Councilman Shulstad moved the adoption of the following resolution: BE IT RESOLVED, by the City Council of the City of Chanhassen, Minnesota, as follows: 1. It is hereby found and determined that Schoell and Madson, Inc., the Consulting Engineers for the City, have reported to this Council that a local improvement as hereinafter described is feasible and may best be made as proposed, and that the estimated cost of said improvement to the City is $1,715,445.00. 2. Said improvement consists of the following: Installation of trunk and lateral water and sanitary sewer mains, sewer lift stations, and restoration of all streets within Carver Beach Addition and contiguous areas to be served by said facilities. 3. This Council shall meet at the Chanhassen Elementary School on the 12th day of June 1975, at 7:30 p.m., for the purpose of holding a public hearing on the proposed construction of said improvement. 4. The Clerk is authorized and directed to cause notice of the time, place and purpose of said meeting to be published for two successive weeks in the Carver County Herald, being the official newspaper of the City, the first of such publications to be not less than 10 days and the second not less than 3 days prior to the date of said meeting, and to be mailed to the owners of the property in the area proposed to be assessed not less than 10 days prior to the date of said meeting. It is hereby found and determined that notice of hearing on a sanitary sewer and water improvement in the City was duly mailed on NAY ,2 ,1975,and published in the Carver County Herald, the official newspaper of the City, on May 29, and June 5, 1975, as re- quired by Minnesota Statutes, Chapter 429, and as ordered by resolution of this Council adopted on May 23, 1975. 2. A public hearing having been held on June 12, 1975, and opport- unity having been given at such hearing to all persons to make known their views on said improvement, and this Council being fully advised of the pertinent facts, does hereby order the construction of said improvements, in accordance with the description thereof contained in said notice of hearing, and as shown in the feasibility study for • sanitary sewer and water service to the Carver Beach area submitted by the City Engineers under date of April 10, 1975, but deleting therefrom the reconstruction or upgrading of the existing Sunrise Hills Lift Station and the location of the 8" forcemain extending southerly or southeasterly therefrom but including the proposed 8" forcemain from the proposed Carver Beach Lift Station to the existing Sunrise Hills Lift Station. 2a. The Council shall take immediate steps to provide for an outfall for the proposed Carver Beach sewer by either approving the 8" forcemain along the shoreline of Lotus Lake as proposed in the initial feasibility study or by acting to authorize the placement of the forcemain as shown as alternates #1 & 2 under the supplemental feasibility study of the City Engineers! dated June 20, 1975. 3. said improvement is hereby designated and shall hereafter be referred to as "Carver Beach Sanitary Sewer & Water Improvement Project No. 75 -2. 4. Schoell & Madson, Inc., the consulting engineers for the City are hereby authorized and directed to prepare final plans and specifi- cations for said improvement and to submit them to this Council. 5. The City hereby determines that it is necessary to acquire all property rights which will be needed for the construction and location of the trunk and lateral sanitary sewer and water mains and related facilities described in Paragraphs 2 and 3; and the such acquisition is in the public interest and for the public purpose authorized by Minnesota Statute 444.075. -2- . 6. Russell H. Larson, Attorney at Law, is hereby authorized and directed to proceed with the acquisition of all such property rights by negotiation, contract or condemnation, and is authorized to do all things necessary to secure the right of entry or possession of such property for construction purposes as soon as possible. It is hereby found and determined that notice of hearing on a street and storm sewer improvement in the City was duly mailed on March 19, 1975 , 1975, and published in the Carver County Herald, the official newspaper of the City, on March 6, 1975, and March 13, 1975, as required by Minnesota Statutes, Chapter 429, and as ordered by resolution of this Council adopted on February 24, 1975. 2. A public hearing having been held on March 31, 1975, and opportunity having been given at such hearing to all persons to make known their views on said improvement, and this Council being fully 0 advised of the pertinent facts, does hereby order the construction of said improvements as follows: a. The improvement of 79th Street within Frontier Development Park consisting of the construction of a nine (9) ton bituminous roadway, 36 feet in width, with concrete curb and gutter. b. Construction of a storm sewer system within Frontier Development Park consisting of the installation of storm water drainage pipes, catch basins, and earthen swales. c. Construction of a storm water drainage system at the south- west corner of Trunk Highways 101 and 5 consisting of excavation, pipe jacking, sodding, placement of pipe, rip -rap and aprons, and employing storm drain system Alternate C (also shown as Alternate 3) on the City Engineers' drawing of May 19, 1974, and underground storm drain pipe throughout the entire course of the storm water drainage system along the southerly right of way of Highway 5 and southerly along the easterly right of way of Highway 101. d. The foregoing authorization for this improvement is contingent upon the receipt by the City Attorney of a satisfactory arrangement for the dismissal of the pending lawsuit by Martin Ward versus the City of Chanhassen and Martin Ward versus the State of Minnesota now pending in Carver County District Court not to exceed sixty (60) days • from the date hereof. 3. Said improvement is hereby designated and shall hereafter be . referred to as Storm Sewer g Street Improvement Project No, 74 -1A. 4. Schoell g Madson, Inc., the consulting engineers for the City are hereby authorized and directed to prepare final plans and specifi- cations for said improvement and to submit them to this Council. 5. BE IT, THEREFORE, RESOLVED by the City Council of the CITY OF CHAN- HASSEN as follows: July 14, 1975 CHANHASSEN 1. Effective and until further notice name of city will be a member of the CARVER COUNTY CIVIL DEFENSE COMMON ORGANIZATION. 2. This for the purpose of receiving and considering sealed bids for the construction of said improvement, and the Clerk is hereby authrozied and directed to cause notice of said meeting to be published in the official news- paper and in the Construction Bulletin, published at Minneapolis, Minnesota, once at least three weeks prior to the time of said meeting, accompanied by a cashier's check or certified check or bid bond in the amount of at least 5% of the respective bid, that the Council reserves the right to hold such bids for a period of 40 days without explanation and to waive any informalities. WHEREAS, the City of Chanhassen meets all the eligibility criteria for such grants as set forth in the Department of Agriculture's Regulation Agr 107, including the administration of • a shade tree disease control program approved by the Minnesota Commissioner of Agriculture, and a local subsidy program which is compatible with the administrative requirements of the State grant program. WHEREAS, $17,000.00 has been appropriated by the City of Chan- hassen for the local subsidy program and based upon the appropriate formulas and tree surveys, it has been estimated that the amount of State grant will not exceed $3,000.00 for the fiscal year ending December 31, 1975. NOW THEREFORE BE IT RESOLVED BY THE City Council of Chanhassen, Minnesota (1) That such plans and specifications are hereby approved. (2) That the City Engineer shall prepare and cause to be inserted in the official City Newspaper an advertisement for bids upon making of such improvement under such approved plans and specifications. The advertisement shall be published for 21 days, shall specify the work to be done, shall state that bids will be opened and considered by the Council at 11:00 a.m. on January 8, 1976, in the Council Chambers of the City Hall and that no bids will be considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashiers check, bid bond or certified check payable to the Clerk for 5% of the amount of the bid.
