I have been pursuing the possibility of contracting out the Chanhassen Park and
Recreation Summer Tennis Program. I have received a tennis program proposal from
Excellence in Sports (EIS) Tennis. Inc. A summary proposal is as follows:
ElS Tennis
· provide all equipment
· hire, supervise and pay all instructors
provide City with promotional material, flyers, brochures, etc.
· receive 80% of registration fee
· communication with participant regarding class cancellation, inclement weather, etc.
CiD' of Chanhassen
· take all registrations
· provide tennis lesson information in summer newsletter
· receive 20% of registration fee
I have not contracted out for recreation programs in the past; however, I have spoken with
Jerry in regards to the contract with Minnetonka Community Education for lifeguard
services at Lake Ann Park. This arrangement involves minimal commitment from the
Chanhassen Park and Recreation staff, yet Chanhassen residents are able to take
advantage of swimming lessons and open swim time at Lake Ann.
EIS Tennis organizes the City of Chaska's tennis program. In speaking with Kathy
Skinner, I learned this arrangement is very positive to both the customer and to the City.

Last year, our in-house tennis program generated $4,168.50, expenses were $2,823.65.
This created a net gain of $1,344.85. The net gain does not include administrative time.
For comparison purposes, 20% of $4,168.50 in revenue equals $833.70.
Please note that lesson fees will increase from $3.75 per hour to $4.50 for a 45 minute
class and $6.00 for a one hour class. While it is a substantial increase, I believe the

TENNIS INSTRUCTION AGREEMENT

RECITALS:
1. Chanhassen, as a part of its summer recreation programs, has offered a strong tennis instruction program for
the community.
2. Chanhassen is desirous of continuing a stable, strong tennis program which meets the needs of the
community.
3. EIS believes that the future of tennis is at the grass roots level through local recreation departments and
community education services. ElS is in the business of developing, growing and teaching tennis in Carver
County and Western Hennepin County.
4. Chanhassen is willing to have EIS teach tennis on Chanhassen's facilities on the terms set forth in this
agreement.
~'~OW THEREFORE the parties agree as follows:
1. Facilities a;,d r. romotion. Chanhassen shall provide the tennis facilities and promoticn as follows:
~: ~-hanhassen shall reserve from other use and make available the tennis courts for use by
ElS for the times required and at the locations indicated on the class schedule attached.
b. Promotion of the tennis program will be provided by Chanhassen through its
channels of desimminatino re""::t;.:,~ information to the community. Ci~anhassen will assist ElS
in effects ',, -' . ' ,':~ ,~, uc~es and other tennis information in local news media.
Program Manaoer--~-' , ........ ,s program will be managed by ElS as follows:
a. The EIS Tennis Director, Jim Martin, will oversee and be responsible for all instruction
provided for Chanhassen.
b. Each class or program will be taught by a professional tennis instructor. If the program or
class is over six (6) persons an assistant instructor may be used with and under the direction of
the professional instructor.
c. All tennis instructors will be employees of ElS.
d. ElS shall be responsible for all income and payroll taxes for ElS and its employees. EIS's
federal employer identification number is 41-1742615.
e. ElS shall provide liability insurance of'two million dollars ($2,000,000.00) for each instructor or assistant in
the pr~gra;~.
f. ElS will represent the interests of Chanhassen at all UST ~',. meetings and fun~,tions necessary to the programs
and beneficial to Chanhassen. Grants for tennis programs, when available, will be applied for, on Chanhassens
behalf by ElS.
2. Programs Offered ElS will determine and be responsible for the program content and conduct of all tennis
prograrr- '- :: ...... ?, ~he following:
a. Every effort will be made to continue any existing tennis programs that have been successful
in the past. Classes and pr~-~_r3ms ~,,i','. ~: .~u~j~ct to appro'val of Chanhassen.
b. Ali instruction and programs will be conducted in accord with the principles and guidelines set
forth by the United States Professional Tennis Association and the United States Ter:;,;~
Association. Programs of these two organizations will be implemented into Chanhassen
programs whenever possible.
c. ElS will conduct free tennis lessons as oart of the tennis industries "Play Tennis America"
program in the Chanhassen community dun~-~g the month of May to encourage people to play
tennis.
3. Equipment. All equipment shall be provided as follows:
a. All equipment normally a part of and attached to tennis courts will be supplied by
Chanhassen.
b. All tennis balls, ball cads, ball baskets, teaching aids, ball machines, etc. will be provided by
ElS.
c. Free loaner tennis racquets will be provided for "Little Tennis" ?rogr~ms. R-"::._..,¢ts may be

