Sales Tax Procedures
Bruce, as you know I went to a sales tax seminar put on by National Seminars Group,
Padgett-Thompson on Friday, December 12, 2003. We also received a letter from
HLB Tautges Redpath regarding sales tax laws. After attending the seminar, reading
the letter from HLB Tautges Redpath and the sales tax fact sheets from the Minnesota
Department of Revenue regarding recreational areas, I believe there are some changes
that we need to make concerning our sales tax reporting. The following is a list of
some of the sales tax laws we need to address:
League fees at Lake Ann. Admission to recreational areas owned by city
governments is subject to sales tax. These admissions include league fees. We should
be collecting sales tax on league fees for softball at Lake Ann. The issue of paying
sales tax twice on softballs needs to be discussed further. At this time we pay sales tax
when we purchase the softballs. If we pay sales tax now on the entire league fee are
we paying sales tax twice when we are supplying the softballs to the league as part of
their fees?
The Chan Rec Center. Basketball leagues should come under the same ruling as the
league fees at Lake Ann. We should be collecting sales tax on these fees also. Another
issue would be the people who use the exercise rooms at the Rec Center to work out on
their own schedule. This would not apply to people who are taking aerobic classes,
only to those who are using the equipment on their own time.
Canoe rack rentals. We have always collected sales tax on these rentals but I don't
believe we need to do this. The Minnesota Department of Revenue says that boat
launching and slip rental fees are nontaxable sales. The issue is whether the canoe rack
rentals are a slip rental even if they are not in the water. Does it make a difference
whether the boat is in the water or on a rack on shore?
Let me know when we can set up a time to meet with the appropriate department heads
to discuss this matter.

SUBJECT: McAllister Parcel
I have reviewed the Plowshares Development proposal for an 18-unit
townhouse project (McAllister Parcel) as it relates to the park and trail section
of the city's comprehensive plan. This property lies within the park service
area of the Bluff Creek Park Preserve. The preserve features expansive open
space, natural areas, and a trail system; however, a public playground or ball
field is not located within walking distance. A private playground facility
owned by the Arboretum Village Association is located just south of the
McAllister property.
A sidewalk connection to the city's comprehensive trail system should be
included as a condition of approval for this project. The nearest section of the
trail system is located just to the south of the property along West 78th Street.
RECOMMENDATION
It is recommended that the applicant pay park fees in lieu of land dedication or
trail construction on seventeen of the eighteen lots. One lot is exempt from
these charges due to the existing single family home on the property. The
park fee will vary from $2,000 to $2,400 per unit, depending on the number of
dwellings in each building.

SUB J: Kenyon Bluff
I have reviewed the application to subdivide 2. I acres into four single family lots
(Kenyon Bluff) as it relates to the park and trail section of the city's
Comprehensive Plan. Kenyon Bluff lies within the park service area of North
Lotus Lake Park. Future residents of this subdivision will easily be able to access
the park via Pleasant View Road. No sidewalks or trails are currently available
along Pleasant View Road. It is unlikely that these amenities will be constructed
in the future even though a pedestrian route along Pleasant View Road is
identified in the Comprehensive Plan. The topography of the area and curvilinear
nature of the road would present nearly insurmountable challenges to the
construction of a trail or sidewalk.
However, if an effort to construct a sidewalk along Pleasant View Road was ever
undertaken, the 18 feet of additional right-of-way being acquired as a part of this
subdivision could accommodate the improvements required of such a project.
RECOMMENDATION
It is recommended that the applicant pay park fees in lieu of land dedication or
trail construction on three of the four lots. One lot is exempt from these charges
due to the existing single family home on the property. The park fee on three
single family homes totals $7,200 and is payable at the time of platting.

Reasons for discontinuing pond skating
Discontinued because of safety concerns due to poor ice conditions, inability to clean ice with
Blaine standard equipment.
"We found it difficult to consistently and predictably maintain ice on a pond. It was difficult to
monitor the depth and consistency of the ice, for both skater safety and the safety of our
operators and equipment. Some winters it was impractical to provide ice for any significant
period of time. (It was) also much less efficient than our regular flooding method of providing
Burnsville ice. It was difficult and very time consuming. So, we dropped it."
Discontinued because of unsafe cleaning conditions, most cases there was water always
flowing into ponds from somewhere and they though it wise not to send people out in those
Farmington conditions.
New Hope At one time had 20 rinks, but budget cuts forced it down to one site.

SELF-ADVOCACY PLAYS KEY ROLE
IN BUDGET RESTORATION
Self-advocates recently playecl a key role in getting
funding for Reach For Resources reinstated into
the 2004 Hennepin County Developmental
Disabilities budget. In early October, Hennepin
County administrators had recommended total
elimination of all County DD Community Support
programs, including Reach, as part of a County
budget reduction plan.

