My last conversation with Mark on this subject was December 15, 2009. At that time he asked me to email him the site plan agreement and consent form, which I did. To date, I have not received the executed mortgage holder consent. In discussing this matter with Bob Generous today, he suggested I contact you to determine if it would still be necessary to record the site plan permit because a Certificate of Occupancy has already been issued for the site; however, Phase II of the project has yet to occur, and the site plan agreement references both phases. Please advise as to whether I should continue pursuing obtaining the required mortgage holder consent from Associated Bank. I have attached a copy of the site plan permit for reference. Thanks! I always check the County land title records on recording documents before I send them in for recording to make sure all fee owner and lienholders are correct. When I did so for this site plan permit I found that the fee owner (Equitable Holding Co. LLC - which signed a consent to the permit) took out and filed a mortgage with Associated Bank on July 28, 2008 which was a little over a week BEFORE you sent the permit to me for review and recording. Since you typically get lienholder consents to site plan permits as well as fee owner consents, I think we should do the same for this one. I have attached a copy of the recorded mortgage for your information. Would you please prepare the necessary consent, obtain the required signatures and sent to me for filing with the permit? Thanks! I always check the County land title records on recording documents before I send them in for recording to make sure all fee owner and lienholders are correct. When I did so for this site plan permit I found that the fee owner (Equitable Holding Co. LLC - which signed a consent to the permit) took out and filed a mortgage with Associated Bank on July 28, 2008 which was a little over a week BEFORE you sent the permit to me for review and recording. Since you typically get lienholder consents to site plan permits as well as fee owner consents, I think we should do the same for this one. I have attached a copy of the recorded mortgage for your information. Would you please prepare the necessary consent, obtain the required signatures and sent to me for filing with the permit? Thanks!
