use; (2) reasonable travel times between public accesses and inspection stations; (3) adequate staffing to minimize wait times and provide adequate hours of operation at inspection stations and public accesses; (4) adequate enforcement capacity; (5) measures to address inspections of water-related equipment at public water accesse& for commercial entities and private riparian land owners; and (6) other elements as required by the commissioner to ensure statewide consistency, appropriate inspection and decontamination protocols, and protection -of the state's resources, pubic safety, and access to public waters. (1) A goverwnent unit authorized to conduct inspections under this subdivision must submit an annual report to the connois.sioner summarizing the results and issues related to implementing the inspection program. (j) The commissioner may waive the plan requirement in paragraph (g) for inspection programs where authorized inspectors are placed directly at one or more water access sites, with no requirement for a person to travel from the water access for inspection or decontamination, and no local ordinance or other regulation requiring a mandatory inspection before placing watercraft or water-related equipment into a water body or after watercraft or water-related equipment are removed from a water body.