"This cannot stand," was the response of one
tireless self-advocate, Tom Carey. Tom immediately
set to work to canvass members of Fraser's
Excelsior Court Community in Minnetonka where
he lives. He discovered that several tenants with
disabilities were relying on Reach's services for
independent living support. "We've worked too
hard to get here, into our own apartments, to lose
our independence now," Tom concluded. Working
together with Mary Perkins, Executive Director of
Reach, Tom organized a meeting between Reach and
Excelsior Court residents. "Come on, Mary, we'll
just keep fighting 'til we win!" reacted Kirsten
Hokanson, Excelsior Court resident, after hearing
of Reach's elimination. Kirsten, Tom and many
others wrote letters and made phone calls to
Hennepin County Commissioners. They also
organized themselves and their families to attend
an Arc sponsored Town Meeting for all seven
Hennepin County Commissioners.
At the Town Meeting, hundreds of self-advocates
joined parents and concerned professionals to
communicate face to face and let their needs be
known. "We want Reach open!" stated Jim
Lunclquist, speaking from a podium to the
Commissioners in front of the large gathering.
Other self-advocates had also stepped up to the
plate. Joe Parker, another self-advocate leader,

activist, Cliff Poetz. "Tell them to
save our groups!" urged Jim
Nylander, a long time

Jim helped other group
members get assistance to continue writing letters
and signing petitions. Sara Schultz and Rachel
Popper, working with the empowerment group,
organized No Place Like Home Communities'
residents who receive Reach Services to do the
same. Jim, Sara, Rachel and Joe, together with
others, also volunteered to attend budget hearings
downtown at the government center. Some even
volunteered to go to the podium and speak very
publicly about themselves, their disabilities, and the
progress they have made in their lives.
Others, like Deanna Arndt, took time from work
to meet personally with their own Commissioner,
sharing stories of struggles and successes in living
with a disability. "Reach helps me stay independent~"
testified Tim Thompson. "It keeps me out of
trouble," offered Rodel Wilkins. Commissioners
heard similar messages from Rachel Polk, Sara
Schultz and Rachel Popper, all of whom were
willing to stand up and speak for themselves.
During the weeks and months of uncertainty, all of
the staff back at Reach could not but be struck by the
power, tenacity and old fashioned Yankee ingenuity of
all of the self-advocates."Their strength and fortitude

This is a group for parents with
developmental disabilities who are
interested in improving their parenting

the core issues of parenting and
address specific challenges parents with

Reach for Resources offers a Personal
Empowerment Group for adults with mild
developmental disabilities who wish to
address their feelings and concerns and
promote self-esteem. This is a group for
people who have felt lonely and scared or
who have felt they are not good enough
because they learn slowly or don't
understand things the way others do.
Participants will learn how to take care of
themselves by making appropriate choices
and will become empowered to gain more
independence in living their lives.

Don't let the lack of snow get you down show up at the next meeting
Tuesday Jan. 13th and find others to hook up with to go find the snow.
I hear Michigan has plenty. If you want to ride make plans with
friends or fellow club members, only you can make it happen.
Other options include riding the Crow River, although I must warn
you to set your sled up for ice. This involves studs and some good
carbides up front. Ice is solid now, no open areas. An excellent place
to ride in iow snow conditions. Lots of curves, scenery, and wildlife.

2004 Community Special Events
In the past the Park and Recreation Commission requested a listing for the
city's community events. Our department will coordinate and sponsor the
following events in 2004:
February Festival: The tenth Annual February Festival will be held Saturday,
February 7 at Lake Ann Park. This special event includes open ice skating on
a large rink on Lake Ann, a s'mores cookout on a flaming bon fire, ice fishing
contest, food concessions and more. This one-day event will draw 1000-1500
participants and spectators.
Easter Egg Candy Hunt: The Easter Egg Candy Hunt on Saturday, April 10,
will celebrate its 21st anniversary this spring. Over 900 children, ages 2-10,
and their parents attend this annual event. The program includes live
entertainment, a coloring contest, and the candy hunt. This event will be held
at the Chanhassen Recreation Center.
Fourth of July Celebration: Chanhassen's premier community event. This
annual celebration is a year-round topic of conversation in the community and
is renowned throughout the state. Participation levels stop 3,000 people per
day. This year's activities are scheduled for July 3rd and 4th. Highlights
include a kiddie parade, carnival games, adult and children fishing festivals,
beach games, the Chamber of Commerce Trade Fair, a street dance, and the
spectacular fireworks display over Lake Ann. City Center Park (north of City
Hall) and Lake Ann Community Park are the venues for this event.
Halloween Party: The Halloween Party has provided children with
Halloween fun and entertainment for 18 years. The Halloween Party includes
trick or treating, live entertainment, games, haunted room, an authentic horse-
drawn hayride, and refreshments. A targeted service level of 1,200 children
and parents has been set for this year's celebration on Saturday, October 30.

Tree Lighting Ceremony: This annual event will be held on Saturday,
December 4. The location will at City Center Park just east of the new
library. You can enjoy the lighting of the holiday tree, refreshments and a
visit from Santa Claus.