4. Fees. Fee policy shall be as follows:
a. Fees for all programs shall be six dollars ($6.00) per hour per participant with the exception
of NJTL Team Tennis which is thirty-five dollars f$"¢5.00) fo- the summer season. Any special
event fees sh-~! h~ ~ ~reed uF-':" ~' ' ha~nassen and ElS at the time the event is incorporated
~nto the Chanhassen programs. Fees shall be agreed upon and set for each year subseq~,-;~ to
this first year to allow for increase in costs.
b. All fees will be collected by Chanaas~sn through its normal fee system for roars
programs.,
c. ElS will bill Chanhassen for 80% of fees for persor~s participating in classes or
when the class or progrs'~- ':%,h,~. Payment will be in the normal City of Chanhassen payment
cycle for such billings by independent contractors.
5. Term of this ~_0. reemenmi;, The initial term of this agreement is one (1) year and shall automatically be
r'~'~','¢~;d at ti'~e end of the initial term and each renewal terr:. (or an additional term of one (1) year unless, at
least 60 days before the end cf th~ i~i:;.~i ~erm or renewal term, either Chanhassen or ElS gives the other of
them written notice of termination of the Agreement. In such event, this agreement will terminate at the end of-
the term and will not be renewed for an additional term. Notwithstanding the foregoing, this agreement may be
terminated as follows:
a. Chanhassen, at its option, may immediately terminate this Agreement if EtS violates ar'"

i~. If either Chanhassen or ElS violates this Agreement, the other party may terminate this

6. Entire Agreement, Except as suplemented in a writing signed by both parties to this Agreement, this

or oral, regarding the subject matter of this Agreement, shall be of any force or effects.
b. Modifications. No change, nodification or Waiver of any provision of this Agreement shall be
valid or binding unless it is in writing, dated subsequent to the date hereof and signed by the
parties intended to be bound. No waiver of any breach, term or condition of this Agreement by
an'/ party shall constitute a subsequent waiver of the same of any other breach, term or
condition.
c. Notices. All notices, requests, demands or other communications required or permitted by
this Agreement shall be in writing, and delivery shall be deemed to be sufficient if delivered
personally or by registered or certified mail, return receipt requested, postage prepaid, addressed
as follows:

are limited for more individualized attention.

persons who have taken l:rs:~_r· - tennis lessons nod are ready to move up to the next level. 'Intermediate 2~' programs
are for tennis players who have a good command of the forehand, backhand, volley and serve ~. zkes, and who are
playing competitively. Instructor approval is required before registering for intermediate 2.
"Little Tennis' programq include free use of a tennis racquet during the program if you don't have one.

JUNIOR TEAM TENNIS
Competition, skill development, sportsmanship, tennis efiqaette, and loads of fun are all part of this summer
tennis program sponsored by C!:nnS:zsen Park & Recreation and the United States Tennis Association. Matches
are played in the metro area. Practices/home matches are played at City Center Park Courts.

Learn to play tennis in just 6 sessions! It's easy and it's fun the USTA "Play Tennis America" way. This program
is a three .cvel program. It combines instruction and play while emphasizing the fun and social aspects of tennis.
Beginners: Forehand, backhand, volley and serve techniques willbe taught to those with little or no tennis
experience.
Continuing: A continuation of the beginner program with added strokes, strategy for singles and doubles pla-'

ADULT TENNIS LEAGUE
If you play tennis and are ~,~ki~ for fun and competition, join the Western Lake Minnetonka Tennis
League. Players will be from all communities mound Western Lake Hennepin. Matches will be played each
Saturday morning starting at 9:00 am. Leagues include mens and womens singles & doubles. The playing site will
alternate each Saturday between the Chaska High School 7~ Courts and the Mound-Westonka High School
Tennis Courts. A teaching professiorz2 will be supervise the Saturday matches.
